CHAPTER I GENERAL PROVISIONS
Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Public Waters Management and Reclamation Act and matters necessary for the enforcement thereof.
CHAPTER II MANAGEMENT OF PUBLIC WATERS
SECTION 1 Management of Public Waters
Article 2(Management of public waters) #
(1) Public waters, other than public waters managed by the Minister of Oceans and Fisheries in accordance with Article 4 (2), with the exception of its subparagraphs, of the Public Waters Management and Reclamation Act (hereinafter referred to as the "Act"), shall be managed as follows:
1. Public waters in the harbor zones of regional trade ports under Article 3 (2) 2 of the Harbor Act and regional coastal ports under paragraph (3) 2 of that Article: The competent Special Metropolitan City Mayor, Metropolitan City Mayor, Special Self-Governing Province Governor, or Do Governor;
2. Public waters other than public waters under subparagraph 1: The competent Special Self-Governing City Mayor, Special Self-Governing Province Governor, or the head of the competent Si/Gun/Gu (the head of a Gu means the head of an autonomous Gu; hereinafter the same shall apply).
(2) "Public waters prescribed by Presidential Decree" in Article 4 (2) 2 of the Act means any of the following public waters:
1. Public waters in the harbor zones of the national trade ports under Article 3 (2) 1 of the Harbor Act;
2. Public waters in the harbor zones of the national coastal ports under Article 3 (3) 1 of the Harbor Act.

Article 3(Removal of derelict ships) #
(1) Where the Minister of Oceans and Fisheries, the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu (hereinafter referred to as "management agency of public waters") intends to remove a capsized, sunken, derelict, or moored ship, derelict waste material, or other things (hereinafter referred to as "derelict ship, etc.") pursuant to Article 6 (3) of the Act, the following matters shall be applicable only to the owners, occupants, and interested persons of derelict ships, etc. (referring to persons entered in the ship register pursuant to the Ship Registry Act, and persons entered in the ship register, etc. pursuant to the Act on Mortgage on Motor Motor Vehicles and Specific Movables): The same shall apply in this Article. In such cases, where the owner, occupant, or interested person of the relevant derelict ship, etc. is unknown or it is impossible to notify such fact due to other unavoidable reasons, the matters to be notified shall be publicly announced on the site where the relevant derelict ship, etc. has been derelict and on the bulletin board or website of the management agency of public waters for at least 14 days. <Amended on Mar. 23, 2013; Aug. 9, 2017; Sep. 8, 2020>
