Article 1(Purpose) #
The purpose of this Act is to prescribe matters concerning the establishment and operation of Korea National Open University to contribute to guaranteeing the people's right to learn and promoting lifelong education of the State in accordance with the Framework Act on Education.
Article 2(Establishment) #
(1) Korea National Open University (hereinafter referred to as "Open University"), which is a national school, shall be established under the jurisdiction of the Minister of Education.
(2) The location of Open University shall be prescribed by Presidential Decree.
Article 3(Responsibility of Open University) #
(1) The president of Open University shall establish a mid- to long-term development plan for Open University and faithfully implement such plan in order to contribute to guaranteeing the people's right to learn and promoting lifelong education of the State.
(2) The State and local governments may provide support necessary for Open University to fulfill its responsibilities under paragraph (1).
Article 4(Relationship with other Acts) #
(1) This Act shall take precedence over other Acts with respect to matters concerning Open University.
(2) Except as otherwise provided for in this Act, the establishment, organization, and operation of Open University shall be governed by the Higher Education Act, the Public Educational Officials Act, the Act on the Establishment of University Accounting and Financial Operation of National Universities, and other relevant statutes on higher education.
Article 5(President) #
(1) Open University shall have a president.
(2) The president shall supervise academic affairs, direct and supervise its personnel, guide students, and represent Open University.
Article 6(Vice president) #
(1) Open University may have a vice president from among its professors to assist the president in his or her duties.
(2) If the president is unable to perform his or her duties for any unavoidable reason, the vice president shall act on his or her behalf.
(3) The vice president may perform his or her duties by being delegated by the president with part of authority, such as academic affairs, to efficiently promote the business of the university.
Article 7(Faculty and staff members) #
(1) Open University shall have faculty and staff members and teaching assistants (hereinafter referred to as "faculty and staff members") under Article 14(2) and (3) of the Higher Education Act and adjunct faculty, etc. under Article 17 of that Act.
(2) Matters necessary for the appointment and the fixed number of faculty and staff members of Open University shall be prescribed by Presidential Decree.
Article 8(University rules) #
(1) The president may enact or amend university rules (hereinafter referred to as "university rules") within the scope of statutes.
(2) Matters necessary for the items to be included in university rules, procedures for enactment and amendment, etc. shall be prescribed by Presidential Decree.
Article 9(Instruction) #
(1) Instruction of Open University shall be conducted by such methods as remote instruction using broadcasting and information and communications media, etc., attendance instruction, and field practice instruction.
(2) Other matters necessary for academic management, such as curriculum, grades, and degrees, shall be prescribed by university rules.
Article 10(Colleges) #
(1) Open University may have colleges and departments, schools, etc. belonging to colleges that operate degree programs.
(2) Open University may have a general graduate school, specialized graduate school (excluding medical, dental, Korean medicine, and law schools), or special graduate school (hereinafter referred to as "graduate school") under Article 29-2(2) of the Higher Education Act. <Amended on Oct. 18, 2022>
(3) Each college, graduate school, department, school, etc. under paragraphs (1) and (2) shall have a head; the head of a college or graduate school shall be concurrently held by a professor or associate professor, and the head of a department or school shall be concurrently held by a professor, associate professor, or assistant professor.
(4) The head of a college or graduate school shall, under the direction of the president, and the head of a department or school shall, under the direction of the head of the college or graduate school, supervise academic affairs of the relevant college, graduate school, department, or school, direct and supervise its faculty and staff members, and guide students.
(5) Other matters necessary for the organization and operation of colleges, graduate schools, departments, schools, etc. shall be prescribed by university rules.
Article 11(Affiliated facilities) #
(1) The president may have support facilities, research facilities, affiliated facilities, and other necessary facilities to achieve the purpose of establishment of Open University.
(2) Matters necessary for the organization and operation of affiliated facilities, etc. shall be prescribed by Presidential Decree.
Article 12(Subordinate organizations) #
Matters concerning the composition and operation of subordinate organizations of Open University shall be prescribed by Presidential Decree.
Article 13(Partner schools) #
Open University may have partner schools at home and abroad, as prescribed by university rules, to smoothly conduct the education of Open University.
Article 14(Cooperation by related agencies) #
The head of a State agency, a local government, or a public institution (referring to a public institution under Article 4 of the Act on the Management of Public Institutions) shall cooperate in attendance instruction for students of Open University who are employed at the relevant agency, to the extent that it does not impede business.
Article 15(Prohibition of use of similar names) #
No person other than Open University under this Act shall use the name "Korea National Open University" or any other name or emblem similar thereto.
Article 16(Administrative fines) #
(1) An administrative fine not exceeding 5 million won shall be imposed on a person who violates Article 15.
(2) Administrative fines under paragraph (1) shall be imposed and collected by the Minister of Education.
