Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Traditional Cultural Industry Promotion Act and matters necessary for the enforcement thereof.
Article 2(Traditional culture) #
"Any of the following, prescribed by Presidential Decree" in subparagraph 1 of Article 2 of the Traditional Cultural Industry Promotion Act (hereinafter referred to as the "Act") means the following:
1. Traditional arts and traditional lifestyles;
2. Materials, techniques, patterns, ideas, and customs related to traditional arts and traditional lifestyles.
Article 3(Fact-finding survey) #
(1) The fact-finding survey under Article 6 (1) of the Act (hereinafter referred to as "fact-finding survey") shall be divided into regular survey and occasional survey, and regular survey shall be conducted every 2 years, and occasional survey shall be conducted where it is deemed necessary by the Minister of Culture, Sports and Tourism.
(2) The fact-finding survey shall include each of the following matters:
1. Current status of production, distribution, and sale of traditional cultural products;
2. Current status of workers in the traditional cultural industries (including gender status);
3. Consumer satisfaction and awareness of the traditional cultural industries;
4. Other matters that the Minister of Culture, Sports and Tourism deems necessary for a fact-finding survey to promote the traditional cultural industries.
(3) The Minister of Culture, Sports and Tourism may use electronic methods such as information and communications networks and e-mail to conduct the fact-finding survey more efficiently.
(4) The Minister of Culture, Sports and Tourism may commission an institution or organization with expertise in the research on the traditional culture industries to conduct the fact-finding survey.
Article 4(Designation of professional training institutions for traditional cultural industry) #
(1) The Minister of Culture, Sports and Tourism may designate an institution, corporation, or organization that meets all of the following requirements as a professional training institution for the traditional culture industry (hereinafter referred to as "training institution") under Article 7 (2) of the Act:
1. An institution, corporation, or organization that falls under any of the following items:
(a) Schools that open and operate education courses related to the traditional culture industries among schools defined in Article 2 of the Higher Education Act;
(b) Public institutions that perform affairs related to the traditional culture industries among public institutions under Article 4 of the Act on the Management of Public Institutions;
(c) Facilities that operate training courses related to the traditional culture industries among the vocational skills development training establishments under subparagraph 3 of Article 2 of the National Lifelong Vocational Skills Development Act;
(d) Cultural arts education facilities under subparagraph 3 of Article 2 of the Culture and Arts Education Support Act or cultural arts education organizations under subparagraph 4 of that Article that open and operate educational courses related to the traditional culture industries;
(e) Non-profit corporations established under Article 32 of the Civil Act with the primary purpose of promoting the traditional cultural industries;
2. The Minister of Culture, Sports and Tourism shall have the standards, which are deemed necessary for fostering professional human resources for the traditional cultural industries and thus publicly notified by the Minister of Culture, Sports and Tourism, such as human resources for education, educational facilities and equipment, curricula, financing plans for operating expenses, and regulations on the operation of training institutions.
(2) An institution, corporation, or organization seeking to be designated as a training institution under paragraph (1) shall submit to the Minister of Culture, Sports and Tourism an application for designation in the form prescribed by Decree of the Ministry of Culture, Sports and Tourism, along with documents prescribed by Decree of the Ministry of Culture, Sports and Tourism.
(3) When the Minister of Culture, Sports and Tourism designates a training institution under paragraph (1), he or she shall publish that fact on the website of the Ministry of Culture, Sports and Tourism.
Article 5(Objects of support for technology development) #
(1) The Minister of Culture, Sports and Tourism may provide necessary support for the following projects in accordance with Article 8 (2) of the Act:
1. Clarification of the characteristics and manufacturing principles of the materials and ingredients of traditional cultural products;
2. Establishment of database on the materials and ingredients of traditional cultural products;
3. Improvement of the production process of traditional cultural products and development of management technology;
4. Development of traditional cultural product designs;
5. Production of prototypes of traditional cultural products;
6. Other technology development projects necessary for the industrialization of traditional cultural products.
(2) The procedures and methods for support under Article 8 (2) of the Act shall be governed by the Subsidy Management Act or the National Research and Development Innovation Act.
Article 6(Subject of standardization recommendation) #
“Specifications of traditional culture products and other matters prescribed by Presidential Decree” in Article 9 (1) of the Act refers to the following matters:
1. Specifications of traditional cultural goods;
2. Function and performance of traditional cultural products;
3. Production process and manufacturing method of traditional cultural products;
4. Other matters publicly notified by the Minister of Culture, Sports and Tourism as necessary to recommend standardization to business entities engaged in the traditional cultural culture industries.
Article 7(Quality labeling) #
(1) The items subject to quality labeling under Article 10 (1) of the Act shall be designated and publicly notified by the Minister of Culture, Sports and Tourism among traditional cultural products, taking into consideration the following matters:
1. It shall be possible to induce the production of high-quality traditional cultural products;
2. It shall be able to contribute to the development of traditional cultural industries;
3. It shall be able to secure market competitiveness.
(2) The Minister of Culture, Sports and Tourism may determine and publicly notify quality labeling information, such as the producer, country of origin of materials, and manufacturing method, for items designated and publicly notified under paragraph (1). In such cases, the Minister of Culture, Sports and Tourism may determine the matters for labeling quality differently for each item.
(3) Where a business entity engaged in the traditional cultural industry places a quality labeling under paragraph (2), he or she shall attach or print the quality labeling onto traditional cultural products or the packaging, etc. of traditional cultural products, so that the quality labeling information is clearly visible.
(4) Except as otherwise provided in paragraphs (1) through (3), matters necessary for quality control, such as quality labeling, shall be determined and publicly notified by the Minister of Culture, Sports and Tourism.
Article 8(Requirements for designation of dedicated institution) #
(1) The Minister of Culture, Sports and Tourism may designate an institution or corporation that meets all of the following requirements as an institution in charge of promoting the traditional cultural industries in accordance with Article 15 (1) of the Act (hereinafter referred to as “dedicated institution”):
1. It shall be a public institution designated under Article 4 of the Act on the Management of Public Institutions or a non-profit corporation established under Article 32 of the Civil Act;
2. It shall professionally perform affairs for the promotion of the traditional cultural industries;
3. It shall establish a dedicated organization necessary for carrying out tasks related to the promotion of the traditional cultural industries;
4. It shall have at least 10 professional personnel with at least 2 years of experience in the field of research and study related to the traditional culture industries;
5. It shall secure an office and equipment to carry out affairs for the promotion of the traditional culture industries.
(2) A person who wishes to be designated as a dedicated institution pursuant to Article 15 (1) of the Act shall submit to the Minister of Culture, Sports and Tourism an application for designation in the form prescribed by Decree of the Ministry of Culture, Sports and Tourism, along with documents prescribed by Decree of the Ministry of Culture, Sports and Tourism.
(3) Where the Minister of Culture, Sports and Tourism designates a dedicated institution, he or she shall issue a designation certificate of dedicated institutions in the form prescribed by Decree of the Ministry of Culture, Sports and Tourism to the relevant institution or corporation, and post the fact on the website of the Ministry of Culture, Sports and Tourism.
(4) In cases where a dedicated institution falls under Article 15 (3) 2 of the Act, the Minister of Culture, Sports and Tourism may set a period of no more than 30 days to correct the violations.
(5) If a dedicated institution fails to meet the designation criteria under paragraph (1) within the period under paragraph (4), the Minister of Culture, Sports and Tourism may cancel the designation of the dedicated institution.
(6) Except as otherwise provided in paragraphs (1) through (5), matters necessary for the designation, operation, etc. of a dedicated institution shall be determined and publicly notified by the Minister of Culture, Sports and Tourism.
Article 9(Objects of support for fostering regional specialized traditional cultural products) #
“Matters prescribed by Presidential Decree” in Article 17 (1) of the Act refers to the following matters:
1. Participation in exhibitions or fairs related to the traditional cultural industries;
2. Activities such as sales linked to local festivals or local tourist resources;
3. Other matters necessary for the development, production, sales, and export promotion of regional traditional cultural products.
