ACT ON FACILITATION OF MANAGEMENT AND UTILIZATION OF INDUSTRIAL PROPERTY INFORMATION

CHAPTER I GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Act is to strengthen industrial competitiveness and contribute to the development of the national economy by prescribing matters necessary for facilitating the management and utilization of industrial property information.

Article 2(Definitions) #

The terms used in this Act are defined as follows: <Amended on Oct. 1, 2025>

1. The term "industrial property" means intellectual property collected or generated in the course of the creation, modification, and extinction of industrial property rights defined in subparagraph 4 of Article 2 of the Invention Promotion Act;

2. The term "industrial property information" means all types of knowledge or data collected, generated, or processed by means of research, analysis, processing, linkage, etc. by the Minister of Intellectual Property in the stages of creation, protection and utilization of industrial property;

3. The term "industrial property informatization" means the systematic production, management, provision, and utilization of industrial property information to enhance the efficiency of research and development by the public and private sectors or to effectively establish, promote, and evaluate technologies and industry-related strategies;

4. The term "industrial property information database" means a collection of information systematically organized and processed for users to search and utilize the same;

5. The term "industrial property information system" means an organized system of equipment and software related to the collection, creation, processing, storage, management, retrieval, transmission, reception, and utilization of industrial property information;

6. The term "industrial property diagnosis" means presenting systematic strategies for research and development and commercialization through comprehensive survey on and analysis of industrial property and industrial property information; provided, evaluation prescribed in Article 28 of the Invention Promotion Act shall be excluded herefrom.
