Article 1(Purpose) #
The purpose of this Decree is to provide for matters mandated by the Gugak Promotion Act and matters necessary for the enforcement thereof.
Article 2(Fact-finding survey) #
(1) The fact-finding survey under Article 6(1) of the Gugak Promotion Act (hereinafter referred to as the "Act") (hereinafter referred to as "fact-finding survey") shall include the following matters; provided, when conducting an ad hoc survey under paragraph (2), some of the following matters may be omitted in consideration of the necessity, etc. of such survey:
1. Matters regarding the promotion of Gugak promotion projects by relevant central administrative agencies, local governments, etc.;
2. Matters regarding the preservation and succession of Gugak;
3. Matters regarding the education of Gugak;
4. Matters regarding the enjoyment of Gugak;
5. Matters regarding professional human resources, such as Gugak majors and persons engaged in the Gugak music industry;
6. Matters regarding international cooperation and overseas expansion of Gugak and Gugak cultural industry;
7. Other matters that the Minister of Culture, Sports and Tourism deems requires a fact-finding survey to promote Gugak and revitalize Gugak cultural industry.
(2) The fact-finding survey shall be conducted as either a regular survey or an ad hoc survey; the regular survey shall be conducted annually, while the ad hoc survey shall be conducted when the Minister of Culture, Sports and Tourism deems it necessary.
(3) The Minister of Culture, Sports and Tourism may commission a fact-finding survey to an institution, corporation, or organization with expertise and human sources in Gugak and the Gugak cultural industry.
Article 3(Designation of training institutions for Gugak specialists) #
(1) The Minister of Culture, Sports and Tourism, the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") may designate an institution, corporation, or organization that meets all of the following requirements as a training institution for Gugak specialists under Article 11(2) of the Act (hereinafter referred to as "training institution") in accordance with the classification under each subparagraph of paragraph (2):
1. It shall be an institution, corporation, or organization that falls under any of the following items:
a. A university that opens and operates educational courses related to Gugak and Gugak cultural industry among schools defined in Article 2 of the Higher Education Act;
b. Public institutions under Article 4 of the Act on the Management of Public Institutions that perform business affairs related to Gugak and Gugak cultural industry;
c. Non-profit corporations established in accordance with Article 32 of the Civil Act for the purpose of promoting Gugak and Gugak cultural industry;
d. Schools defined in Article 2 of the Elementary and Secondary Education Act which open and operate educational courses related to Gugak and Gugak cultural industry;
e. Other institutions, corporations, or organizations publicly notified by the Minister of Culture, Sports, and Tourism as deemed to have the capability to train Gugak specialists;
2. It shall meet all of the standards for designation of training institutions under Appendix 1.
(2) An institution, corporation or group seeking to be designated as a training institution under paragraph (1) shall apply for designation to a person according to the following categories as prescribed by Decree of the Ministry of Culture, Sports and Tourism Ordinance:
1. In the case of an institution, corporation, or organization falling under paragraph (1)1a,b,d, or e: The Minister of Culture, Sports and Tourism;
2. In the case of a corporation falling under paragraph (1)1c: The Mayor/Do Governor.
(3) Upon designating a training institution under paragraph (1), the Minister of Culture, Sports and Tourism and the Mayor/Do Governor shall publish such fact on the websites of the Ministry of Culture, Sports and Tourism and the relevant City/Do.
Article 4(Revocation of designation of training institutions) #
(1) The criteria for revocation of designation and suspension of business of training institutions under Article 11(3) of the Act are as specified in Appendix 1.
(2) Where the Minister of Culture, Sports and Tourism revokes the designation of a training institution under Article 11(3) of the Act, he or she shall publish such fact on the website of the Ministry of Culture, Sports and Tourism.
Article 5(Gugak Day) #
(1) The Gugak Day under Article 14 of the Act shall be June 5 each year.
(2) The State and local governments may hold the following events, etc. in the month to which the Gugak Day belongs:
1. Cultural and artistic events and academic events related to Gugak and Gugak cultural industry;
2. Contests related to Gugak and Gugak cultural industry;
3. Awards for meritorious contributors in the field of Gugak and Gugak cultural industry;
4. Other various projects to promote Gugak and revitalize Gugak cultural industry.
(3) The State and local governments may provide necessary support to institutions, corporations, or organizations related to Gugak and Gugak cultural industry that hold events, etc. under paragraph (2).
Article 6(Designation of support agency) #
(1) The Minister of Culture, Sports and Tourism may designate an institution or corporation that meets all of the following requirements as a support agency under Article 16(1) of the Act (hereinafter referred to as "support agency"): <Amended on Jan. 2, 2026>
1. It shall be an institution, corporation, or organization that falls under any of the following items:
a. Public institutions that perform business affairs related to Gugak and Gugak cultural industry among public institutions under Article 4 of the Act on the Management of Public Institutions;
b. Non-profit corporations established in accordance with Article 32 of the Civil Act for the purpose of promotion of Gugak and Gugak cultural industry;
2. It shall have a dedicated organization necessary for carrying out business affairs related to the promotion and fostering of Gugak and Gugak cultural industry;
3. It shall employ at least 10 full-time professional personnel necessary for performing duties related to the promotion and development of Gugak and the Gugak cultural industry (including cases where working hours are reduced during the child-rearing period pursuant to Article 19-2 of the Equal Employment Opportunity and Work-Family Balance Assistance Act).
(2) Where the Minister of Culture, Sports and Tourism designates a support agency, he or she shall publish that fact on the website of the Ministry of Culture, Sports and Tourism.
Article 7(Revocation of designation of support agency) #
(1) The standards for revocation of designation of, and corrective order to, a support agency under Article 16(3) of the Act are as set forth in Appendix 3.
(2) When the Minister of Culture, Sports and Tourism revokes the designation of a support agency under Article 16(3) of the Act, he or she shall publish the fact on the website of the Ministry of Culture, Sports and Tourism.
Article 8(Review of regulations) #
The Minister of Culture, Sports and Tourism shall examine the appropriateness of the standards for designation of training institutions under Article 3 and the standards for designation of supporting agencies under Article 6 every 3 years, counting from July 1, 2024 (referring to the period that ends on the day before July 1 of every third year) and shall take measures, such as making improvements.
