Article 1(Purpose) #
The purpose of this Act is to contribute to stabilizing the lives of residents, improving their quality of life, and safeguarding the territory of the Republic of Korea by prescribing matters necessary for the sustainable development of remote islands on the outskirts of the national territory, which are located at the outermost borders of the Republic of Korea and possess unique geographical and historical characteristics while serving the role of national border outposts, including the establishment of a safe residential environment, income growth, and improvement and expansion of infrastructure for daily living.
Article 2(Definitions) #
The term “remote islands on the outskirts of the national territory” as used in this Act means inhabited islands falling under any of the following subparagraphs; provided, that the main island of Jeju Special Self-Governing Province shall be excluded:
1. Islands located at a distance of 50 kilometers or more from the mainland;
2. Islands serving as base points for determining straight baselines under Article 2 (2) of the Territorial Sea and Contiguous Zone Act;
3. Other islands prescribed by Presidential Decree in consideration of accessibility, such as sea route distance.
Article 3(Responsibilities of the State and local government) #
(1) The State and local governments (hereinafter referred to as “State, etc.”) shall formulate and implement comprehensive policies and seek support measures to create a safe residential environment and enhance regional vitality on remote islands on the outskirts of the national territory.
(2) The State, etc. shall secure budgets for related projects and provide necessary financial support to ensure the efficient implementation of the policies under paragraph (1).
Article 4(Relationship to Other Acts) #
(1) This Act shall take precedence over other Acts with respect to support for remote islands on the outskirts of the national territory; provided, this shall not apply to the Act on the Sustainable Use of Dokdo and the Special Act on Support for Five Islands of the Republic of Korea in the Yellow Sea.
(2) The comprehensive development plan under Article 5 shall be formulated in harmony with relevant plans under other Acts.
Article 5(Formulation and modification of the comprehensive development plan for remote islands on the outskirts of the national territory) #
(1) The Minister of the Interior and Safety shall formulate and implement a comprehensive development plan (hereinafter referred to as “comprehensive development plan”) every 5 years to improve residential conditions and promote sustainable development of remote islands on the outskirts of the national territory.
(2) The comprehensive development plan shall include the following matters:
1. Basic directions and sectoral strategies for supporting remote islands on the outskirts of the national territory;
2. Matters concerning the creation of safe residential conditions for residents of such islands;
3. Matters concerning the promotion of industries such as agriculture, fisheries, tourism, and distribution, and the increase of residents’ income;
4. Matters concerning the improvement of living environments including education, medical care, housing, culture, telecommunications, water supply, electricity, and welfare;
5. Matters concerning the expansion and improvement of transportation facilities such as roads, ports, and airports, and other infrastructure;
6. Matters concerning support and subsidies for the smooth distribution and supply of daily necessities;
7. Other matters necessary for the development of such islands and improvement of residents’ quality of life as prescribed by Decree of the Ministry of the Interior and Safety.
(3) The Minister of the Interior and Safety shall, in consultation with the heads of relevant central administrative agencies, prepare guidelines (hereinafter referred to as “guidelines”) for the formulation of the comprehensive development plan and notify the Mayors of metropolitan cities, the Do Governors, and the Governor of the Special Self-Governing Province (hereinafter referred to as “Mayor/Do Governor”) having jurisdiction over such islands.
(4) Each Mayor/Do Governor shall, after collecting opinions from residents and relevant experts through public hearings and the like, prepare a draft development plan for the remote islands under their jurisdiction (hereinafter referred to as “City/Do development plan draft”) in accordance with the guidelines notified under paragraph (3), and submit it to the Minister of the Interior and Safety.
(5) The Minister of the Interior and Safety shall, based on the City/Do development plan drafts submitted under paragraph (4), prepare a draft comprehensive development plan, consult with the heads of relevant central administrative agencies, and finalize the comprehensive development plan through deliberation by the Island Development Deliberative Committee under Article 14 of the Islands Development Promotion Act (hereinafter referred to as “Island Development Deliberative Committee”).
Article 6(Formulation and modification of annual implementation plans) #
(1) The Minister of the Interior and Safety shall formulate and implement annual implementation plans (hereinafter referred to as “annual implementation plans”) in accordance with the comprehensive development plan under Article 5.
(2) Procedures for the formulation and modification of annual implementation plans shall apply mutatis mutandis to paragraphs (3) through (7) of Article 5.
(3) Other matters necessary for the formulation and modification of annual implementation plans shall be prescribed by Presidential Decree.
Article 7(Special support for subsidies) #
(1) Notwithstanding the differential subsidy rates under Article 10 of the Subsidy Management Act or subsidy rates under other Acts, the State shall increase and provide subsidies for projects implemented by local governments pursuant to the comprehensive development plan and annual implementation plans, and the subsidy rates shall be prescribed by Presidential Decree.
(2) The Minister of the Interior and Safety may provide special support from local allocation tax under the Local Subsidy Act in accordance with Presidential Decree to support the implementation of projects under the comprehensive development plan and annual implementation plans.
Article 8(Priority support for resident safety facilities) #
The State, etc. may give priority to installing resident evacuation facilities, emergency water supply facilities, and other facilities prescribed by Presidential Decree on remote islands on the outskirts of the national territory to ensure the safety of residents living there, and may provide financial support for their maintenance.
Article 9(Special support for educational expenses) #
The State, etc. may formulate and implement policies such as reducing the burden of educational expenses and improving educational environments to promote compulsory education for students residing on remote islands on the outskirts of the national territory, where necessary.
Article 10(Installation of infrastructure) #
(1) The State, etc. may provide support to ensure that the following types of infrastructure are installed with priority to improve residential conditions and enhance regional vitality on remote islands on the outskirts of the national territory:
1. Transportation facilities such as roads, ports, and airports;
2. Storage and supply facilities for water, electricity, gas, oil, etc.;
3. Cultural and sports facilities such as libraries, museums, and gymnasiums;
4. Welfare facilities such as nursing homes, childcare centers, and hospitals;
5. Other facilities necessary for the development of such islands and the improvement of residents’ quality of life as prescribed by Presidential Decree.
(2) The State, etc. may provide financial support necessary for the smooth operation of the facilities installed pursuant to paragraph (1).
Article 11(Support for prevention of illegal fishing operations) #
The State, etc. shall take measures to ensure the safe fishing operations of fishers operating in the vicinity of remote islands on the outskirts of the national territory and to prevent damages caused by illegal fishing operations.
Article 12(Support for expansion of the de facto population) #
The State, etc. may support projects prescribed by Presidential Decree, including those pursuant to the policies under Article 21 of the Special Act on Decentralization and Balanced Regional Development, to expand the de facto population on remote islands on the outskirts of the national territory.
