Article 1(Purpose) #
The purpose of this Decree is to prescribe matters concerning the establishment and operation of Gugak National High School, National High school of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts, and the appointment of teachers thereto, as well as other related matters, pursuant to Article 62(2) of the Elementary and Secondary Education Act and Article 33(2) of the Educational Public Officials Act. <Amended on Oct. 20, 2015>
Article 2(Establishment) #
(1) The Minister of Culture, Sports and Tourism shall, as entrusted by the Minister of Education pursuant to Article 62(2) of the Elementary and Secondary Education Act, establish and operate the following schools in order to provide systematic education in Gugak and traditional arts and to foster professional Gugak musicians and traditional arts practitioners: <Amended on Mar. 23, 2013; Oct. 20, 2015>
1. High schools listed in the following subparagraphs:
a. Gugak National High School;
b. National High School of Traditional Arts;
2. Various schools at the middle school level listed in the following subparagraphs:
a. Gugak National Middle School;
b. National Middle School of Traditional Arts.
(2) The location of each school specified in paragraph (1) shall be the Seoul Metropolitan City.
Article 3(Number of public officials) #
The number of public officials assigned to Gugak National High School, National High School of Traditional Arts, Gugak National Middle School, and National Middle School of Traditional Arts shall be prescribed by Decree on the Organization of the Ministry of the Ministry of Culture, Sports and Tourism and Institutions under Its Jurisdiction. <Amended on Oct. 20, 2015>
Article 4(Appointment of teachers) #
(1) Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts shall each have a principal. <Amended on Oct. 20, 2015>
(2) Pursuant to Article 33(2) of the Educational Public Officials Act, the principals of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts shall be appointed by the President upon the recommendation of the Minister of Culture, Sports and Tourism. <Amended on Oct. 20, 2015>
(3) The appointment authority over principals under paragraph (2) (excluding the authority to appoint a person as a principal) shall be delegated to the Minister of Culture, Sports and Tourism pursuant to Article 33(2) of the Educational Public Officials Act.
(4) Pursuant to Article 33(2) of the Educational Public Officials Act, the vice-principals, senior teachers, and teachers of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts shall be appointed by the Minister of Culture, Sports and Tourism. <Amended on Oct. 20, 2015>
(5) Among the appointment authority under paragraph (4), the Minister of Culture, Sports and Tourism shall delegate the following appointment authority to the principals of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts pursuant to Article 33(2) of the Educational Public Officials Act: <Amended on Oct. 20, 2015>
1. Appointment of affiliated teachers;
2. Promotion of affiliated vice principal.
Article 5(Special cases concerning personnel exchange) #
(1) Notwithstanding Article 13-3(1) of the Decree on the Appointment of Educational Public Officials, the superintendent of education of the region in which Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts are located shall establish a personnel exchange plan, including educational public officials affiliated with Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts. <Amended on Oct. 20, 2015>
(2) When formulating a personnel exchange plan under paragraph (1), the superintendent of education shall consult in advance with the principals of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts regarding the scale and methods of personnel exchanges involving educational public officials affiliated with such schools. <Amended on Oct. 20, 2015>

Article 7(Qualification standards for industrial-educational adjunct teachers) #
Notwithstanding Article 42 and Appendix 2 of the Enforcement Decree of the Elementary and Secondary Education Act, the qualification standards for industrial-educational adjunct teachers assigned to Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts shall be as follows: <Amended on Oct. 20, 2015; Mar. 25, 2016; Nov. 3, 2020; May 7, 2024>
1. A person who has won a prize in a domestic competition in the field of Gugak or traditional arts recognized by the Minister of Culture, Sports and Tourism and has worked for at least 3 years in a field related to the subject in charge;
2. A person whose expertise in a field related to the subject in charge is recognized, such as a holder of national intangible cultural heritage, an instructor for successor training, or a person who has completed relevant training;
3. A person who has qualifications similar to those under subparagraphs 1 and 2 and meets the qualification standards separately determined by the Minister of Culture, Sports and Tourism.
Article 8(Curriculum) #
Where the Minister of Education establishes basic matters concerning the standards and content of the curriculum pursuant to Article 23(2) of the Elementary and Secondary Education Act, the Minister of Culture, Sports and Tourism may present opinions so that Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts may operate curricula in line with their characteristics, and the Minister of Education shall reflect such opinions unless there are special circumstances. <Amended on Mar. 23, 2013; Oct. 20, 2015>
Article 9(Admission screening) #
(1) Admission screening for Gugak National High School and National High School of Traditional Korean Arts shall be conducted by the principal of the relevant school. In such cases, matters necessary for admission screening, such as methods thereof, shall be determined by the principal of the relevant school with the approval of the Minister of Culture, Sports and Tourism. <Amended on Oct. 20, 2015>
(2) The Minister of Culture, Sports and Tourism shall establish a basic admission screening plan, determining basic matters concerning admission screening such as procedures, methods, and changes for the following school year's admission for Gugak National High School and National High School of Traditional Korean Arts, in consultation with the Minister of Education by March 31 each year, and shall publicly announce it; provided, where there is a special reason such as a change in the classification of high schools under Article 76-3 of the Enforcement Decree of the Elementary and Secondary Education Act after the public announcement, Minister of Culture, Sports and Tourism shall formulate a revised plan in consultation with the Minister of Education and publicly announce it by 3 months before the date of admission screening. <Amended on Mar. 23, 2013; Oct. 20, 2015>
(3) Where the principal of Gugak National High School or National High School of Traditional Korean Arts intends to conduct admission screening, he or she shall formulate and publicly announce a plan for the implementation of admission screening, including the date and time of admission screening, receipt of written applications, screening methods, etc. within the scope of the basic admission screening plan under paragraph (2), by three months before the screening date. <Amended on Oct. 20, 2015>
(4) Admission screening for Gugak National High School and National High School of Traditional Korean Arts shall be conducted with the aim of enhancing students' self-directed learning abilities, as determined by the Minister of Culture, Sports and Tourism, by reflecting middle school records (referring to materials utilized in lieu of school records if no such records exist) and some or all of the following subparagraphs, within the level and scope of the middle school curriculum: <Amended on Oct. 20, 2015>
1. A letter of recommendation from a teacher of the middle school the student attends or has graduated from;
2. An interview;
3. Other matters through which a student's self-directed learning ability can be evaluated, such as grades in practical skill tests.
Article 10(Operation of practical training courses) #
(1) The principals of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts may operate practical training courses in the fields of Gugak and traditional arts for elementary school students in order to foster talented individuals at an early stage in the fields of Gugak and traditional arts. <Amended on Oct. 20, 2015>
(2) Matters concerning the methods, procedures, etc. of the practical training courses under paragraph (1) shall be determined by the principals of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts with the approval of the Minister of Culture, Sports and Tourism. <Amended on Oct. 20, 2015>
Article 11(Subsidization of school expenses) #
(1) Entrance fees and tuition shall be exempted for students of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts. <Amended on Oct. 20, 2015>
(2) The Minister of Culture, Sports and Tourism may, within the budgetary limits, provide students of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts with expenses necessary for learning, including costs for learning materials and clothing, and other related school expenses. <Amended on Oct. 20, 2015>
Article 12(Suspension of payment of school expense subsidies) #
Where a student of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, or National Middle School of Traditional Arts takes a leave of absence or is suspended from school due to disciplinary action, the payment of subsidies for school expenses under Article 11 shall be suspended during such period. <Amended on Oct. 20, 2015>
Article 13(Reimbursement of subsidies for school expenses) #
(1) A person who drops out of Gugak National High School or National High School of Traditional Korean Arts shall reimburse the school expenses paid during his or her enrollment; provided, the principal of Gugak National High School or National High School of Traditional Korean Arts may waive all or part of the reimbursement amount with the approval of the Minister of Culture, Sports and Tourism. <Amended on Oct. 20, 2015>
(2) Matters necessary for the reimbursement under paragraph (1) shall be determined by the Minister of Culture, Sports and Tourism.
Article 14(Burden of expenses) #
Expenses necessary for the operation of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts shall be borne by the budget under the jurisdiction of the Ministry of Culture, Sports and Tourism. <Amended on Oct. 20, 2015>
Article 15(Relationship to other statutes or regulations) #
Except as provided in this Decree, the establishment and operation of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts shall be governed by the statutes or regulations related to education. <Amended on Oct. 20, 2015>
Article 16(Entrustment of authority) #
Pursuant to Article 62(2) of the Elementary and Secondary Education Act, the Minister of Education shall entrust the Minister of Culture, Sports and Tourism with the authority for the guidance and supervision of Gugak National High School, National High School of Traditional Korean Arts, Gugak National Middle School, and National Middle School of Traditional Arts under Article 6 of the same Act. <Amended on Mar. 23, 2013; Oct. 20, 2015>
