Article 1(Purpose) #
The purpose of this Act is to provide for matters relating to the establishment, operation and management of multifunction school facilities, and thereby support the educational activities of schools by encouraging the establishment of multifunction school facilities for the joint use of students and community residents, and contribute to the development of schools and communities through the increased use of school facilities.
Article 2(Definitions) #
The terms used in this Act are defined as follows: <Amended on Jan. 21, 2025>
1. The term "school" means any of the following schools:
a. A kindergarten under subparagraph 2 of Article 2 of the Early Childhood Education Act;
b. A school under Article 2 of the Elementary and Secondary Education Act;
c. A school under Article 2 of the Higher Education Act or a school of an equivalent or higher level established under other statutes or regulations;
2. The term "head of the supervisory authority" means any of the following persons, as classified as follows:
a. For schools referred to in subparagraph 1 a.: The head of the supervisory authority under Article 18 (1) of the Early Childhood Education Act;
b. For schools referred to in subparagraph 1 b.: The head of the supervisory authority under Article 6 of the Elementary and Secondary Education Act;
c. For schools referred to in subparagraph 1 c.: Any of the following persons:
1) For national schools established and operated by the State or by a national university corporation: The president;
2) For public schools established and operated by a local government: The president;
3) For private schools established and operated by a school corporation: The chairperson of the board of directors of the school corporation;
3. The term "multifunction school facilities" means a facility installed in a school or a closed school (referring to a closed school under Article 2 subparagraph 1 of the Special Act on the Promotion of Utilization of Abolished School Property; hereinafter the same shall apply) that may be jointly used by students and local residents for purposes of education, culture, welfare, sports, or parking, and is determined through consultation between the head of the local government and the head of the supervisory authority; provided, this shall not apply to facilities under Article 9 of the Educational Environment Protection Act:

Article 3(Responsibilities of the State and local governments) #
(1) The State and local governments shall develop and implement policies necessary for the smooth and efficient establishment and operation of multifunction school facilities.
(2) The State and local governments shall make efforts to establish a harmonious and cooperative relationship between schools and community residents.
(3) The State and local governments shall adopt measures to assure the safety of students from the risks of crimes, safety-related incidents, etc. that could occur due to the establishment of multifunction school facilities.
(4) The State and local governments shall prepare plans for administrative and financial support, such as securing human resources and a budget necessary for fulfilling the responsibilities under paragraphs (1) and (3). <Added on Mar. 23, 2021>
Article 4(Relationship to other statutes) #
This Act shall prevail over other statutes in regard to the establishment, operation and management of multifunction school facilities. In such cases, the School Facilities Projects Promotion Act shall apply mutatis mutandis to matters not provided for in this Act.
Article 5(Installation of multifunction school facilities) #
(1) The head of a local government may install multifunction school facilities in any of the following cases: <Amended on Mar. 23, 2021; Jan. 21, 2025>
1. Where the head of the supervisory authority consents to the installation of multifunction school facilities;
2. Where the head of the supervisory authority requests the installation of multifunction school facilities.
(2) Notwithstanding paragraph (1), the head of the supervisory authority may, if he or she deems it necessary to install multifunction school facilities for educational activities or for promoting the welfare of the local community, install such facility in consultation with the head of the local government. <Added on Mar. 23, 2021; Jan. 21, 2025>
(3) Where a multifunction school facility is to be installed under paragraph (1) or (2), construction work, including the planning, design, and building of the facility, shall be carried out by the relevant installing party under each paragraph; the head of the local government and the head of the supervisory authority may otherwise agree through consultation. <Added on Mar. 23, 2021; Jan. 21, 2025>
(4) Ownership of multifunction school facilities may be determined through consultation between the head of the local government and the head of the supervisory authority, considering the method of construction such as extension, reconstruction, or remodeling, and the ratio of financial contributions; in the case of a private school, such ownership shall be determined through consultation with the school founder. <Added on Mar. 23, 2021; Jan. 21, 2025>
(5) Where a multifunction school facility is installed in a school referred to in Article 2 of the Elementary and Secondary Education Act, the procedures necessary for the implementation of such project shall follow the Act on the School Facilities Projects Promotion Act, unless otherwise provided in this Act. <Added on Mar. 23, 2021; Jan. 21, 2025>
(6) Other matters necessary for the installation of multifunction school facilities shall be prescribed by Presidential Decree. <Added on Mar. 23, 2021>
Article 5-2(Establishment and operation of multifunction school facilities support system) #
(1) The Minister of Education may establish and operate multifunction school facilities support system (hereinafter referred to as the “support system”) to efficiently support the installation and operation of multifunction school facilities by providing information on the status of installation and operation of such facilities and other facilities of similar purpose.
(2) The Minister of Education may request the heads of relevant central administrative agencies, the heads of local governments, or the heads of public institutions to provide information necessary for the establishment and operation of the support system. In such cases, the requested parties shall cooperate unless there is a compelling reason not to do so.
(3) Matters necessary for the establishment and operation of the support system and for requests for information under paragraph (2) shall be prescribed by Decree of the Ministry of Education.

Article 6(Principles for operation and management of multifunction school facilities) #
(1) Multifunction school facilities shall be operated and managed by the person who installed the facility pursuant to Article 5; provided, the head of the local government and the head of the supervisory authority may otherwise agree on a person to operate and manage the facility (hereinafter referred to as the “facility operator”) by considering the primary user area, frequency of use, and usage hours by students or local residents. <Added on Mar. 23, 2021; Jan. 21, 2025>
(2) The facility operator shall maintain and manage multifunction school facilities in a safe and pleasant manner to promote the welfare of students, parents, school staff, and local residents. <Amended on Mar. 23, 2021; Jan. 21, 2025>
(3) The facility operator shall ensure that the curriculum for students, duties of school staff, and other normal educational activities and school operations are not restricted or infringed upon due to the installation or operation of multifunction school facilities. <Amended on Mar. 23, 2021; Jan. 21, 2025>
(4) The facility operator may entrust all or part of the operation and management of multifunction school facilities to a nonprofit corporation or organization, provided that the educational activities and school operations of the relevant school are not restricted or infringed upon. <Amended on Mar. 23, 2021; Jan. 21, 2025>
(5) Other matters necessary for the operation and management of multifunction school facilities shall be prescribed by Presidential Decree. <Amended on Mar. 23, 2021>
Article 6-2(Exemption from liability for proactive administration) #
(1) Where a facility operator or a school staff member of a school in which a multifunction school facility is installed proactively and actively carries out the operation of the multifunction school facility or the management of student safety without willful misconduct or gross negligence, he or she shall not be held liable for any disciplinary action or sanction under relevant statutes or regulations.
(2) Specific criteria and procedures for exemption under paragraph (1) and other necessary matters shall be prescribed by Presidential Decree.

Article 7(Multifunction school facility operation council) #
(1) For the establishment, operation and management of a multifunction school facility, a multifunction school facility operation council (hereinafter referred to as "operation council") composed of students, parents, teachers and staff, community residents, and education and safety experts may be established at each school.
(2) Matters necessary for the composition, operation, etc. of an operation council may be prescribed by ordinance of the local government concerned.
Article 8(Ensuring safety of students) #
(1) Multifunction school facilities shall be installed in accordance with the crime prevention standards for buildings under Article 53-2 of the Building Act, and the safety of students shall be ensured by measures such as separating the movement paths of students from those of local residents and other users of the facility.
(2) The facility operator shall take all necessary measures to ensure the safety of students in accordance with the decisions of the operation council. <Amended on Jan. 21, 2025>
(3) The facility operator may install and manage fixed video surveillance devices referred to in Article 2 subparagraph 7 of the Personal Information Protection Act (hereinafter referred to as “fixed video surveillance devices”) to prevent student safety accidents and create a safe educational environment. <Added on Jan. 21, 2025>
(4) Matters necessary for the designated areas for installation, facility standards, and other related requirements for fixed video surveillance devices shall be prescribed by Ordinance of the Ministry of Education. <Added on Jan. 21, 2025>
(5) Except as otherwise provided in this Act, matters concerning the installation and management of fixed video surveillance devices shall be governed by the Personal Information Protection Act. <Added on Jan. 21, 2025>

Article 9(Specialized institutions) #
(1) The Minister of Education may designate a specialized institution in accordance with Presidential Decree to conduct tasks such as surveys, analyses, research, and advisory services related to the installation and operation of multifunction school facilities. <Amended on Jan. 21, 2025>
(2) The Minister of Education may provide full or partial financial support necessary for a specialized institution to perform the tasks referred to in paragraph (1).

Article 9-2(Multifunction school facilities support centers) #
(1) A superintendent of education may establish or designate multifunction school facilities support center (hereinafter referred to as the “support center” in this Article) to facilitate the installation, operation, and management of multifunction school facilities.
(2) The support center shall perform the following duties:
1. Supporting the formulation of plans for the installation, operation, and management of multifunction school facilities;
2. Supporting the installation, operation, and management of multifunction school facilities;
3. Other duties deemed necessary by the superintendent of education in relation to multifunction school facilities.
(3) A superintendent of education may provide full or partial financial support necessary for the support center to perform the duties referred to in paragraph (2).
(4) Matters necessary for the standards and procedures for the establishment, designation, operation, and revocation of designation of a support center shall be prescribed by Presidential Decree.

Article 10(Special cases concerning subsidies for educational expenses) #
The head of a local government may subsidize all or part of the expenses incurred in the installation, operation, and management of multifunction school facilities to the relevant head of the supervisory authority (excluding the Minister of Education). <Amended on Jan. 21, 2025>

Article 10-2(Support for expenses) #
Where the Minister of Education deems it necessary to achieve the purpose of installing multifunction school facilities, he or she may provide partial financial support for the installation and operation of such facility, as prescribed by Presidential Decree.
