Article 60(Delegation and entrustment of authority) #
(1) The Minister of Patriots and Veterans Affairs shall delegate his or her authority over the following matters (excluding subparagraphs 10 through 12, 14, 15, 18, and 19) to the head of the regional or district office of patriots and veterans affairs having jurisdiction over the relevant address (referring to the Jeju Special Self-Governing Province Governor, if the relevant address is in Jeju Special Self-Governing Province) pursuant to Article 97 (1) of the Act, and shall delegate his or her authority over the matters specified in subparagraphs 10 through 15, 18, and 19 to the head of the regional or district office of patriots and veterans affairs having jurisdiction over the location of the relevant educational education (referring to the Jeju Special Self-Governing Province Governor, if the location of the relevant educational education is in Jeju Special Self-Governing Province); provided, if the authority is delegated to the Jeju Special Self-Governing Province Governor, the authority transferred to the Jeju Special Self-Governing Province Governor pursuant to Article 345 of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City, among the authority over the following matters, shall be excluded: <Amended on Jun. 21, 2016; Apr. 6, 2021; Feb. 17, 2022; May 9, 2022; May 23, 2023; Jul. 11, 2023>
1. Receipt of an application for registration, determination of registration, request for verification of facts related to the requirements of the Compensation Deliberative Committee, and receipt of notification of the results thereof under Article 7 of the Act; and issuance of a certificate of persons of distinguished service to the May 18 Democratization Movement under subparagraph 2 of Article 3 of this Decree;
2. Notification of the determination on the applicability of the Act, request for deliberation and resolution by the Patriots and Veterans Entitlement Commission, and demand for the submission of materials under Article 6 (4) and (5);
3. Issuance and reissuance of patriots and veterans registration cards under Article 6-2 (1) and (2) and use of the operating system under the latter part of paragraph (3) of that Article;
3-2. Issuance of verification documents under Article 6-2 (4);
4. Receipt of reports on changes in personal circumstances, subsequent measures and notification, and demand for the submission of materials under Article 8 of the Act;
5. Determination of whether the right to receive honorable treatment is extinguished and receipt of notification regarding the extinguishment of such right under Article 9 (4) and (5) of the Act;
6. Provision of educational assistance under Article 12 (3) of the Act;
7. Receipt of applications for educational assistance under Article 12-3 of the Act;
8. Request for the submission of materials, instructions for inspections and inquiries to public officials, rejection of applications for educational assistance, or suspension of educational assistance under Article 12-4 of the Act;
9. Request for the provision of financial information, etc. under Article 12-5 of the Act;
10. Verification of persons eligible for educational assistance who seek admission to school and preparation and submission of lists of applicants for admission under Article 9;
11. Receipt of notification of lists of persons eligible for educational assistance under Article 10 (2);
12. Verification of persons eligible for educational assistance who seek transfer to another school under Article 11;
13. Issuance of certificates of eligibility for educational assistance and issuance of certificates of eligibility for exemption from university tuition fees, etc. under Article 12 (3) and (4);
14. Receipt of applications for payment of subsidies filed by private universities, etc., determination of whether to provide subsidies and notification of such determination under Article 12 (5) and (6);
15. Request for the submission of materials under Article 12 (7);
16. Receipt of applications for payment of tuition fees, etc., determination of whether to provide subsidies, and request for the submission of materials under Article 16 (4) of the Act and Article 12-2 of this Decree;
17. Receipt of applications for subsidies and provision of subsidies under Article 16-2 of the Act and Article 12-3 of this Decree;
18. Payment of learning subsidies under Article 17 of the Act;
19. Receipt of a notice of changes in school attendance status under Article 14;
20. Issuance of certificates of eligibility for employment assistance under Article 19;
21. Receipt of applications for employment assistance under Article 22-2 of the Act;
22. Recommendation of persons eligible for employment assistance under Article 23 of the Act;
23. Receipt of notification regarding the quota for, and employment of, public officials in general service, etc. of State agencies, etc.; inspection and monitoring of the actual employment conditions of such agencies, etc.; request for rectification or supplementation; and receipt of notification of the result of such measures under Article 24 of the Act;
24. Receipt of reports filed by enterprises, etc.; and issuance of instructions to relevant public officials to request explanations and submission of relevant materials necessary for understanding the actual conditions of enterprises, etc. under Article 24-3 (1) and (2) of the Act;
25. Recommendation of multiple persons eligible for employment assistance, receipt of notification by enterprises, etc., issuance of orders to enterprises, etc. to employ such persons, and notification of employment under Article 25 of the Act;
26. Restrictions on employment assistance under Article 26 of the Act;
27. Request for rectification and receipt of notification of the result under Article 28 (2) and (3) of the Act;
28. Receipt of notification of employment, etc. under Article 29 of the Act;
29. Provision of vocational rehabilitation training and recommendation of persons eligible for vocational skills development training under Article 30 (1) and (2) of the Act;
30. Payment of incentives or subsidies for employment skills development under Article 31 (1) of the Act, and request for the submission of materials regarding vocational skills development training establishments, etc. under Article 31-3 (2) of this Decree;
31. Entrustment of medical treatment under Article 34 (2) of the Act and receipt of notification of emergency medical treatment under the latter part of Article 33 (3) of this Decree;
32. Provision of prosthetic devices under Article 35 of the Act;
33. Determination of the maximum amount of loans under Article 43 (2) of the Act (applicable only to authority over the persons determined by the Financial Services Commission who fail to repay their obligations within the agreed period in commercial transactions, such as financial transactions; hereafter in subparagraphs 34 through 37, the same shall apply);
34. Receipt of applications for loans and for payment of loans, and provision of loans under Article 45 of the Act and Article 39-2 of this Decree;
35. Receipt of applications for the payment of subsidies and payment of subsidies under Article 48 of the Act and Article 44 of this Decree;
36. Issuance of payment guarantee certificates, acquisition of security, provision of security by the guarantors, acquisition of other security, approval for the replacement of security property, and implementation of procedures for cancellation of mortgage under Article 49 of the Act (excluding paragraph (6));
37. Receipt of reports on succession to obligations under Article 54 (2) of the Act;
37-2. Request for submission of reports, materials, etc. under Article 81 of the Act (applicable only to matters regarding the authority delegated to the head of the competent regional or district office of patriots and veterans affairs or the Jeju Special Self-Governing Province Governor);
38. Receipt of applications for the payment of subsidies for care service assistance and payment of subsidies under Article 84-2 of the Act;
38-2. Provision of domiciliary care services for patriots and veterans and receipt of applications for such services under Article 84-3 (1) and (2) of the Act;
39. Preferential supply of housing under Article 89 of the Act;
39-2. Payment of living allowances under Article 89-2 of the Act; and receipt of applications for the installment payment of living allowances or for the payment of such allowances, inspections and inquiries for determination of persons eligible for such payment, request for providing financial information, etc., promotion of applications for payment of living allowances, payment of unpaid living allowances, and suspension of payment of living allowances under Articles 13 (2), 14-2 through 14-5, 18, and 20 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State, which is applied mutatis mutandis in Article 89-2 (3) through (5) of the Act;
40. Installation, establishment, etc. of facilities under Article 91 of the Act;
41. Recovery of learning subsidies, etc. and the interests thereon, collection of arrears, collection in the same manner as the compulsory collection of national taxes, and write-offs under Article 92 of the Act;
41-2. Determination to approve the installment payment of the amount to be recovered and revocation of such determination under Article 55-2 (5) and (7);
42. Exemption from the obligation to return and investigation and verification of grounds for exemption under Article 93 of the Act and Article 57 (2) of this Decree;
43. Suspension of honorable treatment under Article 94 of the Act;
44. Exclusion from the application of the Act, reregistration of excluded persons, and request for the verification of criminal records under Article 95 of the Act (excluding paragraph (4);
45. Receipt of notification of the results of deliberation and resolution by the Patriots and Veterans Entitlement Commission; and determination of, and notification regarding persons subject to suspension of honorable treatment under Article 59 (2) and (3);
46. Imposition and collection of administrative fines under Article 100 of the Act (applicable only to matters regarding the authority delegated to the head of the competent regional or district office of patriots and veterans affairs or the Jeju Special Self-Governing Province Governor).
(2) The Minister of Patriots and Veterans Affairs shall entrust the following assistance for social welfare facilities to the Service pursuant to Article 86 (1) of the Act: <Amended on Apr. 6, 2021; May 23, 2023>
1. Senior care assistance under Article 84 of the Act;
2. Child care assistance under Article 85 of the Act.
(3) Pursuant to Article 97 (2) of the Act, the Minister of Patriots and Veterans Affairs shall entrust banks under the Banking Act (hereinafter referred to as "bank") with business affairs regarding the provision of loan services under Articles 39 through 49 and 52 through 54 of the Act (excluding business affairs regarding the provision of loan services for persons determined by the Financial Services Commission who have failed to repay their obligations within the agreed period in commercial transactions, such as financial transactions) and shall entrust a post office under the Postal Savings and Insurance Act and a bank with the business affairs regarding the payment of living allowances under Article 89-2 of the Act. <Amended on Jun. 26, 2009; Nov. 15, 2010; Jun. 21, 2016; Apr. 6, 2021; Feb. 17, 2022; May 23, 2023>
