ENFORCEMENT DECREE OF THE SUSTAINABLE TRANSPORTATION LOGISTICS DEVELOPMENT ACT

CHAPTER I GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Decree is to prescribe matters mandated by the Sustainable Transportation Logistics Development Act and matters necessary for the enforcement thereof.

Article 2(Types of motor vehicles) #

"Motor vehicles ... prescribed by Presidential Decree" in subparagraph 8 of Article 2 of the Act means any of the following:

1. A motor vehicle defined in subparagraph 1 of Article 2 of the Motor Vehicle Management Act;

2. A dump truck and a concrete mixing transport truck among construction machinery under Article 2 and Appendix 1 of the Enforcement Decree of the Construction Machinery Management Act.

CHAPTER II MASTER PLAN FOR DEVELOPMENT OF SUSTAINABLE NATION

Article 3(Matters to be included in master plan for development of sustainable national transport logistics) #

"Matters prescribed by Presidential Decree" in Article 7 (2) 5 of the Act shall be as follows:

1. Adjustment of transport mode share structure for the establishment of sustainable transport logistics systems;

2. Setting and management of reduction targets for greenhouse gases and air pollutants in the transport logistics sector;

3. Setting and management of energy-saving targets in the transport logistics sector;

4. Current status and goals of technology development in the sustainable transport logistics sector;

5. Public-private cooperation plans for establishing a sustainable transport logistics living culture;

6. Plans for training professional workforce in the sustainable transport logistics sector;

7. Plans for establishing survey and statistical systems in the transport logistics sector;

8. Plans for promoting international cooperation in the transport logistics sector;

Article 6(Formulation of annual implementation plans of master plan) #

(1) If the Minister of Land, Infrastructure and Transport intends to formulate an annual implementation plan of the master plan (hereinafter referred to as the "implementation plan of the master plan") under Article 8 (1) of the Act, the Minister shall have a prior consultation with the heads of the relevant central administrative agencies and the Special Metropolitan City Mayor, Metropolitan City Mayors, the Special Self-Governing City Mayor, Do Governors, and Special Self-Governing Do Governors (hereinafter referred to as "Mayor/Do Governor"), and undergo deliberation by the National Transport Commission under Article 106 of the National Transport System Efficiency Act. <Amended on Mar. 23, 2013; Oct. 22, 2014>

(2) The heads of the relevant central administrative agencies shall submit the performance of the implementation plan of the master plan for the previous year and the implementation plan for the relevant year to the Minister of Land, Infrastructure and Transport by January 31 of every year, and the Minister shall formulate the implementation plan of the master plan for the relevant year by the end of February every year. <Amended on Mar. 23, 2013>

(3) Upon formulating the implementation plan of the master plan, the Minister of Land, Infrastructure and Transport shall notify the heads of the relevant central administrative agencies and Mayor/Do Governors of the contents thereof, and the heads of the relevant central administrative agencies and Mayor/Do Governors shall actively cooperate to ensure smooth implementation of the plan. <Amended on Mar. 23, 2013>

(4) Paragraphs (1) and (3) shall apply mutatis mutandis to the modification of the implementation plan of the master plan; provided, this shall not apply to any of the following cases:

1. Where the financial resources required for implementing the implementation plan of the master plan are modified by up to 10/100;

2. Where matters such as miscalculations, clerical errors, omissions, or other matters not affecting the basic direction of the implementation plan of the master plan are modified.

Article 7(Hearing opinions of residents and relevant experts) #

(1) The Special Metropolitan Mayor, a Metropolitan Mayor, the Special Self-Governing City Mayor, or a Mayor (including administrative city mayors under Article 11 (2) of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of an International Free City, but excluding mayors of cities with a population of less than 100,000; hereafter the same shall apply to this Article, Articles 8, 9, 11, and 12, and Articles 37, 39, and 40) shall, under Article 9 (1) of the Act, hear the opinions of residents, local councils, and relevant experts regarding the sustainable local transport logistics development plan (hereinafter referred to as the "regional plan"), and shall publicly announce the main contents of the regional plan through 2 or more general daily newspapers (meaning general daily newspapers under Article 2 of the Act on the Promotion of Newspapers; hereinafter the same shall apply), official gazettes, websites, or broadcasting media, where the relevant Special Metropolitan City, Metropolitan City, Special Self-Governing City, or City (including administrative cities under Article 10 (2) of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of an International Free City, but excluding cities with a population of less than 100,000; hereinafter the same shall apply) is the main distribution area, and shall make the local plan available for public inspection for at least 2 weeks. <Amended on Oct. 22, 2014; Jan. 22, 2016; Feb. 8, 2019; Nov. 24, 2020>

(2) Any person who has an opinion on the contents of the regional plan publicly announced and made available for inspection under paragraph (1) may submit such opinion to the Special Metropolitan City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, or head of a Si during the inspection period. <Amended on Oct. 22, 2014>

(3) The Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si shall, within 2 months from the date on which the inspection period ends, decide whether to reflect the opinions submitted under paragraph (2), and notify the persons who submitted such opinions of the results. <Amended on Oct. 22, 2014>

Article 11(Methods of sustainability survey and evaluation) #

(1) The Minister of Land, Infrastructure and Transport shall conduct a survey and evaluation on the sustainability of the transport logistics system (hereinafter referred to as the "sustainability survey and evaluation") under Article 15 (1) of the Act according to the following classifications: <Amended on Mar. 23, 2013; Oct. 22, 2014>

1. Regular survey and evaluation: Conducted annually for the Special Metropolitan City, Metropolitan Cities, the Special Self-Governing City, or Sis;

2. Occasional survey and evaluation: Conducted as needed, either to supplement the regular survey and evaluation referred to in subparagraph 1 or to cover specific areas or particular items.

(2) The sustainability survey and evaluation shall include the following matters: <Amended on Mar. 23, 2013>

1. Sustainability management indicators and sustainability management standards publicly notified by the Minister of Land, Infrastructure and Transport under Article 14 (1) of the Act;

2. Other matters deemed necessary by the Minister of Land, Infrastructure and Transport.

(3) The sustainability survey and evaluation may be conducted by means of on-site surveys, remote surveys using methods such as satellites, or indirect surveys through the use of nationally certified statistics or literature review.

(4) Before commencing a sustainability survey and evaluation, the Minister of Land, Infrastructure and Transport may conduct a preliminary survey to ascertain the general status of the area to be surveyed. <Amended on Mar. 23, 2013>

(5) The Minister of Land, Infrastructure and Transport may request the heads of relevant central administrative agencies and the Special Metropolitan City Mayor, Metropolitan City Mayors, the Special Self-Governing City Mayor, or the heads of Sis to submit or provide data or assistance necessary for the sustainability survey and evaluation. In such cases, the heads of relevant central administrative agencies and the Special Metropolitan City Mayor, Metropolitan City Mayors, the Special Self-Governing City Mayor, or the heads of Sis shall comply with such request unless there is a compelling reason not to do so. <Amended on Mar. 23, 2013; Oct. 22, 2014>

(6) If the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si installs measurement equipment necessary for the sustainability survey and evaluation, the Minister of Land, Infrastructure and Transport may subsidize all or part of the expenses therefor within the budget. <Amended on Mar. 23, 2013; Oct. 22, 2014>

Article 15(Establishment of total volume of motor vehicle traffic) #

(1) The Minister of Land, Infrastructure and Transport, the Special Metropolitan City Mayor, Metropolitan City Mayors, the Special Self-Governing City Mayor, or the head of a Si/Gun shall, under Article 18 (1) of the Act, set and manage the total volume of motor vehicle traffic on major roads within their respective transport logistics zones (referring to transport logistics zones under Article 12 (1) of the Act; hereinafter the same shall apply) by classifying them into the following types: <Amended on Mar. 23, 2013; Oct. 22, 2014>

1. The total volume of motor vehicle traffic for the base year (hereinafter referred to as "base total volume"): The total volume of motor vehicle traffic calculated on the basis of a specific year in the present or the past.

2. The projected total volume of motor vehicle traffic for the target year (hereinafter referred to as "projected total volume"): The total volume of motor vehicle traffic for the target year, calculated on the basis of the base year;

3. The reduced total volume of motor vehicle traffic for the target year (hereinafter referred to as the "total reduction target"): The total volume of motor vehicle traffic planned to be reduced below the projected total volume referred to in subparagraph 2 for the target year, by establishing a plan to further reduce motor vehicle traffic under the former part of Article 18 (2) of the Act (hereinafter referred to as the "reduction plan").

(2) The Minister of Land, Infrastructure and Transport, the Special Metropolitan City Mayor, Metropolitan City Mayors, the Special Self-Governing City Mayor, or the head of Si/Gun shall, when setting the total volume of motor vehicle traffic under paragraph (1), comply with the following criteria: <Amended on Mar. 23, 2013; Oct. 22, 2014>

1. Ease and objectivity of measuring motor vehicle traffic on the relevant roads;

2. Feasibility of implementing the reduction plan.

(3) When setting the total volume of motor vehicle traffic under paragraph (1), the Minister of Land, Infrastructure and Transport, the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun shall comply with the following methods: <Amended on Mar. 23, 2013; Oct. 22, 2014>

1. Consider the closed lines and boundary lines of the relevant transport logistics zone for efficient analysis of traffic volumes;

2. Consider traffic on trunk roads that generate a significant level of motor vehicle traffic demand;

3. Set the total volume of motor vehicle traffic as the annual average daily traffic volume; provided, other methods may be used if necessary, considering periods of sudden increases in traffic;

4. Consider the following data:

a. Recent trends in the increase of motor vehicle traffic;

b. Indicators related to future socioeconomic development;

c. Mid- to long-term transportation-related plans;

d. The national transport database under Article 17 of the National Transport System Efficiency Act;

e. Nationally certified statistical data.

(4) The detailed guidelines for the criteria and methods for setting the total volume of motor vehicle traffic under paragraphs (2) and (3) shall be determined by the Minister of Land, Infrastructure and Transport. <Amended on Mar. 23, 2013>

Article 16(Application for reduction plan agreement) #

(1) If the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun intends to formulate a reduction plan and conclude an agreement (hereinafter referred to as the "reduction plan agreement") with the Minister of Land, Infrastructure and Transport under the former part of Article 18 (2) of the Act, they shall prepare a reduction plan covering a period not exceeding 5 years that includes the following matters and submit it to the Minister of Land, Infrastructure and Transport: <Amended on Mar. 23, 2013; Oct. 22, 2014>

1. Current status of and outlook for motor vehicle traffic;

2. Methods and details for calculating the base total volume and the projected total volume;

3. Step-by-step total reduction targets and implementation strategies;

4. Implementation measures such as transport demand management, promotion of public transportation, and enhancement of efficiency in the transport logistics system;

5. Key points and criteria for evaluating the implementation performance of the reduction plan;

6. Required financial resources and financing measures;

7. Implementation systems;

8. Other matters necessary to achieve the total reduction target, except as provided in subparagraphs 1 through 7.

(2) The Minister of Land, Infrastructure and Transport shall, after consultation with the heads of relevant central administrative agencies, determine whether to conclude the reduction plan agreement based on an evaluation of the submitted reduction plan by a review and evaluation panel composed of transport-related experts and others, in order to ensure a professional and objective evaluation of the plan. <Amended on Mar. 23, 2013>

(3) Upon making a decision to enter into a reduction plan agreement under paragraph (2), the Minister of Land, Infrastructure and Transport shall notify the heads of relevant central administrative agencies and the heads of the relevant local governments of the contents thereof. <Amended on Mar. 23, 2013>

(4) Matters regarding the organization and operation of the review and evaluation panel under paragraph (2) shall be determined by the Minister of Land, Infrastructure and Transport. <Amended on Mar. 23, 2013>

Article 21(Public invitation for eligible parties to modal shift agreement) #

(1) If the Minister of Land, Infrastructure and Transport, the Minister of Oceans and Fisheries, the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun intends to conclude a modal shift agreement under Article 21 (3) of the Act (hereinafter referred to as the "modal shift agreement"), they shall issue a public invitation for eligible parties to the modal shift agreement, such as transport logistics operators, transport logistics users, and cargo owners (hereinafter referred to as "eligible parties to a modal shift agreement"); provided, if it is deemed particularly necessary for efficiently implementing a modal shift support project, a person who has the qualifications and capacity necessary to perform the project may be selected without such public invitation. <Amended on Mar. 23, 2013; Oct. 22, 2014>

(2) When the Minister of Land, Infrastructure and Transport, the Minister of Oceans and Fisheries, the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun intends to issue a public invitation for eligible parties to a modal shift agreement under paragraph (1), they shall publicly announce the following matters in the Official Gazette: <Amended on Mar. 23, 2013; Oct. 22, 2014>

1. Purpose of the modal shift support;

2. Fields subject to the modal shift agreement, such as passenger or cargo transport;

3. Criteria for selecting eligible parties to the modal shift agreement;

4. Required documents to be submitted by eligible parties to the modal shift agreement, such as project plans;

5. Support to be provided to eligible parties to the modal shift agreement;

6. Schedule for selecting eligible parties to the modal shift agreement;

7. Other matters necessary for the public invitation for eligible parties to the modal shift agreement, except as provided in subparagraphs 1 through 6.

Article 24(Reporting of implementation results of modal shift agreement) #

(1) A party implementing the modal shift agreement (hereinafter referred to as the "implementer of the modal shift agreement"), which has concluded the modal shift agreement under Article 23 (1), shall regularly report to the competent authority for the modal shift agreement on the implementation results of the modal shift agreement, as prescribed therein; provided, after the expiration of the period of the modal shift agreement, the implementer of the modal shift agreement shall comprehensively report on the implementation results for the entire period of the modal shift agreement.

(2) The report under paragraph (1) shall include the following matters:

1. Overview of the modal shift agreement;

2. Results of implementation of the modal shift project plan and achievement of the modal shift target volume;

3. Reasons for failure to achieve the modal shift target volume, if any.

(3) The competent authority for a modal shift agreement may conduct on-site inspections at the place of business of the implementer of the modal shift agreement or other relevant sites to verify whether the matters specified in the modal shift agreement have been implemented.

(4) After verifying whether the matters specified in the modal shift agreement have been implemented, the competent authority may provide the implementer with full or partial financial support within the budget, and may also provide the following administrative or technical support, based on the implementation results: <Amended on Mar. 23, 2013>

1. Support for the installation of facilities and equipment for transfer and transshipment;

2. Support for the development of modal shift technology;

3. Support for reduction of transport logistics prices;

4. Support recognized as necessary by the Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries, such as securing operating personnel for the implementation of the modal shift agreement, in addition to the support provided in subparagraphs 1 through 3.

(5) Except as provided in paragraph (4), matters necessary for the criteria and procedures for subsidies shall be determined by the competent authority for the modal shift agreement.

Article 35(Establishment of plans for improvement of pedestrian traffic) #

(1) The Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun shall establish a plan for improvement of pedestrian traffic (hereinafter referred to as "improvement plan") every 5 years under Article 38 of the Act. <Amended on Oct. 22, 2014>

(2) When establishing an improvement plan, the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun shall hear the opinions of residents and relevant experts in advance, and have a prior consultation with the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun of adjacent areas. <Amended on Oct. 22, 2014>

(3) The Special Metropolitan City Mayor, a Metropolitan City Mayor, or the Special Self-Governing City Mayor shall undergo deliberation by the local transportation committee under Article 110 of the National Transport System Efficiency Act, after hearing opinions and holding consultations under paragraph (2). <Amended on Oct. 22, 2014>

(4) Upon establishing an improvement plan, the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun shall submit such plan to the Minister of Land, Infrastructure and Transport, if the person is the Special Metropolitan City Mayor, a Metropolitan City Mayor, or the Special Self-Governing City Mayor, and to the Do Governor, if the person is the head of a Si/Gun, along with the following documents: <Amended on Mar. 23, 2013; Oct. 22, 2014>

1. Results of hearing opinions of residents and relevant experts;

2. Results of consultation with the Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun of adjacent areas.

(5) Upon receipt of an improvement plan under paragraph (4), the Minister of Land, Infrastructure and Transport or the Do Governor shall review whether it conforms to the master plan and decide whether to approve it. <Amended on Mar. 23, 2013>

(6) The Special Metropolitan City Mayor, a Metropolitan City Mayor, the Special Self-Governing City Mayor, or the head of a Si/Gun shall publicly notify the approved improvement plan under paragraph (5) and make it available for public inspection. <Amended on Oct. 22, 2014>

Article 41(Designation of graduate schools specializing in low-carbon green transport logistics) #

(1) "Criteria prescribed by Presidential Decree" in Article 46 (2) of the Act means the following: <Amended on Mar. 23, 2013>

1. A university or graduate school that has a department related to low-carbon green transport logistics;

2. The university or graduate school shall secure a certain number of full-time faculty members as determined and publicly notified by the Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries;

3. At least 3 courses of the subjects determined and publicly notified by the Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries, such as those relating to low-carbon green transport and logistics policies, shall be offered.

(2) A graduate school under Article 29 of the Higher Education Act or a graduate university under Article 30 of that Act, which intends to be designated as a graduate school specializing in low-carbon green transport logistics under Article 46 (2) of the Act, shall submit an application for designation prescribed by Decree of the Ministry of Land, Infrastructure and Transport or Decree of the Ministry of Oceans and Fisheries to the Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries. <Amended on Mar. 23, 2013>

(3) The Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries may establish a selection committee composed of public officials of relevant central administrative agencies and private experts to designate graduate schools specializing in low-carbon green transport logistics. <Amended on Mar. 23, 2013>

(4) The Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries may fully or partially subsidize expenses incurred in the following projects for graduate schools or graduate universities designated as graduate schools specializing in low-carbon green transport logistics, within the budget: <Amended on Mar. 23, 2013>

1. Education and training to enhance the capacity of personnel engaged in low-carbon green transport logistics;

2. Development and dissemination of advanced techniques, educational programs, and teaching materials to streamline and revitalize the low-carbon green transport logistics system;

3. Joint program development with foreign universities or research institutions for establishing a low-carbon green transport logistics system;

4. Research and development of facilities and equipment for low-carbon green transport logistics;

5. Research and development of low-carbon green transport logistics technologies;

6. Other projects recognized by the Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries as necessary for the development of low-carbon green transport logistics.

Article 47(Entrustment of business affairs) #

(1) The Minister of Land, Infrastructure and Transport shall entrust the following business affairs to the Korea Transport Institute established under the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutes under Article 51 (2) of the Act: <Amended on Mar. 23 2013>

1. Surveys and evaluations of sustainability under Article 15 (1) of the Act (excluding business affairs related to surveys on greenhouse gas emissions);

2. Establishment and operation of databases under Article 15 (2) of the Act;

3. Estimation of socioeconomic costs under Article 17 (1) of the Act.

(2) The Minister of Land, Infrastructure and Transport shall entrust the following business affairs to the Korea Transportation Safety Authority established under the Korea Transportation Safety Authority Act, under Article 51 (2) of the Act: <Amended on Mar. 23 2013; Feb. 8 2019>

1. Business affairs related to surveys on greenhouse gas emissions among the surveys and evaluations of sustainability under Article 15 (1) of the Act;

2. Business affairs related to the development of greenhouse gas emission coefficients and preparation of relevant data under Article 16 (2) of the Act.

(3) The Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries may, under Article 51 (2) of the Act, entrust the following business affairs to any agency, corporation, or organization determined and publicly notified by the Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries from among publicly-invested or government-funded institutions and relevant corporations or organizations recognized to have expertise in business affairs related to sustainable transport logistics systems: <Amended on Mar. 23 2013>

1. Management of agreements under Article 18 (2) of the Act;

2. Management of modal shift agreements under Article 21 (3) of the Act;

3. Surveys on pedestrian traffic conditions under Article 37 (1) of the Act;

4. Preparation of comprehensive indicators for the improvement of pedestrian traffic under Article 37 (3) of the Act.

(4) When the Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries entrusts business affairs under paragraph (3), they shall publicly notify the name, representative, and location of the agency, corporation, or organization entrusted with the business affairs, as well as the details of the entrusted affairs, in the Official Gazette. <Amended on Mar. 23 2013>
