Article 1(Purpose) #
The purpose of this Act is to establish the Korea Education and Research Information Service to produce, survey, and collect information necessary for education and academic research and to establish and operate an educational information service system, thereby improving the quality of education and academic research and contributing to the development of national education.

Article 2(Definitions) #
"Educational information service system" in this Act means a system established and operated by the Korea Education and Research Information Service (hereinafter referred to as the "KERIS") to collect, process, and store various types of information related to domestic and overseas education and academic research and to provide such information to consumers.

Article 3(Legal personality) #
The KERIS shall be a corporation.

Article 4(Establishment) #
(1) The KERIS shall be established by registering its establishment at the location of its principal office.
(2) Matters required for the registration for incorporation under paragraph (1) shall be as follows:
1. Purpose;
2. Name;
3. Principal office;
4. Names and addresses of executive officers;
5. Method of making public announcement.
(3) With respect to registration other than registration of establishment, the provisions concerning registration of incorporated foundations in the Civil Act shall apply mutatis mutandis.

Article 5(Articles of incorporation) #
(1) The articles of incorporation of the KERIS shall include the following matters:
1. Purpose;
2. Name;
3. Location of the principal office;
4. Matters concerning its board of directors;
5. Matters concerning executive officers and employees;
6. Matters concerning organization;
7. Matters concerning business and the execution thereof;
8. Matters concerning property and accounting;
9. Matters concerning its funds;
10. Matters concerning amendment to the articles of incorporation;
11. Matters concerning the method of public announcement;
(2) To amend the articles of incorporation, the KERIS shall obtain authorization from the Minister of Education. <Amended on Mar. 23, 2013>

Article 6(Projects) #
The KERIS shall perform the following projects:
1. Production, investigation, collection, and management of information necessary for education and academic research, and research for utilizing such information;
2. Establishment, management, and operation of an education information provision system;
3. Systematization and standardization necessary for the development and distribution of education and academic information;
4. Research, development, discovery, and dissemination of educational information and materials using multimedia;
5. Support for library computerization and establishment of electronic libraries in schools of various levels;
6. Support for the informatization of education and educational administration in schools of various levels;
7. Distance education and training, and support therefor;
8. International exchange and cooperation related to education and academic information.

Article 7(Officers) #
(1) The KERIS shall have not more than 11 directors, including the President, and 1 auditor as its officers.
(2) The term of office of the President shall be 3 years, and the terms of office of directors and the auditor shall be 2 years; however, they may be reappointed in units of 1 year.
(3) Directors shall be classified into standing and non-standing directors; the fixed number of standing directors shall be less than 1/2 of the fixed number of directors including the President.
(4) Matters necessary for the appointment, duties, etc. of officers shall be prescribed by the articles of incorporation.
(5) The auditor shall audit the business and accounts of the KERIS.

Article 8(Grounds for disqualification of officers) #
No person who falls under any of the following subparagraphs shall be eligible to be an officer of the KERIS:
1. A person who is not a national of the Republic of Korea;
2. A person for whom any ground for disqualification under the subparagraphs of Article 33 of the State Public Officials Act exists.

Article 9(Board of directors) #
(1) The KERIS shall have a board of directors to deliberate on and resolve important matters concerning its business.
(2) The board of directors shall consist of directors, including the President.
(3) The President shall convene meetings of the board of directors and serve as its chairperson.
(4) The auditor may attend meetings of the board of directors and state his or her opinions.
(5) Except as provided in paragraphs (1) through (4), necessary matters concerning the board of directors shall be prescribed by the articles of incorporation.

Article 10(President) #
(1) The President shall represent the KERIS and provide overall supervision of its business.
(2) The President shall be appointed by the Minister of Education from among multiple persons recommended by the executive recommendation committee established in the KERIS under Article 29 of the Act on the Management of Public Institutions, and the composition of the executive recommendation committee and other procedures shall be prescribed by the articles of incorporation. <Amended on Mar. 23, 2013>

Article 11(Local education information centers) #
(1) The KERIS may establish local education information centers in necessary places to perform the projects under Article 6.
(2) Matters necessary for the establishment and operation of local education information centers shall be prescribed by Presidential Decree.

Article 12(Appointment and dismissal of employees) #
The employees of the KERIS shall be appointed and dismissed by the President as prescribed by the articles of incorporation.

Article 13(Operating resources) #
The KERIS shall be operated with the following resources:
1. Contributions and subsidies from the Government;
2. Subsidies from the special accounts for educational finances of local governments;
3. Usage fees, commissions, and proceeds generated by operating the education information service system;
4. Other revenues.

Article 14(Usage fees and commissions) #
(1) The KERIS may collect usage fees from persons who intend to use the education information service system and persons who intend to receive information services provided by the education information service system, as determined by the Minister of Education. <Amended on Mar. 23, 2013>
(2) The KERIS may collect commissions or other actual expenses in connection with the projects under Article 6.

Article 15(Business year) #
The business year of the KERIS shall follow the fiscal year of the Government.

Article 16(Submission of business projects) #
(1) The President shall prepare a business project and a budget for each business year and submit them to the Minister of Education, as prescribed by Presidential Decree. The same shall also apply where he or she intends to change them. <Amended on Mar. 23, 2013>
(2) The President shall submit the business results for each fiscal year and a statement of accounts audited by a certified public accountant or an accounting firm and resolved by the board of directors to the Minister of Education within 2 months after the end of each fiscal year and obtain approval therefor. <Amended on Mar. 23, 2013>

Article 17(Request for personnel secondment) #
(1) Where particularly necessary to achieve its objectives and improve expertise, the Education Information Service may request the Minister of Education to dispatch personnel from state organs, local governments, educational institutions, research institutes, or public organizations (hereinafter referred to as "public institutions, etc."). <Amended on Mar. 23, 2013>
(2) The head of a public institution, etc. who has received a request for personnel secondment under paragraph (1) may second his or her subordinate employees to the KERIS.
(3) No person who is seconded to the KERIS under paragraph (2) shall be treated unfavorably in terms of his or her status, including personnel management and remuneration, on the ground of such secondment.

Article 18(Request for provision of materials) #
(1) The KERIS may request public institutions to provide publications or materials necessary for performing its services.
(2) The KERIS shall pay costs corresponding to publications or materials if a person who provides such publications or materials under paragraph (1) so requests.
(3) No publications or materials provided to the KERIS under paragraph (1) shall be used for any purpose other than the business objectives of the KERIS.

Article 19(Inspection and demand for correction) #
(1) The Minister of Education may, if necessary, have his or her subordinate public officials inspect matters concerning the business and accounting of the KERIS or demand the KERIS to submit necessary materials. <Amended on Mar. 23, 2013>
(2) In any of the following cases, the Minister of Education may demand the President to make a correction or take other necessary measures: <Amended on Mar. 23, 2013>
1. Where the details of educational information or materials violate relevant statutes;
2. Where any illegal or unjust matter exists as a result of inspection under paragraph (1).

Article 20(Confidentiality) #
No executive or employee, or former executive or employee, of the KERIS shall divulge any confidential information learned in the course of performing his or her duties.

Article 21(Prohibition on use of similar names) #
No person other than the KERIS under this Act shall use the name "Korea Education and Research Information Service" or any other name similar thereto.

Article 22(Legal fiction as public officials for purposes of penalty provisions) #
Executive officers and employees of the KERIS shall be deemed public officials for the purposes of applying Articles 129 through 132 of the Criminal Act.

Article 23(Mutatis mutandis application of the Civil Act) #
Except as provided in this Act and the Act on the Management of Public Institutions, the provisions of the Civil Act concerning foundation shall apply mutatis mutandis to the KERIS.

Article 24(Penalty provisions) #
Any person who discloses any confidential information in violation of Article 20 shall be punished by imprisonment with labor for not more than 2 years or by a fine not exceeding 20 million won. <Amended on Apr. 23, 2019>

Article 25(Administrative fines) #
(1) A person who uses a similar name in violation of Article 21 shall be punished by an administrative fine not exceeding 5 million won.
(2) Administrative fines under paragraph (1) shall be imposed and collected by the Minister of Education, as prescribed by Presidential Decree. <Amended on Mar. 23, 2013>
