Article 1(Purpose) #
The purpose of this Decree is to prescribe the matters mandated by the Act on Fostering of and Support for Next Generation Farmers or Fishers and Young Farmers or Fishers and those necessary for the enforcement thereof.
Article 2(Requirements for next generation farmers or fishers) #
“A person who meets the requirements prescribed by Presidential Decree with respect to age, the period during which the person has engaged in farming or fishing, etc.” in subparagraph 1 of Article 2 of the Act on Fostering of and Support for Next Generation Farmers or Fishers and Young Farmers or Fishers (hereinafter referred to as the "Act") means a person who meets all of the following requirements:
1. A person under 50 years of age;
2. A person who has engaged in farming or fishing for less than 10 years in total.
Article 3(Requirements for young farmers or fishers) #
“A person who meets the requirements prescribed by Presidential Decree with respect to age, the requirement of residence, etc.” in subparagraph 2 of Article 2 of the Act means a person under 40 years of age.
Article 4(Scope of organization of next generation farmers or fishers) #
“An organization specified by Presidential Decree” in subparagraph 4 of Article 2 of the Act means a non-profit, non-governmental organization registered under Article 4 of the Assistance for Non-Profit, Non-Governmental Organizations Act.
Article 5(Details of master plan) #
"Matters prescribed by Presidential Decree" in Article 6 (2) 5 of the Act means the matters regarding the following:
1. Evaluation of a master plan for policies on the fostering of next generation farmers and fishers under Article 6 (1) of the Act (hereinafter referred to as “master plan”);
2. Support for exchanges and cooperation among institutions and organizations related to next generation farmers and fishers;
3. Other matters that the Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries deems necessary for fostering next generation farmers or fishers.
Article 6(Interval, scope and method of current situation survey) #
(1) A survey on the actual conditions of next generation farmers or fishers, including the status of next generation farmers or fisheries in their settlement in agricultural or fishing communities, under Article 7 (1) of the Act (hereinafter referred to as "current situation survey") shall be conducted every 5 years.
(2) The scope of a current situation survey shall be as follows:
1. General information on next generation farmers or fishers, such as gender, age, place of residence, etc.;
2. Matters regarding income status and business activities of next generation farmers or fishers;
3. Matters regarding the housing, culture, and welfare conditions of next generation farmers or fishers;
4. Other matters that the Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries deems necessary for fostering and supporting next generation farmers or fishers.
(3) A current situation survey may be conducted by means of a written survey, an on-site survey, etc.
(4) The Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries may conduct additional surveys whenever deemed necessary to supplement a current situation survey or to conduct a survey on specific matters.
Article 7(Establishment and operation of integrated information system) #
The Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries may request the heads of relevant central administrative agencies, the heads of local governments, or the heads of agriculture or fisheries-related institutions and organizations to provide information necessary for the establishment and operation of the integrated information system under Article 14 (1) of the Act.
Article 8(Recovery of subsidies) #
Where the Minister of Agriculture, Food and Rural Affairs, the Minister of Oceans and Fisheries, or the head of a local government intends to recover a subsidy pursuant to Article 16 (1) of the Act, he or she shall notify a person obligated to return the subsidy of the payment in writing, specifying the grounds for recovery, the amount subject to recovery, the deadline for payment, and the receiving institution.
