Article 1(Purpose) #
The purpose of this Act is to contribute to the development of agriculture, fisheries, and agricultural and fishing villages, which are the foundation of the State and the national economy, and to the enhancement of the welfare of farmers and fishers, by establishing the Presidential Committee on Agriculture, Fisheries and Rural Policy to consult on the direction of sustainable development of agriculture, fisheries, and agricultural and fishing villages and to respond to the President's requests for advice, and by providing for matters necessary for the composition and operation thereof.
Article 2(Establishment and functions of Committee) #
(1) The Presidential Committee on Agriculture, Fisheries and Rural Policy (hereinafter referred to as the "Committee") shall be established under the jurisdiction of the President.
(2) The Committee shall consult on the following matters:
1. Matters regarding long-term policy directions for the sustainable development of agriculture, fisheries, and agricultural and fishing villages and the realization of their public functions;
2. Matters regarding the regional development of agricultural and fishing villages and the enhancement of welfare;
3. Matters regarding the systematic conservation and efficient use of the ecology, environment, and resources of agricultural and fishing villages;
4. Matters regarding the establishment of autonomous agricultural administration based on local autonomy and decentralization;
5. Matters regarding the nation's food supply through the stable supply of agri-food;
6. Matters regarding surveys and research for the realization of the multi-faceted values of agriculture, fisheries, and agricultural and fishing villages;
7. Matters regarding requests by the chairperson or not less than 1/4 of the incumbent members of the Committee;
8. Matters regarding the inspection and evaluation of action plans and the progress of implementation under subparagraphs 1 through 7;
9. Other matters regarding requests for advice by the President.
Article 3(Composition of Committee) #
(1) The Committee shall be composed of up to 30 members, including 1 chairperson, taking gender into account
(2) The chairperson shall be appointed by the President from among persons who have a high level of understanding and extensive experience in agriculture, fisheries, and agricultural and fishing villages.
(3) Members of the Committee shall be the following persons: <Amended on Oct. 24, 2023; Oct. 1, 2025>
1. The Minister of Economy and Finance, the Minister of Agriculture, Food and Rural Affairs, the Minister of Oceans and Fisheries, the Minister of Planning and Budget, the Minister for Government Policy Coordination, and the Minister of Food and Drug Safety;
2. Persons commissioned by the President from among the following:
a. Not more than 12 representatives of farmers and fishers' organizations, such as producer organizations under subparagraph 4 of Article 3 of the Framework Act on Agriculture, Rural Community and Food Industry and producer organizations under subparagraph 5 of Article 3 of the Framework Act on Fisheries and Fishing Villages Development;
b. Not more than 12 experts in relevant fields (including regional development, education, culture, health and welfare, and science and technology), such as academia, who have extensive expertise and experience in agriculture, fisheries, and agricultural and fishing villages.
(4) Matters necessary for the composition, operation, etc., of the Committee shall be prescribed by Presidential Decree.
Article 4(Term of office of members) #
(1) The term of office of members under Article 3(3)2 (hereinafter referred to as "commissioned members") shall be 2 years and may be renewed; provided, the term of office of a member newly commissioned due to resignation or other reasons shall be the remaining period of the predecessor's term.
(2) A commissioned member may perform his or her duties until a successor is commissioned even after his or her term of office under paragraph (1) expires.
Article 5(Decommissioning of members) #
The President may decommission a commissioned member if the member falls under any of the following:
1. Where the member becomes unable to perform his or her duties due to a mental or physical disability;
2. Where the member engages in any misconduct in relation to his or her duties;
3. Where the member is deemed unfit as a member due to neglect of duties, injury to dignity, or other grounds;
4. Where the member expresses his or her intent that it is impracticable for him or her to perform his or her duties.
Article 6(Duties of chairperson) #
(1) The chairperson shall represent the Committee and exercise general supervision over its business affairs.
(2) When the chairperson is unable to perform his or her duties due to unavoidable circumstances, such duties shall be performed by a commissioned member, in accordance with the order determined in advance by the Committee.
Article 7(Meetings) #
(1) The chairperson shall convene meetings of the Committee and shall preside over such meetings.
(2) Meetings of the Committee shall be convened in any of the following cases:
1. Where the President requests to convene a meeting;
2. Where not less than 1/3 of the incumbent members request to convene a meeting;
3. Other cases where the chairperson deems it necessary.
(3) A majority of the members of the Committee shall constitute a quorum, and any resolution thereof shall require the concurring vote of a majority of those present.
(4) The chairperson may have the head of a relevant administrative agency, public organization, or other agency or organization, or a private expert attend a meeting to hear their opinions, if necessary for the consultation on an agenda item submitted for deliberation.
Article 8(Sectoral committees and special committees) #
(1) The Committee shall have sectoral committees for each field to ensure the efficient operation of the Committee. In such cases, the chairperson of a sectoral committee shall be designated by the chairperson from among commissioned members.
(2) If necessary to deliberate on specific matters among those within its jurisdiction, the Committee may establish special committees to be operated for a specified period.
(3) Matters necessary for the composition and operation of subcommittees and special committees shall be prescribed by Presidential Decree.
Article 9(Secretariat) #
(1) The secretariat shall be established in the Committee to conduct the business affairs of the Committee.
(2) The secretariat shall have 1 director, and the director shall supervise the business affairs of the secretariat and direct and supervise its staff under the direction of the chairperson.
(3) Matters necessary for the organization and operation of the secretariat shall be prescribed by Presidential Decree.
Article 10(Request for dispatch of public officials) #
(1) The Committee may request the dispatch or concurrent appointment of public officials belonging to central administrative agencies and local governments, and executive officers and employees of public institutions, relevant agencies, organizations, or research institutes, if necessary for the operation of the Committee or the performance of the secretariat's business affairs.
(2) The Committee may, if necessary for the operation of the Committee or the performance of the secretariat's business affairs, employ experts in relevant fields as public officials in fixed-term positions within the budget.
Article 11(Request for cooperation from relevant agencies) #
(1) The Committee may hear the opinions of relevant experts with professional knowledge and experience, or request relevant administrative agencies and other agencies, corporations, or organizations for cooperation, such as the submission of materials and presentation of opinions, if necessary to perform its business affairs.
(2) If necessary for the performance of its business affairs, the Committee may commission relevant experts or agencies, corporations, or organizations to conduct specialized investigations or research.
(3) If necessary for the performance of its business affairs, the Committee may collect public opinion through surveys, public hearings, seminars, or similar means.
Article 12(Reporting on results of consultation) #
(1) The chairperson shall report major activities, such as the results of the Committee's consultations, to the President.
(2) The chairperson shall notify relevant administrative agencies of the matters decided by the Committee, urge them to implement such matters, and conduct inspections and evaluations of the progress of implementation.
(3) The Committee shall report its operational results to the Agriculture, Food, Rural Affairs, Oceans and Fisheries Committee of the National Assembly on a semi-annual basis.
Article 13(Period of existence) #
The Committee shall exist until April 24, 2029. <Amended on Oct. 24, 2023>
