Article 1(Purpose) #
The purpose of this Decree is to provide for matters delegated by the School Sports Promotion Act and matters necessary for its enforcement.
Article 2(Basic policies for promotion of school sports) #
(1) Basic policies for the promotion of school sports under Article 4(1) of the School Sports Promotion Act (hereinafter referred to as the "Act") shall include the following: <Amended on Apr. 20, 2021>
1. Matters concerning mid- to long-term policy goals and basic directions for the promotion of school sports;
2. Matters concerning the establishment of foundations for and revitalization of school sports;
3. Matters concerning the expansion of investment and necessary financial resources for the promotion of school sports;
4. Matters concerning the analysis and evaluation of policies for the promotion of school sports;
4-2. Matters concerning the protection of human rights of student athletes;
5. Other matters necessary for the promotion of school sports.
(2) When the Minister of Education establishes basic policies under paragraph (1), he or she shall notify the following persons of the details thereof: <Amended on Mar. 23, 2013>
1. Special Metropolitan City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, Do Governor, and Special Self-Governing Do Governor;
2. Superintendents of education of a Special Metropolitan City, Metropolitan City, Special Self-Governing City, Do, and Special Self-Governing Do (hereinafter referred to as "superintendent of education").
Article 2-2(Supervision of measures for promotion of school sports) #
(1) The Minister of Education and the superintendent of education shall supervise the measures for the promotion of school sports under Article 6(1) at least once every year pursuant to Article 6(3) of the Act.
(2) Supervision under paragraph (1) shall be conducted through written inspection; provided, field inspection may be conducted if necessary.

Article 2-3(Installation of fixed visual information processing devices) #
Points where fixed visual information processing devices may be installed pursuant to Article 7(3) of the Act are as follows: <Amended on Sep. 12, 2023>
1. Indoor and outdoor training grounds (including rooms for school sports instructors and conference rooms);
2. Entrance doors, corridors, parking lots, and major intersections of dormitories and training facilities for student athletes;
3. Facilities used by many people, such as cafeterias and auditoriums of dormitories and training facilities for student athletes.

Article 3(Qualification standards for school sports instructors) #
(1) The head of a school may appoint a school sports instructor from among sports instructors under subparagraph 6 of Article 2 of the National Sports Promotion Act pursuant to Article 12(7) of the Act. <Amended on Oct. 28, 2014>
(2) The salary of a school sports instructor shall be determined by the head of the school in consideration of his or her instruction experience and performance.
(3) A school sports instructor shall perform the following duties: <Amended on Apr. 20, 2021>
1. Preparation of training plans for student athletes, and instruction and management thereof;
2. Support for participation of student athletes in various competitions and leading them;
2-2. Safety management of student athletes during training and participation in various competitions;
3. Analysis of performance and preparation of training logs;
4. Safety management of training grounds.
(4) When the head of a school reappoints a school sports instructor, he or she shall decide whether to reappoint the instructor after evaluating the following: <Amended on Apr. 20, 2021>
1. Performance of duties under each subparagraph of paragraph (3);
2. Attitude toward service;
3. Performance of operation of the school sports team;
4. Whether there is any infringement on the right to learn and human rights of student athletes.
Article 3-2(Anti-doping education) #
(1) Anti-doping education under Article 12-2(1) of the Act (hereinafter referred to as "anti-doping education") shall be conducted by the Minister of Education and the superintendent of education.
(2) Anti-doping education shall be conducted at least once every year.
(3) Anti-doping education shall include the concept of doping, information on prohibited substances, and doping-related regulations.
(4) Anti-doping education may be conducted through various methods, such as field trips, experiential activities, or distance education using information and communications media.

Article 3-3(Human rights education in sports field) #
(1) Human rights education in the sports field under Article 12-3(1) of the Act shall include the following:
1. Types of human rights violations in the sports field;
2. Matters concerning the prevention of human rights violations in the sports field;
3. Methods of responding to and reporting the occurrence of human rights violations in the sports field;
4. Major systems and cases related to human rights violations in the sports field;
5. Other matters recognized as necessary for the protection of human rights of student athletes by the Minister of Education or the superintendent of education.
(2) Human rights education under paragraph (1) shall be conducted at least once every semester for at least one hour per session.
(3) When the Minister of Education and the superintendent of education take measures for psychological treatment and safety under Article 12-3(2) of the Act, they shall have experts in the relevant field participate therein.

Article 4(Qualification standards for sports instructors) #
(1) The head of an elementary school may appoint a sports instructor from among sports instructors under subparagraph 6 of Article 2 of the National Sports Promotion Act pursuant to Article 13(2) of the Act. <Amended on Oct. 28, 2014>
(2) The head of an elementary school may appoint a sports instructor by entering into a contract on a 1-year basis.
(3) When the head of an elementary school reappoints a sports instructor, he or she shall decide whether to reappoint the instructor after evaluating the following:
1. Qualifications as an instructor;
2. Attitude toward service;
3. Satisfaction of students.
Article 5(Entities entrusted with operation of physical activity programs for infants and students with disabilities) #
Pursuant to Article 14(2) of the Act, the head of a kindergarten and the head of a school may entrust the operation of physical activity programs for infants and students with disabilities to any of the following institutions or organizations among specialized institutions or organizations related to school sports: <Amended on Mar. 23, 2013>
1. An institution or organization selected by the Minister of Education, the Minister of Culture, Sports and Tourism, or the superintendent of education through deliberation by the Central School Sports Promotion Committee or a Regional School Sports Promotion Committee under Article 16 of the Act;
2. A university that operates a department of physical education among universities under subparagraph 1 of Article 2 of the Higher Education Act.
Article 6(Composition of Central School Sports Promotion Committee) #
(1) The Central School Sports Promotion Committee under Article 16 of the Act (hereinafter referred to as the "Central Committee") shall be composed of not more than 25 members, including 1 chairperson and 2 vice chairpersons.
(2) The chairperson shall be jointly appointed by the Minister of Education and the Minister of Culture, Sports and Tourism from among members who are not public officials. <Amended on Mar. 23, 2013>
(3) Vice chairpersons shall be director-general level public officials in charge of school sports at the Ministry of Education and the Ministry of Culture, Sports and Tourism, who are designated by the head of the relevant institution. <Amended on Mar. 23, 2013>
(4) Members shall be jointly appointed or commissioned by the Minister of Education and the Minister of Culture, Sports and Tourism from among any of the following persons, in consideration of gender: <Amended on Mar. 23, 2013>
1. A person recommended by a sports organization under subparagraph 9 of Article 2 of the National Sports Promotion Act;
2. A person recommended by an education or sports-related organization among non-profit private organizations under Article 2 of the Assistance for Non-Profit, Non-Governmental Organizations Act;
3. A director level public official in charge of school sports at the offices of education of a Special Metropolitan City, Metropolitan City, Special Self-Governing City, Do, and Special Self-Governing Do;
4. Other persons with extensive knowledge of and field experience in school sports.
(5) The term of office of the chairperson and the commissioned members under paragraph (4) shall be 2 years.
(6) To conduct the affairs of the Central Committee, 2 executive secretaries shall be assigned to the Central Committee, and the executive secretaries shall be director level public officials in charge of school sports at the Ministry of Education and the Ministry of Culture, Sports and Tourism, who are designated by the head of the relevant institution. <Amended on Mar. 23, 2013>
Article 7(Exclusion, challenge, and avoidance of members) #
(1) A member of the Central Committee shall be excluded from the deliberation and resolution of the Central Committee in any of the following cases:
1. Where a member or his or her spouse or former spouse becomes a party to the relevant agenda item (including executive officers where the party is a corporation or organization; hereinafter the same shall apply in this subparagraph and subparagraph 2) or is a joint holder of rights or a joint obligor with a party to the agenda item;
2. Where a member is a relative of a party to the relevant agenda item;
3. Where a member has given testimony or statement, or has provided consultation, research, service, or appraisal regarding the relevant agenda item;
4. Where a member or a corporation or organization to which a member belongs is or was a representative of a party to the relevant agenda item.
(2) A party to the relevant agenda item may apply for a challenge against a member to the Central Committee if there are circumstances that make it difficult to expect fair deliberation and resolution from the member, and the Central Committee shall decide thereon by resolution. In such cases, the member who is the subject of the application for challenge shall not participate in the resolution.
(3) Where a member falls under any cause for exclusion under the subparagraphs of paragraph (1), he or she shall voluntarily avoid the deliberation and resolution of the relevant agenda item.
Article 8(Decommissioning of members) #
The chairperson may decommission a member if the member falls under any of the following subparagraphs:
1. Where the member becomes unable to perform his or her duties due to a mental or physical disability;
2. Where the member is deemed unfit to serve due to negligence of duty, damage to dignity, or other reasons;
3. Where the member fails to avoid deliberation and resolution, despite falling under any of the subparagraphs of Article 7(1).
Article 9(Duties of chairperson) #
(1) The chairperson shall represent the Central Committee and supervise the overall affairs of the Central Committee.
(2) Where the chairperson is unable to perform his or her duties due to inevitable circumstances, the vice chairperson who is a director-general level public official of the Ministry of Education, and the vice chairperson who is a director-general level public official of the Ministry of Culture, Sports and Tourism, shall act for the chairperson in that order. <Amended on Mar. 23, 2013>
Article 10(Operation of Central Committee) #
(1) The chairperson shall convene meetings of the Central Committee and shall be the presiding officer thereof.
(2) A meeting of the Central Committee shall open with the attendance of a majority of the members on the register and shall pass a resolution with the affirmative vote of a majority of the members present.
(3) Where necessary to efficiently conduct the affairs of the Central Committee, a subcommittee may be established under the Central Committee.
(4) Members who attend the Central Committee may be paid allowances and travel expenses within the budget; where a member who is a public official attends a meeting in direct connection with his or her duties under his or her jurisdiction, allowances and travel expenses shall not be paid.
(5) Matters necessary for the composition and operation of the Central Committee and subcommittees, other than those provided for in this Decree, shall be determined by the chairperson through a resolution by the Central Committee.
Article 11(Delegation of authority) #
The Minister of Education shall delegate the following authority to the superintendent of education pursuant to Article 19 of the Act:
1. Supervision of measures for the promotion of school sports under Article 6(3) of the Act;
2. Human rights education in the sports field under Article 12-3(1) of the Act;
3. Psychological treatment and safety measures under Article 12-3(2) of the Act.
