Article 1(Purpose) #
The purpose of this Act is to systematically inherit, develop, and support the tangible and intangible culture of Sungkyunkwan, Hyanggyo, and Seowon, thereby contributing to the inheritance of traditional culture and the development of national culture.
Article 2(Definitions) #
The terms used in this Act are defined as follows:
1. The term "Sungkyunkwan" means a national educational institution of the nature of a national university established in the Goryeo and Joseon Dynasty to disseminate Confucianism and train bureaucrats;
2. The term "Hyanggyo" means a government-run educational institution established in the local regions during the Goryeo and Joseon Dynasty for the purpose of providing education in Confucianism;
3. The term "Seowon" refers to a private educational institution established in the Joseon Dynasty for the purpose of holding memorial services for esteemed scholars and providing education to Confucian students;
4. The term “the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon” means tangible cultural heritage formed around Sungkyunkwan, Hyanggyo, and Seowon, and intangible cultural heritage related thereto that is handed down through generations.
Article 3(Responsibilities of the State) #
(1) The State and local governments shall endeavor to inherit and develop the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon.
(2) The State and local governments shall formulate and implement long-term policies to inherit and develop the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon.
(3) The State and local governments may provide necessary administrative and financial support within the scope of budget to inherit and develop the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon.
Article 4(Relationship to other statutes) #
Except as otherwise provided for in other statutes regarding the succession, development, and support of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon, the provisions of this Act shall apply.
Article 5(Formulation and implementation of comprehensive plans) #
(1) The Minister of Culture, Sports and Tourism shall formulate and implement a comprehensive plan for the inheritance and development of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon (hereinafter referred to as "comprehensive plan") every 5 years. In such cases, the Minister shall consult with the heads of relevant central administrative agencies and the Special Metropolitan City Mayor, Metropolitan City Mayors, Special Self-Governing City Mayor, Do Governors, or Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") prescribed by Presidential Decree.
(2) A comprehensive plan shall include the following:
1. Matters regarding the basic direction and goals for the succession and development of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon;
2. Matters regarding the management, conservation, and utilization of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon;
3. Matters regarding the procurement of financial resources necessary for the succession and development of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon;
4. Matters regarding the creation of a humane environment necessary for the inheritance and development of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon;
5. Matters regarding the development of content related to the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon and the establishment of an organic network with educational institutions to enhance educational effects;
6. Other matters necessary for the succession and development of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon, as prescribed by Presidential Decree.
(3) When the Minister of Culture, Sports and Tourism establishes a comprehensive plan, he or she shall give public notice of it as prescribed by Presidential Decree.
(4) The Minister of Culture, Sports and Tourism may, if necessary for the formulation and implementation of a comprehensive plan, request relevant institutions, organizations, etc. to provide cooperation, such as provision of materials. In such cases, a person who is requested to cooperate with the provision of data, etc. shall comply therewith, except in extenuating circumstances.
(5) In case of modifying important matters of a comprehensive plan, the Minister of Culture, Sports and Tourism shall consult with the heads of the relevant central administrative agencies and the Mayor/Do Governor under paragraph (1); provided, this shall not apply where he or she intends to modify minor matters prescribed by Presidential Decree.
Article 6(Formulation and implementation of action plans) #
(1) The Minister of Culture, Sports and Tourism and the Mayor/Do Governor shall formulate and implement an action plan (hereinafter referred to as "action plan") for the comprehensive plan every year.
(2) When the Mayor/Do Governor formulates an action plan or completes the implementation thereof under paragraph (1), he or she shall submit the results thereof to the Minister of Culture, Sports and Tourism.
(3) Other matters necessary for the formulation, implementation, etc. of action plans shall be prescribed by Presidential Decree.
Article 7(Public hearings) #
(1) When the Minister of Culture, Sports and Tourism formulates a comprehensive plan, he or she shall hear opinions from citizens or relevant experts through public hearings, briefing sessions, seminars, surveys, etc. (hereinafter referred to as "public hearings, etc."). In such cases, where the opinions presented at public hearings, etc. are deemed appropriate, the Minister shall reflect the opinions in the comprehensive plan.
(2) Matters necessary for holding public hearings, etc. under paragraph (1) shall be prescribed by Presidential Decree.
Article 8(Basic survey) #
(1) The Minister of Culture, Sports and Tourism may conduct a basic survey on matters necessary for the confirmation of the cultural heritage value, as well as the management and conservation status of the cultural heritage of Sungkyunkwan, Hyanggyo, and Seowon, and the formulation, modification, etc. of a comprehensive plan and action plans.
(2) Matters necessary for the methods, procedures, etc. of a survey under paragraph (1) shall be prescribed by Presidential Decree.
Article 9(Establishment and operation of consultative body) #
(1) The Mayor/Do Governor and the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereinafter referred to as the "head of a Si/Gun/Gu") may establish and operate a consultative body comprised of local residents, civic groups, experts, etc. (hereinafter referred to as "consultative body"), if necessary for the inheritance and development of the traditional culture of Sungkyunkwan, Hyanggyo, and Seowon.
(2) The Mayor/Do Governor and the head of a Si/Gun/Gu may provide administrative and financial support necessary for the establishment and operation of a consultative body.
(3) Matters necessary for the establishment, operation, etc. of the consultative body shall be prescribed by Presidential Decree.
Article 10(Delegation and entrustment of authority) #
(1) The Minister of Culture, Sports and Tourism may delegate part of the authority vested under this Act to the Mayor/Do Governor or the head of a Si/Gun/Gu, as prescribed by Presidential Decree.
(2) The Mayor/Do Governor may delegate part of his or her authority vested under this Act to the head of the relevant Si/Gun/Gu, as prescribed by Presidential Decree.
(3) The Minister of Culture, Sports and Tourism or the Mayor/Do Governor may entrust part of his or her authority vested under this Act to an institution, corporation, or organization, etc. established for the purpose of protection, conservation, dissemination, utilization, etc. of cultural heritage, as prescribed by Presidential Decree.
