Article 1(Purpose) #
The purpose of this Act is to contribute to the protection of the rights of citizens and the development of the national economy by establishing the Korea Land and Geospatial Informatix Corporation to support the construction of spatial information systems, conduct cadastral surveys, research and technology development of spatial information and cadastral systems, and other projects related thereto.
Article 2(Legal personality) #
The Korea Land and Geospatial Informatix Corporation (hereinafter referred to as the "Corporation") shall be a corporation.
Article 3(Registration) #
(1) The Corporation shall be formed by registering its incorporation at the location of its main office.
(2) The registration of incorporation of the Corporation and other matters necessary for the registration shall be prescribed by Presidential Decree.
Article 4(Offices) #
(1) The location of the Corporation's main office shall be prescribed by its articles of incorporation.
(2) The Corporation, if necessary to conduct its business affairs, may have regional headquarters, branches, offices, research institutes, training institutes, and other affiliated institutions by a resolution of the board of directors.
Article 5(Articles of incorporation) #
(1) The following matters shall be included in the articles of incorporation of the Corporation:
1. Purpose;
2. Name;
3. Location of the main office;
4. Matters regarding organization and structure;
5. Matters regarding business affairs and the execution thereof;
6. Matters regarding the board of directors;
7. Matters regarding executive officers and employees;
8. Matters regarding property and accounting;
9. Matters regarding any amendment to the articles of incorporation;
10. Matters regarding the methods of public announcement;
11. Matters regarding the enactment, amendment, and repeal of regulations;
12. Matters regarding dissolution.
(2) Where the Corporation intends to amend the articles of incorporation, it shall obtain authorization of the Minister of Land, Infrastructure and Transport in advance.
Article 6(Projects) #
The Corporation shall perform the following projects:
1. Projects prescribed by Presidential Decree to support for the construction of a spatial information system under the Framework Act on National Spatial Data Infrastructure, etc. excluding the following:
a. Projects falling within the range of surveying business (excluding cadastral surveying business) under the Act on Construction and Management of Spatial Data;
b. Projects falling under competing products among small and medium business operators under the Act on Facilitation of Purchase of Small and Medium Enterprise-Manufactured Products and Support for Development of Their Markets;
2. Projects of research, technology development, standardization, and education regarding spatial information and cadastral systems;
3. Projects of introduction of foreign technology regarding spatial information and cadastral systems, international interchange and cooperation, and overseas expansion;
4. Projects of cadastral surveys conducted on any of the reasons falling under Article 23(1)1 and 3 through 5 of the Act on the Establishment and Management of Spatial Data;
5. Projects of cadastral resurveys under the Special Act on Cadastral Resurvey;
6. Projects falling under subparagraphs 1 through 5 entrusted by the State, local governments, or public institutions under the Act on the Management of Public Institutions;
7. Projects which can be conducted by or are entrusted to the Corporation in accordance with other statutes;
8. Other projects prescribed by the articles of incorporation, which are necessary to achieve the purpose of the incorporation of the Corporation.
Article 7(Executive officers) #
(1) The Corporation shall have not more than 11 directors, including 1 president and 1 vice president, and 1 auditor as its executive officers, and directors shall be classified into standing directors and non-standing directors, as prescribed by the articles of incorporation.
(2) The president shall represent the Corporation and exercise overall control over its affairs.
(3) The auditor shall audit and inspect the accounting and business affairs of the Corporation.
(4) The president shall not represent the Corporation with respect to matters in which the interests of the Corporation conflict with those of the president, and in such cases, the auditor shall represent the Corporation.
Article 8(Appointment and dismissal of employees and appointment of agents) #
(1) The president shall appoint and dismiss employees of the Corporation, as prescribed by the articles of incorporation.
(2) The president of the Corporation may appoint an agent authorized to conduct all judicial activities or activities, other than trials, regarding the business affairs from among its employees, as prescribed by its articles of incorporation.
Article 9(Raising of funds) #
(1) Funds necessary for the operation and projects of the Corporation shall be raised by the following methods:
1. Contributions and subsidies from persons other than the Government (including public enterprises under Article 5(4)1 of the Act on the Management of Public Institutions);
2. Profits accrued from projects under Article 6;
3. Loans under Article 13;
4. Funds raised by issuing bonds under Article 14;
5. Other proceeds prescribed by Presidential Decree or the articles of incorporation.
(2) Matters necessary for the management, use, etc. of contributions under paragraph (1) shall be prescribed by Presidential Decree.
Article 10(Subsidies) #
The State may partially subsidize expenses necessary for conducting projects of the Corporation within the budget.
Article 11(Investment) #
(1) Where necessary for the efficient performance of the Corporation's projects, the Corporation may invest in, or contribute to, the projects under Article 6.
(2) Matters necessary for investment or contribution under paragraph (1) shall be prescribed by Presidential Decree.
Article 12(Collection of fees) #
The Corporation may collect fees and other actual expenses with regard to projects under Article 6, as determined by the Minister of Land, Infrastructure and Transport.
Article 13(Borrowing of funds) #
The Corporation may borrow funds (including funds and commodities borrowed and brought from foreign countries; hereinafter the same shall apply) with approval from the Minister of Land, Infrastructure and Transport, if necessary to perform projects under Article 6.
Article 14(Issuance of bonds) #
(1) The Corporation may issue bonds to raise funds necessary for performing projects under Article 6.
(2) Where the Corporation intends to issue bonds under paragraph (1), it shall obtain approval from the Minister of Land, Infrastructure and Transport. In such cases, the Minister of Land, Infrastructure and Transport shall consult with the Minister of Economy and Finance in advance. <Amended on Oct. 1, 2025>
(3) The State may guarantee the redemption of the principal and interest of bonds issued by the Corporation.
(4) The extinctive prescription of bonds, which shall be counted from the date of redemption, shall be 5 years for the principal and 3 years for the interest accrued thereon.
(5) Other matters necessary for the issuance of bonds shall be prescribed by Presidential Decree.
Article 15(Appropriation of surplus) #
When a surplus accrues in settlement of accounts at the end of each business year, the Corporation shall make up for any loss carried forward, and shall use remaining surplus as revenue for the following business year.
Article 16(Request for provision of data) #
(1) If necessary for performing projects under Article 6, the Corporation may request the heads of relevant central administrative agencies, local governments, or agencies, organizations, etc. related to spatial data to provide necessary data.
(2) A person who is requested to provide data in accordance with paragraph (1) shall comply with such request unless there is a compelling reason not to do so.
Article 17(Supervision over corporation) #
(1) The Minister of Land, Infrastructure and Transport shall guide and supervise the following matters among the projects of the Corporation:
1. Matters regarding business performance and settlement of accounts;
2. Matters regarding appropriate performance of projects under Article 6;
3. Other matters prescribed by relevant statutes or regulations such as the Act on the Management of Public Institutions.
(2) Where any illegality or impropriety is discovered in the course of supervision under paragraph (1), the Minister of Land, Infrastructure and Transport may order the Corporation to take corrective measures or take necessary measures.
Article 18(Prevention of divulgence of confidential information) #
A person who is or was an executive officer or employee of the Corporation shall not disclose or illegally use any confidential information that he or she learned in the course of performing his or her duties.
Article 19(Prohibition of use of similar name) #
No person, other than the Corporation, shall use the name "Korea Land and Geospatial Informatix Corporation" or any similar name thereto.
Article 20(Application mutatis mutandis of other statutes) #
Except as provided in this Act and the Act on the Management of Public Institutions, the provisions of the Civil Act governing incorporated foundations shall apply mutatis mutandis to the Corporation.
Article 21(Penalty provisions) #
A person who has disclosed or illegally used any confidential information that he or she learned in the course of performing his or her duties, in violation of Article 18, shall be punished by imprisonment with labor for not more than 2 years or by a fine not exceeding 20 million won.
Article 22(Administrative fines) #
(1) A person who uses the name of the Korea Land and Geospatial Informatix Corporation or any similar name, in violation of Article 19, shall be subject to an administrative fine not exceeding 5 million won.
(2) An administrative fine under paragraph (1) shall be imposed and collected by the Minister of Land, Infrastructure and Transport, as prescribed by Presidential Decree.
