Article 1(Purpose) #
The purpose of this Decree is to prescribe matters delegated by the Act on the Establishment and Administration of Incheon National University and matters necessary for its enforcement.
Article 2(Registration for incorporation) #
The matters to be registered for establishment under Article 4(2) of the Act on the Establishment and Administration of Incheon National University (hereinafter referred to as the "Act") shall be as follows:
1. Purpose;
2. Name;
3. Location of the principal office;
4. Names and addresses of executive officers;
5. Total amount of assets.
Article 3(Registration for relocation) #
If Incheon National University, a national university corporation relocates its principal office, it shall register the new location and the date of relocation at the previous location or the new location within 3 weeks after such relocation.

Article 4(Registration of changes) #
Incheon National University, a national university corporation shall register the changed matters at the location of its principal office within 3 weeks after such changes are made, if any matter subject to registration under any subparagraph of Article 2 is changed (excluding cases falling under relocation registration under Article 3).

Article 5(Documents to accompany application for registration) #
Each application for registration under Articles 2 through 4 shall be accompanied by the following documents:
1. Registration of incorporation under Article 2: Articles of incorporation of Incheon National University, a national university corporation;
2. Registration of relocation under Article 3: documents certifying the relocation of the principal office;
3. Registration of changes under Article 4: documents certifying the changes.
Article 6(Calculation of period for registration) #
Where a matter to be registered under Articles 2 through 4 requires authorization or approval from the Minister of Education, the period for registration shall commence from the date on which the written authorization or approval is received. <Amended on Mar. 23, 2013>
Article 6-2(Formulation of appointment plans for gender equality) #
(1) The classification by academic field for formulating plans necessary to implement affirmative measures, such as appointment plans for gender equality at universities under the former part of Article 6-2(3) of the Act (hereinafter referred to as "gender equality action plan"), shall be based on the classification by academic field in Appendix 1 to the Regulations on the Establishment and Operation of Universities and Colleges.
(2) The President shall formulate a plan for gender equality measures and submit it to the Minister of Education by October 31 of the year preceding the year of implementation, and shall submit the implementation results to the Minister of Education by December 31 of each year.
(3) When the Minister of Education evaluates a gender equality action plan and the performance results thereof under Article 6-2(4) of the Act, the evaluation shall be conducted in writing in principle; if necessary, on-site evaluation may be conducted concurrently.

Article 6-3(Standards for permission for concurrent service as outside director by professors) #
(1) Where the president intends to grant permission for concurrent service as an outside director to a professor, associate professor, or assistant professor under Article 6-3(1) of the Act, the president shall undergo deliberation by the Faculty Personnel Committee under Article 53-4(1) of the Private School Act, which applies mutatis mutandis pursuant to Article 6(3) of the Act, regarding the following matters:
1. Necessity of concurrent service;
2. Appropriateness of the period of concurrent service;
3. Suitability of the enterprise for which concurrent service is to be performed;
4. Other matters the president considers necessary to ensure that education and guidance of students and academic research are not hindered.
(2) Where a professor, associate professor, or assistant professor concurrently serving as an outside director reports the total amount of remuneration received from the relevant private enterprise for the relevant year under Article 6-3(2) of the Act, the person shall obtain from the relevant private enterprise and submit to the president documents containing the following payment details as of December 31 of the relevant year:
1. Monthly payment details of the total remuneration for the relevant year;
2. Payment details by item, including transportation expenses and meeting allowances.
(3) In addition to matters prescribed in paragraph (1), detailed matters necessary for permission for concurrent service shall be determined by the president.

Article 7(Grounds for disqualification) #
(1) "Grounds prescribed by Presidential Decree" in Article 14(2) of the Act means cases where a person violates provisions prescribed by the Act, this Decree, or the Higher Education Act, or fails to comply with an order issued thereunder.
(2) Revocation of approval for appointment of an executive officer on the grounds under paragraph (1) may be made only where the relevant person fails to comply with a request for correction within 15 days from the date on which the Minister of Education requests such correction on those grounds. <Amended on Mar. 23, 2013>
Article 8(Gratuitous transfer of public property) #
(1) Where a local government gratuitously transfers public property and goods to Incheon National University, a national university corporation under the former part of Article 21(1) of the Act, the ledger value of such property and goods shall be deemed the value thereof.
(2) When the Minister of Education holds consultations under the latter part of Article 21(1) of the Act, the Minister shall submit to and consult with the Minister of the Interior and Safety, by no later than 3 months before the scheduled date of registration of incorporation of Incheon National University, a national university corporation, documents stating the following matters: <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
1. Description, quantity, value, current status, and use of public property and goods;
2. Purpose or grounds for gratuitous transfer;
3. In cases of public property and goods for which a plan has been formulated for use in education, research, community service, industry-academia cooperation, and welfare benefits for students and faculty members and staff members, matters concerning financing necessary for implementation of such plan, including the utilization plan and budget statement therefor;
4. Other matters requiring consultation in connection with gratuitous transfer.
(3) Gratuitous lease, use, or profit-making of public property and goods under Article 21(3) of the Act shall be governed by a lease agreement or use and profit-making agreement entered into between the relevant local government and Incheon National University, a national university corporation.
Article 9(Application of the Public Property and Commodity Management Act) #
Except as otherwise prescribed in this Decree, procedures for gratuitous transfer, gratuitous loan, or gratuitous use and profit-making of public property and goods under Article 21(1) and (3) of the Act shall be governed by the Public Property and Commodity Management Act.
Article 10(Long-term borrowing and issuance of school bonds) #
(1) Where Incheon National University, a national university corporation intends to make long-term borrowing with a repayment period of at least 1 year or issue school bonds under the main clause of Article 24(1) of the Act, it shall obtain approval in advance from the Minister of Education by furnishing documents classified as follows after undergoing a resolution of the board of directors: <Amended on Mar. 23, 2013>
1. In cases of long-term borrowing:
a. Documents stating the amount to be borrowed, lender, and grounds for borrowing;
b. Documents stating the repayment method and repayment plan;
c. A copy of the minutes of the board of directors meeting;
2. In cases of issuance of school bonds:
a. Documents stating the limit on issuance of school bonds, persons subject to subscription, and grounds for issuance;
b. Documents referred to in subparagraph 1b and c.
(2) "Minor matters prescribed by Presidential Decree" in the proviso of Article 24(1) of the Act means long-term borrowing satisfying all of the following requirements:
1. The ratio of total borrowings (including the amount planned to be borrowed; hereinafter the same shall apply) to the basic property of the corporation accounting under Article 18(1) of the Act shall be less than 20 percent;
2. Total borrowings shall be less than 20 billion won;
3. Long-term borrowing with a repayment period of at least 1 year shall be made from a financial institution under any item of subparagraph 1 of Article 2 of the Act on the Structural Improvement of the Financial Industry.
(3) The basic property referred to in paragraph (2)1 shall mean net assets obtained by subtracting total liabilities from total assets, which constitute the value of fundamental assets continuously invested and operated in Incheon National University, a national university corporation.
Article 11(Submission of budget draft and settlement report) #
(1) Pursuant to Article 25(1) of the Act, the president shall submit to the Minister of Education, by no later than 5 days before the commencement of each fiscal year, a revenue and expenditure budget draft accompanied by the following documents: <Amended on Mar. 23, 2013>
1. General provisions of the budget;
2. A table of remuneration for staff members (including allowances);
3. A table of organization and fixed number of personnel;
4. A copy of the minutes of the board of directors meeting;
(2) When the president submits a settlement report to the Minister of Education under Article 25(2) of the Act, the president shall attach the following documents thereto: <Amended on Mar. 23, 2013>
1. Financial statements, including the statement of operations and the statement of financial position for the relevant year;
2. Comparative table of a business plan for the relevant year and the result of the execution thereof;
3. A letter of opinion and audit report issued by the accounting firm that conducted the audit for the relevant year;
4. A copy of the minutes of the board of directors meeting;
5. Other documents that can verify the settlement details.
Article 11-2(Items and timing of disclosure of budget) #
(1) When the president discloses details of the budget for corporation accounting under Article 25(3) of the Act, the president shall disclose a revenue and expenditure budget bill including budget supplementary statements prescribed by Decree of the Ministry of Education, such as a tuition statement and personnel expense statement.
(2) When the president discloses details of the budget for corporation accounting under Article 25(3) of the Act, such disclosure shall be made by no later than 5 days before the commencement of each fiscal year. In such cases, the disclosure period shall be 1 year.
(3) When the president discloses details of the budget for corporation accounting under Article 25(3) of the Act, such disclosure shall be made by posting them on the internet website of Incheon National University, a national university corporation.

Article 11-3(Items and timing of disclosure of settlement accounts) #
(1) When the president discloses details of settlement accounts for corporation accounting under Article 25(3) of the Act, the president shall disclose settlement reports including supplementary settlement statements prescribed by Decree of the Ministry of Education, such as a statement of notes receivable and a statement of tangible fixed assets, and the audit report (including the opinion letter) under Article 11(2)3.
(2) When the president discloses details of settlement accounts for corporation accounting under Article 25(3) of the Act, such disclosure shall be made within 3 months after the end of each fiscal year. In such cases, the disclosure period shall be 1 year.
(3) When the president discloses details of settlement accounts for corporation accounting under Article 25(3) of the Act, such disclosure shall be made by posting them on the internet website of Incheon National University, a national university corporation.

Article 12(Submission of contribution budget request) #
(1) By April 30 of each year, the president shall submit to the Minister of Education a contribution budget request for the following year (meaning a contribution under Article 28(3) of the Act; hereinafter the same shall apply), accompanied by the following documents: <Amended on Mar. 23, 2013>
1. A project plan for the following year;
2. Documents necessary to clarify the details of the budget request for contributions.
(2) Where the Minister of Education finds the details of a request for contribution under paragraph (1) reasonable, the Minister shall appropriate such details in the budget, and when the contribution budget has been determined, the Minister shall notify the president thereof. <Amended on Mar. 23, 2013>
Article 13(Payment of contributions) #
(1) To receive contributions, the president shall submit to the Minister of Education an application for payment accompanied by a business plan for the relevant year and a quarterly budget execution plan. <Amended on Mar. 23, 2013>
(2) Where the Minister of Education finds the business plan and quarterly budget execution plan reasonable upon receipt of an application for payment under paragraph (1), the Minister shall pay contributions on a quarterly basis. <Amended on Mar. 23, 2013>
Article 14(Establishment of the Basic Academic Discipline Promotion Committee) #
(1) A Basic Academic Discipline Promotion Committee shall be established within Incheon National University, a national university corporation to formulate plans under Article 29(1) of the Act.
(2) The Basic Academic Discipline Promotion Committee shall be comprised of not more than 11 experts in relevant fields from within or outside Incheon National University, a national university corporation.
(3) The Basic Academics Promoting Committee shall deliberate on the following matters:
1. Matters concerning the formulation and implementation of plans for the support and promotion of necessary fields including basic academics;
2. Matters concerning the expansion and execution of financial resources for implementing plans for the support and promotion of necessary fields including basic academics;
3. Matters concerning the evaluation of implementation of plans for the support and promotion of necessary fields including basic academics;
4. Other matters the Basic Academic Discipline Promotion Committee considers necessary for deliberation for support and promotion of basic academic disciplines and other necessary fields.
(4) The Basic Academics Promoting Committee shall deliver the results of the deliberation under paragraph (3) to the President, and the President shall take necessary measures in accordance with the articles of incorporation.
(5) Matters necessary for the composition, operation, and deliberation of the Basic Academics Promoting Committee, other than those provided for in paragraphs (1) through (4), shall be prescribed by the articles of incorporation.
(6) To receive financial support from the State under Article 29(2) of the Act, the president shall request the Minister of Education therefor by specifying the following matters: <Amended on Mar. 23, 2013>
1. Objectives and effects of support and promotion projects;
2. Fields of support and promotion and implementation plans;
3. Expenses incurred in support and promotion projects and amount to be supported.
Article 15(Establishment of the Scholarship and Welfare Committee) #
(1) A Scholarship and Welfare Committee shall be established within Incheon National University, a national university corporation to formulate and implement scholarship and welfare policies under Article 29(3) of the Act.
(2) The Scholarship and Welfare Committee shall be comprised of not more than 11 experts in relevant fields from within or outside Incheon National University, a national university corporation.
(3) The Scholarship and Welfare Committee shall deliberate on the following matters:
1. Matters concerning establishment and implementation of scholarship and welfare policies for students;
2. Matters concerning the expansion and execution of financial resources for implementing scholarship and welfare policies for students;
3. Matters concerning the evaluation of scholarship and welfare policies for students;
4. Other matters the Scholarship and Welfare Committee considers necessary for deliberation for promotion of scholarship and welfare for students.
(4) The Scholarship and Welfare Committee shall deliver the results of deliberation under paragraph (3) to the president, and the president shall take necessary measures as prescribed by the articles of incorporation.
(5) Matters necessary for the composition, operation, and deliberation of the Scholarship and Welfare Committee, other than those provided for in paragraphs (1) through (4), shall be prescribed by the articles of incorporation.
