CHAPTER I GENERAL PROVISIONS
Article 1(Purpose) #
The purpose of this Act is to contribute to safeguarding sovereignty, maintaining public order, and ensuring safety and other relevant interests at sea, by prescribing fundamental matters regarding the acquisition and management of coast guard equipment.
Article 2(Definitions) #
The terms used in this Act are defined as follows:
1. The term “coast guard equipment” means vessels, aircraft, and onboard equipment necessary for performing the duties of the coast guard under Article 14 of the Coast Guard Act;
2. The term “onboard equipment” means equipment installed on and used in vessels or aircraft, as prescribed by Presidential Decree;
3. The term “acquisition” means purchasing, constructing, or manufacturing coast guard equipment and delivering such equipment to a coast guard equipment manager;
4. The term “management” means acts such as inspection, maintenance, and disposal conducted by a coast guard equipment manager upon taking delivery of coast guard equipment, to ensure that such equipment can perform its original functions;
5. The term “operation” means the safe use of coast guard equipment in accordance with its functions and purposes;
6. The term “disposal” means the transfer of ownership of coast guard equipment to a person other than the State, or the transfer of management rights to another agency, by means such as sale or gratuitous transfer;
7. The term “service life” means the economically useful life of coast guard equipment, estimated as the period during which such equipment can properly perform coast guard duties without operational impairment;
8. The term “coast guard equipment manager” means a public official of the Korea Coast Guard who directly manages and operates coast guard equipment.
Article 3(Relationship to other statutes) #
Except as otherwise provided in other statutes, the acquisition and management of coast guard equipment and other relevant matters shall be governed by this Act.
