Article 1(Purpose) #
The purpose of this Decree is to prescribe matters necessary for the enforcement of the Act on Restoring the Honor of Participants in the March 15 Uprising.
Article 2(Application for ascertainment of truth) #
(1) A person who intends to apply for the ascertainment of the truth of the March 15 Uprising shall prepare an application for ascertainment of truth under Article 7(1) of the Enforcement Decree of the Framework Act on Settling Past Incidents for Truth and Reconciliation and submit it to the Truth and Reconciliation Commission under Article 4(1) of the Framework Act on Settling the Past for Truth and Reconciliation (hereinafter referred to as the "Truth and Reconciliation Commission"), Gyeongsangnam-do, or Changwon-si. <Amended on Feb. 25, 2026>
(2) Upon receipt of an application under paragraph (1), Gyeongsangnam-do or Changwon-si shall immediately forward such application to the Truth and Reconciliation Commission.
Article 3(Period for application for ascertainment of truth) #
An application for the ascertainment of the truth of the March 15 Uprising under Article 2(1) shall be filed from October 4, 2023 through December 31, 2023. <Amended on Sep. 26, 2023>
Article 4(Reapplication) #
Where a person who has submitted an application pursuant to Article 2(1) receives a decision of dismissal without prejudice from the Truth and Reconciliation Commission pursuant to Article 24 of the Framework Act on Settling the Past for Truth and Reconciliation, he or she may re-apply to the Truth and Reconciliation Commission by rectifying the grounds for such dismissal. <Amended on Feb. 25, 2026>
Article 5(Disclosure of investigation results report on the march 15 uprising) #
The Truth and Reconciliation Commission shall disclose the investigation results report under Article 4(1) of the Act on Restoring the Honor of Participants in the March 15 Uprising (hereinafter referred to as the "Act") on the website of the Truth and Reconciliation Commission.
Article 6(Duty of local governments to cooperate) #
Where the Truth and Reconciliation Commission requests cooperation, such as the provision of places or personnel support, from Gyeongsangnam-do or Changwon-si for the ascertainment of the truth under Article 3 of the Act pursuant to Article 5(1) of the Act, Gyeongsangnam-do and Changwon-si shall cooperate unless there is any special circumstance.
Article 7(Joint performance of duties) #
(1) Pursuant to Article 5(2) of the Act, the Truth and Reconciliation Commission may jointly perform the following duties with Gyeongsangnam-do and Changwon-si:
1. Publicity regarding procedures and methods for applying for the ascertainment of the truth of the March 15 Uprising;
2. Investigation of basic facts for the ascertainment of the truth of the March 15 Uprising.
(2) The Truth and Reconciliation Commission may determine matters necessary for procedures and methods for handling duties jointly performed under paragraph (1). In such cases, it shall hear the opinions of Gyeongsangnam-do and Changwon-si in advance.
Article 8(Financial support) #
Pursuant to Article 9 of the Act, the State and local governments may support part of the expenses necessary for the following projects:
1. Holding commemorative events for the March 15 Uprising;
2. Construction of commemorative facilities for the March 15 Uprising;
3. Support for educational and academic activities concerning the March 15 Uprising;
4. Other projects for succeeding to the spirit of the March 15 Uprising.
