Article 1(Purpose) #
The purpose of this Decree is to establish the Presidential Committee on Policy Planning to ensure the smooth and orderly development of the national governance system, to strengthen national policy planning through public participation and communication, and to prescribe matters necessary for its composition and operation.
Article 2(Establishment) #
A Presidential Committee on Policy Planning (hereinafter referred to as the "Committee") shall be established under the jurisdiction of the President to provide advice and suggestions on national policy planning to the President.
Article 3(Functions) #
The Committee shall advise the President on the following matters:
1. Understanding the structure, functions, and budget status of the Government;
2. Setting directions for the Government’s state administration;
3. Establishing medium- and long-term plans for the selection and implementation of major national policies;
4. Other matters necessary for the President's national policy planning.
Article 4(Composition) #
(1) The Committee shall be comprised of up to 55 members, including 1 chairperson and 3 vice chairpersons.
(2) The chairperson, vice chairpersons, and members shall be appointed or commissioned by the President.
(3) The Committee shall have 1 secretary member and 1 spokesperson respectively, with the secretary member designated by the chairperson from among the vice chairpersons, and the spokesperson designated by the chairperson from among the members.
Article 5(Duties of chairperson) #
(1) The chairperson shall have general supervision and control of the duties of the Committee, and direct and supervise the staff of the Committee.
(2) The chairperson shall, from time to time, report to the President on the matters currently being handled by the Committee and receive necessary instructions.
(3) If the chairperson is unable to perform their duties due to any unavoidable cause, a vice chairperson designated by the President shall act on behalf of the chairperson.
Article 6(Operating committee) #
(1) The Committee shall have an operating committee comprised of the chairperson, 3 vice chairpersons, and the chairpersons of subcommittees established under paragraph (2) for the smooth operation of the Committee.
(2) The Committee shall have subcommittees composed of members in order to perform the duties of the Committee by specialized field.
(3) The Committee shall have a working committee comprised of public officials in general service belonging to the Senior Executive Service of the relevant administrative agencies, whose class of duties is Grade A or equivalent thereto, who shall serve as working-level members of the working committee to support the duties of subcommittees. In such cases, the First Deputy Minister of the Office for Government Policy Coordination shall be the chairperson of the working committee.
Article 7(Organization for public participation and communication) #
(1) In order to gather policy ideas and opinions from the public and reflect them in Government policies, etc., a body for public participation and communication (hereinafter referred to as the "Public Participation Body") shall be established within the Committee.
(2) The Public Participation Body shall appoint the following persons as operating committee members and other personnel to facilitate discussion, evaluation, and other related tasks regarding submitted policy ideas and opinions:
1. A person commissioned by the chairperson from among the citizens who have participated in policy proposals;
2. A member appointed by the chairperson;
3. A secretary who assists with related duties of the Office of the President;
4. Persons appointed or commissioned by the chairperson from among public officials belonging to the relevant administrative agencies or persons who have extensive knowledge of and experience in public participation and communication.
Article 8(Operation) #
(1) The chairperson may convene meetings of the Committee when deemed necessary and shall preside over such meetings.
(2) A resolution of a meeting of the Committee shall require the concurring vote of a majority of all incumbent members.
(3) The chairperson may, when deemed necessary for the efficient operation of the Committee, hold meetings in private upon resolution by the Committee.
Article 9(Secretariat) #
The Committee may establish a secretariat to efficiently perform its duties.
Article 10(Staff) #
(1) The Committee may have staff members, such as expert members, advisory members, and clerical staff, to efficiently perform its duties.
(2) Staff members, such as expert members, advisory members, and clerical staff, shall be appointed or commissioned by the chairperson.
(3) Expert members shall assist the chairperson, vice chairpersons, and members, and shall perform their duties under the subcommittees or secretariat to which they belong.
(4) If deemed necessary for the performance of its duties, the Committee may request that public officials of relevant administrative agencies or executive officers and staff of relevant organizations concurrently serve as expert members, advisory members, clerical staff, or other staff, or be assigned to the Committee, with the consent of the head of their respective agencies or organizations. In such cases, the heads of the relevant agencies or organizations shall comply with such requests unless there is a compelling reason not to do so.
Article 11(Grounds for disqualification of members) #
No person who falls under any subparagraph of Article 33 of the State Public Officials Act shall become the chairperson, the vice chairperson, a member, or a staff member of the Committee.
Article 12(Prohibition of divulgence of confidential information and abuse of authority) #
The chairperson, vice chairpersons, members, working-level members, and staff of the Committee (including operating committee members, etc. belonging to the Public Participation Body under Article 7 (2)), as well as any persons who formerly held such positions, shall not disclose to others any confidential information they have become aware of in the course of performing their duties or use such information for purposes other than those related to the Committee's duties, nor shall they abuse their authority.
Article 13(Support for Committee activities) #
(1) The Minister of the Interior and Safety shall provide support for the following matters to ensure the smooth operation of the Committee:
1. Necessary measures including office space, equipment, communication services, and vehicles;
2. Budget support necessary for the establishment and operation of the Committee;
3. Support for the establishment and operation of a participation platform for the operation of the Public Participation Body;
4. Other matters necessary for the operation of the Committee.
(2) The head of a relevant agency shall provide the cooperation necessary for efficient operation of the Committee, such as submission of materials, information, or opinions and securing of budgets.
Article 14(Allowances) #
Allowances, travel expenses, and other necessary expenses may be paid to the chairperson, vice chairpersons, members, working-level members, staff, etc. of the Committee within the budget.
Article 15(Publication of white paper) #
The Committee shall prepare a white paper with regard to the progress of its activities and the details of budget execution and shall disclose it within 30 days from termination of its activities.
Article 16(Term of existence) #
The Committee shall remain in existence for a period not exceeding 60 days from the date it is established and begins operation; provided, if deemed necessary, the term of existence of the Committee may be extended by up to 20 days, with the resolution of the Committee and the approval of the President.
Article 17(Detailed operating rules) #
Except as provided in this Decree, matters necessary for the composition, operation, etc. of the Committee shall be determined by the chairperson following a resolution by the Committee.
