Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on the Support for Cultural and Artistic Activities of Artists with Disabilities and matters necessary for the enforcement thereof.
Article 2(Scope of artists with disabilities) #
(1) "Person prescribed by Presidential Decree" in the provisions, with the exception of the items, of subparagraph 1 of Article 3 of the Act on the Support for Cultural and Artistic Activities of Artists with Disabilities (hereinafter referred to as the "Act") means any of the following persons: <Amended on Sep. 12, 2023>
1. A person who has obtained certification of artistic activities pursuant to Article 3-2 of the Artist Welfare Act;
2. Any of the following persons, other than those falling under subparagraph 1:
a. A person who has works defined in subparagraph 1 of Article 2of the Copyright Act, which are cultural or artistic works that have been made public in accordance with subparagraph 25 of that Article;
b. A person who has income from cultural and artistic activities, such as creation, performance, or technical support;
c. Any other person recognized by the Minister of Culture, Sports and Tourism as having records of cultural and artistic activities equivalent to those specified in items a and b.
(2) Detailed standards for artists with disabilities under the items of paragraph (1)2 shall be determined and publicly notified by the Minister of Culture, Sports and Tourism.
Article 3(Formulation and implementation of master plan and implementation plan) #
(1) Where the Minister of Culture, Sports and Tourism formulates a master plan under Article 6(1) of the Act (hereinafter referred to as "master plan"), he or she shall notify the head of the relevant central administrative agency, the Special Metropolitan City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, Do Governor, or Special Self-Governing Province Governor ( hereinafter referred to as the "Mayor/Do governor") thereof.
(2) Where a Mayor/Do Governor formulates an implementation plan for the following year (hereinafter referred to as "implementation plan") pursuant to Article 6(3) of the Act, he or she shall submit it to the Minister of Culture, Sports and Tourism by December 31 each year.
(3) The Minister of Culture, Sports and Tourism shall integrate the implementation plans submitted pursuant to paragraph (2) and the implementation plans formulated by the Minister of Culture, Sports and Tourism, and notify the heads of competent central administrative agencies and the competent Mayor/Do Governor thereof without delay.
(4) Where the Minister of Culture, Sports and Tourism and the Mayor/Do Governor request the submission of data, opinions, etc. necessary for formulating the master plan and implementation plans pursuant to Article 6(4) of the Act, he or she shall do so in writing, stating the purpose of such request, the scope of materials, opinions, etc. to be submitted, the deadline for submission, etc.
Article 4(Organization and operation of Committee of Support for Cultural and Artistic Activities of Artists with Disabilities) #
(1) The commissioned members of the Committee for Support of Cultural and Artistic Activities of Artists with Disabilities under Article 7 of the Act (hereinafter referred to as the "Committee") shall be commissioned by the Minister of Culture, Sports and Tourism in consideration of gender, and shall include at least 4 artists with disabilities. In this regard, the proportion of artists with disabilities shall not be concentrated in a particular type of disability.
(2) The chairperson of the Committee (hereinafter referred to as the "chairperson") shall convene and preside over meetings of the Committee.
(3) When the chairperson is unable to perform his or her duties due to unavoidable reasons, a member of the Committee designated in advance by the chairperson shall act on his or her behalf.
(4) The term of office of a member of the Committee newly commissioned due to the resignation, etc. of a member of the Committee shall be the remainder of the term of office of the predecessor.
(5) A committee meeting shall require the presence of a majority of the incumbent members, and any decision thereof shall require the concurring vote of a majority of those present.
(6) Committee members who attend meetings of the Committee may be provided with allowances, travel expenses, and other necessary expenses within budgetary limits; provided, this shall not apply where a member who is a public official attends the meeting in direct connection with his or her duties.
(7) Except as otherwise provided for in paragraphs (1) through (6), matters necessary for the composition and operation of the Committee shall be determined by the chairperson through a resolution of the Committee.
Article 5(Content of fact-finding survey) #
A fact-finding survey under Article 8(1) of the Act (hereinafter referred to as "fact-finding survey") shall include the following matters:
1. Current status and conditions of cultural and artistic activities, such as creation, exhibition, and performance of artists with disabilities;
2. Current status of employment, such as employment status of artists with disabilities;
3.Current status of income related to cultural and artistic activities of artists with disabilities;
4. Current status of subscription to insurance for artists with disabilities, such as employment insurance and industrial accident compensation insurance;
5. Current status and operation of cultural facilities related to artists with disabilities;
6. Current status and operation of organizations related to artists with disabilities;
7. Other matters for which the Minister of Culture, Sports and Tourism deems necessary to conduct a fact-finding survey to formulate and implement a master plan and implementation plans.
Article 5-2(Preferential purchase of creative works of artists with disabilities) #
(1) The scope of public institutions under Article 4 of the Act on the Management of Public Institutions (hereafter referred to as "public institutions" in this Article), which shall take measures necessary for the preferential purchase of works created by artists with disabilities pursuant to Article 9-2(1) of the Act shall be public enterprises, quasi-governmental institutions, and other public institutions under Article 5 of that Act.
(2) The types of creative works such as craft goods, public performances (hereinafter referred to as "creative works") for which the State, local governments, and public institutions (hereafter referred to as "preferential purchasing institutions" in this Article) shall prepare measures necessary for preferential purchase pursuant to Article 9-2(1) of the Act shall be as follows:
1. Craft goods under the Craft Industry Promotion Act;
2. Performances under the Public Performance Act;
3. Artworks such as paintings, sculptures, photographs, calligraphy, murals, and media art;
(3) A preferential purchasing institution shall, pursuant to Article 9-2(1) of the Act, purchase at least 3 percent of the total amount of creative works purchased during the relevant year as creative works produced by artists with disabilities; provided, if it is difficult for the head of a priority purchasing institution to meet the preferential purchasing ratio stipulated in the main clause due to the characteristics of the institution, the head may separately determine the preferential purchasing ratio in consultation with the Minister of Culture, Sports, and Tourism.
(4) The head of a preferential purchasing institution shall submit the results of preferential purchase of creative works of artists with disabilities in the preceding year to the Minister of Culture, Sports and Tourism by no later than January 31 of each year.
(5) The Minister of Culture, Sports and Tourism may act as a broker for the purchase of creative works of artists with disabilities in order to support the preferential purchase of creative works of artists with disabilities by preferential purchasing institutions in order to support the preferential purchase of creative works of artists with disabilities.
(6) Except as otherwise provided for in paragraphs (1) through (5), matters necessary for the preparation of measures for preferential purchase of works created by artists with disabilities, such as the standards for calculating the results of preferential purchase of works created by artists with disabilities, shall be determined and publicly notified by the Minister of Culture, Sports and Tourism.
Article 6(Subsidy for expenses necessary for improving accessibility to cultural facilities) #
(1) The expenses necessary for improving the accessibility to cultural facilities for artists with disabilities under Article 12(2) of the Act shall be the expenses incurred in installing, renovating, or repairing the cultural facilities and appurtenant facilities (excluding convenience facilities that the owner, etc. of facilities under Article 3 of the Act on the Guarantee of Convenience Promotion of Persons with Disabilities, Senior Citizens, Pregnant Women and Nursing Mothers shall be obligated to install pursuant to Article 9 of that Act) to ensure that artists with disabilities conduct cultural and artistic activities safely and smoothly.
(2) A person who intends to receive support pursuant to Article 12(2) of the Act shall submit an application for support prescribed by Decree of the Ministry of Culture, Sports and Tourism to the Minister of Culture, Sports and Tourism or the head of a local government.
(3) Except as otherwise provided for in paragraph (2), matters concerning procedures for subsidizing expenses necessary for the improvement of accessibility to cultural facilities shall be prescribed by Decree of the Ministry of Culture, Sports and Tourism.
Article 7(Requirements for designation of dedicated institutions) #
(1) The Minister of Culture, Sports and Tourism may designate an institution that meets all of the following requirements as a dedicated agency under Article 14(1) of the Act (hereinafter referred to as "dedicated agency"): <Amended on Jan. 2, 2026>
(2) Any institution that wishes to be designated as a dedicated institution shall submit an application for designation in the form prescribed by Decree of the Ministry of Culture, Sports and Tourism to the Minister of Culture, Sports and Tourism.
(3) Where the Minister of Culture, Sports and Tourism has designated a dedicated institution, he or she shall issue a certificate of designation of a dedicated institution prescribed by Decree of the Ministry of Culture, Sports and Tourism to the relevant institution, and publicly announce such fact on the website of the Ministry of Culture, Sports and Tourism.
(4) Where the Minister of Culture, Sports and Tourism revokes the designation of a dedicated institution pursuant to Article 14(3) of the Act, he or she shall notify the relevant institution of such fact, and publicly announce it on the website of the Ministry of Culture, Sports and Tourism.
(5) Except as otherwise provided for in paragraphs (1) through (4), matters necessary for the designation, operation, etc. of dedicated institutions shall be determined and publicly notified by the Minister of Culture, Sports and Tourism
Article 8(Entrustment of business affairs) #
(1) The Minister of Culture, Sports and Tourism may entrust the following business affairs to a dedicated institution pursuant to Article 15(2) of the Act: <Amended on Mar. 28, 2023>
1. Business affairs concerning support for creative activities of artists with disabilities under Article 9 of the Act;
2. Affairs concerning expansion of participation of artists with disabilities under Article 10 of the Act;
3. Affairs concerning education and publicity for the promotion of employment of artists with disabilities, and campaigns to improve awareness of persons with disabilities, etc. under Article 11 of the Act;
4. Affairs concerning subsidization of expenses necessary for improving the accessibility to cultural facilities for artists with disabilities under Article 12 of the Act;
5. Affairs concerning subsidizing expenses incurred in activities of organizations related to artists with disabilities under Article 13 of the Act;
6. Affairs concerning the brokerage of purchase of works created by artists with disabilities under Article 5-2(5).
(2) The Minister of Culture, Sports and Tourism shall, when he or she entrusts his or her business affairs to a dedicated institution pursuant to paragraph (1), publicly notify the entrusted institution and the details of the entrusted affairs.
