Article 1(Purpose) #
The purpose of this Decree is to prescribe matters delegated by the Special Act on Support for Gyeongju Asia-Pacific Economic Cooperation 2025 and matters necessary for the enforcement thereof.
Article 2(Asia-Pacific Economic Cooperation) #
"Meetings prescribed by Presidential Decree" in subparagraph 1 of Article 2 of the Special Act on Support for the Gyeongju Asia-Pacific Economic Cooperation 2025 (hereinafter referred to as the "Act") means the following meetings (including events accompanied therewith):
1. The 32nd Asia-Pacific Economic Cooperation (APEC) in 2025;
2. The following meetings to be held during the period of Republic of Korea’s leadership of the APEC:
(a) Senior Officials’ Meetings;
(b) APEC Ministerial Meeting;
(c) Sectoral Ministerial Meetings;
(d) Sectoral meetings administered by central administrative agencies.
3. APEC CEO Summit and meetings of the APEC Business Advisory Council;
4. Other meetings recognized by the joint head of the Preparatory Office under Article 6 (1) of the Act as necessary to be held during the period during which the meetings referred to in subparagraphs 1 and 2 are held.
Article 3(Facilities related to APEC Economic Leaders’ Meeting and other meetings) #
"Facilities prescribed by Presidential Decree" in subparagraph 2 of Article 2 of the Act means the following facilities and appurtenant facilities used for the APEC Economic Leaders’ Meeting and other meetings:
1. Media center;
2. Exhibition hall;
3. General situation room;
4. Banquet hall;
5. Venue;
6. Other facilities deemed necessary by the joint head of the Preparatory Office under Article 6 (1) of the Act to hold the APEC Economic Leaders’ Meeting and other meetings.
Article 4(Duties of chairperson of Organizing Committee) #
(1) The chairperson of the Korea APEC 2025 Organizing Committee under Article 5 (1) of the Act (hereinafter referred to as the "Organizing Committee") shall represent the Organizing Committee and exercise overall control over the affairs of the Organizing Committee.
(2) Where the chairperson of the Organizing Committee is unable to perform duties due to any unavoidable cause, a member predesignated by the chairperson shall perform the duties on behalf of the chairperson.
Article 5(Meetings of Organizing Committee) #
(1) The chairperson of the Organizing Committee shall convene and preside over meetings of the Organizing Committee when deemed necessary.
(2) A majority of the members of the Organizing Committee shall constitute a quorum, and any resolution decision thereof shall require the concurring vote of a majority of those present.
Article 6(Composition of Preparatory Office) #
(1) The Preparatory Office for APEC 2025 under Article 6 (1) of the Act (hereinafter referred to as the "Preparatory Office") shall have two joint heads and one deputy head, and the following persons shall serve as the joint head, and the 2nd Vice Minister of Foreign Affairs shall serve as the deputy head:
1. Minister of Foreign Affairs;
2. Full-time Diplomatic Security Special Advisor for Foreign Affairs in the Office of the President.
(2) The joint heads of the Preparatory Office shall jointly exercise overall control over the affairs of the Preparatory Office and direct and supervise the members of the Preparatory Office.
(3) Where one of the joint heads of the Preparatory Office is unable to perform his or her duties due to any unavoidable cause, the other joint heads shall independently perform their duties, but where all of the joint heads are unable to perform their duties due to any unavoidable cause, the deputy head shall independently act on behalf of the joint heads; provided, where the Minister of Foreign Affairs from among the joint heads is unable to perform the duties under paragraph (4) due to any unavoidable cause, the deputy head shall act on behalf of the Minister.
(4) The Preparatory Office shall have an office of the chairperson of the Senior Officials' Meeting and a planning office, and the chairperson of the Senior Officials' Meeting and the head of the planning office shall be appointed by the Minister of Foreign Affairs from among the joint heads who are public officials belonging to the Senior Executive Service of the Ministry of Foreign Affairs.
(5) The chairperson of the senior management council and the head of the planning and office shall perform the duties according to the following classifications:
1. The chairperson of the Senior Officials’ Meetings: Presiding over the Senior Officials’ Meetings and overall control over establishing the agenda of the APEC Economic Leaders’ Meeting and other meetings and managing the outcomes thereof;
2. The head of the planning office: Overall control over the affairs concerning the preparation and holding of the APEC Economic Leaders’ Meeting and other meetings.
(6) The Preparatory Office may have divisions and teams.
(7) The members of the Preparatory Office shall be as follows:
1. A person who is dispatched or concurrently employed from among public officials of the Ministry of Foreign Affairs;
Article 7(Working-level coordination committee) #
(1) The joint heads of the Preparatory Office may organize and operate a working-level coordination meeting, if necessary for smooth consultations among the relevant administrative agencies in relation to the preparations for the APEC Economic Leaders’ Meeting and other meetings.
(2) The chairperson of the working-level coordination meeting shall be the deputy head of the Preparatory Office.
(3) Matters necessary for the composition and operation of the working-level coordination committee under paragraph (1) shall be determined by the joint heads of the Preparatory Office.
Article 8(Operation of civilian advisory committee) #
(1) A civilian advisory committee may be established in the Preparatory Office to advise on the preparation of the APEC Economic Leaders’ Meeting and other meetings.
(2) Matters necessary for the composition and operation of the civilian advisory committee under paragraph (1) shall be determined by the joint heads of the Preparatory Office.
Article 9(Request for cooperation from relevant agencies) #
(1) The chairperson of the Organizing Committee or the joint heads of the Preparatory Office may, if necessary for the operation of the Preparatory Committee or the performance of duties of the Preparatory Office, request the heads of relevant administrative agencies or the heads of relevant institutions or organizations to provide necessary cooperation, such as submission of materials and opinions.
(2) The Preparatory Office may request the heads of relevant administrative agencies or relevant institutions or organizations to concurrently hold the positions of public officials, executive officers or employees under their control, if necessary to perform their duties.
(3) Where necessary for the performance of duties of the Preparatory Office, the joint heads of the Preparatory Office may request relevant experts or relevant institutions, organizations, etc. in Korea and abroad to conduct surveys and research.
Article 10(Detailed operating rules) #
(1) Except as provided in Articles 4, 5, and 9 (1), matters necessary for the composition and operation of the Organizing Committee shall be determined by the chairperson of the Preparatory Committee following deliberation by the Committee.
(2) Except as provided for in Articles 6 through 9, matters necessary for the composition and operation of the Preparatory Office shall be determined by the joint heads of the Preparatory Office.
Article 11(Security safety control group) #
(1) The Security Safety Control Group (hereinafter referred to as the "Control Group") shall be established in the Presidential Security Service in order to formulate and implement security and safety measures for holding the APEC Economic Leaders‘ Meeting and other meetings.
(2) The Chief of the Presidential Security Service shall be the head of the Control Group.
(3) Except as otherwise expressly provided for in paragraphs (1) and (2), matters necessary for the composition, operation, etc. of the control group shall be determined by the Chief of the Presidential Security Service in consultation with the heads of relevant administrative agencies.
Article 12(Support from the State) #
(1) The heads of relevant central administrative agencies or the heads of local governments may preferentially implement projects to install, expand, or improve the following facilities, etc. pursuant to Article 7 (3) of the Act in line with the timing of hosting the APEC Economic Leaders’ Meeting and other meetings:
1. Facilities related to APEC Economic Leaders‘ Meeting and other meetings;
2. Infrastructure, such as roads, railroads, and airports necessary for hosting the APEC Economic Leaders’ Meeting and other meetings;
3. Means of transportation and facilities for emergency medical services, such as ambulances necessary for emergency medical services;
4. Other facilities determined by the chairperson of the Organizing Committee following deliberation by the Preparatory Committee, which need to be preferentially implemented to host the APEC Economic Leaders’ Meeting and other meetings.
(2) The head of a relevant central administrative agency or the head of a local government may subsidize expenses incurred in restoring accommodation facilities among the APEC-related facilities after hosting the APEC Economic Leaders’ Meeting and other meetings.
Article 13(Procedure for receipt of donations) #
(1) Where the Preparatory Office receives donations pursuant to Article 8 (1) of the Act, it shall issue a receipt to the donor; provided, where the donor is unknown due to anonymous donation, etc., it may not issue a receipt.
(2) Where a donor of donations received pursuant to Article 8 (1) of the Act designates the purpose of use of such donations, the Preparatory Office shall use such donations only for such purpose.
(3) Notwithstanding paragraph (2), the Preparatory Office may use the donations for other purposes with the consent of the donor, if there is any special reason that makes it difficult to use them for the purposes designated by the donor, notwithstanding paragraph (2), but if there is any unavoidable circumstances in which the consent of the donor cannot be obtained, such as where the donor is unknown, the Preparatory Office may use them for other purposes after posting the relevant details on the bulletin board and website of the Preparatory Office for at least 7 days.
(4) The Preparation Office shall establish and manage a separate account for donations received pursuant to Article 8 (1) of the Act.
(5) The Preparatory Office shall prepare books concerning the current status, the usage record, and other relevant details of donations received pursuant to Article 8 (1) of the Act so that donors can inspect them.
Article 14(Criteria for imposition of administrative fines) #
Standards for imposing administrative fines prescribed in Article 18 (1) of the Act are prescribed as Appendix.
