INVENTION PROMOTION ACT — 법갈피

Article 10(Service invention) #

(1) If an employee, etc. acquires a patent or completes registration of a utility model or design (hereinafter referred to as "patent, etc."), or succeeds to the right to acquire a patent, etc., for a service invention, the employer, etc. shall have a non-exclusive license in the right to a patent, utility model, or design (hereinafter referred to as "patent right, etc."); provided, this shall not apply to an employer, etc. which is an enterprise other than a small and medium enterprise under Article 2 of the Framework Act on Small and Medium Enterprises unless it concludes or prepares, in advance, any of the following contracts or employment regulations subject to consultation with an employee, etc.: <Amended on Jul. 30, 2013>

1. A contract or employment regulations that makes the employer, etc. succeed to the right to acquire a patent, etc. or a patent right, etc. for a service invention made by the employee, etc.;

2. A contract or employment regulations that requires the grant of an exclusive license to the employer, etc. for a service invention made by the employee, etc.

(2) Notwithstanding paragraph (1), the State or a local government may succeed to the rights to a service invention created by a public official or a non-public official belonging to the State or a local government (hereinafter referred to as "public official, etc.") and patent right, etc. of a public official, etc. to such service invention, to which the State or a local government succeeds, shall be State property or public property; provided, an exclusively responsible organization under the latter part of Article 11 (1) of the Technology Transfer and Commercialization Promotion Act (hereinafter referred to as "exclusively responsible organization") may succeed to the rights of a teaching staff member, who works at a national or public school under Article 3 of the Higher Education Act (hereinafter referred to as "national or public school"), to a service invention, and thus the patent right, etc. of a teaching staff member of a national or public school to a service invention, to which the exclusively responsible organization succeeds, shall be owned by the exclusively responsible organization. <Amended on Apr. 20, 2021>

(3) Any provision of a contract or employment regulations shall be void, if the provision makes an employer, etc. succeed to the right to acquire a patent, etc., or a patent right, etc., in advance, for an invention made by an employee, etc. other than a service invention or requires an employee, etc. to grant an exclusive license in the patent right, etc. to the employer, etc.

(4) Notwithstanding Article 8 of the State Property Act, the disposal and management of patent rights, etc. (including waiver of patent rights, etc.) that become State property pursuant to paragraph (2) shall be under the jurisdiction of the Minister of Intellectual Property, and matters necessary for the disposal and management thereof shall be prescribed by Presidential Decree. <Amended on Jan. 30, 2009; Jan. 27, 2010; Oct. 1, 2025>

Article 15(Compensation for service invention) #

(1) An employee, etc. shall be entitled to fair compensation where the employer, etc. succeeds to the right to acquire a patent, etc., or a patent right, etc., for a service invention, or is to be granted an exclusive license in the patent right, etc. under a contract or employment regulations.

(2) The employer, etc. shall prepare compensation regulations stipulating the criteria for determining the type and amount of compensation referred to in paragraph (1), the method of payment thereof, etc., and shall inform the employee, etc. thereof in writing. <Amended on Jul. 30, 2013; Nov. 15, 2022>

(3) The employer, etc. shall consult with the employee, etc. regarding the preparation or modification of the compensation regulations under paragraph (2); provided, in the case of a modification disadvantageous to the employee, etc., the employer, etc. shall obtain consent of a majority of the employees, etc. to whom the relevant contract or compensation regulations apply. <Amended on Jul. 30, 2013>

(4) The employer, etc. shall give a written notice to an employee, etc. who will receive compensation under paragraph (1) of the details of such compensation, including the amount of the compensation determined under the compensation regulations under paragraph (2). <Added on Jul. 30, 2013; Nov. 15, 2022>

(5) Necessary matters, such as the scope of employees, etc. and procedures, which require consultation or consent under paragraph (3) shall be prescribed by Presidential Decree. <Added on Jul. 30, 2013>

(6) Compensation paid by the employer, etc. to the employee, etc. pursuant to paragraphs (2) through (4) shall be deemed fair compensation; provided, this shall not apply to cases where the amount of compensation fails to factor in the benefits the employer, etc. is anticipated to obtain from a service invention and the degree of contribution by the employer, etc. and employee, etc. to the completion of the invention. <Added on Jul. 30, 2013>

(7) The State or a local government shall pay fair compensation, when it succeeds to rights to a service invention of a public official, etc. pursuant to Article 10 (2). In such cases, matters necessary for the payment of compensation shall be prescribed by Presidential Decree or municipal ordinance. <Amended on Jul. 30, 2013; Apr. 20, 2021>

Article 16-2(Waiver of rights succeeded to and acquisition by employee, etc.) #

(1) Where a public research institute under subparagraph 6 of Article 2 of the Technology Transfer and Commercialization Promotion Act (hereafter in this Article referred to as "public research institute") succeeds to rights to obtain a patent, etc., or a patent right, etc. for a service invention (hereinafter referred to as "right to a service invention") in the Republic of Korea or overseas and then waivers such right, all the employees, etc. who have contributed to the completion of the relevant service invention may acquire the right to the invention.

(2) Notwithstanding paragraph (1), where the head of a public research institute deems it particularly necessary to waive a right to a service invention for public interests, he or she need not transfer the right to the employee, etc. In such cases, the head of a public research institute shall notify the employee, etc. of the specific reasons therefor within the period referred to in paragraph (3).

(3) The head of a public research institute who intends to waiver the right to a service invention pursuant to paragraph (1) shall notify all the employees, etc. involved in the completion of the relevant service invention of such fact within the period prescribed by Presidential Decree.

(4) Upon receipt of a notice under paragraph (3), an employee, etc. who intends to acquire a right to a service invention shall give a written notice of his or her intent to acquire such right to the head of the public research institute within the period prescribed by Presidential Decree from the date of receipt of such notice. <Amended on Nov. 15, 2022>

(5) Where an employee, etc. gives notice of his or her intent to acquire the right to a service invention pursuant to paragraph (4), such right shall be deemed transferred to the employee, etc. from the day immediately following the expiration of the period referred to in paragraph (4). In such cases, where a public research institute shares the right to a service invention with a third party, it shall be deemed that the right is transferred only when the head of the public research institute obtains consent from all of the other joint owners.

(6) Where at least two employees, etc. give notice of their intent to acquire the right to a service invention pursuant to paragraph (4), such right shall be jointly owned.

(7) The head of a public research institute and employee, etc. may consult with each other on a plan to adjust the compensation to the employee, etc. for a service invention, in exchange for the employee, etc. partially bearing the expenses for retaining the right to a service invention, within the period referred to in paragraph (3).

(8) The head of a public research institute may require an employee, etc. to reimburse expenses incurred in connection with the service invention (including taxes) after the date the right to such invention is deemed transferred to the employee, etc. pursuant to the former part of paragraph (5).

Article 18(Mediation of disputes related to service inventions) #

(1) In any of the following cases, an employee, etc. may request his or her employer, etc. to organize a deliberative committee for deliberation: <Amended on Feb. 6, 2024>

1. Where there are differences in opinions between the employee, etc. and employer, etc. as to whether an invention is a service invention;

2. Where the employer, etc. asserts succession to rights to, or grant of an exclusive license to, an invention, other than a service invention, contrary to the intent of the employee, etc. in violation of Article 10 (3);

3. Where the employer, etc. asserts succession to rights to, or grant of an exclusive license of, a service invention contrary to the intent of the employee, etc. in violation of Article 13 (2);

4. Where the employer, etc. asserts a non-exclusive license in violation of the proviso of Article 10 (1), or 13 (3);

5. Where there are differences in opinions on compensation regulations proposed by the employer, etc.;

6. Where there are differences in opinions on procedures for consultation or consent with the employer, etc.;

7. Where there are differences in opinions on the details of compensation, including the amount of compensation notified by the employer, etc. pursuant to Article 15 (4);

8. Where the employer, etc. fails to pay compensation to the employee, etc. under Article 15 (2) through (4);

9. Other cases where there are differences in opinions between the employer, etc. and employee, etc. with regard to the rights to, and compensation for, a service invention.

(2) The rights under paragraph (1) shall be exercised within 30 days from the date any of the grounds under the subparagraphs of paragraph (1) arises; provided, in cases falling under paragraph (1) 7, the rights shall be exercised within 30 days from the date the employee, etc. receives notice.

(3) Upon receipt of a request under paragraph (1), the employer, etc. shall organize a deliberative committee to deliberate on the relevant matter within 60 days. In such cases, the deliberative committee shall include at least one advisor who is an expert in the field related to service inventions.

(4) The deliberative committee under paragraph (3) shall give written notice to the employer, etc. and employee, etc. of the results of deliberation without delay.

(5) The Government may send an expert in the relevant field as an advisor under paragraph (3) at the request of the employer, etc., and matters necessary therefor shall be prescribed by Presidential Decree.

(6) An employer, etc. or an employee, etc. dissatisfied with the results of deliberation by the deliberative committee under paragraph (3) may file an application for mediation with the committee for mediation of disputes over industrial property rights under Article 41. <Amended on May 18, 2015>

Article 23(Regional intellectual property centers) #

(1) A regional intellectual property center may be established in each area in order to raise awareness of industrial property rights among regional small and medium enterprises and residents and to support the creation, protection and utilization of industrial property rights. <Amended on Mar. 30, 2011>

(2) A regional intellectual property center under paragraph (1) (hereinafter referred to as a "regional intellectual property center") shall conduct the following business activities: <Amended on Jan. 27, 2010; Mar. 30, 2011>

1. Provision of information or counseling on industrial property rights;

2. Raising awareness of industrial property rights, including education and public relations thereon;

3. Supporting the creation, protection and utilization of industrial property rights;

4. Other support activities related to intellectual property rights.

(3) A person who intends to establish a regional intellectual property center shall file for registration of the center with the Minister of Intellectual Property. <Amended on Oct. 1, 2025>

(4) A person who intends to be designated as an evaluation institute under paragraph (1) shall have specialized human resources, organizations, and facilities for evaluations prescribed by Presidential Decree. <Amended on Jul. 30, 2013; May 18, 2015; Jan. 3, 2023>

(5) No person, other than a regional intellectual property center, shall use the name "regional intellectual property center".

(6) The Government may subsidize the operation of regional intellectual property centers within the budget.

(7) A regional intellectual property center may engage in profit-making business in order to finance the projects under paragraph (2). <Amended on Mar. 30, 2011>

(8) A person who files for registration of a regional intellectual property center pursuant to paragraph (3) shall submit to the Minister of Intellectual Property a business plan for the relevant business year by one month before the date each business year begins and a business performance report for the relevant business year within three months from the date the business year ends. <Added on Mar. 30, 2011; Oct. 1, 2025>

(9) Matters necessary for the registration procedures under paragraph (3) and other relevant matters shall be prescribed by Presidential Decree. <Amended on Mar. 30, 2011>

(10) The Minister of Intellectual Property may evaluate the performance, achievements, etc. of projects of a regional intellectual property center each year. In such cases, necessary matters regarding the procedures, methods, etc. for such evaluation shall be prescribed by Presidential Decree. <Added on Mar. 30, 2011; Jul. 30, 2013; Oct. 1, 2025>

(11) The Minister of Intellectual Property may warn a regional intellectual property center with poor business performance based on the results of an evaluation of business performance pursuant to paragraph (10) and suspend or reduce the financial support under paragraph (6). <Added on Mar. 30, 2011; Oct. 1, 2025>

Article 26-2(Patent counseling center of public patent attorneys) #

(1) The Minister of Intellectual Property shall establish a patent counseling center of public patent attorneys (hereinafter referred to as "counseling center") to provide pro bono patent legal services, such as counseling related to patent, to the socially disadvantaged. <Amended on Oct. 1, 2025>

(2) The counseling center shall execute the following business: <Amended on Oct. 1, 2025>

1. Counseling and documentation support related to procedures for application, examination, registration, and adjudication of industrial property rights;

2. Representation in matters to be filed with the Ministry of Intellectual Property or courts under Article 2 of the Patent Attorney Act;

3. Reviewing applications for dispute mediation related to industrial property rights and supporting the preparation of tentative recommendations for settlement;

4. Providing management consulting and legal advice on patent disputes;

5. Holding briefings for industrial property rights and providing counseling;

6. Providing legal service in connection with industrial property rights and other business prescribed by Presidential Decree that conforms to the purpose of operating the counseling center.

(3) The counseling center shall provide services to any of the following persons: <Amended on May 18, 2015; Dec. 2, 2016>

1. Eligible recipients of medical benefits under the National Basic Living Security Act;

2. Persons who have rendered distinguished services to the State, and their families or bereaved families under Articles 4 and 5 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;

3. Persons with disabilities registered under Article 32 (1) of the Act on Welfare of Persons with Disabilities;

4. Students of schools under Article 2 of the Elementary and Secondary Education Act and Article 2 of the Higher Education Act (excluding students of special graduate schools);

5. Small enterprises under Article 2 of the Framework Act on Small and Medium Enterprises;

6. Other persons prescribed by Presidential Decree as particularly requiring counseling and support.

(4) The Government may provide expenses necessary for the operation of the counseling center within its budgetary limits.

(5) The Minister of Intellectual Property may entrust the operation of the counseling center to a corporation or organization prescribed by Presidential Decree, which has expertise in the field of industrial property rights. <Amended on Oct. 1, 2025>

(6) Matters necessary for organization, operation, scope of business, procedures, etc. of a counseling center shall be prescribed by Presidential Decree.

Article 32-3(Financing program of purchasing and utilizing secured industrial property rights) #

(1) In order to conduct the program of purchasing and utilizing secured industrial property rights, the Minister of Intellectual Property may make a contribution to any of the following institutions or organizations (hereinafter referred to as "responsible institution"): <Amended on Oct. 1, 2025>

1. The Korea Invention Promotion Association established under Article 52;

2. The Korea Institute for Advancement of Technology under Article 38 of the Industrial Technology Innovation Promotion Act;

3. Other institutions or organizations prescribed by Presidential Decree.

(2) Funds for the operation of the program of purchasing and utilizing secured intellectual property rights shall be raised from the following sources:

1. Contributions from financial companies, etc.;

2. Contribution from the Government;

3. Proceeds from transactions of secured industrial property rights;

4. Other financial resources prescribed by Presidential Decree.

(3) In order to ensure the efficient conduct of the program of purchasing and utilizing secured industrial property rights, a responsible institution may designate any institution or organization with expertise in the field of industrial property rights as a specialized agency and have it perform the following duties on its behalf; in such cases, the responsible institution may fully or partially subsidize the expenses incurred in performing the relevant duties: <Amended on Oct. 1, 2025>

1. Purchase of secured industrial property rights;

2. Management, disposal, grant of license, and other uses of secured industrial property rights that have been purchased;

3. Other duties deemed by the Minister of Intellectual Property to be necessary for operating the business.

(4) Except as provided in paragraphs (1) and (3), matters necessary for conducting the program of purchasing and utilizing secured industrial property rights shall be prescribed by Presidential Decree.

Article 34(Establishment of the Korea Industrial Property Business Support Center) #

(1) A Korea Industrial Property Business Support Center (hereinafter referred to as the "Business Support Center") shall be established to support the commercialization or utilization of technology related to any of the following inventions, etc. (hereafter in this Article referred to as "patent technology") and of trademarks: <Amended on Jan. 3, 2023>

1. An invention for which an application is filed in the Republic of Korea or a foreign country or which is registered;

2. A trade secret;

3. A layout-design.

(2) The Business Support Center shall conduct the following business activities: <Amended on Jan. 30, 2009; Mar. 18, 2009; Jul. 30, 2013; Jan. 3, 2023>

1. Operation of a permanent market and an Internet market for patent technology for referral or brokerage of transfer, sale, or purchase of patent technology and trademarks;

2. Referral or brokerage of grant of a license or a right to use for an industrial property right (including where an industrial property right holder grants the execution or use of such license or such right to the Business Support Center, and it, then, grants a sub-license or a right to use therefor to a third party; in such cases, the Business Support Center shall pay the royalties that it has received from the third party to the industrial property right holder in compliance with the extent and procedures stipulated in the agreement concluded with the industrial property right holder);

3. Survey, analysis, and evaluation of the demand for referral or brokerage of patent technology and trademarks;

4. Collection, analysis, and provision of information related to referral or brokerage of patent technology and trademarks;

5. Establishment of a cooperative system with institutions related to technology transfer, such as the Korea Institute for Advancement of Technology under Article 38 of the Industrial Technology Innovation Promotion Act;

6. Other activities necessary to support the commercialization of patent technology and to facilitate referral or brokerage of patent technology.

(3) The Government may make a contribution to help cover all or part of the expenses for the establishment and operation of the Business Support Center or the conduct of its business activities. <Amended on Jan. 3, 2023>

(4) The organization, functions, and operation of the Business Support Center, the Government's contribution, and other necessary matters shall be prescribed by Presidential Decree. <Amended on Jan. 3, 2023>

Article 41(Committee for mediation of disputes over industrial property rights) #

(1) A committee for mediation of disputes over industrial property rights (hereinafter referred to as the "Committee") shall be established in order to examine and mediate disputes over the following matters (hereinafter referred to as "disputes"): <Amended on Jun. 8, 2010; May 18, 2015; Feb. 4, 2020; Jan. 30, 2024>

1. Industrial property rights (including applications for industrial property rights);

2. Service inventions;

3. Trade secrets;

4. An act of unfair competition defined in subparagraph 1 of Article 2 of the Unfair Competition Prevention and Trade Secret Protection Act (hereinafter referred to as "act of unfair competition");

5. Layout-design rights defined in subparagraph 5 of Article 2 of the Act on the Layout-Designs of Semiconductor Integrated Circuits, exclusive licenses under Article 11 of that Act, and non-exclusive licenses under Article 12 of that Act;

6. Other matters subject to deliberation by the Committee under other statutes or regulations.

(2) The Committee shall be comprised of not less than 15 but not more than 100 members for mediation (hereinafter referred to as "mediators"), including one chairperson. <Amended on Jan. 27, 2010; Jun. 8, 2010; Feb. 4, 2020>

(3) Mediators of the Committee shall be commissioned by the Minister of Intellectual Property, from among the following persons, and the chairperson shall be appointed by the Minister of Intellectual Property, from among the mediators: <Amended on Jan. 27, 2010; Jun. 8, 2010; May 18, 2015; Oct. 1, 2025>

1. Public officials ranked Grade III or members of the Senior Executive Service, among public officials of the Ministry of Intellectual Property;

2. Persons who currently serve as a judge or a public prosecutor;

3. Persons who hold a license as attorney-at-law or patent attorney;

4. Associate professors or higher-ranked professors at a college;

5. Persons recommended by non-profit, non-governmental organizations under Article 2 of the Assistance for Non-Profit, Non-Governmental Organizations Act;

6. Other persons with extensive knowledge of and experience in the matters referred to in the subparagraphs of paragraph (1).

(4) The term of office of each mediator shall be three years; provided, the term of office of mediators who fall under paragraph (3) 1 or 2 shall coincide with their respective term of office for the position entitling them to serve on the Committee.

(5) A vacancy for a mediator shall be filled by a substitute commissioned in accordance with paragraph (3), and his or her term of office shall be the remaining term of his or her predecessor; provided, if the number of mediators is not less than 15 persons, a substitute may not be commissioned.

(6) A secretariat shall be established in the Korea Institute for Intellectual Property Protection Agency under Article 55-2 (1) to support the Committee in the conduct of business affairs. <Added on Feb. 4, 2020>

Article 51(Korea Institute of Intellectual Property) #

(1) The Government shall establish Korea Institute of Intellectual Property (hereinafter referred to as "Institute") in order to prepare efficient schemes for dealing with disputes, in Korea and abroad, related to intellectual property rights, analyze domestic and overseas trends of intellectual property rights, and conduct research on the field of new intellectual property rights. <Amended on Mar. 22, 2013>

(2) The Institute shall be a corporation. <Added on Mar. 22, 2013>

(3) The Institute shall be established by registering its incorporation at the seat of its main office. <Added on Mar. 22, 2013>

(4) The Institute shall perform the following affairs as prescribed by its articles of incorporation: <Added on Mar. 22, 2013>

1. Survey and research on intellectual property in Korea and abroad;

2. International cooperation and exchange with regard to intellectual property in Korea and abroad;

3. Projects for the promotion of awareness of intellectual property in Korea and abroad, information collection, operation of a special intellectual property library, etc.;

4. Undertaking of research contracts issued by the Government, domestic and foreign public institutions or private organizations, or corporations, etc. or conducting joint research with them;

5. Policy advice or recommendation on intellectual property and intellectual property rights;

6. Other projects incidental to those referred to in subparagraphs 1 through 5, and projects deemed by the Government to serve the purpose of the establishment prescribed in paragraph (1).

(5) The Government shall establish and enforce a supporting policy necessary for the Institute under paragraph (1). <Amended on Mar. 22, 2013>

(6) The policy under paragraph (5) shall include the following matters: <Amended on Mar. 22, 2013>

1. Subsidization of project costs and operating expenses;

2. Sending public officials for research on intellectual property rights;

3. Other matters necessary for research on intellectual property.

(7) Except as provided in this Act, the provisions of the Civil Act governing incorporated foundations shall apply mutatis mutandis to the Institute. <Added on Mar. 22, 2013>

(8) The Minister of Intellectual Property shall guide and supervise the Institute in its conduct of business affairs. <Added on Mar. 22, 2013; Oct. 1, 2025>

Article 55-3(Business affairs of Protection Agency) #

(1) The Protection Agency shall perform the following business affairs; provided, the business affairs of the Korea Copyright Protection Agency under subparagraphs 1 through 6 of Article 122-5 of the Copyright Act shall be excluded herefrom: <Amended on Nov. 15, 2022; Oct. 1, 2025>

1. Research and study on the protection of intellectual property in Korea and abroad;

2. Creation of infrastructure for the protection of intellectual property in Korea and abroad and education and publicity thereof;

3. International cooperation for the protection of intellectual property in Korea and abroad;

4. Prevention of disputes and support for responses for the protection of intellectual property in Korea and abroad;

5. Provision of support for law enforcement affairs against unfair competition practices and infringements on trademarks and exclusive licenses under subparagraph 38 of Article 5 of the Act on the Persons Performing the Duties of Judicial Police Officers and the Scope of Their Duties;

5-2. Provision of support for law enforcement affairs against an act of infringement of patent rights or exclusive licenses, unfair competition practices, the acquisition, use, or disclosure of trade secrets, and infringement of design rights or exclusive licenses under subparagraph 38-2 of Article 5 of the Act on the Persons Performing the Duties of Judicial Police Officers and the Scope of Their Duties;

6. Supporting the operation of the Committee;

7. Business affairs entrusted by the Minister of Intellectual Property for the protection of intellectual property in Korea and abroad;

8. Other business affairs prescribed by Presidential Decree as necessary to attain the establishment objectives of the Protection Agency.

(2) The Protection Agency may engage in a profit-making business to raise funds necessary to perform its functions specified in paragraph (1).

(3) The Government may fully or partially subsidize the project costs and operating expenses of the Protection Agency within the budget.

Article 55-9(Confidentiality order) #

(1) If a party establishes a prima facie case of the party's trade secret on any of the following grounds in a lawsuit over a monetary compensation for a service invention, the court may, upon the party's request, order the other party (if the party is a corporation, its representative), the person who represents the other party in the lawsuit, or any other person who becomes aware of the trade secret in the course of the legal proceedings not to use the trade secret for any purpose other than conduct of the lawsuit, and not to disclose the trade secret to a person other than the persons in receipt of the order under this paragraph in connection with the trade secret; provided, this shall not apply where the other party (if the party is a corporation, its representative), the person who represents the other party in the lawsuit, or any other person who becomes aware of the trade secret in the course of the legal proceedings has already acquired the trade secret by any means other than inspection of trial briefs and examination of evidence referred to in subparagraph 1 before the request is filed:

1. That the trade secret is included in a trial brief already submitted or to be submitted, in a piece of evidence already examined or to be examined, or data submitted or to be submitted pursuant to Article 55-8 (3);

2. That the trade secret referred to in subparagraph 1 is likely to hinder the party's business operations, if used or disclosed for any purpose other than the conduct of the relevant lawsuit, and thus the use or disclosure of such trade secret needs to be restricted to prevent such hindrance.

(2) A request for an order under paragraph (1) (hereinafter referred to as "confidentiality order") shall be filed in writing, stating the following:

1. The person to whom the confidentiality order shall be issued;

2. Facts sufficient for specifying the trade secret to be protected by the confidentiality order;

3. Facts relevant to the grounds under the subparagraphs of paragraph (1).

(3) When a court decides to issue a confidentiality order, it shall serve a written decision on the person to whom the confidentiality order is issued.

(4) A confidentiality order shall take effect when the written decision under paragraph (3) is served on the person to whom the confidentiality order is issued.

(5) An immediate appeal may be filed against a decision to reject a request for a confidentiality order, with or without prejudice.
