Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Craft Industry Promotion Act and matters necessary for the enforcement thereof.
Article 2(Modification to Minor Matters) #
"Minor matters prescribed by Presidential Decree" in the proviso of Article 5 (6) of the Craft Industry Promotion Act (hereinafter referred to as the "Act") means matters falling under Article 5 (2) 3, 4, 6, or 9 of the Act.
Article 3(Craft Industry Promotion Committee) #
(1) Members of the Craft Industry Promotion Committee established under Article 6 of the Act (hereinafter referred to as the "Committee") shall be commissioned by the Minister of Culture, Sports and Tourism from among the following persons:
1. A person who majored in any study related to the craft industry at a university or college defined in subparagraph 1 of Article 2 of the Higher Education Act and then who has been working or worked for at least 5 years as an associate professor or in a position equivalent thereto at a school under the subparagraphs of that Article or an officially recognized research institute;
2. A person who has been working or worked in the field related to the craft industry for at least 10 years.
(2) Where the chairperson of the Committee (hereinafter referred to as "chairperson") is unable to perform his or her duties for unavoidable reasons, the vice chairperson shall act on behalf of the chairperson, and where both the chairperson and the vice-chairperson are unable to perform their duties for unavoidable reasons, the Committee members shall act on their behalf in the order of seniority.
(3) The chairperson shall convene and preside over the meetings of the Committee.
(4) A majority of the members of the Committee shall constitute a quorum, and any resolution thereof shall require the concurring vote of at least a majority of those present.
(5) Allowances, travel expenses, and other necessary expenses may be paid to members who attend a meeting of the Committee within budgetary limits.
(6) Except as provided in paragraphs (1) through (5), matters necessary for the composition and operation of the Committee shall be determined by the chairperson following a resolution by the Committee.
Article 4(Dismissal of Members) #
Where a member falls under any of the following subparagraphs, the Minister of Culture, Sports and Tourism may dismiss the relevant member:
1. Where he or she becomes unable to perform his or her duties due to a mental or physical disorder;
2. Where he or she has committed any misconduct in connection with his or her duties;
3. Where it is deemed inappropriate for the member to retain his or her position due to neglect of duties, injury to dignity, or any other reason;
4. Where the member voluntarily declares that it is impracticable for him or her to perform the duties.
Article 5(Details of Fact-Finding Surveys) #
(1) A fact-finding survey under Article 7 (1) of the Act (hereinafter referred to as "fact-finding survey") shall include the following:
1. The current market status of the craft industry;
2. The current status of human resources who have been working in the craft industry and the supply and demand therefor;
3. The current status of facilities related to the craft industry and the operation thereof;
4. Overseas market trends of the craft culture industry;
5. Other matters for which the Minister of Culture, Sports and Tourism deems it necessary to conduct a fact-finding survey in order to promote the craft industry.
(2) Fact-finding surveys shall be classified into regular surveys and occasional surveys, and regular surveys shall be conducted every 3 years, and occasional surveys shall be conducted when deemed necessary by the Minister of Culture, Sports and Tourism to formulate and implement a basic plan for the promotion of the craft industry and a detailed implementation plan under Article 5 of the Act.
(3) To ensure an efficient fact-finding survey, the Minister of Culture, Sports and Tourism may request that an institution or organization with expertise in the craft industry research conduct such survey.
Article 6(Support for Business Start-Up and Production) #
(1) The scope of business start-up eligible for support from the Minister of Culture, Sports and Tourism under Article 8 (1) of the Act shall be as follows:
1. Business start-up for the development of craft techniques and materials;
2. Business start-up for the development and production of craft goods;
3. Business start-up for the distribution and export of craft goods;
4. Other business start-up deemed necessary by the Minister of Culture, Sports and Tourism to support for the promotion of the craft industry.
(2) The scope of production eligible for support from the Minister of Culture, Sports and Tourism, the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") under Article 8 (2) of the Act shall be as follows:
1. Production of craft goods designated as excellent craft goods under Article 14 (1) of the Act;
2. Production of local craft goods under Article 18 of the Act;
3. Production of craft goods developed to be exhibited in a sample market, demonstration, exhibition, etc. on an international scale;
4. Production of other craft goods with high cultural value, recognized by the Minister of Culture, Sports and Tourism or a Mayor/Do Governor.
(3) The Minister of Culture, Sports and Tourism or a Mayor/Do Governor shall select persons eligible for support under Article 8 by means of a public contest, and may organize an examination committee for the selection of persons eligible for support or request a specialized institution to conduct an examination.
Article 7(Designation of Institutions for Training Professionals) #
(1) The State or the head of a local government may designate an institution for training professionals in the craft industry under Article 9 (2) of the Act (hereinafter referred to as "institution for training professionals") from among the following facilities, institutions, or organizations: <Amended on Feb. 17, 2022>
1. A school defined in Article 2 of the Higher Education Act, which operates a curriculum related to the craft industry;
2. A non-profit corporation established for the main purpose of promoting the craft industry pursuant to Article 32 of the Civil Act;
3. A facility or organization that operates curriculum related to the craft industry as a facility for culture and arts education or an organization for culture and arts education defined in subparagraph 3 or 4 of Article 2 of the Culture and Arts Education Support Act;
4. A vocational skills development training establishment defined in subparagraph 3 of Article 2 of the National Lifelong Vocational Skills Development Act, which operates training courses related to the craft industry;
5. An institution designated as an institution dedicated to the promotion of the craft industry under Article 16 (1) of the Act (hereinafter referred to as "dedicated institution").
(2) The standards for designating an institution for training professionals shall be as follows:
1. To provide appropriate educational curriculum and content;
2. To secure at least 1 full-time faculty member;
3. To secure educational facilities and equipment necessary for training professionals, such as educational facilities with an area exceeding the area prescribed by Ordinance of the Ministry of Culture, Sports and Tourism;
4. To have the ability to fund operating expenses.
(3) A facility, institution or organization that intends to be designated as an institution for training professionals pursuant to paragraph (1) shall file an application for designation as an institution for training professionals, as prescribed by Ordinance of the Ministry of Culture, Sports and Tourism.
(4) Where the State or the head of a local government designates an institution for training professionals pursuant to paragraph (1), such fact shall be published on the website.
Article 8(Support for Quality Improvement and Technique Development of Craft Goods) #
(1) The following shall be eligible for support under Article 10 (1) of the Act:
1. Development of forms of craft goods;
2. Establishment of database on craft materials and raw materials;
3. Development of handling techniques of craft materials and raw materials;
4. Development of facilities and equipment for producing craft goods;
5. Other matters requiring support for the improvement of the quality of craft goods and the development of craft techniques.
(2) The Minister of Culture, Sports and Tourism shall select persons eligible for support under paragraph (1) by means of a public contest, and may organize an examination committee for the selection of persons eligible for support or request a specialized institution to conduct an examination.
(3) The following shall be eligible for support under Article 10 (2) of the Act:
1. Fields related to the stable securing of materials necessary for the production of craft goods, such as joint purchase;
2. Research and development of materials that can replace the raw materials of craft goods;
3. Other fields related to the smooth supply and demand for the raw materials of craft goods.
(4) Paragraph (2) shall apply mutatis mutandis to the procedures for providing support under paragraph (3).
Article 9(Designation of Institutions Dedicated to Development of Craft Techniques) #
(1) The Minister of Culture, Sports and Tourism may designate any of the following institutions, corporations, or organizations as an institution entrusted with and dedicated to any affairs related to projects for improving the quality of craft goods and developing craft techniques under Article 10 (3) of the Act (hereafter referred to as "institution dedicated to the development, etc. of craft techniques" in this Article): <Amended on Jul. 9, 2019>
1. A public institution under the Act on the Management of Public Institutions;
2. A non-profit corporation established under Article 32 of the Civil Act, which is deemed to have professionals and a dedicated organization necessary for any affairs related to projects for improving the quality of craft goods and developing craft techniques;
3. An institution designated as a dedicated institution;
4. Other non-profit organizations publicly notified by the Minister of Culture, Sports and Tourism as deemed capable of undertaking projects for improving the quality of craft goods and developing craft techniques.
(2) Any person who intends to be designated as an institution dedicated to the development, etc. of craft techniques pursuant to paragraph (1) shall submit documents regarding the following matters to the Minister of Culture, Sports and Tourism:
1. The current status of securing human resources dedicated to the development of craft techniques;
2. The current status of possessing craft techniques;
3. The current status of possessing facilities necessary for the operation of an organization dedicated to projects for improving the quality of craft goods and developing craft techniques;
4. Detailed plans for projects for improving the quality of craft goods and developing craft techniques;
5. Plans for funding operating expenses.
(3) The standards for designating an institution dedicated to the development, etc. of craft techniques shall be as follows:
1. To have at least 5 human resources dedicated to the development of craft techniques with at least 10 years' current or previous work experience in the field related to the craft industry;
2. To have an appropriate system for craft technique evaluation and technical guidance;
Article 10(Support for Facilitation of International Exchanges and Advancement into Overseas Markets) #
(1) In order to promote the craft industry under Article 13 (1) of the Act, the Minister of Culture, Sports and Tourism may fully or partially subsidize expenses incurred in implementing the following projects so that international exchanges and advancement into overseas markets can be facilitated:
1. Projects to publicize the excellence of Korean crafts;
2. Education, survey and research projects for the globalization of Korean crafts;
3. Projects to support the hosting and participation of domestic and international craft-related expositions, sales exhibitions, etc.;
4. Other projects for which support is deemed necessary by the Minister of Culture, Sports and Tourism to facilitate international exchanges in the craft industry and advancement into overseas markets.
(2) The Minister of Culture, Sports and Tourism shall select persons eligible for support under paragraph (1) by means of a public contest, and may organize an examination committee for the selection of persons eligible for support or request a specialized institution to conduct an examination; provided, in cases of projects undertaken under a memorandum of understanding, an agreement, etc. with a foreign country or a foreign institution or organization, the Minister of Culture, Sports and Tourism need not hold a public contest.
Article 11(Designation of Excellent Craft Goods) #
(1) A person who intends to have his or her craft goods designated as excellent under Article 14 (1) of the Act (hereinafter referred to as "excellent craft goods") shall submit an application for designation prescribed by Ordinance of the Ministry of Culture, Sports and Tourism to the Minister of Culture, Sports and Tourism.
(2) The standards for designating excellent craft goods shall be as follows:
1. Craft goods which are designed and produced by nationals of the Republic of Korea;
2. Craft goods, the process of which consists of at least 50/100 of manual work;
3. Conditions in place, such as stocks available for sale or facilities to produce them;
4. Craft goods in which Korean cultural elements are embedded, with excellent production techniques and finishing conditions;
5. Beautiful and unique appearance elements of craft goods, such as form, shape and color;
6. Competitiveness in the market of craft goods;
7. Craft goods, the safety of which is assured.
(3) Notwithstanding paragraph (2), any of the following craft goods shall be excluded from designation as excellent craft goods:
1. Pure art works;
2. Craft goods bearing the trademark of an overseas orderer;
3. Craft goods which are, or are likely to be, in a legal dispute at home and abroad.
(4) Where necessary for the designation of excellent craft goods, the Minister of Culture, Sports and Tourism may hear the opinions of relevant experts.
(5) The Minister of Culture, Sports and Tourism who designates excellent craft goods shall publicly announce such fact in the Official Gazette, daily newspapers, websites, etc.
(6) The Minister of Culture, Sports and Tourism may authorize a dedicated institution to designate excellent craft goods.
(7) Except as provided in paragraphs (1) through (6), matters necessary for the designation of excellent craft goods shall be prescribed by Ordinance of the Ministry of Culture, Sports and Tourism.
Article 12(Effective Period of Designation of Excellent Craft Goods) #
(1) The effective period of designation of excellent craft goods shall be 3 years from the date of designation.
(2) The Minister of Culture, Sports and Tourism may extend the effective period of designation of excellent craft goods under paragraph (1) only once by up to 2 years, where receiving an application for the extension of the effective period not later than 30 days before the expiration of such period.
Article 13(Labeling of and Support for Excellent Craft Goods) #
(1) Pursuant to Article 14 (2) of the Act, a label prescribed by Ordinance of the Ministry of Culture, Sports and Tourism may be attached to the relevant craft goods designated as excellent craft goods, their packages, promotional materials, etc.
(2) The Minister of Culture, Sports and Tourism may provide the following support pursuant to Article 14 (3) of the Act:
1. Support for the branding of excellent craft goods;
2. Support for establishing and operating permanent exhibition halls and sales shops for excellent craft goods;
3. Support for securing intellectual property rights of excellent craft goods;
4. Support for promoting the purchase of excellent craft goods and securing the market.
Article 14(Designation and Operation of Dedicated Institutions) #
(1) The Minister of Culture, Sports and Tourism may designate any of the following institutions, etc. as a dedicated institution pursuant to Article 16 (1) of the Act:
1. A public institution under the Act on the Management of Public Institutions, which performs affairs related to the craft industry;
2. A non-profit corporation established with the main purpose of promoting the craft industry pursuant to Article 32 of the Civil Act, which is deemed to have professionals and a dedicated organization necessary for promoting the craft industry.
(2) The Minister of Culture, Sports and Tourism who designates a dedicated institution pursuant to paragraph (1) shall publicly notify such fact in the Official Gazette.
Article 15(Promotion of Local Craft Goods) #
"Matters prescribed by Presidential Decree" in Article 18 (1) of the Act means the following:
1. Participation in regional craft exhibitions or expositions;
2. Sales in connection with local festivals;
3. Sales in connection with local tourism resources.
Article 16(Entrustment of Authority) #
The Minister of Culture, Sports and Tourism shall entrust the following affairs to a dedicated institution pursuant to Article 20 (2) of the Act:
1. Support for business start-up and production under Article 8 of the Act;
2. Support for facilitating international exchanges and advancement into overseas markets under Article 13 (1) of the Act.
Article 17(Criteria for Imposition of Administrative Fines) #
The criteria for imposing administrative fines under Article 22 (1) of the Act shall be as specified in the attached Table.
