Article 1(Purpose) #
The purpose of this Act is to contribute to the prosperity and development of the Asia-Pacific region by supporting the successful hosting of the 32nd Asia-Pacific Economic Cooperation (APEC) held in Gyeongju, Gyeongsangbuk-do in 2025.
Article 2(Definitions) #
The terms used in this Act are defined as follows:
1. The term "The APEC Economic Leaders' Meeting (AELM) and other meetings" means all meetings prescribed by Presidential Decree, such as summit meetings to be held during the 32nd Asia-Pacific Economic Cooperation (APEC) in 2025 and the Senior Officials' Meeting and sectoral Ministerial meetings by field to be held during the period of Republic of Korea‘s chairmanship of the APEC.
2. The term "facilities related to AELM and other meetings" means conference halls used for the AELM and other meetings, convenience facilities and lodging facilities incidental to the conference hall, such as access roads, surrounding parks, parking lots, and other facilities prescribed by Presidential Decree, which are related to AELM and other meetings
Article 3(Relationship to other statutes) #
Matters applicable to projects concerning the establishment and use of facilities related to AELM and other meetings in this Act shall prevail over other statutes.
Article 4(Responsibilities of the State and local governments) #
(1) The State and local governments shall formulate and implement comprehensive policies to ensure successful hosting of AELM and other meetings.
(2) The State and local governments shall endeavor to establish, expand, or improve lodging facilities, transportation facilities, tourism convenience facilities, etc. to be used by participants in AELM and other meetings.
Article 5(Korea APEC 2025 Organizing Committee) #
(1) Korea APEC 2025 Organizing Committee (hereinafter referred to as the "Organizing Committee") shall be established under the jurisdiction of the Prime Minister to deliberate on action plans, etc. related to the hosting of the AELM and other meetings
(2) The Organizing Committee shall deliberate on the following matters:
1. Matters concerning plans for preparing and hosting AELM and other meetings;
2. Matters concerning the inspection and evaluation of affairs with regards to preparations for hosting AELM and other meetings;
3. Matters concerning the sharing of duties among administrative agencies related to AELM and other meetings;
4. Other matters deemed necessary by the chairperson of the Organizing Committee in connection with hosting summit meetings.
(3) The Organizing Committee shall be comprised of not more than 40 members, including one chairperson, and the Prime Minister shall serve as the chairperson of the Organizing Committee, and the following persons shall serve as its members: <Amended on Oct. 1, 2025>
1. The Minister of Finance and Economy, the Minister of Science and ICT, the Minister of Education, the Minister of Foreign Affairs, the Minister of Justice, the Minister of the Interior and Safety, the Minister of Culture, Sports and Tourism, the Minister of Agriculture, Food and Rural Affairs, the Minister of Trade, Industry and Resources, the Minister of Health and Welfare, the Minister of Environment, the Minister of Employment and Labor, the Minister of Gender Equality and Family, the Minister of Land, Infrastructure and Transport, the Minister of Oceans and Fisheries, the Minister of SMEs and Startups, the Presidential Security Service, the Minister of the Office for Government Policy Coordination, the Minister of Food and Drug Safety, the Administrator of the Korea Disease Control and Prevention Agency, the Chariperson of the Korea Communications Commission, the Chairperson of the Fair Trade Commission, the Chairperson of the Anti-Corruption and Civil Rights Commission, and the Chairperson of the Personal Information Protection Commission;
2. The heads of local governments having jurisdiction over AELM and other meetings;
3. The Chairpersons of the Korea Chamber of Commerce and Industry established under the Chambers of Commerce and Industry Act, the Korea Federation of Small and Medium Business established under Article 3 (1) 4 of the Small and Medium Enterprise Cooperatives Act, the Federation of Middle Market Enterprises of Korea established under Article 27 of the Special Act on the Promotion of Growth and the Strengthening of Competitiveness of Middle-Standing Enterprises, and the Federation of Korean Industries, the Korea Enterprises Federation, and the Korea International Trade Association established under Article 32 of the Civil Act;
Article 6(Preparatory Office for APEC 2025) #
(1) Preparatory Office for APEC 2025 (hereinafter referred to as "Preparatory Office") shall be established under the Organizing Committee to efficiently conduct affairs necessary for the preparation and hosting of AELM and other meetings.
(2) The Preparatory Office shall perform the following duties:
1. Formulation and implementation of plans for the preparation and hosting AELM and other meetings;
2. Procuring and operating human resources, equipment, facilities, etc. necessary for the preparation and hosting AELM and other meetings;
3. Compilation and execution of budgets necessary for preparing for AELM and other meetings and operating the Preparatory Office;
4. Coordination of affairs and cooperation with related institutions necessary for preparing for and hosting AELM and other meetings;
5. Cooperation with local governments for preparing for and hosting AELM and other meetings;
6. Formulation and execution of internal and external publicity plans for hosting AELM and other meetings;
7. Support for surveys, research, data collection, etc. necessary for preparing for and hosting AELM and other meetings;
8. Follow-up arrangement, evaluation, and reporting of AELM and other meetings;
9. Other matters necessary for preparing for and hosting AELM and other meetings.
(3) Other matters necessary for the organization, operation, etc. of the Preparatory Office shall be prescribed by Presidential Decree.
Article 7(Support from the State) #
(1) The Preparatory Office or a local government hosting AELM and other meetings may request the State, local governments, public institutions (referring to public institutions under Article 4 of the Act on the Management of Public Institutions; hereinafter the same shall apply), corporations, organizations, etc. to provide administrative and financial cooperation and support and other necessary convenience. Upon receipt of such request, the relevant institutions shall comply therewith, except in extenuating circumstances.
(2) The State or a local government may subsidize budgets necessary for the following matters:
1. Development of infrastructure projects for AELM and other meetings;
2. Creating a cityscape neighboring venues of AELM and other meetings;
3. Construction, renovation, and maintenance of facilities related to AELM and other meetings;
4. Other matters necessary for hosting AELM and other meetings.
(3) The State or local governments may preferentially implement projects for facilities related to AELM and other meetings, in accordance with the timing of hosting AELM and other meetings, as prescribed by Presidential Decree.
(4) The heads of the State, local governments, and relevant administrative agencies may support volunteer activities for the successful hosting of AELM and other meetings pursuant to plans for AELM and other meetings.
Article 8(Receipt of donations) #
(1) Notwithstanding Article 5 (2) of the Act on Collection and Use of Donations and Promotion of Donation Culture, the Preparatory Office may receive donations voluntarily deposited within the scope consistent with the purpose of the project.
(2) Matters necessary for the procedures for and method of receiving donations under paragraph (1) shall be prescribed by Presidential Decree.
Article 9(Lending of the State and public property) #
(1) Where the State or a local government deems it necessary to support the operation and activities of the Preparatory Office or a local government hosting AELM and other meetings, notwithstanding the State Property Act, the Commodity Management Act, and the Public Property and Commodity Management Act, the State or the local government may lend State or public property gratuitously to the extent that it does not interfere with its use, or allow it to use State or public property gratuitously or to transfer office supplies or other commodities or to use such goods gratuitously.
(2) Where the Minister of Land, Infrastructure and Transport gratuitously lends, allows the use of property or commodities, or permits or transfers profits pursuant to paragraph (1), the details, conditions, procedures, etc. thereof shall be determined by a contract between the managing authority of the relevant property or commodities and the Preparatory Office, or the local government hosting AELM and other meetings.
Article 10(Issuance of commemorative coins) #
The Preparatory Office or local governments hosting AELM and other meetings may request the Bank of Korea to issue commemorative coins to publicize or commemorate AELM and other meetings.
Article 11(Issuance of commemorative stamps) #
The Preparatory Office or local governments hosting AELM and other meetings may request the Minister of Science and ICT to issue commemorative postage stamps or postcards to publicize or commemorate AELM and other meetings.
Article 12(Request for dispatch of public officials) #
The Preparatory Office may request the heads of relevant administrative agencies or related institutions or organizations to dispatch public officials, executive officers or employees under their control, if necessary to perform their duties.
Article 13(Requests for provision of data) #
(1) The Preparatory Office may request the relevant administrative agencies, public institutions, educational institutions, research organizations, etc. to provide data, such as investigation reports, research papers, etc. related to summit meetings.
(2) The head of an institution or organization in receipt of a request under paragraph (1) shall comply therewith, unless there is a compelling reason not to do so.
Article 14(Formulation of measures for special transportation and lodging) #
(1) The heads of local governments hosting AELM and other meetings shall formulate special transportation and accommodation measures.
(2) The heads of local governments hosting AELM and other meetings shall organize and operate the headquarters for special transportation and accommodation measures.
(3) The heads of local governments hosting AELM and other meetings may request the head of a public institution to provide necessary cooperation, such as dispatching employees belonging to the headquarters for special transportation and accommodation measures , if necessary to implement special transportation and accommodation measures formulated pursuant to paragraph (1).
(4) The State and local governments may subsidize the budget necessary for local governments hosting AELM and other meetings to formulate and implement measures for special transportation and lodging.
Article 15(Use of insignia of AELM) #
Any person who intends to use an insignia designated by the Preparatory Office or any similar emblem of a summit meeting shall obtain prior approval from the Preparatory Office.
Article 16(Prohibition of use of similar title) #
No one shall use the title "32nd Asia-Pacific Economic Cooperation (APEC) in 2025" or any similar title without approval from the Preparatory Office.
Article 17(Legal fiction as public official in application of penalty provisions) #
Executive officers and employees dispatched to the Preparatory Office from a related institution or organization pursuant to Article 12 shall be deemed public officials for the purposes of penalty provisions under Articles 127 and 129 through 132 of the Criminal Act.
Article 18(Administrative fines) #
(1) A person who violates Articles 15 or 16 shall be subject to an administrative fine not exceeding 3 million won.
(2) An administrative fine under paragraph (1) shall be imposed and collected by the Minister of Foreign Affairs, as prescribed by Presidential Decree.
