Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the National Agricultural Museum Act and matters necessary for the enforcement thereof.
Article 2(Museum materials) #
Relics and historical materials related to the history and culture of agriculture and rural communities (hereinafter referred to as "Museum materials") under Article 5(1)2 of the National Agricultural Museum Act (hereinafter referred to as "the Act") shall meet all of the following requirements; provided, intangible Museum materials shall be limited to those that can be expressed by codes, characters, voice, sound, images, etc.:
1. They shall have academic or artistic value for collection, preservation, management, investigation, research, exhibition, hands-on experience, or education by the National Agricultural Museum under Article 2 of the Act (hereinafter referred to as the “Museum”) for achieving the purpose of establishment of the Museum and carrying out its projects;
2. They shall pertain to history, folklore, art, science, technology, industry, etc. related to agriculture, rural culture, and the agriculture, forestry, livestock, and food industry.
Article 3(Profit-making business) #
(1) Profit-making business under Article 5(1)6 of the Act shall be as follows:
1. Admission to and viewing of exhibitions, exhibition halls, etc. of the Museum;
2. Leasing of Museum facilities;
3. Production and sale of souvenirs, publications, printed materials, etc. related to the Museum;
4. Distribution of educational programs developed by the Museum;
5. Advertisement using the Museum's structures;
6. Operation of agriculture-related hands-on experience programs;
7. Other business deemed necessary by the Minister of Agriculture, Food and Rural Affairs to raise funds for carrying out the projects of the Museum.
(2) If the Museum intends to obtain approval for profit-making business pursuant to Article 5(2) of the Act, it shall submit the following documents to the Minister of Agriculture, Food and Rural Affairs after obtaining a resolution of the board of directors under Article 10(1) of the Act (hereinafter referred to as the “board of directors”):
1. An application for approval of profit-making business;
2. A profit-making business plan;
3. An estimated profit and loss statement and schedules attached thereto.
(3) Where the Museum intends to conduct profit-making business approved pursuant to Article 5(2) of the Act, it shall report the business plan for the following business year to the Minister of Agriculture, Food and Rural Affairs by October 1 each year; provided, if it has submitted a profit-making business plan to obtain approval for profit-making business pursuant to paragraph (2) during the relevant business year, it may omit such report.
(4) Upon completion of a business year, the Museum shall submit a performance report and the statement of accounts for its profit-making business to the Minister of Agriculture, Food and Rural Affairs by March 31 of the following business year.
(5) The Museum shall establish and manage separate accounts for revenues and expenditures arising from the operation of profit-making business.
Article 4(Application for approval of long-term borrowings) #
Where the Museum intends to obtain approval for long-term borrowings pursuant to the proviso to Article 11(1)3 of the Act, it shall submit to the Minister of Agriculture, Food and Rural Affairs an application for approval of long-term borrowings along with the following documents; in such cases, the Museum shall obtain a resolution of the board of directors in advance:
1. Documents stating the lender, grounds for borrowing, borrowing terms and conditions, and borrowing amount;
2. Documents stating the repayment method and repayment period for the borrowings;
3. Other documents stating matters necessary for the borrowing and repayment of funds.
Article 5(Submission of budget request for contributions) #
(1) If the Museum intends to request contributions from the State pursuant to Article 11(2) of the Act, it shall submit to the Minister of Agriculture, Food and Rural Affairs, by April 30 each year, a budget request for contributions along with the following documents:
1. A business plan for the following business year;
2. An estimated statement of financial position, estimated profit and loss statement, and schedules attached thereto for the following business year;
3. Other materials explaining the details of the request for contributions.
(2) If the Minister of Agriculture, Food and Rural Affairs deems a budget request under paragraph (1) reasonable, he or she shall formulate a budget proposal reflecting such request and, if the budget for contributions is finalized, notify the Museum thereof.
Article 6(Payment of contributions) #
(1) If the Museum intends to receive contributions pursuant to Article 11(2) of the Act, it shall submit the following documents to the Minister of Agriculture, Food and Rural Affairs:
1. An application for payment of contributions;
2. A quarterly business plan;
3. A quarterly budget execution plan.
(2) Where the Minister of Agriculture, Food and Rural Affairs deems the quarterly business plan and quarterly budget execution plan submitted pursuant to paragraph (1) reasonable, he or she shall pay contributions accordingly.
(3) The Museum shall establish and manage separate accounts for contributions paid pursuant to paragraph (2).
(4) Contributions shall be used only for the purposes specified in the quarterly business plan and quarterly budget execution plan under paragraph (1).
(5) Where the Museum receives contributions pursuant to paragraph (2), it shall report quarterly execution performance to the Minister of Agriculture, Food and Rural Affairs within 20 days from the end of the relevant quarter.
Article 7(Procedures for acceptance of donated money or goods) #
(1) If the Museum receives donations of money or other property from individuals, corporations, or organizations pursuant to Article 11(3) of the Act, it shall issue a receipt to the donor; provided, if a donation is made anonymously or the donor cannot be identified, the Museum need not issue a receipt.
(2) If a donor under paragraph (1) designates the purpose of use of money or other property donated by the donor (hereinafter referred to as “donated money or goods”), the Museum shall use such donated money or goods only for the designated purpose; provided, if there exists a special reason making it difficult to use the donated money or goods for the purpose designated by the donor, the Museum may use them for another purpose with the donor’s consent.
(3) The Museum shall keep books concerning the status of acceptance and use performance of donated money or goods and shall allow donors to inspect the status of acceptance and use performance, etc. of their donated money or goods.
(4) The Museum shall establish and manage separate accounts for donated funds.
Article 8(Submission of business plans) #
(1) If the Director of the Museum (hereinafter referred to as the “Museum Director”) intends to obtain approval for a business plan and budget pursuant to Article 13(2) of the Act, he or she shall submit the business plan and budget for the following business year to the Minister of Agriculture, Food and Rural Affairs by December 15 each year.
(2) The business plan under paragraph (1) shall include the following matters for each project:
1. Objectives of the project;
2. Details of the project;
3. Beneficiaries;
4. Project costs;
5. Other matters necessary to clarify the contents of the business plan.
(3) The budget under paragraph (1) shall include the following matters:
1. General provisions of the budget;
2. An estimated statement of financial position, estimated profit and loss statement, and schedules attached thereto;
3. A funding plan;
4. Other matters necessary to clarify the contents of the budget.
(4) Where the Museum Director intends to amend the business plan and budget approved pursuant to Article 13(2) of the Act, he or she shall submit the following documents to the Minister of Agriculture, Food and Rural Affairs:
1. Documents stating the details of, and grounds for, the amendment;
2. The business plan and budget reflecting the amendment.
Article 9(Submission of statement of accounts) #
The Museum Director shall submit to the Minister of Agriculture, Food and Rural Affairs, pursuant to Article 13(3) of the Act, a business performance report and a statement of accounts of revenues and expenditures for each fiscal year, along with the following documents:
1. The financial statements for the relevant fiscal year (including an audit opinion issued by a certified public accountant under the Certified Public Accountant Act or an accounting corporation under Article 23 of that Act) and supplementary documents thereof;
2. A comparative table of the business plan and execution performance for the relevant fiscal year;
3. A copy of the minutes of the meeting of the board of directors concerning the resolution on the statement of accounts of revenues and expenditures;
4. Other documents necessary to clarify the details of the settlement.
Article 10(Disposition of surplus) #
The Museum shall first appropriate any surplus from each business year for debt repayment, and the remainder shall be carried forward to the following business year or used for carrying out the projects of the Museum.
Article 11(Composition and operation of supporters' association) #
(1) The supporters' association of the Museum under Article 14(1) of the Act (hereinafter referred to as the "supporters' association") shall be composed of individuals or corporations that intend to support the projects of the Museum.
(2) A member of the supporters' association (hereinafter referred to as a “supporting member”) may provide money, goods, academic materials, etc. to the Museum through the supporters' association. In such cases, the supporting member may designate a specific project among the projects of the Museum for support.
(3) The Museum Director may distribute publications issued by the Museum to supporting members free of charge or exempt them from admission fees, viewing fees, or facility use fees.
(4) If the Museum Director receives money, goods, academic materials, etc. from the supporters' association pursuant to paragraph (2), he or she shall notify the supporters' association of the details of their use by December 31 of each year.
(5) Matters necessary for the organization and operation of the supporters’ association, other than those prescribed in paragraphs (1) through (4), shall be prescribed by the articles of incorporation of the Museum.
Article 12(Entrustment and management of Museum materials) #
(1) Where any damage, destruction, or other loss occurs to Museum materials entrusted by the State to the Museum Director for management pursuant to Article 15(1) of the Act, the Museum Director shall report such fact to the Minister of Agriculture, Food and Rural Affairs without delay.
(2) Where the Museum Director intends to conduct large-scale repair or restoration altering the original form of Museum materials entrusted by the State for management pursuant to Article 15(1) of the Act, he or she shall obtain approval in advance from the Minister of Agriculture, Food and Rural Affairs; provided, in urgent cases, he or she shall take the minimum necessary measures and then report the details thereof to the Minister of Agriculture, Food and Rural Affairs without delay.
(3) If the Minister of Agriculture, Food and Rural Affairs entrusts the management of Museum materials pursuant to Article 15(1) of the Act, he or she may support expenses necessary for the preservation, treatment, and management thereof within the budget.
Article 13(Request for secondment of public officials) #
(1) If the Museum Director intends to obtain approval for secondment pursuant to Article 17(1) of the Act, he or she shall submit to the Minister of Agriculture, Food and Rural Affairs a request for approval of secondment stating the following matters:
1. Grounds for requesting secondment;
2. Period of secondment;
3. Number of persons to be seconded;
4. Specialized fields and qualification requirements of personnel to be seconded.
(2) Public officials, etc. seconded to the Museum pursuant to Article 17(2) of the Act shall comply with service regulations, etc. determined by the Museum Director during the period of secondment.
(3) The Museum Director may pay allowances to public officials, etc. seconded pursuant to Article 17(2) of the Act in accordance with the standards prescribed by the articles of incorporation of the Museum; provided, allowances for seconded persons who are public officials shall not exceed the standards classified as follows:
1. In cases of State public officials: Standards determined by the Minister of Personnel Management pursuant to Article 41(8) of the Decree on the Appointment of Public Officials;
2. In cases of local public officials: Standards determined by the Minister of Education or the Minister of the Interior and Safety pursuant to Article 27-2(6) of the Decree on the Appointment of Local Public Officials.
Article 14(Conduct of operational evaluation) #
(1) The Minister of Agriculture, Food and Rural Affairs shall conduct the operational evaluation under Article 18(2) of the Act (hereinafter referred to as the “operational evaluation”) every 3 years.
(2) The criteria for operational evaluation shall be classified as follows:
1. Evaluation concerning the management status of the Museum: The degree of responsible management and operational efficiency, and the appropriateness of budgetary, organizational, and human resource management, etc.;
2. Evaluation concerning the performance of projects, such as the collection, preservation, management, and exhibition of Museum materials: The degree of expansion of the foundation for collecting Museum materials, the results of implementation of the master operational plan and the mid- to long-term development plan of the Museum, etc.;
3. Evaluation concerning public services related to the operation of the Museum: The level of customer satisfaction and public perception, and performance in service improvement, etc.
(3) Where the Minister of Agriculture, Food and Rural Affairs intends to conduct an operational evaluation, he or she shall prepare evaluation guidelines specifying the following matters in detail and notify the Museum thereof by 3 months before the date of conducting the operational evaluation:
1. Basic direction of the operational evaluation;
2. Subjects and criteria of the operational evaluation;
3. Schedule for the operational evaluation;
4. Other matters necessary for the operational evaluation.
Article 15(Criteria for imposition of administrative fines) #
The criteria for the imposition of administrative fines pursuant to Article 25(1) of the Act shall be as set forth in the Appendix.
