CHAPTER I GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Act is to improve citizens’ quality of life and to contribute to the development of the national economy, by creating foundations for developing the last-mile logistics industry and by promoting the rights and interests of last-mile delivery service workers and consumers.

Article 2(Definitions) #

The terms used in this Act are defined as follows: <Amended on Jan. 16, 2024>

1. The term "last-mile logistics services" means activities relating to logistics defined in Article 2 (1) 1 of the Framework Act on Logistics Policies, which are providing, at the request of consumers, the services of delivering mostly small-size, low-weight goods through the process of collecting, packaging, storing, sorting, etc. and the services of directly delivering them using two-wheeled motor vehicles or brokering such delivery through information and communications networks, etc.;

2. The term "last-mile logistics industry" means the industry that creates economic or social value added through last-mile delivery service activities;

3. The term "last-mile logistics business" means the following business which provides last-mile logistics services at a cost:

(a) Package delivery service business: The business of delivering goods through the process of collecting, sorting, etc. by using trucks for the trucking transport service permitted pursuant to Article 3 (1) of the Trucking Transport Business Act;

(b) Small package delivery agency service business: Business of delivering cargo directly by using two-wheeled vehicles under Article 3 (1) 5 of the Motor Vehicle Management Act, drones under Article 2 (1) 1 of the Act on the Promotion of Utilization of Drones and Formation of Infrastructure (hereinafter referred to as "drones") or outdoor mobile robots under subparagraph 4-2 of Article 2 of the Act on the Promotion of Development and Distribution of Intelligent Robots (hereinafter referred to as "outdoor mobile robot") or of mediating such deliveries by utilizing information and communications networks, etc.;

4. The term "last-mile logistics business operator" means any of the following business providers who conduct the last-mile logistics business:

Article 5(Registration of package delivery service business) #

(1) A person who intends to engage in the package delivery service business by using trucks that are used for the trucking transport service provided by a person with permission under Article 3 (1) of the Trucking Transport Business Act (hereinafter referred to as "trucks dedicated to package delivery services"), only for the purpose of collecting and delivering goods eligible for package delivery service business, shall satisfy the following requirements and file for registration of his or her business with the Minister of Land, Infrastructure and Transport as prescribed by Presidential Decree: <Amended on Jan. 16, 2024>

1. The person shall obtain permission for the trucking transport service pursuant to Article 3 (1) of the Trucking Transport Business Act;

2. The person shall meet the standards prescribed by Presidential Decree for facilities, equipment, business offices, etc.;

3. Where the person intends to use drones or outdoor mobility robots for the collection and delivery of cargo, he or she shall meet the requirements prescribed by Presidential Decree, such as registration of ultra-light aircraft rental services under Article 48 of the Aviation Business Act or operation safety certification under Article 40-2 of the Intelligent Robot Development and Distribution Promotion Act.

(2) Where a person who has filed for registration pursuant to paragraph (1) intends to change any registered matter, he or she shall file for registration of such change with the Minister of Land, Infrastructure and Transport, as prescribed by Presidential Decree; provided, the foregoing shall not apply where such person changes any minor matter prescribed by Presidential Decree.

(3) The Minister of Land, Infrastructure and Transport shall issue a registration certificate, as prescribed by Decree of the Ministry of Land, Infrastructure and Transport, to a person who has filed for registration of his or her package delivery service business or has filed for registration of change thereof pursuant to paragraph (1) or (2).

(4) A package delivery service provider shall file a report on matters relating to the requirements for registration under paragraph (1) with the Minister of Land, Infrastructure and Transport within three years from the date of registration under paragraph (1), as prescribed by Decree of the Ministry of Land, Infrastructure and Transport.

Article 10(Renewal of contract for outsourcing package transport and delivery services) #

(1) Where a package delivery service worker requests to renew the contract for outsourcing package transport and delivery services during the period between 150 days and 60 days prior to the expiration date of the contract, and the total contract terms (referring to the terms from the date of entering into the first contract for outsourcing package transport and delivery services to the expiration date of such contract intended to be renewed; hereafter in this Article, the same shall apply) is six years or less, the relevant package delivery service provider (including a business office that has concluded a contract for outsourcing package transport and delivery services with the package delivery service provider; hereafter in this Article and Article 11, the same shall apply) shall not refuse to renew it except in any of the following cases:

1. Cases where the package delivery service worker concluded the contract by fraud or other improper means;

2. Cases prescribed by Presidential Decree where the package delivery service provider finds it impracticable to renew the contract for outsourcing package transport and delivery services due to a serious breach, etc. by the package delivery service worker;

3. Cases prescribed by Presidential Decree where it is impracticable for the package delivery service provider to maintain normal operations of his or her package delivery service business.

(2) Where a package delivery service worker on the total contract terms exceeding six years requests the renewal of the contract, the relevant package delivery service provider shall endeavor to renew the contract taking into consideration the protection of the status of the package delivery service worker and other similar matters.

(3) A package delivery service provider that intends to refuse the request for renewal under paragraph (1) shall give written notice of the reasons for refusal to the relevant package delivery service worker, within 15 days from the date of receipt of such request.

(4) Where a package delivery service provider fails to give notice of refusal required under paragraph (3) or fails to give written notice of change in the terms and conditions of the relevant contract or of that it is not willing to renew the relevant contract, to the relevant package delivery service worker during the period between 150 days and 60 days prior to the expiration date of the contract, the contract is deemed to be renewed under the same terms and conditions as those of the existing contract; provided, the foregoing shall not apply where the package delivery service worker raises any objection by not later than 30 days before the expiration of the contract or where a natural disaster or any other unavoidable cause prescribed by Presidential Decree occurs to the package delivery service provider or to the package delivery service worker.

Article 13(Succession to status of package delivery service providers) #

(1) Where a package delivery service provider transfers his or her package delivery service business or is dead or where a package delivery service provider that is a corporation is merged with another corporation, the transferee, the heir, or the surviving or newly established corporation following the merger shall succeed to the status of the previous package delivery service provider; provided, the foregoing shall not apply if the transferee of the package delivery service business or the surviving or newly established corporation following the merger falls under any of subparagraphs 1 through 4 of Article 6.

(2) Where an heir who succeeds to the status of a package delivery service provider pursuant to paragraph (1) falls under any of subparagraphs 1 through 4 of Article 6 or where a corporation that succeeds to such status pursuant to paragraph (1) falls under subparagraph 5 of that Article, the heir shall transfer the status of the package delivery service provider to a third person, or the corporation shall replace the executive officer at issue, within six months from the date of the commencement of inheritance or the date of merger, respectively.

(3) A person who has succeeded to the status of a package delivery service provider pursuant to paragraph (1) shall file a report with the Minister of Land, Infrastructure and Transport on the succession within 30 days from the date a cause for the succession arises, as prescribed by Decree of the Ministry of Land, Infrastructure and Transport.

(4) The Minister of Land, Infrastructure and Transport shall give notice to a person who has filed a report as to whether to accept the report within 30 days from receipt of the report under paragraph (3).

(5) If the Minister of Land, Infrastructure and Transport fails to give notice to a person who has filed a report as to whether to accept the report or whether to extend a processing period under a statute or regulation governing processing of civil petitions within the period prescribed in paragraph (4), the report shall be deemed to be accepted on the day following the end of that period (if such processing period is extended or re-extended under a statute or regulation governing processing of civil petitions, referring to the relevant processing period).

Article 19-2(Restrictions on engaging in small package delivery agency service business) #

(1) Any of the following persons shall be prohibited from becoming a small package delivery agent service worker:

1. A person who has committed any of the following crimes and has been sentenced to date imprisonment without labor or heavier, and for whom the period specified by Presidential Decree has yet to elapse, considering the type and nature of crime, length of the sentence, risk of recidivism and other factors, within a maximum range of 20 years from the date their sentence was executed (including cases deemed executed) or exempted:

(a) A crime prescribed in each subparagraph of Article 2 (1) of the Act on Special Cases concerning the Punishment of Specific Violent Crimes;

(b) A crime under Article 5-2, 5-4, 5-5, 5-9, and 11 of the Act on the Aggravated Punishment of Specific Crimes;

(d) A crime under Articles 2 (1) 2 through 4, 3 through 9, 14, 14-2, 14-3, and 15 of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;

(e) A crime under subparagraph 2 of Article 2 of the Act on the Protection of Children and Youth against Sex Offenses;

2. A person for whom the period of suspension has yet to elapse after he or she was sentenced to the suspension of execution of imprisonment without labor or heavier for a crime under subparagraph 1.

(2) Where a certified small package delivery agent service provider or a business office (hereinafter referred to as "small package delivery agent service worker, etc.") verifies that a small package delivery agent service worker or a person who intends to become a small package delivery agent service worker (hereinafter referred to as "small package delivery agent service worker, etc.") falls under the grounds for restriction on his or her engagement as prescribed in paragraph (1), the small package delivery agent service worker or the business office shall not enter into or terminate a transport consignment contract, labor contract, etc. with the relevant small package delivery agent service worker, etc.

Article 26(Development and management of professional human resources) #

(1) The Minister of Land, Infrastructure and Transport may formulate and promote policies for the development, management, education and training, etc. of human resources with technical expertise or skills in the last-mile logistics industry (hereinafter referred to as "professional human resources").

(2) Policies under paragraph (1) shall include the following:

1. Matters relating to the supply of and demand for, and the use of, professional human resources;

2. Matters relating to the development and education and training of professional human resources;

3. Other matters prescribed by Presidential Decree, which are necessary for the development and management of professional human resources.

(3) The Minister of Land, Infrastructure and Transport may designate a research institute, university, institution, or organization prescribed by Presidential Decree as a training institution for professional human resources and may authorize such institution to provide education and training under paragraph (1).

(4) The Minister of Land, Infrastructure and Transport may fully or partially subsidize costs incurred in providing education and training for a training institution for professional human resources designated under paragraph (3).

(5) Where a training institution for professional human resources designated under paragraph (3) falls under any of the following cases, the Minister of Land, Infrastructure and Transport may revoke the designation; provided, in the case of subparagraph 1, such designation shall be revoked:

1. Where it has obtained the designation by fraud or other improper means;

2. Where it fails to meet the requirements for designation as a training institution for professional human resources under paragraph (6) for at least three consecutive months.

(6) Matters necessary for the development and management of professional human resources, the designation of training institutions for professional human resources and revocation of such designation, the subsidization for such institutions, and other relevant matters under paragraphs (1) through (5) shall be prescribed by Presidential Decree.

Article 33(Service terms and conditions) #

(1) Last-mile logistics business operators shall prepare terms and conditions for last-mile logistics services (hereinafter referred to as "service terms and conditions") and file a report thereon with the Minister of Land, Infrastructure and Transport. The foregoing shall also apply where any change of such terms and conditions is intended.

(2) The Minister of Land, Infrastructure and Transport shall give notice to a person who has filed a report as to whether to accept the report within 30 days from the date of receipt of the report or of the report of change under paragraph (1).

(3) If the Minister of Land, Infrastructure and Transport fails to give notice to a person who has filed a report as to whether to accept the report or whether to extend a processing period under a statute or regulation governing processing of civil petitions within the period prescribed in paragraph (2), the report shall be deemed to be accepted on the day following the end of that period (if such processing period is extended or re-extended under a statute or regulation governing processing of civil petitions, referring to the relevant processing period).

(4) The Minister of Land, Infrastructure and Transport may recommend last-mile logistics business operators to use the standard terms and conditions for last-mile logistics services (hereinafter referred to as "standard terms and conditions"), if any, examined by the Fair Trade Commission pursuant to Article 19-3 of the Act on the Regulation of Terms and Conditions.

(5) If a last-mile logistics business operator consents to the use of the standard terms and conditions when he or she files for registration pursuant to Article 5 (1) (including filing for registration of change thereof under Article 5 (2)) or obtains certification pursuant to Article 17 (1), such operator shall be deemed to have filed a report pursuant to paragraph (1).

(6) Where a last-mile logistics business operator has filed a report on the service terms and conditions or on any change of them pursuant to paragraph (1), he or she shall disclose the service terms and conditions on the operator's website and keep them at a place readily visible to consumers to make them available to the consumers for perusal.

(7) Details to be included in the service terms and conditions referred to in paragraph (1), procedures for reporting, and other necessary matters shall be prescribed by Presidential Decree.

Article 35(Assessment of last-mile logistics services) #

(1) The Minister of Land, Infrastructure and Transport may assess last-mile logistics services provided by last-mile logistics business operators (hereinafter referred to as "assessment of services") to improve the quality of last-mile logistics services, to protect the rights and interests of last-mile delivery service workers and consumers, and to conduct any other similar activities.

(2) Criteria for the assessment of services shall be as follows: <Amended on Oct. 24, 2023; Jan. 16, 2024>

1. Consumer satisfaction with last-mile logistics services;

2. Stability of last-mile logistics services;

3. Promotion of the rights and interests of last-mile delivery service workers and consumers;

4. Improvement of the quality of last-mile logistics services, including the level of service charges in logistically vulnerable areas;

5. Safety of the working conditions for last-mile delivery service workers;

6.Other matters equivalent to subparagraph 1 through 5 as prescribed by Decree of the Ministry of Land, Infrastructure and Transport.

(3) Service evaluation shall include a survey of consumers and last-mile delivery service workers, and matters necessary for detailed evaluation methods and procedures, etc. shall be prescribed by Decree of the Ministry of Land, Infrastructure and Transport. <Amended on Jan. 16, 2024>

(4) The Minister of Land, Infrastructure and Transport may officially announce details, such as the results of assessment by item, after conducting the assessment of services under paragraph (1), as prescribed by Presidential Decree.

(5) The Minister of Land, Infrastructure and Transport may grant awards to persons showing outstanding results in assessments as prescribed by Presidential Decree and may give priority to providing administrative or financial support for such persons under Article 23.

(6) The Minister of Land, Infrastructure and Transport may request the provision of information prescribed by Presidential Decree, such as the purchase of industrial accident compensation insurance under Article 125 of the Industrial Accident Compensation Insurance Act, from the Korea Workers' Compensation and Welfare Service established under Article 10 of that Act, in order to assess matters relating to the promotion of rights and interests of last-mile delivery service workers prescribed in paragraph (2) 3. In such cases, the Korea Workers' Compensation and Welfare Service shall comply with such request unless there is a compelling reason not to do so.

(7) For assessing services, the Minister of Land, Infrastructure and Transport may request a last-mile logistics business operator to submit relevant materials, to give opinions, and to perform other similar activities or may conduct an on-site investigation on relevant services, as prescribed by Presidential Decree; and the last-mile logistics business operator so requested shall comply with such request unless there is a compelling reason not to do so.

Article 42(Programs of mutual aid association) #

(1) The Mutual Aid Association shall conduct the following programs:

1. Mutual aid services to cover the liability of a member for damage caused by an accident occurring in the use of his or her vehicle for business purposes and for damage to the loads;

2. Mutual aid services to cover damage caused to a member's vehicle for business purposes by an accident occurring while he or she possesses, uses, or manages the vehicle;

3. Mutual aid services to cover a small package delivery agent service worker's bodily injury caused by an accident occurring while he or she possesses, uses, or manages its relevant member's vehicle for business purposes;

4. Mutual aid services to cover losses sustained by employees of the Mutual Aid Association due to accidents on duty;

5. Establishment, operation, and management of common use facilities and other programs for the promotion of its members' convenience and welfare;

6. Surveys and research projects to improve the management of small package delivery agent service business;

7. Other programs incidental to those specified in subparagraphs 1 through 6, which are prescribed by the articles of incorporation.

(2) When the Mutual Aid Association intends to conduct a mutual aid program specified in paragraph (1) 1 through 4, it shall establish regulations on mutual aid and obtain authorization from the Minister of Land, Infrastructure and Transport. The same shall also apply to amendments to the regulations on mutual aid.

(3) The regulations on mutual aid referred to in paragraph (2) shall include guidelines necessary to operate mutual aid programs such as the scope of the mutual aid programs, the details of mutual aid contracts and contributions, mutual aid benefits, liability reserve funds to cover mutual aid benefits, and the appropriation and accumulation of reserves.

(4) The Insurance Business Act shall not apply to mutual aid programs referred to in paragraph (1) 1 through 4.

(5) Either party to a dispute over a mutual aid agreement or the payment of mutual aid benefits or to any other dispute arising in connection with a mutual aid program conducted under paragraph (1) may apply for mediation to the Committee for Guaranteeing Motor Vehicle Accident Compensation under Article 23-3 of the Compulsory Motor Vehicle Liability Security Act. <Amended on Jan. 9, 2024>

Article 44(Reporting and inspections) #

(1) In any of the following cases, the Minister of Land, Infrastructure and Transport may require a last-mile logistics business operator or a business office to give a report or submit a document regarding business operations or the ownership or use of vehicles of transportation; and if necessary, the Minister may require public officials under his or her jurisdiction to enter the place of business of such operator or office to inspect books, documents, or other objects or to inquire of relevant persons:

1. Where it is necessary to check whether such operator or such office meets the requirements for registration under Article 5 (1) or complies with the standards for certification under Article 17 (6);

2. Where it is necessary to ascertain the acts of disturbing the order of the market for last-mile logistics services, such as receipt or provision of unlawful profits under Article 34 or other similar acts;

3. Where it is necessary to check whether a last-mile logistics business operator, a business office, or a last-mile delivery service worker has violated this Act;

4. Where it is necessary to render an administrative disposition, such as revocation of registration of package delivery service business or revocation of certification of a certified small package delivery agent service provider.

(2) Where necessary to verify whether a last-mile logistics business operator is equipped with a rest facility pursuant to Article 36 (2), the Minister of Land, Infrastructure and Transport may require the last-mile logistics business operator to report on such facility or may have public officials under his or her control enter the relevant place of business to inspect books, documents, and other articles. <Added on Jan. 9, 2024>

(3) A public official who enters the place of business or conducts an inspection under paragraph (1) or (2) shall carry identification indicating his or her authority and present it to the relevant persons. <Amended on Jan. 9, 2024>

Article 51(Administrative fines) #

(1) Any of the following persons shall be subject to an administrative fine not exceeding 5 million won: <Amended on Jan. 16, 2024>

1. A person who fails to file for registration of change under Article 5 (2) or who has filed for registration of change under Article 5 (2) by fraud or other improper means;

2. A person who fails to file a report on requirements for registration under Article 5 (4);

3. A person who refuses to renew a contract for outsourcing package transport and delivery services without good cause, in violation of Article 10 (1);

4. A person who fails to file a report on succession to status under Article 13 (3) after an inheritance, transfer, acquisition by transfer, or merger;

5. A person who fails to file a report on temporary or permanent closure of business under Article 14 (1);

6. A person who fails to return the motor vehicle registration certificates for, and motor vehicle license plates of, trucks dedicated to package delivery services, in violation of Article 14 (5);

7. A person who has obtained certification under Article 17 (1) by fraud or other improper means;

8. A person who uses a certification mark or any similar mark, in violation of Article 17 (4);

9. A person who fails to discontinue the use of a certification mark, in violation of Article 19 (2);

9-2. A certified small package delivery agent service provider or a business office that fails to terminate the contract without good causes within 1 month from the date on which it is confirmed that the contract for transportation consignment or labor contract, etc. shall be terminated, in violation of Article 19-2 (2);

9-3. A certified small package delivery agent service provider or a business office that fails to verify the criminal record of a small package delivery agent service worker, etc., in violation of Article 19-3 (1);

10. A person who fails to file a report on service terms and conditions or a report on changes in them under Article 33 (1);

11. A person who has received unlawful profits, in violation of Article 34, or who has made unlawful rebates (excluding where the same act is, for the same reason, subject to a corrective measure under Article 24 of the Monopoly Regulation and Fair Trade Act, a penalty surcharge under Article 24-2 (1) of that Act, or a penalty under subparagraph 2 of Article 67 of that Act);

12. A person who refuses to submit materials, etc. or to undergo an on-site investigation requested for the assessment of services under Article 35 (7) without good cause or who submits false materials, etc.;

13. Where a package delivery service provider fails to comply with an improvement order issued under Article 39 without good cause;

14. A person who fails to give a report under Article 44 without good cause or gives a false report; who fails to submit a document or submits false document; or who refuses, obstructs, or evades an inspection.

(2) Administrative fines under paragraph (1) shall be imposed and collected by the Minister of Land, Infrastructure and Transport, as prescribed by Presidential Decree.
