Article 1(Purpose) #
The purpose of this Act is to prescribe matters necessary for the promotion of the elevator industry to build a foundation for the elevator industry and strengthen the competitiveness of elevator business operators, thereby contributing to the national economy.
Article 2(Definitions) #
The terms used in this Act are defined as follows:
1. The term "elevator" means an elevator defined in subparagraph 1 of Article 2 of the Elevator Safety Management Act;
2. The term "elevator industry" means the industry of developing, manufacturing, producing, distributing, installing, maintaining, or managing elevators or elevator parts, or providing services related thereto;
3. The term "elevator business operator" means a business operator engaged in the elevator industry, and includes an elevator business operator defined in subparagraph 6 of Article 2 of the Elevator Safety Management Act;
4. The term "elevator parts" means elevator parts defined in subparagraph 2 of Article 2 of the Elevator Safety Management Act.
Article 3(Relationship to other statutes) #
Except as provided in other statutes, this Act shall apply to the support for the elevator industry and fostering and promotion thereof.
Article 4(Formulation of master plan) #
(1) The Minister of the Interior and Safety shall formulate a comprehensive plan for the promotion of the elevator industry (hereinafter referred to as "master plan") every 5 years.
(2) A master plan shall include the following matters related to the elevator industry:
1. Basic direction of policies designed to lay a foundation for, and promote, the elevator industry;
2. Matters related to sectoral development strategies for manufacturing, installation, and maintenance of the elevator industry;
3. Matters related to the facilitation of technology research and development;
4. Matters related to the training of specialized human resources in the elevator industry;
5. Matters related to the support for elevator business operators;
6. Measures to improve the structure of the elevator industry and to strengthen its competitiveness;
7. Measures for win-win cooperation among elevator business operators;
8. Matters related to international cooperation and overseas expansion of the elevator industry;
9. Other matters necessary for the promotion of the elevator industry.
Article 5(Action plan) #
(1) The Minister of the Interior and Safety shall formulate a detailed action plan for the promotion of the elevator industry (hereinafter referred to as "action plan") after consulting thereon with the heads of relevant central administrative agencies every year to implement a master plan.
(2) The Minister of the Interior and Safety and the heads of the relevant central administrative agencies shall endeavor to secure financial resources necessary to implement matters under their jurisdiction among matters contained in the action plan.
(3) Where necessary for the promotion of the elevator industry, the heads of the relevant central administrative agencies may request the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, and a Special Self-Governing Province Governor to take measures necessary to implement an action plan.
Article 6(Cooperation from heads of relevant central administrative agencies) #
Where necessary for the formulation and implementation of a master plan and an action plan, the Minister of the Interior and Safety may request the heads of relevant central administrative agencies, the heads of local governments, the heads of public institutions under the Act on the Management of Public Institutions, and the heads of relevant organizations and institutions (hereinafter referred to as "heads of relevant central administrative agencies, etc.") to provide cooperation. In such cases, the heads of relevant central administrative agencies, etc. so requested shall comply unless there is a compelling reason not to do so.
Article 7(Fact-finding survey) #
(1) The Minister of the Interior and Safety shall conduct an annual fact-finding survey on the elevator industry to formulate and implement a master plan and an action plan and to effectively promote policies related to the elevator industry.
(2) Where necessary for a fact-finding survey on the elevator industry, the Minister of the Interior and Safety may request the heads of relevant central administrative agencies, etc. to provide relevant data. In such cases, the heads of the relevant central administrative agencies, etc. so requested shall comply unless there is a compelling reason not to do so.
(3) Matters necessary for the scope, methods, etc. of a fact-finding survey under paragraph (1) shall be prescribed by Presidential Decree.
Article 8(Establishment of elevator industry information system) #
(1) The Minister of the Interior and Safety shall establish an elevator industry information system (hereinafter referred to as "information system") to systematically collect and manage information, data, etc. related to the elevator industry.
(2) The information system shall include matters regarding the following:
1. The current status of the domestic and overseas elevator industries;
2. Performance of elevator business operators, in terms of manufacturing, installation, exportation, importation, etc.;
3. Performance of maintenance business operators registered under the former part of Article 39 (1) of the Elevator Safety Management Act, in terms of maintenance and management;
4. Bidding information of domestic and overseas elevator industries;
5. Research and development related to elevators;
6. Training and management of specialized human resources in the elevator industry;
7. Elevator parts for the maintenance and management of elevators;
8. Other matters necessary for providing information on the elevator industry.
(3) The Minister of the Interior and Safety may request the heads of relevant central administrative agencies, etc. to submit data (including data built by electronic means) necessary for the establishment and operation of the information system. In such cases, the heads of relevant central administrative agencies, etc. so requested shall comply unless there is a compelling reason not to do so.
(4) Except as provided in paragraphs (1) through (3), matters necessary for building, operating, and using the information system shall be prescribed by Presidential Decree.
Article 9(Research and development project) #
(1) The Minister of the Interior and Safety may promote the following projects to facilitate the research and development of technologies related to the elevator industry:
1. Survey on the level of technology;
2. Raising financial resources to support research and development;
3. Measures to commercialize developed technology, such as technical cooperation and technology transfer;
4. Smooth distribution of technical information;
5. Other projects necessary for the research and development of technology.
(2) The Minister of the Interior and Safety may conclude an agreement with an institution or organization prescribed by Presidential Decree and promote the projects referred to in the subparagraphs of paragraph (1), if necessary for the improvement of technology related to the elevator industry and the efficient implementation of a master plan and an action plan.
(3) Expenses necessary for the research and development projects prescribed in paragraph (2) shall be covered by contributions from the Government or any person other than the Government, or by technology development expenses of relevant enterprises, such as elevator business operators.
(4) Matters necessary for the method of concluding an agreement under paragraph (2) and the payment, use and management of contributions under paragraph (3) shall be prescribed by Presidential Decree.
Article 10(Activities for promotion of elevator industry) #
The Government may conduct the following projects to improve the national competitiveness of the elevator industry and to foster excellent elevator business operators:
1. Projects to support the holding of and participation in domestic exhibitions of excellent products and services;
2. Holding competitions or exhibitions of works related to the elevator industry;
3. Holding other events related to fostering and promotion of the elevator industry.
Article 11(Support for international cooperation and overseas expansion) #
(1) The Minister of the Interior and Safety may promote the following projects to assist domestic elevator business operators in international cooperation and overseas expansion:
1. Survey and research for international cooperation of the elevator industry;
2. International exchange of human resources and information for the promotion of the elevator industry;
3. Support for holding and participating in international academic conferences, international exhibitions, etc. related to the elevator industry;
4. Survey on and analysis of overseas elevator industry markets and systematic provision of information;
5. Marketing, public relations, and consulting support for the overseas expansion of the domestic elevator industry;
6. Joint development of technologies related to the elevator industry with foreign universities, research institutes and organizations;
7. Holding regular cooperation meetings with foreign government agencies;
8. Other support for international cooperation and overseas expansion of the domestic elevator industry.
(2) If necessary to promote the projects under paragraph (1), the heads of relevant central administrative agencies, etc. may be requested to submit data. In such cases, the heads of the relevant central administrative agencies, etc. so requested shall comply unless there is a compelling reason not to do so.
(3) Matters necessary for promoting the projects under paragraphs (1) and (2) shall be prescribed by Presidential Decree.
Article 12(Pilot project) #
(1) The Government may conduct a pilot project, if deemed necessary for the promotion of the elevator industry.
(2) The Government may provide necessary support to persons who participate in a pilot project under paragraph (1).
Article 13(Reward and award) #
(1) The Minister of the Interior and Safety may select and reward individuals, organizations, etc. who have made remarkable contributions to the promotion of the elevator industry.
(2) The Minister of the Interior and Safety may award prizes to persons who have won prizes with excellent grades in contests, exhibitions of works, etc. related to the elevator industry.
(3) Matters necessary for rewards and awards under paragraphs (1) and (2) shall be prescribed by Ordinance of the Ministry of the Interior and Safety.
Article 14(Financial support) #
The Government may provide financial support or other necessary support for the development of the elevator industry, as prescribed by Presidential Decree.
Article 15(Establishment of Association) #
(1) Elevator business operators may establish an association of elevator business operators (hereinafter referred to as the "Association") for the sound development of the elevator industry and the common interests of elevator business operators.
(2) The Association shall be a juristic person.
(3) The Association shall be duly formed upon completion of the registration of its establishment at the location of its main office.
(4) Matters related to qualifications for members of the Association and its executive officers, etc. shall be prescribed by its articles of association.
(5) Except as provided in paragraphs (1) through (4), matters to be entered in the articles of association, matters necessary for the supervision thereof, and other relevant matters shall be prescribed by Presidential Decree.
(6) Except as provided in this Act, the provisions of the Civil Act governing incorporated associations shall apply mutatis mutandis to the Association.
Article 16(Authorization for establishment of Association) #
(1) In order to establish the Association, at least 5 elevator business operators qualified as its members shall be promoters, and the articles of association shall be prepared by the resolution of the inaugural general meeting after consent is obtained from at least the number of elevator business operators prescribed by Presidential Decree from among qualified elevator business operators, and then an application for authorization shall be filed with the Minister of the Interior and Safety.
(2) Upon granting authorization for an application under paragraph (1), the Minister of the Interior and Safety shall publicly announce such fact.
(3) Promoters shall be responsible for handling necessary administrative affairs until the Association is established and its executive officers are appointed.
Article 17(Suggestion and advice) #
(1) The Association may make suggestions to the Government on matters necessary for the sound development of the elevator industry.
(2) The Association shall provide advice on the elevator industry upon request of the Government.
(3) Where the Association discovers that a member elevator operator has violated the Elevator Safety Control Act, it shall verify the details thereof and report it to the Minister of the Interior and Safety.
Article 18(Operation of Elevator Industry Development Council) #
(1) The Minister of the Interior and Safety may organize and operate an elevator industry development council in which relevant administrative agencies, public institutions, elevator business operators, relevant organizations, experts, etc. participate to consult on the following matters necessary for the promotion of the elevator industry:
1. Suggestions on systems and policies necessary for the creation of a foundation for the elevator industry and promotion thereof;
2. Discovering support systems to facilitate overseas expansion of the domestic elevator industry;
3. Measures to facilitate exchanges and win-win cooperation among elevator business operators.
(2) Matters necessary for the organization, operation, etc. of the elevator industry development council shall be determined and publicly notified by the Minister of the Interior and Safety.
Article 19(Entrustment of business affairs) #
(1) The Minister of the Interior and Safety may entrust part of the affairs under this Act to the Association under Article 15, the Korea Elevator Safety Agency under Article 55 of the Elevator Safety Control Act, or a corporation or organization prescribed by Presidential Decree, as prescribed by Presidential Decree.
(2) If deemed necessary for the efficient performance of business affairs entrusted under paragraph (1), the Minister of the Interior and Safety may determine and notify guidelines for handling business affairs or may guide and supervise the handling thereof.
(3) Where the Minister of the Interior and Safety entrusts business affairs pursuant to paragraph (1), he or she may provide necessary budgetary support for the smooth performance thereof.
