ENFORCEMENT DECREE OF THE ACT ON THE DEVELOPMENT AND MANAGEMENT OF LOGISTICS FACILITIES

CHAPTER I GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Decree is to provide for matters delegated from the Act on the Development and Management of Logistics Facilities and matters necessary for enforcing delegated matters.

Article 2(Scale of processing and assembly facilities) #

(1) The Facilities with a scale not exceeding the scale prescribed by Presidential Decree in the proviso to subparagraph 2 of Article 2 of the Act on the Development and Management of Logistics Facilities (hereinafter referred to as the "Act") means that the total floor area of a processing and assembly facility does not exceed 1/4 of the total floor area of a logistics terminal.

(2) Other facilities prescribed by Presidential Decree, which have logistics functions in subparagraph 7i of Article 2 of the Act means the following facilities: <Amended on Feb. 29, 2008; Sep. 9, 2009; Dec. 14, 2009; Jul. 19, 2012; Mar. 23, 2013; Mar. 29, 2017; Feb. 19, 2021>

1. A bonded warehouse under the Customs Act;

2. Fishery Product Processing Business Facilities (limited to Freezing and Refrigeration Facilities) under Article 16 of the Seafood Industry Promotion and Support Act;

3. A facility for loading, unloading, storing, or disposing of cargo within a harbor zone among harbor facilities defined in subparagraph 5 of Article 2 of the Harbor Act;

4. A facility for the transportation of cargo and its auxiliary facilities and support facilities within an airport zone among airport facilities defined in subparagraph 7 of Article 2 of the Airport Facilities Act;

5. A facility for the transportation, loading, unloading, or storage of cargo, which a railroad enterprise operator defined in subparagraph 8 of Article 2 of the Railroad Service Act uses for its business;

6. Other facilities prescribed by Decree of the Ministry of Land, Infrastructure and Transport, among facilities for logistics;

(3) Processing and manufacturing facilities prescribed by Presidential Decree in subparagraph 8a of Article 2 of the Act means the following facilities: <Amended on Feb. 29, 2008; Jul. 19, 2012; Mar. 23, 2013; Feb. 19, 2021>

Article 14(Request for designation of general logistics complexes) #

(1) When the Minister of Land, Infrastructure and Transport or a Mayor/Do Governor designates a general logistics complex pursuant to Article 22(2) or (3) of the Act, he or she shall designate a general logistics complex only where it meets the general logistics complex development plan and the guidelines for development of logistics complexes under Article 15. <Amended on Jun. 28, 2016>

(2) A person who intends to request the designation of a general logistics complex pursuant to Article 22(4) of the Act shall submit a draft general logistics complex development plan to the Minister of Land, Infrastructure and Transport or the competent Mayor/Do Governor, along with the following documents and drawings: <Amended on Jun. 28, 2016>

1. Location map, facility layout map, and bird's-eye view;

2. Documents concerning the current status of land utilization in an area subject to designation;

3. Documents concerning the analysis of location conditions, such as water, energy, traffic, and communications facilities;

4. Documents concerning a disposal plan for the developed land, facilities, etc. (in the disposal plan, the location and area of the land, facilities, etc. to be supplied as a general logistics complex development project, the method of determining the price thereof, the qualification requirements for persons to be supplied with the land, facilities, etc., the method of selection, the timing and date of supply; methods and conditions, matters concerning lease management, etc. shall be included; hereinafter the same shall apply);

5. Documents concerning relocation measures.

(3) Where the Minister of Land, Infrastructure and Transport or the Mayor/Do Governor deems that an area requested to be designated as a general logistics complex under paragraph (2) is inappropriate for designation as a general logistics complex, he or she shall notify the person who has made such request of the grounds therefor. <Amended on Jun. 28, 2016>

(4) "Other matters prescribed by Presidential Decree" in Article 22(5)9 of the Act means the following matters. <Amended on Jun. 28, 2016>

1. A plan for supporting major facilities for the development of a general logistics complex;

2. Where replotting is necessary, a replotting plan.

Article 14-2(Designation of urban advanced logistics complexes) #

(1) Article 13(2) and 14(1) and (4) shall apply mutatis mutandis to procedures for designating urban advanced logistics complexes and development plans under Article 22-2(3) of the Act.

(2) Facilities that the implementer of an urban advanced logistics complex development project shall provide to the State or a local government pursuant to Article 22-2(4) of the Act or operating expenses therefor shall be an amount calculated according to the standards determined and publicly notified by the Minister of Land, Infrastructure and Transport within the limit of 25/100 of the land value of the relevant site.

(3) The value of land for the site subject to development under paragraph (2) shall be calculated based on the date the approval of the implementation plan for the development of a logistics complex is publicly notified pursuant to Article 29(1) of the Act, and the amount calculated by arithmetically averaging the amounts appraised by at least two appraisal corporations, etc. under the Act on Appraisal and Certified Appraisers shall be the amount. <Amended on Aug. 31, 2016; Jan. 21, 2022>

(4) "Public interest facilities prescribed by Presidential Decree" in Article 22-2(4)4 of the Act means the following facilities:

1. Public facilities defined in subparagraph 13 of Article 2 of the National Land Planning and Utilization Act;

2. Public, cultural and athletic facilities under Article 2(1)4 of the Enforcement Decree of the National Land Planning and Utilization Act;

3. General medical facilities among health and sanitary facilities under Article 2(1)6 of the Enforcement Decree of the National Land Planning and Utilization Act;

4. Waste treatment facilities among environmental infrastructure under Article 2(1)7 of the Enforcement Decree of the National Land Planning and Utilization Act;

5. Public housing under subparagraph 1a or b of Article 2 of the Special Act on Public Housing.

Article 14-3(Consent of land owners) #

(1) The methods of calculating the number of consenters under Article 22-3(2) of the Act shall be as follows:

1. Where one parcel of land is jointly owned by several persons: Only one representative co-owner who has obtained consent from other co-owners shall be deemed the owner of the relevant land; provided, the sectional owners defined in subparagraph 2 of Article 2 of the Act on Ownership and Management of Condominium Buildings shall be deemed one landowner.

2. Where one building is jointly owned by several persons: Only one representative co-owner who has obtained consent from other co-owners shall be deemed the owner of the relevant building.

3. Where the number of landowners and building owners increases due to the division of sectional ownership under subparagraph 1 of Article 2 of the Act on Ownership and Management of Condominium Buildings after the date of public announcement under Article 17(1): The number of landowners and building owners shall be calculated based on the number of owners before the date of public announcement, and the increased number of owners shall not be additionally included in the total number of owners.

4. A person who has no resident registration number as at the time he or she is registered as an owner in a certified copy of the land register, a certified copy of the building register, a certified copy of the land register, a certified copy of the building register, a certified copy of the land register and a certified copy of the building register and a certified copy of the building register, and whose whereabouts are unknown, where his or her address is currently different from the current address, shall be excluded from the number of landowners, superficies, and building owners.

(2) Where the Minister of Land, Infrastructure and Transport or a Mayor/Do Governor intends to obtain consent or withdrawal of consent from a landowner, superficies holder, or building owner, he or she shall obtain a written consent or a written withdrawal of consent prescribed by Decree of the Ministry of Land, Infrastructure and Transport, and shall obtain a written consent or a written withdrawal of consent from the representative owners of public land, superficies, or buildings, and shall receive additional written consent from the representative owners of public land, superficies, or buildings.

(3) Except as otherwise provided for in paragraphs (1) and (2), detailed matters concerning the methods, procedures, etc. for calculating the number of consenters shall be prescribed by Decree of the Ministry of Land, Infrastructure and Transport.

Article 16(Public notice of designation or alteration of logistics complexes) #

(1) "Matters prescribed by Presidential Decree" in Article 23(1) of the Act means the following: <Amended on Oct. 14, 2010; Feb. 2, 2012; Apr. 10, 2012; Jun. 28, 2016>

1. The name, location, and size of the logistics complex;

2. The objectives of designation of the logistics complex;

3. The implementer of the logistics complex development project;

4. The period and method of development of the logistics complex;

5. A land utilization plan and a plan for major infrastructure;

5-2. A building plan and a plan for the utilization of complex sites under the proviso of Article 22-2(3) of the Act (limited to where an urban advanced logistics complex is designated or the details of such designation are modified);

6. Major types of business to be invited and a plan for the placement of types of business to be invited [including a placement plan for the relevant enterprise, where a person who designates a logistics complex pursuant to Article 22(1) or 22-2(1) of the Act (hereinafter referred to as "person authorized to designate logistics complexes") and an enterprise wishing to move into a logistics complex concludes a tenancy agreement];

7. Where land, buildings, structures or fixtures on the land subject to expropriation or use, rights other than ownership thereof, mining rights, fishery rights, and rights to use water (hereinafter referred to as "land, etc.") exist, the details thereof and the names and addresses of the relevant persons defined in subparagraph 5 of Article 2 of the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects and the owners thereof;

8. A plan for supporting major facilities for the development of a logistics complex;

9. Land substitution plan for former landowners;

10. A master plan for reclamation of public waters under Articles 22 and 27 of the Public Waters Management and Reclamation Act;

11. An Urban/Gun management plan under Article 30 of the National Land Planning and Utilization Act;

12. Topographical drawings, etc. under Article 8(3) of the Framework Act on the Regulation of Land Use;

13. Methods of perusal of related books.

(2) Where the matters referred to in paragraph (1)3,7, or 9 are not finalized when designating a logistics complex, such matters may be separately publicly notified after the details thereof are finalized.

(3) When a Mayor/Do Governor publicly notifies the matters referred to in the subparagraphs of paragraph (1) after designating a logistics complex or altering the designation thereof, he or she shall notify the Minister of Land, Infrastructure and Transport of the details of such public notice without delay. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 17(Hearing of opinions from residents) #

(1) Where an authority designating logistics complexes intends to hear opinions of residents and relevant experts on the designation of a logistics complex pursuant to Article 24(1) of the Act, he or she shall send the details of a draft logistics complex development plan to the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereinafter referred to as the "head of a Si/Gun/Gu") having jurisdiction over the location of the relevant logistics complex, and the head of a Si/Gun/Gu in receipt of such draft logistics complex development plan shall publicly announce the main contents thereof through daily newspapers, official newsletters, website, broadcasting, etc. published in the relevant local area and make them available to the general public for inspection for at least 14 days. <Amended on Nov. 24, 2020>

(2) A person who has an opinion on the details of a draft logistics complex development plan publicly announced pursuant to paragraph (1) may submit a written opinion to the head of the relevant Si/Gun/Gu within the perusal period.

(3) The head of a Si/Gun/Gu shall submit to the authority designating logistics complexes a review opinion on the opinions submitted pursuant to paragraph (2) to the person authorized to designate logistics complexes.

(4) "Matters prescribed by Presidential Decree" in Article 24(1) of the Act means the following:

1. Alteration of the area designated as a logistics complex (limited to cases where at least 1/10 of the area is altered);

2. Alteration of the area of a site for facilities of a logistics complex (limited to cases where less than 1/10 of the area is altered) or alteration of the use of a site for facilities of a logistics complex;

3. Alteration of the area of a site for infrastructure (including ditches) or alteration of the location of such infrastructure (limited to an alteration of less than 1/10 of the area).

(5) Where the authority designating logistics complexes intends to omit the hearing of opinions of residents and relevant experts pursuant to the proviso to Article 24(1) of the Act, he or she shall consult with the heads of relevant administrative agencies in advance.

Article 18(Objects of permission for acts) #

(1) Activities subject to permission from the head of a Si/Gun/Gu pursuant to Article 25(1) of the Act shall be as follows: <Amended on Jan. 5, 2021>

1. Construction of buildings: Construction, substantial repair, or change of the use of buildings, etc., (including temporary buildings) defined in Article 2(1)2 of the Building Act;

2. Installation of structures: Installation of artificially manufactured facilities (excluding buildings defined in Article 2 (1) 2 of the Building Act);

3. Change in the form and quality of land: Change in the shape of land by such means as cutting of land, filling-up of earth, leveling of land, or paving with earth, excavation of land, or reclamation of public waters;

4. Gathering of soil and stone: Gathering of soil and stone, such as earth, sand, gravel, and rocks; provided, subparagraph 3 shall apply to the gathering with the purpose of changing the form and quality of land);

5. Division of land;

6. Piling up goods: Piling up goods which are not easy to move for at least one month;

7. Felling and planting bamboo and trees.

(2) Where the head of a Si/Gun/Gu intends to grant permission for any act referred to in the subparagraphs of paragraph (1) pursuant to Article 25(1) of the Act, if the implementer of a logistics complex development project (hereinafter referred to as "implementer") is designated pursuant to Article 27 of the Act, he or she shall hear opinions of the implementer in advance.

(3) Other activities prescribed by Presidential Decree in Article 25(2)2 of the Act means any of the following activities which are not subject to permission for development activities under Article 56 of the National Land Planning and Utilization Act: <Amended on Feb. 29, 2008; Mar. 23, 2013>

1. Installation of simple structures prescribed by Decree of the Ministry of Land, Infrastructure and Transport, which are directly used for the production of agricultural, forestry, and fishery products;

2. Alteration of the form and quality of land for cultivation;

3. Extracting soil and rocks within the extent not hindering the development of a logistics complex and damaging natural scenery;

4. Piling goods in a site determined to be retained in a logistics complex;

5. Temporary planting of ornamental bamboo and trees (excluding temporary planting in arable land).

(4) A person required to file a report pursuant to Article 25(3) of the Act shall file a report with the head of the competent Si/Gun/Gu along with the progress of the relevant construction works or project and an implementation plan within 30 days from the date the logistics complex is designated and publicly notified.

Article 22(Approval of implementation plans) #

(1) Where an implementer intends to apply for approval of an implementation plan for the development of a logistics complex under Article 28(1) of the Act (hereinafter referred to as "implementation plan"), he or she shall submit an application for approval of an implementation plan stating the following matters to the authority designating logistics complexes:

1. The name and address of the implementer (in cases of a corporation, its name and the name of its representative);

2. The name of a project;

3. The purpose of a project;

4. The location and area of the project to be implemented;

5. Methods and period for implementing the project;

6. Current status of land utilization in the area where the project is to be implemented;

7. A land utilization plan and a plan for infrastructure;

8. A plan for the devolvement and management of public facilities.

(2) The following documents and drawings shall be attached to the application for approval of an implementation plan under paragraph (1): <Amended on Dec. 31, 2009; Feb. 8, 2010; Oct. 14, 2010; Apr. 10, 2012; Jan. 22, 2016; May 7, 2024; Dec. 31, 2024>

1. A location map;

2. A land map prepared according to the cadastral map;

3. A proposed ground plan and drawings and specifications of working design (if reclamation of public waters is included, it includes a description of reclamation work that must be submitted pursuant to Article 48(1) of the Enforcement Decree of the Public Waters Management and Reclamation Act);

4. Project cost and financing plan (including annual investment plan);

5. Documents on disposition of developed land or Facilities;

6. A detailed statement of existing logistics complex facilities, buildings, etc. to be retained in the project area;

7. Documents concerning the purchase of land, buildings, rights, etc. in the project area, compensation therefor, and measures for relocation of residents;

8. Details of land, etc., if any, and the owner thereof, and the name and address of a relevant person defined in subparagraph 5 Article 2 of the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects;

9. A plan for the gratuitous reversion, etc. of public facilities, land, etc.;

10. Relevant documents and drawings necessary for the determination on urban or Gun management planning;

11. A marine use consultation form to be submitted pursuant to Article 11(1) of the Marine Use Impact Assessment Act (attached only in cases of reclamation of public waters);

12. In cases of a project subject to environmental impact assessment under the Environmental Impact Assessment Act or a project subject to traffic impact assessment under the Urban Traffic Improvement Promotion Act, an environmental impact assessment report or a traffic impact assessment report;

13. Documents on measures for the preservation of national heritage.

(3) "An important matter prescribed by Presidential Decree" in the latter part of Article 28(1) of the Act means the following: <Amended on Dec. 14, 2019; Jun. 1, 2015>

1. Change of the address of the implementer;

2. Change of the representative of an implementer who is a corporation;

3. Correction of the implementation area due to errors, etc. within the scope of not changing the project implementation area;

4. Change of the area where the project is implemented by dividing it within the scope not exceeding the project implementation area;

5. Reduction of the area within the scope of 10/100 of the area where the project is implemented;

6. Increase or decrease in the project cost within the limit of 10/100 of the project cost;

7. Change of the site area varying on the result of a cadastral confirmation survey pursuant to subparagraph 2 of Article 45 of the Act on the Establishment and Management of Spatial Data.

Article 24(Entrusted implementation of logistics complex development projects) #

(1) "Other public facilities prescribed by Presidential Decree" in Article 31(1) of the Act means roads, waterworks, railroads, utility tunnels, public wastewater treatment facilities, waste treatment facilities, integrated energy supply facilities, embankments, revetments (shores and bank protective facilities), tide embankment. protection facilities), tide embankments, estuary barrage, and greenbelt facilities. <Amended on Jan. 17, 2017; Jun. 5, 2018; Jan. 5, 2021>

(2) Where an implementer intends to entrust part of a logistics complex development project to the State, a local government, or a public institution pursuant to Article 31(1) of the Act, he or she shall consult with a person to be entrusted with such project on the following matters:

1. Business site of the entrusted project;

2. The type, scale, and amount of the entrusted project, and other matters that serve as the standards for construction design;

3. Implementation period of an entrusted project (including scheduled date of starting and completion);

4. Matters concerning the method of paying expenses necessary for the entrusted project and the management of such funds;

5. Where a truster provides real estate, equipment, materials, or workers, matters concerning the management thereof;

6. Matters concerning risk bearing;

7. Other matters necessary for clarifying the details of the entrusted project.

(3) "A public institution prescribed by Presidential Decree" in Article 31(1) of the Act means the following institutions in the subparagraphs of Article 20(2).

(4) Where an implementer referred to in Article 27(2)4 through 6 of the Act intends to obtain approval of a trust contract pursuant to Article 31(3) of the Act, he or she shall submit an application for approval of a trust contract to the authority designating logistics complexes, along with the following documents: <Added on Dec. 9, 2022>

1. The name and address of the truster and the trustee (in cases of a corporation, referring to the name and address of the corporation and the name and address of its representative);

2. The name, location, and area of the logistics complex;

3. Outline of the trust development project including the purpose, type, and trust period of the trust development;

4. A logistics complex development project plan, including the following matters:

a. A location map of the logistics complex development project;

b. A financing plan for the logistics complex development project;

c. A plan for disposal of land, facilities, etc. created by a logistics complex development project.

(5) Where an implementer referred to in Article 27(2)4 through 6 of the Act concludes a trust contract with approval under paragraph (4), he or she shall submit a copy of the contract to the authority designating logistics complexes within one month from the date of concluding the contract. <Added on Dec. 9, 2022>

Article 25(Land substitution to land owners) #

(1) "Support facilities prescribed by Presidential Decree" in Article 34(1) of the Act means the facilities classified as follows: <Amended on Feb. 6, 2024>

1. In the case of a logistics complex developed by an implementer referred to in Article 27(2)1 through 5 of the Act: Facilities referred to in subparagraph 8a through c of Article 2 of the Act;

2. In the case of a logistics complex developed by an implementer under Article 27(2)6 of the Act: Facilities referred to in the items of subparagraph 8 of Article 2 of the Act.

(2) A land owner eligible for land substitution pursuant to Article 34(1) of the Act shall be a person who owns land in the logistics complex that is larger than the minimum supply area specified in the logistics complex development plan as of the date of designation and announcement of the logistics complex, and who intend to install the following facilities on the relevant land. <Amended on Feb. 6, 2024>

1. In the case of a logistics complex developed by an implementer referred to in Article 27(2)1 through 5 of the Act: Logistics complex facilities suitable for the types of business to be invited specified in the logistics complex development plan or facilities referred to in paragraph (1)1;

2. In the case of a logistics complex developed by an implementer referred to in Article 27(2)6 of the Act: Logistics complex facilities suitable for the types of business to be invited specified in the logistics complex development plan or facilities referred to in paragraph (1)2.

(3) A person who intends to obtain land substitution pursuant to Article 34(1) of the Act shall submit to a project implementer an application for land substitution to an implementer, along with a plan for installation of facilities. <Amended on Feb. 6, 2024>

(4) An application for land substitution under paragraph (3) shall be filed by an implementer during the consultation period specified in the public announcement of compensation for the relevant logistics complex. <Amended on Feb. 6, 2024>

(5) An implementer (excluding an implementer referred to in Article 27(2)6 of the Act) shall determine the methods, procedures, etc. for land substitution in the logistics complex development plan in accordance with the following standards: <Amended on Feb. 6, 2024>

1. The value of the previous land subject to land substitution shall be the amount of compensation for consultation presented by the implementer at the time of public announcement of compensation, and the value of the land substitution shall be based on the sale price for each site of the relevant logistics complex under Article 39;

2. The large area of land substitution shall be based on the previous area of land, but the area may be increased or decreased in consideration of regional conditions, supply and demand conditions, etc., of logistics complexes;

3. The difference between the values of the previous land and of the substituted land shall be paid in cash.

Article 27(Scope and timing of installation of electric facilities) #

(1) The scope of installation of electric power system, telecommunications system, facilities for supply of gas, and regional heating system under Article 38(2) of the Act shall be as follows. <Amended on Apr. 10, 2012; Jan. 5, 2021>

1. Electric power system: Electric power system facilities from key facilities outside the logistics complex to the boundary line of a lot of land (hereinafter referred to as an "individual lot") adjoining an urban or Gun planning road of at least six meters in the land use plan within the logistics complex;

2. Telecommunications system: Pipeline facilities from key facilities outside the logistics complex to the boundary lines of an individual lot in the logistics complex, and key cable facilities outside the logistics complex to the first terminal of an individual lot in the logistics complex;

3. Facilities for supply of gas: Facilities for supply of gas from key gas supply facilities outside the logistics complex to the boundary lines of individual lots within the logistics complex; provided, where a static pressure control room (for purposes of pressure maintenance and control) is installed in a lot of land in the logistics complex to supply gas for cooking or unit heating (excluding centralized heating), gas supply facilities to the static pressure control room:

4. Regional heating system: Heating pipelines running from the point of divergence of key heating pipelines outside the logistics complex to a closing valve at the entrance to each engine room in an individual lot within the logistics complex.

(2) When the authority designating logistics complexes has approved an implementation plan, he or she shall, without delay, notify the installer of electric power system, telecommunications system, gas supply facilities, or regional heating facilities under Article 38(2) of the Act of such fact.

(3) The installation of facilities under paragraph (1) shall be completed by the date of filing an application for approval for completion under Article 46 of the Act (where the authority designating logistics complexes is an implementer, the date of completion of the logistics complex development project), unless there is a compelling reason not to do so.

Article 32(Operation and management of special accounts for development of logistics complexes) #

(1) Where the scope of matters that may be subsidized from the special account for development of a logistics complex by ordinance of the relevant local government pursuant to Article 41(3) of the Act is prescribed, the scope thereof shall be as follows. <Amended on Apr. 10, 2012; Nov. 1, 2022>

1. The following project costs implemented by the head of the relevant local government:

a. Costs of construction of the logistics complex development project;

b. Construction costs of urban/Gun planning facility projects and compensation costs for private sites under subparagraph 10 of Article 2 of the National Land Planning and Utilization Act related to logistics complex development projects.

2. Not more than 1/2 of the following costs of projects to be implemented by a person other than those referred to in subparagraph 1:

a. Construction costs necessary for the installation of urban/Gun planning facilities among logistics complex development projects;

b. Construction costs of urban/Gun planning facility projects under subparagraph 10 of Article 2 of the National Land Planning and Utilization Act related to logistics complex development projects.

3. Expenses incurred in conducting surveys and research under Article 41(1)4 of the Act;

4. Expenses under Article 41(1)6 of the Act.

(2) Where the scope of matters that may be loaned from the special account for development of a logistics complex by ordinance of the relevant local government pursuant to Article 41(3) of the Act is prescribed, the scope thereof shall be as follows: <Amended on Apr. 10, 2012; Nov. 1, 2022>

1.Not more than 1/2 of the construction cost of an urban/Gun planning facility project defined in subparagraph 10 of article 2 of the National Land Planning and Utilization Act implemented by the head of the relevant local government related to the logistics complex development project;

2. Not more than 1/3 of the following costs of projects to be implemented by a person other than those referred to in subparagraph 1:

a. Construction costs necessary for the installation of urban/Gun planning facilities among logistics complex development projects;

b. Construction costs of urban/Gun planning facility projects under subparagraph 10 of Article 2 of the National Land Planning and Utilization Act related to logistics complex development projects.

Article 33(Advance payments) #

(1) An implementer who intends to receive an advance payment under Article 43 of the Act (hereinafter referred to as "advance payment") shall meet the following requirements: <Amended on Feb. 2, 2012>

1. An implementer falling under Article 27(2)1 through 3 of the Act: He or she shall obtain approval for an implementation plan;

2. An implementer falling under Article 27(2)4 and 5 of the Act: he or she shall meet all of the following requirements:

a. He or she shall obtain approval of an implementation plan;

b. He or she shall have secured the ownership of the land to be parceled out and cancel the mortgage established on the relevant land; provided, where it fails to secure the ownership of land or to cancel the mortgage due to unavoidable reasons, the implementer, landowner and mortgagee shall notarize a joint agreement with the following details and submit it to the person authorized to approve implementation plans under Article 28(1) of the Act:

1) No landowner shall transfer the relevant land to a third party or offer it as security;

2) Where a person who has paid the relevant price pursuant to Article 43 of the Act uses the relevant land after obtaining approval for completion or permission for use before approval for completion, the landowner and the mortgagee shall transfer ownership without delay and cancel the mortgage;

c. The progress ratio of construction works for the development project for the land to be sold shall have reached at least 10/100;

d. A letter of guarantee, etc. (a letter of guarantee, insurance policy, term deposit, beneficiary certificates, etc., referred to in the subparagraphs of Article 37(2) of the Enforcement Decree of the Act on Contracts to Which the State Is a Party, in order to guarantee the refund of an advance payment in cases of non- performance of a contract for sale in units shall be submitted to the authority designating logistics complexes:

1) The amount of guarantee or insurance shall be at least the amount obtained by adding the amount equivalent to the agreed interest corresponding to the guarantee or insurance period (referring to the amount calculated according to the level of interest rates on loan on bills of commercial banks, excluding local banks) to the advance payment;

2) The commencement date of the guarantee or insurance period shall be before the date an advance payment is received, and the end date shall be at least 30 days after the completion date; provided, where the business period is extended, a letter of guarantee, etc. stating that the period of guarantee or insurance is the period of adding the extended period to the original period of guarantee or insurance shall be submitted.

(2) After receiving an advance payment under paragraph (1), no implementer shall provide a site or facility he or she has created as security.

(3) Where an implementer fails to perform a project according to the terms and conditions of a sales contract or is deemed incapable of performing the project, the authority designating logistics complexes may use a letter of guarantee, etc. for the refund of advance payment before the completion of the relevant logistics complex.

Article 34(Standards for calculation of charges for retained facilities) #

(1) Public facilities prescribed by Presidential Decree in Article 44(1) of the Act means the following facilities: <Amended on Apr. 10, 2012>

1. Access roads to logistics complexes and arterial roads;

2. Parks and green areas in logistics complexes (referring to parks and green areas determined as urban or Gun Planning Facilities)

3. Water supply facilities, sewage facilities, telecommunications facilities, and waste disposal facilities;

4. Public facilities gratuitously reverted to the state or local governments pursuant to Article 36 of the Act.

(2) Expenses incurred in installing public facilities under paragraph (1) shall be the sum of land costs, land charges, development expenses, infrastructure installation expenses, direct labor costs, relocation measures expenses, sales expenses, general management expenses, capital expenses, and other expenses calculated in accordance with the standards under Article 39(3).

(3) In applying Article 44(1) of the Act, where at least two project operators exist, expenses incurred in installing public facilities in the relevant logistics complex shall be borne by each project operator separately according to the ratio of the total available area (including the total site area for existing facilities, etc.) of the relevant logistics complex to be sold by the project operator to the total available area (including the total site area for existing facilities, etc.) of the relevant logistics complex.

(4) Notwithstanding paragraph (3), where public facilities are installed only for the purpose of use by a certain implementer, the relevant implementer who is to use the public facilities may be required to fully or partially bear expenses incurred in installing the public facilities, taking into comprehensive consideration the location of the public facilities, the purpose of installation, the current status of use, local conditions, etc.

(5) The amount of facility charges that an implementer may impose on the owners of retained facilities pursuant to Article 44(2) of the Act (hereafter referred to as "surcharges for retained facilities" in this Article, Article 34-2, and Appendix 1-2) shall be calculated by multiplying the unit price of charges for retained facilities prescribed in Appendix 1-2 by the area of the site to be retained. <Amended on Jul. 19, 2022>

(6) An implementer may reduce or exempt charges for retained facilities for each facility calculated pursuant to paragraph (5), as prescribed by Decree of the Ministry of Land, Infrastructure and Transport. <Amended on Jul. 19, 2022>

Article 36(Approval for completion) #

(1) Where an implementer intends to obtain approval for completion pursuant to Article 46(1) of the Act, he or she shall submit an application for approval for completion, stating the following matters, to the authority designating logistics complexes:

1. The name and address of the implementer (in cases of a corporation, its name and the name of its representative);

2. The name of a project;

3. The location and area of the implementation area;

4. Project implementation period;

5. A land use plan;

6. Infrastructure plan.

(2) Application for approval for completion under paragraph (1) shall be accompanied by the following documents and drawings: <Amended on Oct. 14, 2010; Aug. 31, 2016; Jan. 21, 2022>

1. As-built drawings and specifications (including as-built photographs);

2. Cadastral survey results charts issued by the head of a Si/Gun/Gu;

3. Jurisdiction records and drawings of public facilities, land, etc. prescribed in Article 36 of the Act (including appraisal records for public facilities, land, etc., whose purposes are abolished, by an appraisal corporation, etc. prescribed in the Act on Appraisal and Certified Appraisers and construction cost calculation sheets of public facilities newly installed, where a project implementer is one under Article 27(2)5 of the Act);

4. A land substitution plan and a comparison map of the old and new land cadastre (to be attached only where land substitution is made pursuant to Article 34 of the Act);

5. Itemized statements of land to be obtained by an implementer and of land, etc. to be reverted to the State or a local government under Article 46 and Article 35(4) of the Public Waters Management And Reclamation Act and Article 51 of the Enforcement Decree of that Act (appended only where public waters are reclaimed);

6. Drawings of land, facilities, etc. before and after completion;

7. Comparison table of land and facilities before and after completion;

8. Other documents stating matters necessary for the completion inspection.

(3) Upon receipt of an application for approval for completion under paragraph (1), the authority designating logistics complexes shall conduct a completion inspection and issue a certificate of approval for completion, if the relevant logistics complex development project is deemed completed in compliance with the implementation plan approved pursuant to Article 28 of the Act.

(4) "A public agency, research institute, and other specialized institution prescribed by Presidential Decree" in the former part of Article 46(2) of the Act means the following institutions: <Amended on Jun. 26, 2009; Sep. 21, 2009>

1. The Korea Land and Housing Corporation incorporated under the Korea Land and Housing Corporation Act;

2. The Korea Expressway Corporation under the Korea Expressway Corporation Act;

3. The Korea Rural Community Corporation under the Korea Rural Community Corporation and Farmland Management Fund Act;

4. The Korea Institute for Industrial Economics and Trade, the Korea Maritime Institute, the Korea Transport Institute, the Korea Rural Economic Institute, the Korea Rural Economic Institute, and the Korea Research Institute for Human Settlements under the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes and the Korea Institute of Civil Engineering and Building Technology under the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes;

5. The Korea Water Resources Corporation under the Korea Water Resources Corporation Act;

6. Deleted; <Sep. 21, 2009>

7. The Port Authority under the Port Authority Act.

(5) Matters to be publicly announced pursuant to Article 46(3) of the Act shall be as follows:

1. The name of a project;

2. The name and address of the implementer (in cases of a corporation, its name and the name of its representative);

3. The location and area of the implementation area;

4. Date of approval for completion;

5. A plan for the management and disposal of public facilities, land, etc.;

(6) Where an implementer obtains approval for completion pursuant to paragraph (3), he or she shall notify the management agency of the relevant logistics complex of the details referred to in the subparagraphs of paragraphs (1) and (2) within one month from the date of obtaining approval for completion.

Article 39(Determination of sale price) #

(1) Where an implementer sells land, facilities, etc. developed pursuant to Article 50(1) of the Act into facilities prescribed by the Minister of Land, Infrastructure and Transport as sites for logistics complex facilities or urban advanced logistics complex facilities, the sale price of such land, facilities, etc. shall be the sum of appropriate profits from the development cost; provided, where the implementer deems it necessary, the sale price may be an amount not exceeding such amount (in cases of public property, the amount under the Public Property and Commodity Management Act). <Amended on Jun. 28, 2016>

(2) Notwithstanding paragraph (1), an implementer may determine the sale price of land, facilities, etc. to be used for sale, such as a superstore, specialized shopping complex, etc. (excluding cases where land, facilities, etc. necessary for livelihood measures are supplied in lieu of land, facilities, etc. in consideration of the status of ownership of land, etc. originally owned by residents and their livelihood, etc.) by a competitive bidding conducted based on the appraised value under the Act on Appraisal and Certified Appraisers at the budget price. <Amended on Aug. 31, 2016; Jan. 5, 2021>

(3) The development costs under paragraph (1) shall be the sum of land costs, land charges, development expenses, infrastructure installation expenses, direct labor costs, relocation measures expenses, sales expenses, general management expenses, capital expenses, and other expenses calculated in accordance with the standards under Appendix 2.

(4) The appropriate profit referred to in paragraph (1) shall be determined by an implementer within the extent not exceeding 5/100 of the amount calculated under paragraph (3), excluding capital costs, expenses for vicarious execution of development projects under Article 27(5) of the Act, and advance payments, respectively, in consideration of demand for moving-in in the relevant logistics complex and regional circumstances, such as the promotion of balanced development among regions, etc.

(5) Where an implementer sells a site for logistics complex facilities or facilities prescribed by the Minister of Land, Infrastructure and Transport as urban advanced logistics complex facilities under paragraph (1) before approval for completion has been granted, he or she may settle the sale price after authorization for completion based on the total project cost and appropriate profits invested in the relevant logistics complex development project. <Amended on Jun. 28, 2016>

(6) Where an advance payment is made for a person who has paid an advance payment pursuant to paragraph (5), the amount equivalent to the interest rate on one-year term deposits of a commercial bank from the date of payment of the advance payment to the date of settlement shall be deducted from the adjusted amount.

(7) The sale price of land, facilities, etc. supplied for purposes other than a site for logistics complex facilities or urban advanced logistics complex facilities prescribed in paragraph (1) shall be determined based on the appraised value under the Act on Appraisal and Certified Appraisers, and where an implementer deems it necessary, it may be determined by an amount not exceeding the amount under the Public Property and Commodity Management Act (in cases of public property, the amount under the Public Property and Commodity Management Act). <Amended on Jun. 28, 2016; Aug. 31, 2016>

(8) Notwithstanding paragraph (7), where an implementer supplies land for the purpose of constructing privately constructed rental housing defined in subparagraph 2 of Article 2 of the Special Act on Private Rental Housing or publicly constructed rental housing defined in subparagraph 1-2 of Article 2 of the Special Act on Public Housing among facilities referred to in Article 2(4)2-2, the sale price of such land shall be the aggregate of appropriate profits from the development cost. In such cases, paragraphs (3) and (4) shall apply mutatis mutandis to the development cost and appropriate profits. <Added on Feb. 8, 2010; Dec. 28, 2015>

Article 41(Methods of supplying land, facilities) #

(1) An implementer shall sell or lease (hereinafter referred to as "supply") the land, facilities, etc. developed by the logistics complex development project according to the use specified in a logistics complex development plan formulated pursuant to Article 22(2) or (3) of the Act (including cases applied mutatis mutandis pursuant to Article 22-2(3) of the Act). In such cases, if deemed necessary for the smooth installation of infrastructure, the implementer may restrict the qualifications of persons to be supplied with the infrastructure or impose conditions on the supply thereof. <Amended on Jun. 28, 2016>

(2) The supply of land, facilities, etc. under paragraph (1) shall be made by lottery at a price determined in advance by the implementer; provided, the land, facilities, etc. to be used for sale, such as a superstore, specialized shopping complex, etc. (excluding cases where land, facilities, etc. necessary for livelihood measures are supplied in lieu of land, facilities, etc. in consideration of the status of ownership of the original land, etc. of residents and their livelihood, etc.) shall be supplied by competitive bidding. <Amended on Jan. 5, 2021>

(3) Where an implementer intends to supply land, facilities, etc. pursuant to paragraph (2), he or she shall publicly announce the following matters; provided, the foregoing shall not apply where a person to be supplied is specified or his or her eligibility is restricted, if he or she has given individual notice:

1. The name and address of the implementer and the name of the representative;

2. Location, area, and use of land, facilities, etc. (including restrictions on the use of land, facilities, etc., if any);

3. Methods and conditions of supply;

4. Supply prices or methods of determining them;

5. Qualification requirements for persons to be supplied and methods of selection;

6. The period and place of application for supply;

7. Other matters deemed necessary by the implementer.

(4) Notwithstanding paragraph (2), an implementer may supply land, facilities, etc. by means of a negotiated contract in any of the following cases. <Amended on Feb. 29, 2008; Feb. 2, 2012; Mar. 23, 2013>

1. Where a site for public facilities that cannot be sold to the general public, such as school sites, sites for public office buildings, etc., is supplied to the State, a local government, or any other person eligible to install the relevant public facilities pursuant to relevant statutes or regulations

2. Where minimum land necessary for the maintenance and management of facilities to be retained in accordance with an implementation plan publicly notified pursuant to Article 29(1) of the Act is supplied;

3. Where land is supplied to a person who has transferred all of the land, etc. owned by him or her in a logistics complex to the project implementer in accordance with the standards prescribed by Decree of the Ministry of Land, Infrastructure and Transport in response to consultation under the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects;

4. Where land is redeemed according to land redemption bonds;

5. Where it is deemed inevitable to supply land with adjacent landowners, etc., the utility value of which is substantially low in light of the scale, shape, location conditions, etc. of the land, and the supply of such land to adjacent landowners, etc.;

6. Where an implementer falling under Article 27(2)1 through 3 of the Act supplies land to a person selected in accordance with the procedures and methods prescribed by Decree of the Ministry of Land, Infrastructure and Transport because it is necessary to develop a logistics complex in a complex and three-dimensional manner for the development of the logistics industry;

6-2. Where a site for logistics facilities (excluding sales facilities) to be directly used by an enterprise included in a plan for the placement of types of business to be invited, among the matters publicly notified pursuant to Article 23(1) of the Act, is supplied to such enterprise after consultation with the authority designating logistics complexes;

7. Where it is permitted to supply products under a negotiated contract pursuant to the relevant statutes or regulations.

(5) Other matters necessary for the methods, etc. of supplying land, facilities, etc. shall be prescribed by the Minister of Land, Infrastructure and Transport. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 42(Transfer of land, facilities subject to restriction on disposal) #

(1) Where any occupant enterprise or support institution intends to transfer the land, facilities, etc. sold in lots to an implementer or a management agency referred to in Article 53 of the Act (hereinafter referred to as "management agency") before completing the installation of logistics complex facilities or support facilities pursuant to Article 51(1) of the Act, it shall submit an application for disposal to the implementer or the management agency, along with documents prescribed by Decree of the Ministry of Land, Infrastructure and Transport. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(2) Upon receipt of an application for disposition under paragraph (1), an implementer or a management agency shall select a person to be transferred pursuant to Article 51(1) of the Act and notify the applicant for disposition thereof within the period prescribed by Decree of the Ministry of Land, Infrastructure and Transport from the date of receipt of the application for disposition. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(3) Where an implementer or a management agency intends to select a person to be transferred pursuant to paragraph (2), it shall publicly announce the following matters in advance and receive an application for purchase from an applicant for occupancy: <Amended on Jan. 5, 2021>

1. Indication of the goods for sale;

2. Selling price and method of payment;

3. Timing of purchase;

4. Qualifications for occupancy of the purchaser;

5. Other matters required by the implementer or management agency.

(4) Other persons prescribed by Presidential Decree in Article 51(1)3 of the Act means the following institutions: <Amended on Nov. 20, 2009; Jan. 6, 2012; Mar. 24, 2014; May 31, 2016; Oct. 25, 2016; Apr. 2, 2019; Feb. 17, 2022>

1. Korea Credit Guarantee Fund under the Credit Guarantee Fund Act;

2. Technology guarantee under the Korea Technology Finance Corporation Act;

3. The Korea Asset Management Corporation established under the Act on the Establishment of Korea Asset Management Corporation;

4. The NongHyup Bank established under the Agricultural Cooperatives Act;

5. The Suhyup Bank established under the Fisheries Cooperatives Act;

6. The National Forestry Cooperatives Federation established under the Forestry Cooperatives Act;

7. The Korea Federation of Small and Medium Business established under the Small and Medium Enterprise Cooperatives Act;

8. The Korea SMEs and Startups Agency under the Small and Medium Enterprises Promotion Act;

9. A local government-invested public corporation established under the Local Public Enterprises Act for the purpose of land development projects;

10. An institution that an operator or a management institution deems particularly necessary to manage the relevant logistics complex.

(5) "Interest and Expenses prescribed by Presidential Decree" in Article 51(2) of the Act means the following amounts. <Amended on Sep. 20, 2010>

1. The amount calculated by multiplying the acquisition price of land, facilities, etc. to be transferred by the producer price index during the period from the date of acquisition to the date of transfer;

2. Acquisition tax and other taxes and public charges incurred in purchase; provided, it shall not be included in the calculation of taxes collected due to reasons attributable to the acquirer;

3. Expenses incurred in maintaining, preserving or improving the land, facilities, etc. to be transferred.

(6) Where a person referred to in any subparagraph of Article 51(1) of the Act intends to transfer the land, facilities, etc. purchased pursuant to that paragraph, he or she shall consult with the management agency in advance.

(7) The transfer price of land, facilities, etc. purchased by a person referred to in any subparagraph of Article 51(1) of the Act pursuant to the same paragraph may be the aggregate of interest and expenses referred to in any subparagraph of paragraph (5) to the acquisition price.

Article 47(Delegation of authority) #

(1) The Minister of Land, Infrastructure and Transport or the Minister of Oceans and Fisheries shall delegate the following authority to Mayors/Do Governors pursuant to Article 64(1) of the Act: <Amended on Feb. 29, 2008; Aug. 11, 2010; Feb. 2, 2012; Nov. 27, 2012; Mar. 23, 2013; Oct. 8, 2020; Jul. 19, 2022; Nov. 5, 2024>

Approval for completion of logistics complex development projects under Article 46(1) (including cases applied mutatis mutandis in Article 49 and 52-2(9)), public announcement of, and notification to project implementers and relevant managing agencies under Article 46(3) (including cases applied mutatis mutandis in Article 49 and 52-2(9)), or permission for use under the proviso of Article 46(5) (including cases applied mutatis mutandis in Article 49 and 52-2(9));

10-2. Imposition and collection of charges for compelling compliance under Article 50-3 (including cases applied mutatis mutandis in Article 52-2(9));

11. Receipt of logistics complex management plans prescribed in Article 55(1) of the Act;

12. Recommendations to managing agencies, etc. prescribed in Article 57 of the Act;

13. Issuance of orders to logistics warehousing business entities to submit reports or data, or inspection of the affairs thereof under Article 61(2) of the Act;

14. Holding of hearings on revocation of the registration of logistics warehousing business under subparagraph 1 of Article 62 of the Act;

15. Imposition of administrative fines on logistics warehousing business entities and collection of such fines therefrom under Article 67 of the Act;
