Article 91(Delegation and entrustment of authority) #
(1) The Minister of Patriots and Veterans Affairs shall delegate his or her authority over the following matters to the head of the regional or district office of patriots and veterans affairs having jurisdiction over the relevant address (referring to the Jeju Special Self-Governing Province Governor, if the relevant address is in Jeju Special Self-Governing Province) pursuant to Article 74 (1) of the Act, and shall delegate his or her authority over the matters specified in subparagraphs 12 through 18 and 21 to the head of the regional or district office of patriots and veterans affairs having jurisdiction over the location of the relevant educational education (referring to the Jeju Special Self-Governing Province Governor, if the location of the relevant educational education is in Jeju Special Self-Governing Province); provided, if the authority is delegated to the Jeju Special Self-Governing Province Governor, the authority transferred to the Jeju Special Self-Governing Province Governor pursuant to Article 344 of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City, among the authority over the following matters, shall be excluded: <Amended on Apr. 28, 2014; Jun. 21, 2016; Dec. 24, 2019; May 9, 2022; May 23, 2023; Jul. 11, 2023>
1. Registration and determination under Article 4 of the Act;
2. Reporting of changes in personal circumstances and measures taken based on such reporting under Article 5 of the Act;
3. Business affairs regarding physical examinations, such as receiving applications for physical examinations, requesting physical examinations, and notifying the results of injury grade assignments, under Article 6 of the Act;
4. Additional recognition of injuries under Article 6 of the Act;
5. Determination of persons whose entitlement to compensation is terminated pursuant to Article 8 (4) of the Act and receipt of notification under paragraph (5) of that Article;
6. Payment of compensation under Article 11 (1) through (3) of the Act;
7. Receipt of certificates of designation of compensation recipients, receipt of documents evidencing the support or raising of persons eligible for veterans' compensation, and receipt of applications for payment of compensation, etc. in equal portions, under Article 12 (2) of the Act and Articles 13, 14, and 14-2 of this Decree;
8. Payment of livelihood improvement allowances under Article 13 of the Act; as well as receipt of applications for payment of livelihood such allowances, inspections and inquiries to determine persons eligible for the allowances, and request for the provision of financial information, etc. under Articles 14 through 16 of the Act;
9. Payment of nursing allowances, allowances for dependents, and additional allowances for severe injuries under Articles 17 (1), 18 (1), and 19 (1) of the Act; payment of lump-sum payment on death under Article 20 (1) through (3) of the Act; and determination on the payment of veterans' benefits and the suspension of such payment under Articles 21 and 23 of the Act;
10. Verification of persons eligible for veterans' benefits, etc. under Article 28 and designation of authorized recipients under Article 29;
11. Receipt of applications for educational assistance and determination of persons eligible for such assistance under Article 25 of the Act;
12. Verification of persons eligible for educational assistance who seek admission to school under Article 33 (1);
13. Preparation and submission of a list of applicants for school admission under Article 33 (2);
14. Receipt of notification of lists of persons eligible for educational assistance under Article 35;
15. Verification of persons eligible for educational assistance who seek transfer to another school under Article 36;
16. Receipt of a notice of changes in school attendance status under Article 37;
17. Issuance of certificates for persons eligible for educational assistance under Article 38 (4) and issuance of certificates for persons eligible for exemption from university tuition fees, etc. under paragraph (5) of that Article;
18. Receipt of applications for payment of subsidies filed by private universities, etc., determination of whether to provide subsidies and notification of such determination, and request for the submission of materials under Article 38 (6) and (7);
19. Receipt of applications for payment of tuition fees, etc., determination of whether to provide subsidies, and request for the submission of materials under Article 29 (4) of the Act and Article 39 of this Decree;
20. Receipt of applications for subsidies and payment of subsidies under Article 30 of the Act and Article 40 of this Decree;
21. Payment of learning allowances under Article 31 of the Act;
22. Issuing certificates for persons eligible for employment assistance under Article 35 of the Act and Article 45 of this Decree;
23. Receipt of applications for employment assistance under Article 36 of the Act;
24. Recommendation of persons eligible for employment assistance under Article 37 of the Act;
25. Acceptance of notification regarding the quota for, and employment of, public officials in general service, etc. of State agencies, etc.; inspection and monitoring of the actual employment conditions of such agencies, etc.; request for rectification or supplementation; and acceptance of notification of the result of such measures under Article 38 of the Act;
26. Acceptance of reports filed by enterprises, etc.; and issuance of instructions to public officials under the relevant jurisdiction to request explanations and submission of relevant materials necessary for understanding the actual conditions of enterprises, etc. under Article 40 (1) and (2) of the Act;
31. Provision of vocational rehabilitation training and recommendation of persons eligible for vocational skills development training under Article 48 (1) and (2) of the Act;
28. Restrictions on employment assistance under Article 42 of the Act;
29. Request for rectification and acceptance of notification of the result under Article 45 (2) and (3) of the Act;
30. Acceptance of notification of employment, etc. under Article 46 of the Act;
31. Provision of vocational rehabilitation training and recommendations for persons eligible for vocational skills development training under Article 48 (1) and (2) of the Act;
32. Payment of incentives for employment skills development, provision of subsidies to cover expenses incurred in such development, and request for the submission of materials regarding vocational skills development training establishments, etc. under Article 49 (1) of the Act and Article 59 of this Decree;
33. Entrustment of medical treatment and receipt of notification of emergency medical care under Article 51 (2) of the Act and Article 61 of this Decree;
34. Provision of prosthetic devices under Article 52 of the Act;
34-2. Provision of domiciliary care services for patriots and veterans and receipt of applications for such services under Article 53-2 (1) and (2) of the Act;
35. Determination of the amount of loans under Article 59 (2) of the Act (applicable only to authority over the persons determined by the Financial Services Commission who fail to repay their obligations within the agreed period in commercial transactions, such as financial transactions; hereafter in subparagraphs 36 through 40, the same shall apply);
36. Acceptance of applications for loans and provision of loans under Article 61 (1) and (2) of the Act;
37. Issuance of payment guarantee certificates, acquisition of security, provision of security by the guarantors, acquisition of other security, and approval for the replacement of secured property under Article 63 (1) through (4), (6), and (7) of the Act;
38. Set-off of the principal and interest on loans, etc. under Article 64 of the Act;
39. Appointment of appraisers under Article 74;
40. Acceptance of reports on succession to obligations under Article 67 (2) of the Act;
41. Recovery of veterans' benefits, etc. and the interests thereon, collection of arrears, collection in the same manner as the compulsory collection of national taxes, and write-offs under Article 68 of the Act;
41-2. Determination to approve the installment payment of the amount to be recovered and revocation of such determination under Article 81 (5) and (7);
42. Exemption from the obligations to return under Article 69 of the Act;
43. Suspension of compensation under Article 71 of the Act and notification of the result under Article 85 of this Decree;
44. Exclusion from persons subject to the application of the Act and their reregistration under Article 72 (1) through (4) of the Act, as well as request for the verification of criminal records under paragraph (5) of that Article;
44-2. Issuance and reissuance of patriots and veterans registration cards under Article 86 (1) and (2) and use of the operating system under the latter part of paragraph (3) of that Article;
44-3. Issuance of verification documents under Article 86 (4);
45. Payment of monetary awards under Article 73 of the Act;
46. Imposition and collection of administrative fines under Article 76 of the Act.
(2) The Minister of Patriots and Veterans Affairs shall entrust business affairs regarding the payment of veterans' benefits under Article 10 of the Act and learning allowances under Article 31 of the Act to postal service offices and banks pursuant to Article 74 (2) of the Act. <Added on Jun. 21, 2016; May 23, 2023>
(3) The Minister of Patriots and Veterans Affairs shall entrust banks with business affairs regarding the provision of loan services under Articles 55 through 67 of the Act (excluding business affairs regarding the provision of loan services for persons determined by the Financial Services Commission who have failed to repay their obligations within the agreed period in commercial transactions, such as financial transactions), pursuant to Article 74 (2) of the Act. <Amended on Jun. 21, 2016; May 23, 2023>
