Article 1(Purpose) #
The purpose of this Act is to prescribe the organization, duties, and other matters necessary for the National Assembly Archives.
Article 2(Status) #
(1) The National Assembly Archives (hereafter in this Article referred to as the "Archives") shall be established under the Speaker of the National Assembly (hereafter in this Article referred to as the "Speaker").
(2) Independence shall be respected with regard to the duties of the Archives.
Article 3(Duties) #
(1) The Archives shall perform the following business affairs:
1. Production, classification, arrangement, transfer, collection, evaluation, disposal, preservation, disclosure, and utilization of records under the jurisdiction of the National Assembly, and business affairs incidental thereto;
2. Collection and management of records of members of the National Assembly (including former members), negotiating groups under Article 33 of the National Assembly Act, or political parties (limited to political parties having members belonging to the National Assembly);
3. Collection and management of constitutional records and materials;
4. Operation of the National Assembly Museum;
5. Guidance, supervision, and support with respect to records management.
(2) The Director of the Archives (hereinafter referred to as the "Director") shall endeavor to ensure that the records referred to in paragraph (1) are disclosed to the public and widely utilized.
Article 4(Director) #
(1) The Chief Librarian shall be a public official in political service, and his or her remuneration shall be equal to that of a Vice Minister.
(2) The Director shall secure professionalism and maintain neutrality in performing his or her duties.
(3) The Director shall, under the supervision of the Speaker, have overall control over the affairs of the Archives and direct and supervise the public officials under his or her authority; this shall not apply where, among affairs related to the Archives, personnel administration, budget and accounting, management of State property, management of supplies, emergency planning, registration of property of public officials, etc. are prescribed by the National Assembly Secretariat Act, the State Public Officials Act, the National Finance Act, the State Property Act, or other statutes or regulations as affairs falling under the authority of the National Assembly Secretariat or the Secretary General of the National Assembly.
Article 5(Recommendation Committee for Director of National Assembly Archives) #
(1) When the Speaker requests consent to the appointment of the Director under Article 22-4(3) of the National Assembly Act, the Speaker shall obtain a recommendation from the Recommendation Committee for the Director of the National Assembly Archives (hereafter in this Article referred to as the "Recommendation Committee") in advance.
(2) The Recommendation Committee shall be composed of persons who possess expertise regarding the duties of the Archives, maintain political neutrality, and are capable of performing recommendation duties fairly, and who are not members of the National Assembly or officials of the National Assembly.
(3) Matters necessary for the composition and operation of the Recommendation Committee shall be prescribed by National Assembly Rules.

Article 6(Documents to be attached when requesting consent to appointment) #
(1) When requesting consent to the appointment of the Director under Article 5(1), evidentiary documents concerning the following matters shall be attached:
1. Occupation, educational background, and career;
2. Reports on military service under the Act on the Report and Disclosure of Military Service Records of Public Officials;
3. Reports on property under Article 10-2(2) of the Public Service Ethics Act;
4. Matters regarding records of payment and delinquency of income tax, property tax, and comprehensive real estate holding tax for the most recent 5 years;
5. Criminal records.
(2) If necessary, a person whose appointment requires consent under paragraph (1) may request documents under the subparagraphs of that paragraph from the head of a Stage agency, a local government, or any other relevant agency, and the head of the agency in receipt of such request shall comply therewith.
Article 7(Appointment of public officials) #
Public officials of Grade V or higher of the Archives shall be appointed or dismissed by the Speaker, and other public officials shall be appointed or dismissed by the Director; provided, the Speaker may delegate part of such appointment authority to the Director as prescribed by National Assembly Rules.
Article 8(Organization) #
(1) The subsidiary bodies of the Archives shall consist of directors general, bureau directors, and division directors; provided, the titles of subsidiary bodies may be prescribed otherwise as prescribed by National Assembly Rules.
(2) Officers in charge may be placed under the Director, chiefs of offices, and chiefs of bureaus to directly assist them, and one division not belonging to any office or bureau may be placed under the Director.
(3) Office chiefs shall be appointed from among State public officials of Grade I, II or research officers in general service, bureau chiefs from among State public officials of Grade II, III or research officers in general service, and division chiefs from among state public officials of Grade III, IV or research officers in general service, respectively; and officers in charge shall be appointed from among State public officials of Grades II through IV or research officers in general service.
(4) An advisory body may be established under the Director to respond to the Director's requests for advice.
(5) The quota of public officials to be assigned to the Archives, the establishment of offices, bureaus, divisions, and officers in charge, the division of duties, and other necessary matters shall be prescribed by National Assembly Regulations; provided, the Director may determine the establishment of divisions and officers in charge equivalent thereto and the division of duties.
Article 9(Provision of materials to committees and members of National Assembly) #
When performing his or her duties, the Director shall, upon request of a committee of the National Assembly (hereafter in this Article referred to as a "Committee") or a member of the National Assembly, provide necessary materials unless there is a compelling reason not to do so.
Article 10(Reports to committees) #
The Director or a public official under his or her jurisdiction designated by the Director shall report or give explanations before the relevant committee in response to a request from the committee.
Article 11(Request for materials) #
The Director may, with the permission of the Speaker, request State agencies or other institutions or organizations to provide materials necessary for the performance of his or her duties. In such cases, a person who has received such request shall comply therewith unless there is a compelling reason not to do so.
Article 12(Delegation provisions) #
Matters mandated by this Act to be prescribed by National Assembly Rules and matters necessary for the enforcement of this Act shall be determined by the Speaker with the consent of the National Assembly Steering Committee.
