Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Coast Guard Affairs Act and matters necessary for the enforcement thereof.
Article 2(Scope of critical coastal facilities) #
"Facilities prescribed by Presidential Decree" in subparagraph 11 of Article 2 of the Coast Guard Affairs Act (hereinafter referred to as the "Act") means the following facilities designated and publicly notified by the Commissioner General of the Korea Coast Guard: <Amended on Nov. 19, 2014, Mar. 29, 2017, Jul. 26, 2017>
1. Office buildings of the State, local governments, or public institutions under Article 4 of the Act on the Management of Public Institutions;
2. Aerodrome and airports under the Airport Facilities Act;
3. Harbors and harbor facilities under the Harbor Act;
4. National key industrial facilities such as power plants, shipyards, steelworks, and oil storage facilities.
Article 2-2(Collection and management of coast guard information) #
(1) The Commissioner General of the Korea Coast Guard shall comply with the following when collecting, managing, and utilizing coast guard information under Article 7-2 (1) of the Act:
1. The purposes of the collection, management, and utilization of coast guard information shall be clarified;
2. An appropriate system shall be established for the collection, management, and utilization of coast guard information.
(2) The Commissioner General of the Korea Coast Guard shall take necessary measures to ensure the security and reliability of the coast guard information system under Article 7-2 (3) of the Act (hereinafter referred to as the "coast guard information system").
(3) The Commissioner General of the Korea Coast Guard may provide education and training to the following persons to ensure the efficient collection, management, and utilization of coast guard information and to strengthen information security:
1. A police official of the Korea Coast Guard who is in charge of coast guard information-related duties;
2. An executive officer or employee of a specialized institution or organization engaged in tasks entrusted under Article 7-2 (4) of the Act.
(4) Except as provided in paragraphs (1) through (3), matters necessary for the collection, management, etc. of coast guard information shall be determined by the Commissioner General of the Korea Coast Guard.

Article 3(Dispatch of guard force overseas) #
When the Commissioner General of the Coast Guard dispatches guard force to a foreign country under Article 9 (1) of the Act, the General shall have a prior consultation with the head of the relevant central administrative agency. <Amended on Nov. 19, 2014; Jul. 26, 2017; Mar. 3, 2020>
Article 3-2(Transfer of decommissioned patrol ships) #
(1) When selecting a developing country eligible for transfer under Article 9 (2) of the Act, the Commissioner General of the Korea Coast Guard shall consider the following:
1. Potential for cooperation with the relevant developing country in the fields of maritime safety, diplomacy, and defense industry;
2. The capacity of the relevant developing country to manage and operate a patrol ship.
(2) When selecting a developing country eligible for transfer under paragraph (1), the Commissioner General of the Korea Coast Guard shall have a consultation with the heads of the following relevant administrative agencies:
1. The Minister of Economy and Finance;
2. The Minister of Foreign Affairs;
3. The Minister of National Defense;
4. The Administrator of Defense Acquisition Program Administration;
5. The heads of other relevant administrative agencies with whom the Commissioner General of the Korea Coast Guard deems it necessary to have a consultation.
(3) The Commissioner General of the Korea Coast Guard shall conclude a written agreement with a developing country selected under paragraphs (1) and (2), including specifications of a patrol ship to be transferred and matters regarding the transportation of the vessel.
(4) Except as provided in paragraphs (1) through (3), matters necessary for the transfer of decommissioned patrol ships, including the maintenance of such ships before transfer, shall be determined by the Commissioner General of the Korea Coast Guard.

Article 4(Establishment and composition of consultative body) #
(1) A consultative body under Article 10 (1) of the Act (hereinafter referred to as "consultative body") shall be established within the Korea Coast Guard. <Amended on Nov. 19, 2014; Jul. 26, 2017>
(2) A consultative body shall consult on and coordinate the following:
1. Matters regarding consultation on emergency measures related to coast guard affairs;
2. Matters regarding the prompt exchange, utilization, etc. of information among relevant agencies;
3. Matters regarding urgent operational cooperation related to issues likely to cause disputes with foreign countries;
4. Other matters deemed to require urgent operational cooperation and referred to a meeting by the chairperson.
(3) A consultative body shall consist of up to 10 members, including 1 chairperson.
(4) The Director General of the Maritime Security Bureau of the Korea Coast Guard shall serve as the chairperson of a consultative body and its members shall be public officials at the director level or equivalent level of the following central administrative agencies, designated by the heads of their respective agencies: <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
1. The Ministry of Foreign Affairs;

3. The Ministry of Oceans and Fisheries;
4. The Korean National Police Agency;
5. The Korea Coast Guard;
6. Other central administrative agencies deemed necessary by the Commissioner General of the Korea Coast Guard for operational cooperation in coast guard affairs.
(5) Except as provided in this Decree, matters necessary for the composition and operation of a consultative body shall be determined by the Commissioner General of the Korea Coast Guard. <Amended on Nov. 19, 2014; Jul. 26, 2017>
Article 4-2(Accident prevention measures) #
"Measures prescribed by Presidential Decree" in Article 14 (3) 3 of the Act means the following measures: <Amended on Nov. 19, 2014; Jul. 26, 2017; Sep. 26, 2017>
1. Measures to board vessels, etc. for the safety management of vessels, etc.;
2. Other measures deemed urgent or unavoidable by the Commissioner General of the Korea Coast Guard for the safety of vessels, etc.

Article 4-3(Bearing of costs for relocation measures) #
"Vessels, etc. prescribed by Presidential Decree" in Article 14 (5) of the Act means vessels, etc. relocated by other vessels, cranes, or any other equipment (excluding those managed or operated by the State or local governments) mobilized by police officials of the Korea Coast Guard. <Amended on Nov. 19, 2014; Jul. 26, 2017; Sep. 26, 2017>

Article 5(Types and standards for use of police equipment and police gear) #
(1) The types of police equipment and police gear under Article 18 (1) of the Act shall be as follows: <Amended on Jan. 5, 2021>
1. Police equipment: Fire extinguisher cannons;
2. Police implements: Paintballs and line-throwing guns (referring to special guns designed to shoot lines).
(2) The standards for the use of police equipment and police gear under Article 18 (1) of the Act shall be as follows:
1. Such equipment and gear shall be used in accordance with ordinary methods of use;
2. Such equipment and gear shall be used within the minimum scope necessary to achieve the purpose;
3. Hazards to the life and body of other persons shall be minimized.
Article 5-2(Methods of awarding) #
(1) The Commissioner General of the Korea Coast Guard may grant a monetary award, within the budget, to a person who has rendered distinguished service in seizing a foreign vessel under Article 20-2 of the Act.
(2) The Commissioner General of the Korea Coast Guard may confer a commendation in conjunction with granting a monetary award under paragraph (1).
(3) Matters necessary for the detailed standards and procedures for granting monetary awards under paragraph (1) and other relevant details shall be determined and publicly notified by the Commissioner General of the Korea Coast Guard.
