Article 1(Purpose) #
The purpose of this Decree is to prescribe matters necessary for the collection, creation, and distribution of security-related space information, including satellite assets, the response to security-related threats to satellite assets, etc., and the performance of security affairs, from among the duties of the National Intelligence Service pursuant to Article 4 (1) of the National Intelligence Service Act.
Article 2(Definitions) #
The terms used in this Decree are defined as follows:
1. The term "satellite assets, etc." means artificial space objects defined in subparagraph 3 (a) of Article 2 of the Space Development Promotion Act and facilities and systems related thereto;
2. The term "security-related space information" means information related to national security from among the following information:
(a) Information on satellite assets, etc.;
(b) Information on space accidents defined in subparagraph 4 of Article 2 of the Space Development Promotion Act, satellite information defined in subparagraph 5 of that Article, and dangers in space defined in subparagraph 6 of that Article;
(c) Information on the security-related threats to satellite assets, etc. from North Korea, foreign countries, foreigners, foreign organizations, transnational actors, or Korean nationals linked thereto;
3. The term "relevant agency" means any of the following institutions and organizations that conduct business affairs related to the collection, preparation, and distribution of security-related space information among the following institutions and organizations:
(a) Public institutions under subparagraph 1 of Article 3 of the Public Records Management Act;
(b) Research institutes pursuant to Article 8 (1) of the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes;
(c) Other institutions and organizations developing, producing, or holding satellite assets, etc.
Article 3(Performance of space security affairs) #
The Director of the National Intelligence Service shall perform the following business affairs for the security of satellite assets, etc. (hereinafter referred to as "space security affairs"):
1. The following business affairs regarding security-related space information:
(a) Collection and preparation of security-related space information;
(b) Developing or purchasing, and operating satellite assets, etc. to collect and prepare security-related space information;
(c) Distributing security-related space information to relevant agencies;
(d) Response to space accidents defined in subparagraph 4 of Article 2 of the Space Development Promotion Act, dangers in space defined in subparagraph 6 of that Article, and security-related threats to satellite assets, etc. defined in subparagraph 6 of that Article;
2. The following security affairs regarding satellite assets, etc. and security-related space information:
(a) Establishment and implementation of security guidelines for satellite assets, etc. and security-related space information;
(b) Development and distribution of cryptographic technology related to security of satellite assets, etc.
Article 4(National Space Security Center) #
(1) The Director of the National Intelligence Service may establish the National Space Security Center to efficiently conduct space security affairs.
(2) If necessary for the operation of the National Space Security Center under paragraph (1), the Director of the National Intelligence Service may request the heads of relevant agencies to provide cooperation, such as the dispatch of executive officers and employees under their control and the submission of data related to space security affairs.
Article 5(Overseas cooperation) #
The Director of the National Intelligence Service may establish an information cooperation system with relevant agencies, foreign intelligence and security agencies, etc., if necessary for space security affairs.
Article 6(Research and development of strategies related to space security affairs) #
(1) The Director of the National Intelligence Service may research and develop strategies, policies, and technologies necessary for performing space security affairs.
(2) The Director of the National Intelligence Service may designate any of the following agencies as a specialized institution for research and development under paragraph (1):
1. Research institutes pursuant to Article 8 (1) of the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes;
2. The Agency for Defense Development established under the Act on the Agency for Defense Development Act;
3. A non-profit corporation established pursuant to Article 32 of the Civil Act, which is an academic society or academic organization related to security, such as satellite assets.
(3) The Director of the National Intelligence Service shall determine detailed matters necessary for designating a specialized institution under paragraph (2), such as the standards and procedures for designation and methods of designation.
(4) The Director of the National Intelligence Service may provide subsidies to cover all or some of expenses incurred by a specialized institution designated pursuant to paragraph (2) in performing its business affairs, within the budget.
Article 7(National Satellite Operation Center) #
(1) The Director of the National Intelligence Service shall perform space security affairs in connection with the business affairs of the Korea Satellite Operations Center under Article 16 of the Decree on the Organization of the Korea Aerospace Administration and Its Affiliated Agencies.
(2) Details necessary for the performance of business affairs under paragraph (1) shall be determined by the Director of the National Intelligence Service in consultation with the Commissioner of the Korea Aerospace Administration.
Article 8(Request for emergency filming) #
If the Director of the National Intelligence Service deems it necessary to preferentially collect security-related space information, he or she may request the head of a relevant agency operating an artificial satellite for an emergency filming.
Article 9(Security guidelines) #
(1) The Director of the National Intelligence Service shall formulate and implement security guidelines necessary to protect satellite assets, etc. and security-related space information.
(2) The Director of the National Intelligence Service may consult with relevant agencies if necessary to formulate and implement security guidelines under paragraph (1).
Article 10(Development and dissemination of cryptographic technology) #
(1) The Director of the National Intelligence Service may develop and distribute encryption technology for the security of satellite assets, etc.
(2) If the head of a relevant agency applies for the application of encryption technology in connection with the development and introduction of satellite assets, etc., the Director of the National Intelligence Service shall determine whether to provide support in consideration of the purpose of use, operational environment, etc.
Article 11(Training of human resources) #
(1) The Director of the National Intelligence Service may operate educational courses or develop educational programs to train specialized technical personnel related to security, such as satellite assets, etc.
(2) The Director of the National Intelligence Service may assist relevant agencies with education on the security of satellite assets, etc.
