Article 1(Purpose) #
The purpose of this Act is to establish the Korea Road Traffic Authority and traffic order and to improve traffic safety through education, public awareness campaigns, research, and technological development regarding road traffic safety, management of driver's license tests, etc., thereby contributing to the prevention of road hazards and obstacles.
Article 2(Corporate personality) #
The Korea Road Traffic Authority (hereinafter referred to as the "Authority") shall be a corporation.
Article 3(Registration of establishment) #
(1) The Authority shall be established at the time it registers such establishment at the location of its main office.
(2) Matters necessary for the establishment and registration of the Authority shall be prescribed by Presidential Decree.
Article 4(Establishment of branch offices) #
The Authority may have branch offices, sub-branch offices, research institutes, traffic accident analysis centers, educational institutions, traffic broadcasting stations, driver's license test centers, etc.
Article 5(Articles of association) #
(1) The articles of association of the Authority shall include the following:
1. Objectives;
2. Name;
3. Location of its main office;
4. Matters relating to its projects;
5. Matters relating to the board of directors;
6. Matters relating to its executive officers and employees;
7. Matters relating to its property and accounting;
8. Matters relating to its operational funds;
9. Matters relating to public announcements;
10. Matters relating to any amendment to the articles of association.
(2) If the Authority intends to amend its articles of association, it shall obtain authorization from the Commissioner General of the Korean National Police Agency.
Article 6(Projects) #
The Authority shall undertake the following projects:
1. Conducting investigations into, and research on, road traffic safety measures;
2. Conducting research on, developing, disseminating, and providing technical services for road traffic safety technologies;
3. Conducting broadcasting and public awareness campaigns relating to road traffic safety, disasters, etc.;
4. Providing education and training on road traffic safety and issuing and managing qualification certificates on one's half;
5. Testing, inspecting, correcting, operating, and managing traffic safety facilities and traffic enforcement equipment as well as providing technical support;
6. Collecting, publishing, and distributing data relating to road traffic safety;
7. Recommending improvements to problems arising from the enforcement of road traffic-related statutes or regulations;
8. Introducing foreign technologies on road traffic safety, and engaging in international cooperation with traffic safety-related organizations;
9. Providing technical support for the administration of road traffic safety, and assisting in the education and training of public officials involved in traffic administration;
10. Investigating and analyzing road traffic accidents, improving accident-prone areas, and providing relevant support;
11. Managing driver's license tests;
12. Conducting regular aptitude tests and occasional aptitude tests for licensed drivers;
13. Conducting affairs relating to road traffic safety entrusted by the State or local governments;
14. Conducting affairs related to education, technology research, development, etc. related to autonomous vehicles;
15. Conducting incidental affairs related to projects referred to in subparagraphs 1 through 14;
16. Conducting other projects necessary to achieve the Authority's objectives.
Article 7(Expense coverage) #
If the Authority is commissioned by any corporation, organization, or individual to perform affairs related to the projects under Article 6, it may receive necessary expenses from such corporation, organization or individual.
Article 8(Executive officers) #
The Authority shall have not more than 11 directors, including 1 president, and 1 auditor.
Article 9(Employees) #
The Authority's employees shall be appointed or dismissed by the president as prescribed in the articles of association.
Article 10(Legal fiction as public officials of the Authority's executive officers and employees) #
The executive officers and employees of the Authority shall be deemed public officials for purposes of applying the penalty provisions under the Criminal Act or other statutes to affairs referred to in subparagraphs 11 through 13 of Article 6 and affairs to be conducted vicariously by the Authority pursuant to Article 147 (5) and (6).
Article 11(Prohibition of disclosure of confidential information) #
No current or former executive officer or employee of the Authority shall disclose or misappropriate any confidential information learned in the course of performing his or her duties.
Article 12(Operating funds) #
(1) The funds required to operate the Authority and to undertake road traffic safety projects shall be appropriated from the following financial resources:
1. Contributions and donations from the Government, local governments, or other entities;
2. Revenues generated from projects under Article 6 and affairs entrusted or conducted on one's behalf under Article 147 of the Road Traffic Act;
3. Profits derived from the management and operation of assets;
4. Subsidies, loans, and borrowings (including funds borrowed and materials introduced from foreign countries);
5. Other revenue sources.
(2) If deemed necessary to implement projects under Article 6, the Authority may receive subsidies, obtain loans, or borrow funds (including those borrowed or materials introduced from international organizations, foreign governments, or foreigners) with the approval of the Commissioner General of the Korean National Police Agency.
(3) Any surplus remaining after the settlement of accounts at the end of each business year shall be used to offset any loss carried forward and any remaining amount shall be transferred to the revenue for the following year.
(4) Matters necessary for the intended use of subsidies, loans, or borrowings under paragraph (1) 4, procedures for the use thereof, and other relevant affairs shall be prescribed by Presidential Decree.
Article 13(Investments) #
(1) If necessary to efficiently implement projects, the Authority may invest in, or contribute to, projects related to those referred to in Article 6.
(2) If the Authority intends to make any investment or contributions pursuant to paragraph (1), it shall obtain approval from the Commissioner General of the Korean National Police Agency as prescribed by Presidential Decree.
Article 14(Gratuitous leases of the State property) #
If necessary for the facilities and the operations of the Authority, the State or local governments may gratuitously lease the State or public property to the Authority and allow the Authority to use or profit from such property.
Article 15(Budget preparation and approval) #
The Authority shall prepare a budget for the following fiscal year and finalize it with the approval of the Commissioner General of the Korean National Police Agency before the start of the following fiscal year after a resolution of the board of directors. The same shall apply to any modification of such budget.
Article 16(Application mutatis mutandis of the Civil Act) #
Except as provided in this Act, the provisions of the Civil Act governing incorporated foundations shall apply mutatis mutandis to the Authority.
Article 17(Guidance and supervision) #
The Commissioner General of the Korean National Police Agency may provide guidance and supervision over the following matters among the Authority's affairs and issue orders necessary to achieve the purpose of its establishment:
1. Organizational management;
2. Management of driver's license tests and execution of regular or occasional aptitude test projects;
3. Execution of projects entrusted or approved by, or required by the Commissioner General of the Korean National Police Agency to be conducted on his or her behalf, and those entrusted or required by the Commissioner General of a City/Do police agency to be conducted on his or her behalf;
4. Other matters prescribed in the Road Traffic Act and related statutes or regulations.
Article 18(Prohibition of use of similar names) #
No person, other than the Authority under this Act, shall use the name "Korea Road Traffic Authority" or any other name similar thereto.
Article 19(Request for data) #
If deemed necessary for the implementation of projects under Article 6, the Authority may request necessary cooperation, such as perusal and provision of data, from relevant administrative agencies or road traffic safety-related institutions, organizations, etc.
Article 20(Penalty provisions) #
Any person who discloses or misappropriates confidential information, in violation of Article 11, shall be punished by imprisonment with labor for not more than 2 years or by a fine not exceeding 5 million won.
Article 21(Administrative fines) #
(1) A person who uses the name "Korea Road Traffic Authority" or any other name similar thereto, in violation of Article 18, shall be subject to an administrative fine not exceeding 5 million won.
(2) Administrative fines under paragraph (1) shall be imposed and collected by the Commissioner General of the Korean National Police Agency.
