Article 1(Purpose) #
The purpose of this Decree is to prescribe the matters mandated by the Act on Facilitation of Cooperation in Local Agriculture and Fisheries Development Projects and those necessary for the enforcement thereof.
Article 2(Scope of private operating agency) #
(1) "Agricultural and fisheries corporations prescribed by Presidential Decree" in subparagraph 5 (a) of Article 2 of the Act on Facilitation of Cooperation in Local Agriculture and Fisheries Development Projects (hereinafter referred to as the "Act") means agricultural and fisheries corporations that conduct their business using tangible and intangible agricultural and fisheries resources, such as agricultural and fisheries products, nature, and culture (hereinafter referred to as "tangible and intangible agricultural and fisheries resources").
(2) "Agriculture and fisheries-related cooperatives and social cooperatives" in subparagraph 5 (f) of Article 2 of the Act means cooperatives and social cooperatives which conduct their business using tangible and intangible agricultural and fisheries resources.
(3) "Agriculture and fisheries-related social enterprises prescribed by Presidential Decree" in subparagraph 5 (g) of Article 2 of the Act means social enterprises that conduct their business by using tangible and intangible agricultural and fisheries resources.
(4) "Agriculture and fisheries-related micro enterprises prescribed by Presidential Decree" in subparagraph 5 (h) of Article 2 of the Act means micro enterprises that conduct their business using tangible and intangible agricultural and fisheries resources.
(5) "Agriculture and fisheries-related small and medium enterprises prescribed by Presidential Decree" in subparagraph 5 (i) of Article 2 of the Act means small and medium enterprises that conduct their business using tangible and intangible agricultural and fisheries resources.
Article 3(Scope of private agencies proposing local agriculture and fisheries development projects) #
"Private agencies prescribed by Presidential Decree" in Article 7 (1) 4 of the Act means any of the following:
1. A person falling under any item of subparagraph 5 of Article 2 of the Act;
2. A non-profit non-governmental organization that conducts, or intends to conduct, a business using tangible and intangible agricultural and fisheries resources, among non-profit non-governmental organizations registered pursuant to Article 4 of the Assistance for Non-Profit, Non-Governmental Organizations Act;
3. A non-profit corporation under the jurisdiction of the Ministry of Agriculture, Food and Rural Affairs;
4. A non-profit corporation under the jurisdiction of the Ministry of Oceans and Fisheries.
Article 4(Grounds for termination and modification of concession agreement) #
"Reason prescribed by Presidential Decree" in Article 9 (1) 5 of the Act means any of the following cases:
1. Where it is deemed difficult to operate and conduct a local agricultural and fisheries development project due to the insolvency, bankruptcy, or dissolution of a private operating agency, suspension of its business, revocation of registration, authorization, permission, etc., temporary or permanent closure of its business, or other any other reasons;
2. Where it is impracticable to continue to conduct all or part of a local agriculture and fisheries development project due to natural disasters or other unavoidable reasons that have occurred after the conclusion of a concession agreement under Article 8 (4) of the Act.
Article 5(Disclosure of progress in local agriculture and fisheries development projects) #
Where the head of a local government discloses the promotion progress pursuant to Article 12 (1) of the Act, he or she shall do so for each project, including the following matters:
1. Name of the project;
2. Necessity and purpose of project promotion;
3. Duration of the project;
4. Project period;
5. Name of the private operating agency;
6. Outline of the project;
7. Performance goals;
8. Other matters deemed by the head of the local government to require disclosure.
Article 6(Criteria for imposition of administrative fines) #
The criteria for imposing administrative fines under Article 14 (1) of the Act shall be as specified in the attached Table.
