Article 1(Purpose) #
The purpose of this Act is to establish the Korea Authority of Land and Infrastructure Safety and enable it to efficiently conduct safety and quality control of construction works, safety and maintenance of establishments, underground safety control, and other related projects, and thereby to contribute to ensuring the safety of citizens and enhancing their welfare.
Article 2(Legal personality) #
The Korea Authority of Land and Infrastructure Safety (hereinafter referred to as "KALIS") shall be a juristic person:
Article 3(Registration for incorporation) #
(1) KALIS shall be shall be established at the time it registers such establishment at the location of its main office.
(2) Matters necessary for the registration of establishment of KALIS shall be prescribed by Presidential Decree.
Article 4(Offices) #
(1) The location of the main office of KALIS shall be prescribed by the articles of incorporation.
(2) KALIS may, if necessary, establish a branch or branch office as prescribed by the articles of incorporation.
(3) KALIS shall take into account balanced regional development when determining the location of its main office under paragraph (1) or establishing a branch or branch office under paragraph (2). <Amended on Jun. 9, 2023>
Article 5(Projects) #
KALIS shall conduct the following projects; provided, matters otherwise provided for the safety of workers in the Occupational Safety and Health Act shall be excluded: <Amended on Jul. 27, 2021>
1. Projects for safety and quality control in the design and construction process, such as review of safety management plans and verification of quality control under the Construction Technology Promotion Act;
2. Projects for the safety and maintenance of establishments, such as the examination of establishment management plans and the evaluation of the results of full safety inspections or full safety examinations conducted under the Special Act on the Safety Control and Maintenance of Establishments;
3. Projects related to underground safety management, such as the examination and re-evaluation of underground safety assessment reports and the underground safety investigation reports after commencement of construction under the Special Act on Underground Safety Management;
4. Research, development, guidance, dissemination, and education of technologies related to the safety and quality control of construction works, the safety and maintenance and management of establishments, and the underground safety management;
5. Tasks incidental to the projects under subparagraphs 1 through 5;
6. Projects incidental to those under subparagraphs 1 through 5;
7. Projects entrusted by the State, local governments, and public institutions under the Act on the Management of Public Institutions;
8. Other projects that KALIS may perform or is entrusted with in accordance with other statutes and regulations.
Article 6(Executive officers) #
(1) KALIS shall have up to 13 directors, including one president, and one auditor.
(2) The president shall represent KALIS and exercise general supervision over its affairs.
Article 7(Appointment and dismissal of employees and appointment of agents) #
(1) The president shall appoint and dismiss employees of KALIS as prescribed by the articles of incorporation.
(2) The president may appoint a representative authorized to do all judicial or extrajudicial acts in connection with the affairs from among the employees, as prescribed by its articles of incorporation.
Article 8(Procurement of funds) #
(1) Funds necessary for the operation and projects of KALIS shall be raised in accordance with the following subparagraphs:
1. Contributions or subsidies from the Government;
2. Contributions and donations from persons (including public enterprises under Article 5(3)1 of the Act on the Management of Public Institutions) other than the Government;
3. Contributions from each mutual-aid association under the Framework Act on the Construction Industry or other organizations prescribed by Presidential Decree;
4. Proceeds from projects under Article 5;
5. Borrowings under Article 12;
6. Funds raised by issuing bonds under Article 13;
7. Other proceeds prescribed by Presidential Decree.
(2) Matters necessary for the management, use, etc. of contributions under paragraph (1) shall be prescribed by Presidential Decree.
Article 9(Subsidies) #
The State may partially subsidize expenses incurred by KALIS in conducting its projects within the budget.
Article 10(Investment) #
(1) KALIS may invest in, or contribute to, the projects under Article 5, if necessary for the efficient conduct of its projects.
(2) Matters necessary for the investment or contribution under paragraph (1) shall be prescribed by Presidential Decree.
Article 11(Collection of fees) #
KALIS may collect fees and other actual expenses with respect to the projects under Article 5 after obtaining approval from the Minister of Land, Infrastructure and Transport.
Article 12(Borrowing of funds) #
(1) KALIS may borrow funds (including funds and commodities borrowed and brought from foreign countries; hereinafter the same shall apply) after obtaining approval from the Minister of Land, Infrastructure and Transport, if necessary for conducting the projects under Article 5.
(2) Where the Minister of Land, Infrastructure and Transport intends to approve the borrowing of funds under paragraph (1), he or she shall consult in advance with the heads of relevant central administrative agencies.
Article 13(Issuance of bonds) #
(1) Where it is urgently necessary to raise funds to ensure the safety of construction works, the safety of establishments, and the underground safety, KALIS may issue bonds after obtaining approval from the Minister of Land, Infrastructure and Transport.
(2) Where the Minister of Land, Infrastructure and Transport intends to approve the issuance of bonds under paragraph (1), he or she shall consult with the Minister of Finance and Economy in advance. <Amended on Oct. 1, 2025>
(3) The State may guarantee the redemption of the principal and interest of bonds issued by KALIS.
(4) A bond claim shall be extinguished by prescription after the lapse of 5 years, in the case of principal, and 2 years, in the case of interest, from the date of redemption.
(5) Other matters necessary for the issuance of bonds shall be prescribed by Presidential Decree.
Article 14(Appropriation of surplus) #
When there is a surplus on the settlement of accounts at the end of each business year, KALIS shall make up for the loss carried forward and accumulate the rest as revenue for the following business year.
Article 15(Gratuitous lending of State property) #
The State may, if necessary for the establishment and operation of KALIS, lend State property and commodities to KALIS or allow KALIS to use them free of charge in accordance with the Act on Regulation of Special Cases concerning State Property.
Article 16(Exemption from obligation to purchase bonds) #
Where KALIS acquires movable property or immovable property for its projects or operation, it shall be exempt from the obligation to purchase various bonds, etc. under other statutes and regulations in the same manner as such exemption is applied to State agencies.
Article 17(Request for provision of data) #
(1) KALIS may request the heads of relevant administrative agencies or the heads of relevant institutions, organizations, etc. to provide necessary data, if necessary for performing its business affairs.
(2) A person who is requested to provide data pursuant to paragraph (1) shall comply with such request unless there is a special reason not to do so.
Article 18(Guidance and supervision) #
(1) The Minister of Land, Infrastructure and Transport shall guide and supervise KALIS with respect to the following business affairs, and may, if deemed necessary, require KALIS to report matters relating to its business affairs, accounting, and property, or require public officials under his or her jurisdiction to inspect books of account, documents, facilities, and other articles of KALIS:
1. Matters regarding the projects directly related to projects entrusted by the Minister of Land, Infrastructure and Transport or directly related to the business affairs under its jurisdiction;
2. Matters regarding the implementation of the management guidelines;
3. Matters regarding the business plan and budgeting for each year;
4. Matters regarding the business performance and settlement of accounts for each year;
5. Other matters prescribed by other statutes and regulations.
(2) When the Minister of Land, Infrastructure and Transport discovers any illegal or unjust fact as a result of a report or inspection under paragraph (1), he or she may order KALIS to correct such fact.
Article 19(Prohibition on confidential information) #
No Any person who works or has worked as an executive officer or employee of KALIS shall divulge or misappropriate any confidential information he or she has learned in the course of performing his or her duties.
Article 20(Legal fiction as public officials in application of penalty provisions) #
The executive officers and employees of KALIS shall be deemed public officials in applying penalty provisions under Articles 129 through 132 of the Criminal Act.
Article 21(Prohibition of use of similar name) #
No person other than KALIS shall use the name "Korea Authority of Land and Infrastructure Safety" or any other similar name.
Article 22(Application mutatis mutandis of the Civil Act) #
Except as provided for in this Act and the Act on the Management of Public Institutions, the provisions of the Civil Act governing incorporated foundations shall apply mutatis mutandis to KALIS.
Article 23(Affiliated organizations) #
(1) KALIS may establish a research institute, education center, and other necessary organizations (hereinafter referred to as "affiliated organizations") under its jurisdiction to efficiently perform the projects under Article 5.
(2) The president of KALIS shall guide and supervise affiliated organizations.
(3) Matters necessary for the establishment and operation of affiliated organizations shall be prescribed by the articles of incorporation of KALIS.
Article 24(Penalty provisions) #
Any person who divulges or misappropriates any confidential information that he or she learned in the course of performing his or her duties, in violation of Article 19, shall be punished by imprisonment with labor for not more than 2 years or by a fine not exceeding 20 million won.
Article 25(Administrative fines) #
(1) Any person who uses the name "Korea Authority of Land and Infrastructure Safety" or any similar name, in violation of Article 21, shall be punished by an administrative fine not exceeding 5 million won.
(2) Administrative fines under paragraph (1) shall be imposed and collected by the Ministry of Land, Infrastructure and Land.
