Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on Flood Damage Prevention Measures for Urban River Basins and matters necessary for the enforcement thereof.
Article 2(Flood prevention facilities) #
"Facilities prescribed by Presidential Decree" in subparagraph 5 e of Article 2 of the Act on Flood Damage Prevention Measures for Urban River Basins (hereinafter referred to as the "Act") means the following facilities: <Amended on Oct. 1, 2025>
1. Nonpoint pollution reduction facilities defined in subparagraph 13 of Article 2 of the Water Environment Conservation Act that are designated and publicly notified by the Minister of Climate, Energy and Environment;
2. Waterway tunnels under Article 2 of the Enforcement Decree of the River Act;
3. Other facilities determined and publicly notified by the Minister of Climate, Energy and Environment for the prevention of flood damage.
Article 3(Formulation and modification of master plans) #
(1) "Matters prescribed by Presidential Decree" in Article 6 (1) 9 of the Act means the following: <Amended on Oct. 1, 2025>
1. Matters regarding the scope of designated urban river basins;
2. Matters regarding projections of rainfall affected by climate change;
3. Matters regarding the status and causes of flood damage over the past 10 years;
4. Matters regarding the analysis of effectiveness and priorities for each flood prevention facility project;
5. Other matters necessary for the prevention of flood damage in designated urban river basins, as determined and publicly notified by the Minister of Climate, Energy and Environment.
(2) "Modification of any minor matters prescribed by Presidential Decree" in the proviso of Article 6 (3) of the Act means any of the following: <Amended on Oct. 1, 2025>
1. Modification made to reflect the details of the enactment, amendment, or repeal of statutes or regulations;
2. Modification made for evident reasons, such as miscalculations, clerical errors, omissions, or other similar reasons;
3. Modification of other matters determined and publicly notified by the Minister of Climate, Energy and Environment that do not affect the purpose and direction of a master plan for flood damage prevention in specific urban river basins under Article 6 (1) of the Act (hereinafter referred to as "master plan").
Article 4(Public notice of master plans) #
When formulating or modifying a master plan, the Minister of Climate, Energy and Environment shall provide public notice of the following in the Official Gazette under Article 6 (4) of the Act: <Amended on Oct. 1, 2025>
1. In cases of the formulation of a master plan: The following:
a. The purpose of the formulation;
b. Major details of the master plan;
c. Matters necessary for perusal of the entire master plan;
2. In cases of the modification of a master plan: The following:
a. The purpose of the modification;
b. Major details of the modification;
c. Matters necessary for perusal of the entire modified master plan.
Article 5(Formulation and modification of action plans) #
(1) "Matters ... prescribed by Presidential Decree" in Article 8 (1) 3 of the Act means the following: <Amended on Oct. 1, 2025>
1. The name, purpose, and overview of flood prevention facility projects;
2. The types, names, and capacities of flood prevention facilities;
3. The location and area of flood prevention facility project sites;
4. Records of land or buildings to be expropriated or used; their lot numbers, land categories, and other relevant information; and a statement of rights other than ownership (to be included only if necessary);
5. Annual implementation plans;
6. Other matters deemed necessary and publicly notified by the Minister of Climate, Energy and Environment for the implementation of flood prevention facility projects.
(2) Expenses necessary for the implementation of an action plan under Article 8 (1) of the Act (hereinafter referred to as "action plan") shall be governed by the River Act, the Sewerage Act, and the Subsidy Management Act.
Article 6(Public notice of action plans) #
(1) When formulating or modifying an action plan, the Minister of Climate, Energy and Environment, or the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") and the head of a Si/Gun/Gu (the head of a Gu refers to the head of an autonomous Gu; hereinafter the same shall apply) shall publicly notify the following in the Official Gazette or public gazette under Article 8 (2) of the Act: <Amended Oct. 1, 2025>
1. In cases of the formulation of an action plan: The following:
a. The purpose of the formulation;
b. Major details of the action plan;
c. Matters necessary for perusal of the entire action plan;
2. In cases of the modification of an action plan: The following:
a. The purpose of the modification;
b. Major details of the modification;
c. Matters necessary for perusal of the entire modified action plan.
(2) Within 10 days from the date of public notice under paragraph (1), a Mayor/Do Governor and the head of a Si/Gun/Gu (hereinafter referred to as the “head of a local government”) shall notify the Minister of Climate, Energy and Environment of the details of such notice. <Amended on Oct. 1, 2025>
Article 7(Consultation on financing and use of funds) #
(1) Upon receipt of a request for consultation on financing and use of funds under Article 8 (3) of the Act, the Minister of Climate, Energy and Environment may request the following institutions to review technical matters: <Amended on Oct. 1, 2025>
1. The Korea Water Resources Corporation established under the Korea Water Resources Corporation Act;
2. The Korea Environment Corporation established under the Korea Environment Corporation Act;
3. The Korea Institute of Civil Engineering and Building Technology established under subparagraph 9 of the Appendix of the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes;
4. The Korea Research Institute for Human Settlements established under subparagraph 22 of the Appendix of the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutes;
5. An agency exclusively responsible for hydrological investigations which is designated under Article 9 (6) of the Act on the Investigation, Planning, and Management of Water Resources;
6. Other institutions with expertise in flood prevention in urban river basins, as designated and publicly notified by the Minister of Climate, Energy and Environment.
(2) If the head of a local government intends to change the details of a consultation under Article 8 (3) of the Act, the head shall consult again with the Minister of Climate, Energy and Environment. <Amended on Oct. 1, 2025>
Article 8(Application of more stringent design standards and design frequencies) #
The Minister of Climate, Energy and Environment may apply standards more stringent than those prescribed by the relevant statutes or regulations under Article 9 (1) of the Act or may recommend that the head of a local government apply such standards under paragraph (2) of that Article, in any of the following cases: <Amended on Oct. 1, 2025>
1. Where the relevant area has a history of flood damage caused by rainfall or other factors exceeding the design standards or design frequency for flood prevention facilities due to climate change or similar causes;
2. Where the relevant area, such as a densely populated area or an industrial complex, is at high risk of significant loss of life or property in the event of flooding;
3. Where the Minister of Climate, Energy and Environment deems it necessary to apply design standards or design frequencies more stringent than those prescribed by the relevant statutes or regulations for the prevention of flood damage.
Article 9(Post management of flood prevention facility projects) #
(1) The head of a local government shall, in accordance with Article 12 (1) of the Act, submit to the Minister of Climate, Energy and Environment, by the end of February of the following year, a report on the implementation performance of flood prevention facility projects for the relevant year, which includes the following; in such cases, the head of a Si/Gun/Gu shall submit such report through the competent Mayor/Do Governor: <Amended on Oct. 1>
1. Progress rate and budget execution status for each flood prevention facility project;
2. Problems and improvement measures for each flood prevention facility project;
3. Status of measures taken in response to recommendations for improvement or requests for correction under Article 12 (2) of the Act (applicable only if there are recommendations for improvement or requests for correction);
4. Plans for implementation of remaining work for each flood prevention facility project;
5. Other matters deemed necessary by the Minister of Climate, Energy and Environment for the efficient implementation of flood prevention facility projects.
(2) The Minister of Climate, Energy and Environment may request the head of a local government to submit necessary materials or conduct on-site inspections if deemed necessary for the efficient post management of flood prevention facility projects. <Amended on Oct. 1, 2025>
(3) Except as provided in paragraphs (1) and (2), matters necessary for the post management of flood prevention facility projects shall be determined by the Minister of Climate, Energy and Environment. <Amended on Oct. 1, 2025>
Article 10(Establishment and operation of water-related disaster control center) #
(1) A water-related disaster control center established under Article 14 (1) of the Act (hereinafter referred to as "control center") shall satisfy all of the following requirements:
1. It shall be equipped with an information and communications system for collecting, disseminating, and managing information on water-related disasters, including flood risks;
2. It shall be equipped with an operational management system including facilities, equipment, and personnel, to ensure an efficient response to water-related disaster situations;
3. It shall secure dedicated personnel necessary for its operation.
(2) The Minister of Climate, Energy and Environment may request the head of the relevant central administrative agency, the head of a local government, or the head of a public institution under Article 4 of the Act on the Management of Public Institutions to dispatch their public officials, executive officers, employees, or other relevant persons, if deemed necessary for the efficient establishment and operation of a control center. <Amended on Oct. 1, 2025>
(3) Except as provided in paragraphs (1) and (2), matters necessary for the establishment and operation of a control center shall be determined by the Minister of Climate, Energy and Environment. <Amended on Oct. 1, 2025>
Article 11(Issuance of urban flood forecasts) #
(1) If the Minister of Climate, Energy and Environment intends to issue urban flood forecasts under Article 15 (1) of the Act (hereinafter referred to as "urban flood forecasts"), the Minister shall publicly notify in advance the measurement points and reference water levels for such forecasts. The same shall also apply to the modification of the publicly notified matters. <Amended on Oct. 1, 2025>
(2) The information provided through urban flood forecasts shall include the following: <Amended on Oct. 1, 2025>
1. Information on measured and predicted water levels of rivers and sewerage systems;
2. Information on flood risks and flood extents caused by the overflow of rivers and sewerage systems, etc.;
3. Other information deemed necessary by the Minister of Climate, Energy and Environment to prevent or mitigate urban flooding.
(3) When the Minister of Climate, Energy and Environment issues an urban flood forecast, the Minister shall do so through media, such as broadcasting and newspapers, and the details of such forecast shall be notified to the head of the relevant local government and other relevant agencies through information and communications networks and by other similar means. <Amended on Oct. 1, 2025>
(4) Upon receipt of notification under paragraph (3), the head of a local government shall immediately notify the head of the relevant agency, such as the chief of the relevant police station or fire station, and take necessary measures to mitigate flood damage.
(5) Except as provided in paragraphs (1) through (4), matters necessary for the issuance of urban flood forecasts shall be determined by the Minister of Climate, Energy and Environment. <Amended on Oct. 1, 2025>
Article 12(Establishment and operation of urban flood forecasting center) #
(1) An urban flood forecasting center under Article 15 (2) of the Act (hereinafter referred to as "forecasting center") shall meet all of the following requirements:
1. It shall be equipped with an information and communications system for collecting, disseminating, and managing information on flood risks;
2. It shall secure dedicated personnel with extensive expertise and experience in urban flood forecasting.
(2) The Minister of Climate, Energy and Environment may request necessary cooperation from relevant institutions, organizations, and experts if deemed necessary for the efficient establishment and operation of a forecasting center. <Amended on Oct. 1, 2025>
(3) Except as provided in paragraphs (1) and (2), matters necessary for the establishment and operation of a forecasting center shall be determined by the Minister of Climate, Energy and Environment. <Amended on Oct. 1, 2025>
Article 13(Delegation of authority) #
(1) The Minister of Climate, Energy and Environment shall delegate the authority over the following duties to the head of a river basin environmental office or the head of a regional environmental office under Article 19 (1) of the Act: <Amended on Oct. 1, 2025>
1. Formulation, modification, public notice, and notification of master plans under Article 6 of the Act;
2. Formulation, modification, and public notice of action plans under Article 8 (1) and (2) of the Act;
3. Consultation on financing and use of funds under Article 8 (3) of the Act;
4. Application of standards more stringent than those prescribed by the relevant statutes or regulations under Article 9 (1) of the Act and recommendation for application under paragraph (2) of that Article;
5. Receipt of reports on the implementation performance of flood prevention facility projects under the former part of Article 12 (1) of the Act;
6. Recommendation for improvement and request for correction under Article 12 (2) of the Act.
(2) The Minister of Climate, Energy and Environment shall delegate the authority over the following duties to the director of a flood control office under Article 19 (1) of the Act: <Amended on Oct. 1, 2025>
1. Establishment and operation of the information system under Article 13 (1) of the Act;
2. Request for the submission of materials under Article 13 (2) of the Act;
3. Issuance of urban flood forecasts under Article 15 (1) of the Act;
4. Establishment and operation of urban flood forecasting centers under Article 15 (2) of the Act.
