CHAPTER I GENERAL PROVISIONS
Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated under the Act on the Use of Electronic Documents in Criminal Justice Procedures and matters necessary for the implementation thereof.
Article 2(Definitions) #
The terms used in this Decree are defined as follows:
1. "Criminal justice portal" means the criminal justice portal defined in subparagraph 6 of Article 2 of the Act on Promotion of the Digitalization of the Criminal Justice Process, which is established to conduct criminal justice procedures using electronic documents;
2. "Electronic records" means a compilation of electronic documents or digitized documents, organized on a case-by-case basis;
3. "Investigative agency, etc." means a criminal justice agency, excluding a court;
4. "Information and communications network" means an information and communications system for collecting, processing, storing, searching for, transmitting, or receiving information by using telecommunications facilities defined in subparagraph 2 of Article 2 of the Framework Act on Telecommunications, or by utilizing such telecommunications facilities in combination with computers and computer-use technologies.
Article 3(Persons eligible to submit electronic documents) #
Pursuant to Article 5(1) of the Act on the Use of Electronic Documents in Criminal Justice Procedures (hereinafter referred to as the "Act"), persons eligible to submit electronic documents through an electronic data processing system, in addition to suspects, defendants, victims, complainants, accusers, and defense counsels, shall be as follows:
1. A legal representative of a suspect, defendant, victim, complainant, or accuser (including the spouse, lineal blood relatives, and siblings of the victim if the victim is deceased);
2. The representative of a suspect, defendant, victim, complainant, or accuser, if such person is a corporation;
