ENFORCEMENT DECREE OF THE NATIONAL SPORTS PROMOTION ACT — 법갈피

Article 7(Measures for promoting workplace sports) #

(1) Affiliated sports groups and sports promotion management committees shall be established pursuant to Article 10 (2) and (3) of the Act and workplaces required to employ certified sports instructors (limited to certified sports instructors who are qualified to guide sports for affiliated sports) pursuant to Article 10 (2) and (3) of the Act shall be State agencies and public organizations with at least 1,000 full-time employees. <Amended on Jul. 7, 2014>

(2) Public Institutions and workplaces that shall establish and operate at least one sports team and have certified sports instructors (limited to certified sports instructors who are qualified to guide professional sports to athletes of sports teams) pursuant to Article 10 (4) of the Act shall be public institutions (referring to public institutions under the Act on the Management of Public Institutions; hereinafter the same shall apply) and public organizations with at least 1,000 full-time employees. <Amended on Jul. 7, 2014>

(3) Where a public institution or a place of business falling under paragraph (1) or (2) has an office or place of business differently in a different region, certified sports instructors and sports teams may be placed or established in at least one office or place of business. <Amended on Jul. 7, 2014; Aug. 5, 2020>

(4) Where a public institution or workplace falling under paragraphs (1) through (3) falls under any of the following subparagraphs, the head of a Si/Gun/Gu may exempt the placement of certified sports instructors and the establishment of a sports team: <Amended on Jul. 7, 2014>

1. A public interest corporation established under the Act on the Establishment and Operation of Public Interest Corporations, which is operated relying on external support, such as subsidies, contributions, and donations, rather than its own revenue;

2. Institutions recognized by the head of the relevant central administrative agency after consultation with the Minister of Culture, Sports and Tourism, from among public institutions and public organizations under paragraph (2);

3. Other public institutions and public institutions recognized by the head of a Si/Gun/Gu as having unavoidable circumstances in light of working conditions, such as reducing the number of personnel due to deteriorating business management, etc.

(5) The heads of public institutions and the heads of workplaces under paragraphs (1) and (2) shall provide facilities for the activities of sports teams and affinity sports groups and subsidize necessary expenses, and shall hold workplace sports competitions and workplace competitions at least once a year.

(6) The heads of public institutions and the heads of workplaces which have established and operated affinity sports groups and athletic teams pursuant to paragraphs (1) and (2) and have certified sports instructors shall report the details thereof to the head of a Si/Gun/Gu within one month. The same shall also apply where affinity sports groups and athletic teams are abolished or changed. <Amended on Jul. 7, 2014>

Article 9(Certified general sports instructor) #

(1) A certified general sports instructor shall be classified into level 1 professional sports instructors, level 2 professional sports instructors, level 1 life sports instructors, and level 2 life sports instructors.

(2) Level 1 professional sports instructors shall be those who have at least 3 years' experience in game guidance in the relevant category of qualification after obtaining the qualification as a level 1 professional sports instructor in the category of qualification under Article 9-6 and have passed the qualification examination for certified sports instructors (hereinafter referred to as "qualification examination") under Article 11 (2) of the Act to obtain the qualification as a level 1 professional sports instructor in the same category of qualification and have completed the training course for certified general sports instructors (hereinafter referred to as "training course") under Article 11 (2) of the Act. <Amended on Jul. 30, 2024>

(3) A level 2 professional sports instructor shall be a person who has at least four years of sports experience in the relevant category of qualification and has completed a training course after passing a qualification examination to obtain qualification as a level 2 professional sports instructor. In such cases, the term of school years for any of the following persons shall be considered as his or her competition experience: <Amended on Aug. 16, 2017>

1. A person who has graduated from a school defined in Article 2 of the Higher Education Act (including a person who is expected to graduate from a sports field) while majoring in a sports field and graduated from a school defined in Article 2 of the Higher Education Act or a person who is deemed to have equivalent academic background under statutes or regulations;

2. A person who has graduated from a school majoring in the field of sports and graduated from a school falling under subparagraph 1 of a foreign country recognized by the Minister of Culture, Sports and Tourism (referring to a school equivalent to or higher than that of a school referred to in subparagraph 1 in terms of school systems or curricula).

(4) With respect to a person who falls under paragraph (3) 1, among persons falling under paragraph (3) 1, who have no provisions concerning the term of school years, the term of school years according to the following classifications shall be considered as his or her competition experience: <Added on Aug. 16, 2017>

1. A person who is deemed to have an academic background equivalent to that of a graduate from a university or college defined in subparagraph 1 of Article 2 of the Higher Education Act: 4 years;

2. A person who is deemed to have an academic background equivalent to that of a graduate from a college or college defined in subparagraph 4 of Article 2 of the Higher Education Act: 2 years.

(5) Level 1 life sports instructors shall be those who have at least three years' work experience in the relevant category of qualification after obtaining the qualification as level 2 life sports instructor for the category of qualification under Article 9-6 and have passed the qualification examination to obtain the qualification as a level 2 life sports instructor for the same category of qualification and have completed the training course. <Amended on Aug. 16, 2017; Jul. 30, 2024>

(6) Level 2 life sports instructors shall be those who have passed a qualification examination to obtain a qualification as a level 2 life sports instructor and have completed a training course. <Amended on Aug. 16, 2017>

Article 10(Conducting qualifying examinations) #

(1) The qualifying examination shall be conducted by dividing it into a written examination and a practical test; provided, the qualification examination for level 1 sports instructors shall be conducted only with a written examination. <Amended on Feb. 19, 2021>

(2) The subjects of the qualifying examination for each type of certified sports instructor shall be as specified in Appendix 2.

(3) Qualifying examinations shall be conducted once a year; provided, the head of an institution for qualifying examinations for certified sports instructors under Article 11-2 of the Act (hereinafter referred to as "qualifying examination institution") may, if necessary, conduct qualifying examinations by adjusting the number of times of qualifying examinations after obtaining approval from the Minister of Culture, Sports and Tourism.

(4) A qualifying examination institution shall establish a qualifying examination committee as prescribed by Decree of the Ministry of Culture, Sports and Tourism to deliberate on matters necessary for the qualifying examination, as prescribed by Decree of the Ministry of Culture, Sports and Tourism.

(5) The head of a qualifying examination institution shall appoint a person who has expertise in the relevant field and is qualified as prescribed by Decree of the Ministry of Culture, Sports and Tourism as an examiner for a written examination and a practical testimony examination, respectively, for the purpose of preparing, reviewing, scoring, etc. the examination. <Amended on Feb. 19, 2021>

(6) Any person who has passed a written examination or a practical test for qualifying examination shall be exempted from the following qualifying examination once. <Amended on Feb. 19, 2021>

(7) Except as provided in paragraphs (1) through (6), matters necessary for conducting qualifying examination, etc. shall be prescribed by Decree of the Ministry of Culture, Sports and Tourism.

Article 11-2(Designation of training institutions) #

(1) Pursuant to Article 11-2 (1) of the Act, the Minister of Culture, Sports and Tourism may designate an institution that meets all the following requirements from among schools, sports organizations, or athletic affiliates under Article 2 of the Higher Education Act as a training institution for certified sports instructors under Article 11-2 of the Act (hereinafter referred to as "training institution"):

1. In the case of a sports organization or athletic organization, it shall be a nonprofit corporation;

2. It shall have an organizational structure, human resources, and facilities for the operation of training courses;

3. There shall be a demand for the establishment and operation of a training institution in the relevant area;

4. It shall be equipped with conditions for on-the-job training.

(2) Types of training institutions shall be as follows; provided, where the Minister of Culture, Sports and Tourism deems it necessary, 2 or more types of training institutions may be consolidated and operated:

1. Training institutions for level 1 professional sports instructors;

2. Training institutions for level 2 professional sports instructors;

3. Training institutions for level 1 life sports instructors;

4. Training institutions for level 2 life sports instructors;

5. Training institutions for certified health exercise managers;

6. Training institutions for level 1 certified sports instructor for the disabled;

7. Training institutions for level 2 certified sports instructor for the disabled;

8. Training institutions for certified sports instructor for the youths;

9. Training institutions for certified sports instructors for the elderly.

(3) The head of a training institution shall establish a steering committee to deliberate on matters necessary for the operation of the training institution, as prescribed by Decree of the Ministry of Culture, Sports and Tourism.

(4) A training Institution (excluding training institutions referred to in paragraph (2) 1, 5, and 6) may establish special training courses for those who are partially exempt from qualifying examinations or training courses under Article 10-2 with approval from the Minister of Culture, Sports and Tourism. The details of such special training courses shall be determined by the Minister of Culture, Sports and Tourism.

(5) Matters necessary for the designation of a training institutions, such as the details of standards and procedures for designation under paragraph (1), shall be determined and publicly notified by the Minister of Culture, Sports and Tourism.

(6) Matters necessary for the operation of training courses, such as the period of training and requirements for relocation, shall be prescribed by Decree of the Ministry of Culture, Sports and Tourism.

Article 11-9(Safety management measures when holding sports events) #

(1) "Number of persons of at least a certain size prescribed by Presidential Decree" in Article 13-2 (1) of the Act means at least 1,000 persons.

(2) The safety management plan for the relevant sports event under Article 13-2 (1) of the Act (hereinafter referred to as "safety management plan") shall include the following matters:

1. The category, types, and period of sports events, and the number of persons to be present at sports events;

2. Place and facilities for holding sports events;

3. The names and roles of a person in charge of safety management (referring to a person who exercises overall control over safety management affairs; hereinafter the same shall apply) and a safety officer (referring to a person who directs and supervises safety personnel; hereinafter the same shall apply);

4. Measures for securing and placing safety personnel and medical personnel;

5. Plans for safety education and safety inspections;

6. Matters requiring cooperation with relevant agencies and measures for cooperation;

7. Measures to prevent safety accidents including fire, etc.;

8. Measures to take measures in cases of safety accidents and contact system in cases of occurrence of safety accidents.

(3) A person who intends to hold a sports event pursuant to Article 13-2 (1) of the Act (hereinafter referred to in this Article as the "sports event organizer") shall consult with the manager of the venue or facility where the sports event is held regarding each of the items in paragraph (2) and reflect the results in the safety management plan.

(4) A sports event organizer shall conduct safety education for sports events pursuant to Appendix 4-2 for persons in charge of safety management, safety supervisors, and safety personnel pursuant to Appendix 4-2; provided, persons in charge of safety management and safety supervisors who have completed education under subparagraph 1 of Appendix 4-2 within 2 years before the date of holding the relevant sports event shall be excluded from those subject to education.

(5) A sports event organizer shall conduct a safety inspection by using a safety inspection table for sports events prescribed by Decree of the Ministry of Culture, Sports and Tourism from the time a safety management plan is formulated to the end of the sports event.

Article 23-2(Distribution ratio of national sports promotion account) #

(1) "Allocation ratio prescribed by Presidential Decree" in the former part, with the exception of the subparagraphs, of Article 22 (2) of the Act means 20/100, and the specific distribution ratio for each person eligible for subsidization shall be as follows:

1. Support for the improvement and repair of public sports facilities of local governments under Article 22 (2) 1 of the Act and paragraph (2) of this Article: 5/100;

2. Support for organizations holding sports games for which sports betting tickets are issued and business for the promotion of sports games for which sports betting tickets are not issued, and support for projects for the enhancement of fairness in sports under Article 22 (2) 2 of the Act and Support for Projects: 10/100;

3. Support for sports and culture and arts projects under Article 22 (2) 3 of the Act: 5/100.

(2) "Public sports facilities of local governments prescribed by Presidential Decree" in the former part of Article 22 (2) 1 of the Act means any of the following sports facilities established and operated by a local government as specialized sports facilities under Article 5 of the Installation and Utilization of Sports Facilities Act or life sports facilities under Article 6 of the same Act, and sports facilities established and opened by a public school under subparagraph 2 of Article 3 of the Elementary and Secondary Education Act or a public school under Article 3 of the Higher Education Act, which are open to local residents: <Amended on Aug. 9, 2022>

1. Sports Facilities for which 10 years have passed since the completion of construction;

2. Sports facilities requiring repair and maintenance for Installation of convenience facilities under Act on the Guarantee of Convenience Promotion of Persons with Disabilities, Senior Citizens, Pregnant Women and Nursing Mothers;

3. Sports facilities that meet the standards determined and publicly notified by the Minister of Culture, Sports and Tourism, which require urgent repair or repair because it is likely to cause harm to the health and safety of users, etc.

(3) The ratio of support to the national sports promotion account shall be 30/100 of the total financial resources used for the improvement and repair under the latter part of Article 22 (2) 1 of the Act (excluding land purchase costs; hereinafter the same shall apply); provided, the ratio of support to the national sports promotion account may be at least 30/100 of the total financial resources, as determined by the Minister of Culture, Sports and Tourism, in cases of improving or repairing sports facilities referred to in paragraph (2) 2 or 3. <Amended on Dec. 29, 2017>

(4) Matters necessary for the detailed standards, procedures, etc. for support under each subparagraph of paragraph (1) shall be determined by the Minister of Culture, Sports and Tourism.

Article 23-4(Methods and procedures for performance evaluation) #

(1) Pursuant to Articles 22-3 (2) and 46 of the Act, the Minister of Culture, Sports and Tourism shall entrust the measurement and evaluation of performance of the use of the national sports promotion account under Article 22-3 (1) of the Act to the account management agency.

(2) An account management agency shall formulate a plan for performance evaluation for the following year, including the following matters, and report it to the Minister of Culture, Sports and Tourism by Dec. 31:

1. Objectives and necessity of evaluation;

2. Subject matter and scope of evaluation;

3. Methods and criteria for evaluation;

4. Evaluation procedures;

5. Plan for utilization of evaluation results.

(3) An account management agency shall conduct a performance evaluation of the projects under Article 22 of the Act in accordance with the performance evaluation plan under paragraph (2) and notify the person who has performed the relevant projects (hereafter in this Article referred to as "project implementer") of the results thereof.

(4) Where necessary to measure and evaluate the outcomes of using the national sports promotion fund, an account management agency may request a project implementer to submit data related thereto.

(5) Where a project performer has an objection to the results notified pursuant to paragraph (3), he or she shall submit a written objection stating the purport of and grounds for the objection, etc. to the account management agency within 14 days from the date he or she is notified of the results.

(6) Upon receipt of an objection raised under paragraph (5), the account management agency shall review the objection and notify the project operator of the results thereof within 20 days from the date of receipt of the objection.

(7) An account management agency shall report the results of the performance evaluation of the use of the national sports promotion fund for the previous year to the Minister of Culture, Sports and Tourism by Mar. 31.

Article 33(Refund money) #

(1) Refunds under Article 27 (1) of the Act shall be as follows: <Amended on Jul. 2, 2019>

1. Sports betting tickets in fixed rate of refund: 50/100 of the amount of sales of sports betting tickets for sports events subject to the relevant betting; provided, the Promotion Foundation shall determine matters concerning the number of times carried forward and the methods of payment of refunds accordingly, where there is no sports betting wrongful person, after obtaining approval from the Minister of Culture, Sports and Tourism;

2. Sports betting tickets in fixed dividend rates: 50/100 through 70/100 of the total sales amount of sports betting tickets in fixed dividend rates for the relevant business year.

(2) Pursuant to Article 27 (1) of the Act, a refund money calculated according to the following formulas shall be paid to a person who is faithful to promote sports betting:

1. Sports betting tickets based on fixed refund rates: Refund for sports betting tickets paid to persons who correctly predicted sports betting: Refund for sports promotion betting tickets by rank × (total amount of refund × ratio of sports promotion betting tickets by rank prescribed by Decree of the Ministry of Culture, Sports and Tourism to persons who correctly predicted sports promotion betting) × Number of sports promotion betting tickets correctly paid by rank;

2. Sports betting tickets in fixed dividend rates: Refund for unit sports betting tickets paid to persons who correctly predict the sports betting: Refund amount of unit sports promotion tickets × Refund dividend rate for unit sports betting tickets × Refund dividend rate for unit sports betting tickets calculated according to the calculation formula (where the total amount of refund for the relevant business year calculated according to the calculation formula falls short of 50/100 of the total amount of sports betting tickets sold in the relevant business year, the difference shall be paid as a refund according to the method determined by the Promotion Foundation with approval from the Minister of Culture, Sports and Tourism).

(3) Where the refund under paragraph (2) falls short of the amount of sports betting tickets by unit, the unit betting amount shall be deemed the refund.

(4) In paying a refund under paragraph (2), where there is a fractional number of less than 10 won in the amount, it shall be calculated as 10 won.

Article 38(Approval and supervision of business plans) #

(1) Pursuant to Article 31 (1) of the Act, an entrusted business entity shall submit a plan for operating sports ticket issuing business (including an operation plan in electronic form) and a budget for revenue and expenditure (including a budget in electronic form) for the following year to the Promotion Foundation by Oct. 31 of each year. <Amended on Aug. 9, 2022>

(2) A plan for operating sports ticket issuing business under paragraph (1) shall include the following matters: <Amended on Jul. 30, 2024>

1. Types of sports betting tickets, betting methods, and determination of registration of sports betting winners;

2. Names, schedule, etc. of athletic competitions subject to issuance of sports betting tickets;

3. Selection and public announcement of athletic competitions subject to issuance of sports betting tickets;

4. Sports betting tickets subject to issuance and number of annual number of sports betting tickets issued;

5. Method of issuing sports betting tickets and the closing time for issuance by each event subject to sports betting;

6. Payment of refunds;

7. An expected annual sales of sports betting tickets and sports betting tickets for fixed dividend rates;

8. An annual plan to change the target refund rates of sports betting tickets in fixed dividend rates;

9. Operation, maintenance, and repair of system for sale and sale of sports betting tickets;

10. Handling customer complaints and services;

11. Other matters prescribed by Decree of the Ministry of Culture, Sports and Tourism with respect to the business of issuing sports betting tickets.

(3) The Promotion Foundation shall submit the documents submitted pursuant to paragraph (1) to the Minister of Culture, Sports and Tourism by no later than November 30, along with a plan for expenditure of expenses incurred in issuing sports betting tickets under Article 28 (1) of the Act, to the Minister of Culture, Sports and Tourism. <Added on Aug. 9, 2022>

(4) When an entrusted business entity submits a report on the settlement of accounts under Article 31 (2) of the Act, he or she shall submit the following documents attached thereto: <Amended on Aug. 9, 2022>

1. Financial statements and annexes thereto;

2. Audit report by certified public accountant;

3. Other documents necessary for verifying the details of the settlement of accounts.

Article 44(Entrustment of affairs) #

(1) Pursuant to Article 46 of the Act, the Minister of Culture, Sports and Tourism shall entrust affairs concerning the recognition of exemplary athletes under subparagraph 2 of Article 2 to the Korean Sports and Olympic Committee and the Korea Paralympic Committee. <Amended on Jul. 7, 2014; Aug. 13, 2019; Jun. 1, 2021>

(2) The Minister of Culture, Sports and Tourism shall entrust the following affairs to the Promotion Foundation pursuant to Article 46 of the Act: <Amended on May 28, 2015; Aug. 5, 2020>

1. Conducting qualification examinations and training courses for certified sports instructors under Article 11 (2) of the Act;

2. Issuance of a certificate of qualification of a certified sports instructor (including reissuance; hereinafter the same shall apply) under Article 11 (2) of the Act;

3. Affairs, such as prior notification and service of a written disposition necessary for the revocation and suspension of qualification of certified sports instructors under Article 12 (1) of the Act;

6. Request for inquiry into criminal records and provision of materials for issuance of certificates of qualification or for revocation or suspension of qualification of certified sports instructors under article 45-3 (1) and (2) of the Act, and request for inquiry into materials for revocation or suspension of qualification of certified sports instructors;

9. Receipt of applications for designation of a certification institution under Article 16-3 (1);

(3) The Minister of Culture, Sports and Tourism shall entrust the Korea Sport Ethics Center with the following affairs pursuant to Article 46 of the Act: <Added on Aug. 5, 2020; Feb. 19, 2021; Jun. 1, 2021>

1. Conducting educational programs to prevent violence, including sexual violence, under Article 18-11 (1) of the Act;

2. Construction and operation of disciplinary disposition information system and request for data under Article 18-13 (1) and (2) of the Act;

3. Fact-finding surveys under Article 18-16 (1) of the Act;

4. Construction and operation of integrated report management system and request for data necessary therefor under Article 18-17 (1) and (2) of the Act.

Article 44-3(Management of personally identifiable information) #

(1) The Minister of Culture, Sports and Tourism (where the relevant authority is delegated or entrusted, including a person to whom such authority is delegated or entrusted), a qualification examination institution designated pursuant to Article 10-3, or a training institution designated pursuant to Article 11-2 may manage data containing resident registration numbers and alien registration numbers under subparagraphs 1 and 4 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if it is inevitable to perform the following affairs: <Amended on Aug. 5, 2020>

1. Affairs concerning qualification examinations under Article 11 (2) of the Act;

2. Affairs concerning training courses under Article 11 (2) of the Act;

(5) The Korea Paralympic Committee may manage data containing resident registration numbers under subparagraph 1 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if it is inevitable to conduct projects for promoting specialized sports for persons with disabilities, such as training players of persons with disabilities and improving their performance under Article 34 (1) 3 of the Act.
