CHAPTER I GENERAL PROVISIONS
Article 1(Purpose) #
The purpose of this Act is to prescribe matters concerning the management and operation of 119 emergency reports in fire, disasters, calamities, disasters, rescue, emergency medical services, and other emergency situations, thereby protecting personal information of reporters, etc. and strengthening their capabilities to respond to emergency reports, thereby contributing to protecting the lives, bodies, and property of citizens and improving their quality of life.
Article 2(Definitions) #
The terms used in this Act are defined as follows:
1. The term "119" means 119, which is a special number assigned in accordance with a plan for the management of telecommunications number resources under Article 48 of the Telecommunications Business Act.
2. The term "119 emergency report" means a report filed by a person who files a report using 119 voice, text report, and other Internet, video, video, smart devices, etc. in a fire, disaster, calamity, disaster, rescue, emergency medical services, and other emergency situations (hereinafter referred to as "emergency situations").
3. The term "agencies related to 119 emergency reporting" means emergency rescue agencies, emergency rescue and relief support agencies, disaster management agencies, and disaster management supervision agencies under Article 3 of the Framework Act on the Management of Disasters and Safety.
4. The term "joint response" means joint response by agencies related to 119 emergency reporting by sharing reported information, where necessary to minimize damage to the lives and property of citizens due to an emergency situation.
Article 3(Responsibilities of the State, etc.) #
(1) The State and local governments shall lay the groundwork necessary for receiving 119 emergency reports, sharing and transferring reported information, joint response, etc.
(2) The State and local governments shall formulate and implement policies necessary for the research and development of new technologies related to 119 emergency reports and for the improvement of convenience and efficiency of reports.
Article 4(Rights and Obligations of People) #
(1) Where an emergency response is required because an emergency situation occurs or is likely to occur or is likely to occur, anyone may request the State or a local government to promptly respond to an emergency situation by using 119 emergency reports.
(2) No person shall file a 119 emergency report for any purpose other than a report to cope with an emergency or falsely for any purpose other than a report to cope with an emergency.
Article 5(Overall Control and Coordination of 119 Emergency Reports) #
The Fire Commissioner of the National Fire Agency shall exercise general control over and coordinate affairs concerning the receipt of 119 emergency reports, the sharing and transfer of reported information, the organization of fire brigades, and the request for joint response.
Article 6(Relationship to Other Statutes) #
Except as otherwise expressly provided for in other Acts, this Act shall apply to 119 emergency reports.
CHAPTER IV ESTABLISHMENT AND OPERATION OF 119 INFORMATIONAL
Article 15(Establishment and Operation of 119 Informational Communications System) #
(1) The Fire Commissioner of the National Fire Agency and Mayors/Do Governors shall establish and operate a 119 information and communications system (hereinafter referred to as “119 information and communications system”) necessary for promptly receiving 119 emergency reports, sharing and transferring information on reports, joint response, support for field activities, etc.
(2) Where necessary for the efficient operation of the 119 information and communications system, the Fire Commissioner of the National Fire Agency may inspect the operation status of the 119 information and communications system operated by a City/Do pursuant to paragraph (1).
(3) Matters necessary for the establishment, operation, maintenance, and management of the 119 information and communications system shall be prescribed by Ordinance of the Ministry of the Interior and Safety.
Article 16(Standardization of 119 Information and Communications Systems) #
(1) The Fire Commissioner of the National Fire Agency shall promote the standardization of 119 information and communications systems operated by Cities/Dos.
(2) Where the Fire Commissioner of the National Fire Agency promotes the standardization of 119 information and communications systems operated by Cities/Dos pursuant to paragraph (1), he or she shall examine the following matters:
1. Matters concerning the application and improvement of new technology related to 119 information and communications systems;
2. Matters concerning the establishment and implementation of a plan for the continuity of business of the 119 information and communications system;
3. Matters concerning the standardization, standardization, and integrated operability of the 119 information and communications system;
4. Matters concerning interoperability between systems and ease of installation and expansion;
5.Other matters deemed necessary by the fire commissioner of the national fire agency to be standardized.
Article 17(Establishment of Fire-Fighting Communications Network) #
(1) The Fire Commissioner of the National Fire Agency and a Mayor/Do Governor shall establish and operate a firefighting communications network (referring to a communications network established to transmit and receive information, such as symbols, signals, words, videos, sound, etc., using wired or wireless lines) so that it can be utilized without delay at the scene of dispatch in the event of an emergency.
(2) The Fire Commissioner of the National Fire Agency and a Mayor/Do Governor shall establish and operate an emergency communications network (referring to a communications network used as an emergency means when it is impossible to use ordinary means of communications where it is impossible to use ordinary means of communications due to damage to communications infrastructure, such as base stations), so as to be able to utilize the firefighting communications network in operation due to a large disaster, etc.
(3) Matters necessary for the establishment and operation of the fire-fighting communications network under paragraph (1) and the emergency communications network under paragraph (2) shall be prescribed by Ordinance of the Ministry of the Interior and Safety.
Article 18(Operation of Radio Frequencies for Fire Service Duties) #
(1) The Fire Commissioner of the National Fire Agency shall efficiently operate the radio frequencies of radio communications allocated for firefighting services pursuant to Article 9 (1) 1 of the Radio Waves Act.
(2) Matters necessary for the operation of frequency radio frequencies for fire service duties under paragraph (1) shall be prescribed by Ordinance of the Ministry of the Interior and Safety.
Article 19(Connection of Information Related to 119 Emergency Reports) #
(1) The Fire Commissioner of the National Fire Agency and a Mayor/Do Governor may request institutions related to 119 emergency response to establish a linkage system, if necessary for jointly responding to and cooperating in 119 emergency response related to 119 emergency reports. In such cases, he or she shall consult with the heads of the relevant institutions in advance.
(2) Matters necessary for the establishment of the linkage system under paragraph (1) shall be prescribed by Presidential Decree.
Article 20(Evaluation and Improvement of 119 Information and Communications Systems) #
(1) The Fire Commissioner of the National Fire Agency shall formulate and implement an evaluation plan for the operation and management of the 119 information and communications system every year for the efficient operation of the 119 information and communications system.
(2) The Fire Commissioner of the National Fire Agency shall conduct the evaluation under paragraph (1) and notify Mayors/Do Governors of the results thereof. In such cases, the Mayors/Do Governors shall formulate and implement a plan to improve the operation and management of the 119 information and communications system by reflecting the results of the evaluation notified.
(3) Matters concerning the evaluation of the operation and management of the 119 information and communications system shall be prescribed by Ordinance of the Ministry of the Interior and Safety.
CHAPTER Ⅴ SUPPLEMENTARY PROVISIONS
Article 21(Securing and Support of Budget) #
(1) The Fire Commissioner of the National Fire Agency and Mayors/Do Governors shall endeavor to secure a budget necessary for the establishment, operation, maintenance, repair, etc. of the central and City/Do 119 information and communications systems.
(2) The State may partially subsidize Cities/Dos for expenses incurred in establishing, operating, maintaining and repairing 119 information and communications systems under Article 15 and standardizing 119 information and communications systems under Article 16.
Article 22(Comprehensive Management of Statistics and Information) #
The Fire Commissioner of the National Fire Agency shall comprehensively collect, store, analyze, analyze, process, and systematically manage information and statistics linked to the 119 information and communications system for the efficient operation of 119 emergency reports.
Article 23(Prior Consultation) #
Where a central administrative agency or local government develops or introduces new technology necessary for 119 emergency reporting, it shall consult with the Fire Commissioner of the National Fire Agency in advance.
Article 24(Education and Training) #
(1) The Fire Commissioner of the National Fire Agency shall prepare and distribute educational and training programs necessary for nurturing professional human resources and improving technology in connection with the operation of the 119 information and communications system.
(2) Matters necessary for the preparation and dissemination of educational and training programs under paragraph (1) shall be determined by the Fire Commissioner of the National Fire Agency.
Article 25(Public Relations Activities for Citizens) #
The Fire Commissioner of the National Fire Agency, etc. shall, if necessary for improving the convenience and convenient use of 119 emergency response services, conduct public relations activities to the people.
CHAPTER VI PENALTY PROVISIONS
Article 26(Penalty Provisions) #
A person who fails to comply with a request made by the Fire Commissioner of the National Fire Agency, etc. under Article 11 (2) without good cause shall be punished by imprisonment with labor for not more than one year or by a fine not exceeding 10 million won.
Article 27(Administrative Fines) #
(1) A person who files a false report on an emergency situation in violation of Article 4 (2) shall be subject to an administrative fine not exceeding five million won.
(2) An administrative fine referred to in paragraph (1) shall be imposed and collected by the Fire Commissioner of the National Fire Agency, as prescribed by Presidential Decree.
