Article 1(Purpose) #
The purpose of this Act is to promote the autonomy and social responsibility of universities and enhance educational and research capabilities by establishing Incheon National University, a national university corporation and prescribing matters concerning its operation, thereby fostering Incheon National University, a national university corporation as a hub university with international competitiveness.
Article 2(Relationship to other Acts) #
(1) This Act shall apply preferentially to matters concerning Incheon National University, a national university corporation over other Acts.
(2) Except as prescribed in this Act, matters concerning the establishment, organization, operation, etc. of Incheon National University, a national university corporation shall be governed by the Higher Education Act.
Article 3(Legal personality) #
Incheon National University, a national university corporation shall be a corporation.
Article 4(Registration of establishment) #
(1) Incheon National University, a national university corporation shall be established by registering its incorporation at the location of its principal office.
(2) Matters necessary for registration of incorporation of Incheon National University, a national university corporation and other registrations shall be prescribed by Presidential Decree.
Article 5(Articles of incorporation) #
(1) The following matters shall be included in the articles of incorporation of Incheon National University, a national university corporation:
1. Purpose;
2. Name;
3. Location of the principal office;
4. Matters concerning its affairs and the implementation thereof;
5. Matters concerning assets and accounting;
6. Major matters concerning education and research;
7. Major matters concerning executives and faculty and staff members;
8. Matters concerning the board of directors;
9. Matters concerning the Council, the Education and Research Committee, and the Finance and Management Committee;
10. Matters concerning amendment to the articles of incorporation;
11. Matters concerning the enactment and amendment of school regulations;
12. Matters concerning the method of public notice;
13. Matters concerning dissolution and merger;
14. Matters required by this Act to be prescribed by the articles of incorporation;
15. Other major matters concerning the operation of the university.
(2) Where Incheon National University, a national university corporation intends to amend its articles of incorporation, it shall obtain approval from the Minister of Education after obtaining a resolution adopted by at least 2/3 of the incumbent directors of the board of directors. <Amended on Mar. 23, 2013>
Article 6(Faculty members and staff members) #
(1) Incheon National University, a national university corporation may have faculty members and staff members under Article 14 of the Higher Education Act and adjunct faculty members, etc. under Article 17 of that Act.
(2) Faculty members and staff members, and adjunct faculty members, etc. of Incheon National University, a national university corporation under paragraph (1) shall be appointed or dismissed by the president as prescribed by the articles of incorporation.
(3) Except as provided in this Act, relevant provisions of the Private School Act concerning qualifications, appointment and dismissal, service, guarantee of status, social security, and disciplinary actions of faculty members and staff members, and adjunct faculty members, etc. of Incheon National University, a national university corporation shall apply mutatis mutandis.
Article 6-2(Formulation of appointment plans for gender equality) #
(1) Incheon National University, a national university corporation shall formulate and implement policies necessary for gender equality in the appointment of faculty members.
(2) Incheon National University, a national university corporation shall endeavor to ensure that persons of a specific gender do not exceed 3/4 of the total number of faculty members. In such cases, the target ratio by year for the gender composition of faculty members shall be prescribed by school regulations.
(3) When appointing faculty members, the President shall, in consultation with the Minister of Education, establish and implement a necessary plan to take affirmative measures, including an appointment plan that presents target appointment ratios by academic field every 3 years, so that a specific gender is not overly represented. In such cases, the implementation results shall be submitted to the Minister of Education annually.
(4) The Minister of Education shall evaluate and make public the plan and implementation results under paragraph (3) each year, and may provide administrative and financial support based on the evaluation results.
(5) Matters necessary for the classification by academic field and the establishment of plans under paragraph (3), and for the methods and procedures for evaluation under paragraph (4), shall be prescribed by Presidential Decree.

Article 6-3(Special cases concerning prohibition of profit-making business and concurrent offices) #
(1) Notwithstanding Article 64 of the State Public Officials Act, which applies mutatis mutandis pursuant to Article 6(3) of this Act and Article 55(1) of the Private School Act, professors, associate professors, and assistant professors under Article 14(2) of the Higher Education Act among faculty members under Article 6 may concurrently serve as outside directors of commercial, industrial, financial, or other private enterprises operated for profit, with permission from the president, to the extent that such concurrent service does not interfere with education and guidance of students and academic research. In such cases, "outside director" means a director who does not engage in the ordinary business of the relevant company under Article 9(3) of the Financial Investment Services and Capital Markets Act (hereinafter referred to as "outside director" in this Article).
(2) Professors, associate professors, and assistant professors concurrently serving as outside directors under paragraph (1) shall report to the president, by January 31 of the following year, the total amount of remuneration received from the relevant private enterprise for the relevant year under Article 388 of the Commercial Act.
(3) Detailed standards, methods, and procedures for permission under paragraph (1), and methods and procedures for reporting under paragraph (2) shall be prescribed by Presidential Decree.

Article 7(Officers) #
(1) Incheon National University, a national university corporation shall have 9 directors, including 1 chairperson of the board, and 2 auditors as its officers.
(2) One auditor under paragraph (1) shall serve on a full-time basis.
Article 8(President) #
(1) Incheon National University, a national university corporation shall have a president as the head of the university.
(2) The president shall represent Incheon National University, a national university corporation and shall exercise overall control over its affairs.
(3) The president shall be appointed by the President of the Republic of Korea upon recommendation by the Minister of Education after the board of directors selects 1 person from among not more than 3 candidates recommended by the Presidential Candidate Recommendation Committee. <Amended on Mar. 23, 2013>
(4) The Presidential Candidate Recommendation Committee shall be comprised of not more than 15 persons, including persons recommended by the board of directors, and detailed matters concerning its composition and operation shall be prescribed by the articles of incorporation.
(5) The term of office of the president shall be 4 years, and the president may serve consecutive terms.
(6) Duties of the president and other necessary matters shall be prescribed by the articles of incorporation.
Article 9(Vice presidents) #
(1) Incheon National University, a national university corporation shall have 1 or more vice presidents to assist the president in duties related to operation of the university.
(2) Vice presidents shall be appointed by the president.
(3) The term of office of a vice president shall be 2 years.
(4) Matters necessary for duties, etc. of vice presidents shall be prescribed by the articles of incorporation.
(5) Matters necessary for establishment, etc. of auxiliary agencies and advisory agencies assisting the president, other than vice presidents, shall be prescribed by the articles of incorporation.
Article 10(Directors) #
(1) Directors shall be comprised of the following persons, and at least 1/2 thereof shall be external persons (meaning persons not affiliated with Incheon National University, a national university corporation; hereinafter the same shall apply): <Amended on Mar. 23, 2013; Oct. 1, 2025>
1. President;
2. One vice president prescribed by the articles of incorporation from among vice presidents;
3. One person recommended by the Minister of Education;
4. One person recommended by the Minister of Planning and Budget;
5. One person recommended by the head of the metropolitan local government having jurisdiction over the location of the principal office of Incheon National University, a national university corporation;
6. One person recommended by the president of the General Alumni Association of Incheon National University, a national university corporation;
7. One person recommended by the Council under Article 15;
8. Other persons with expertise and experience necessary for university management.
(2) Directors under paragraph (1)6 through 8 shall be appointed by the board of directors and shall obtain approval for assumption of office from the Minister of Education. <Amended on Mar. 23, 2013>
(3) The term of office of directors shall be 2 years.
(4) In addition to matters prescribed in paragraphs (1) through (3), matters necessary for the composition of directors shall be prescribed by the articles of incorporation.
Article 11(Board of directors) #
(1) Incheon National University, a national university corporation shall have a board of directors to deliberate and resolve on matters under each subparagraph of Article 12.
(2) The board of directors shall be composed of directors, including the chairperson of the board.
(3) The chairperson of the board shall be elected from among the directors by mutual vote as prescribed by the articles of incorporation.
(4) The chairperson of the board may convene meetings of the board of directors where deemed necessary; provided, the chairperson shall convene a meeting of the board of directors where requested by the president or at least 1/3 of the incumbent directors, or where an auditor requests convocation of the board of directors under Article 13(4).
(5) Auditors may attend and speak at meetings of the board of directors where necessary in connection with their duties.
(6) The chairperson of the board or a director shall not exercise voting rights on matters in which the person has a special interest.
(7) Unless otherwise specifically prescribed by the articles of incorporation, the board of directors shall commence proceedings with the attendance of a majority of the incumbent directors and shall adopt resolutions by a majority vote of directors present; provided, directors who may not exercise voting rights under paragraph (6) shall be excluded from the number of incumbent directors. <Amended on Mar. 23, 2021>
(8) Where the chairperson of the board becomes vacant or is unable to perform duties due to unavoidable reasons, another person shall perform duties on behalf of the chairperson as prescribed by the articles of incorporation.
(9) Other matters necessary for the board of directors shall be prescribed by the articles of incorporation.
Article 12(Functions of board of directors) #
The board of directors shall deliberate and resolve on the following matters: <Amended on Mar. 23, 2021>
1. Matters concerning appointment of the President;
2. Matters concerning the appointment and dismissal of executives;
3. Matters concerning budgets and settlements of accounts;
4. Matters concerning the acquisition, disposal, and management of important assets prescribed by the articles of incorporation;
5. Matters concerning the establishment and abolition of major organizations prescribed by the articles of incorporation;
6. Matters concerning mid- and long-term operation and development of the university;
7. Matters concerning amendments to the articles of incorporation;
8. Matters concerning the enactment, amendment, and abolition of major regulations prescribed by the articles of incorporation;
9. Matters concerning the creation and sponsorship of funds for the development of the university;
10. Matters required to be resolved by the board of directors under this Act or the articles of incorporation;
11. Other matters deemed necessary by the board of directors.
Article 13(Auditors) #
(1) One of the auditors shall be appointed by the board of directors upon the recommendation of the Minister of Education, and the other shall be appointed by the board of directors upon the recommendation of the Senate under Article 15, and both shall obtain approval for their assumption of office from the Minister of Education. In such cases, the Senate shall recommend as an auditor a person who holds a certified public accountant qualification under the Certified Public Accountant Act. <Amended on Mar. 23, 2013>
(2) The auditor shall perform the following duties:
1. Auditing the property status and accounts of Incheon National University, a national university corporation;
2. Auditing matters concerning the operation and affairs of the board of directors;
3. Other matters prescribed by the articles of incorporation as duties of auditors.
(3) Where auditors discover any illegality or impropriety as a result of an audit under paragraph (2), they shall report it to the board of directors and the Minister of Education. <Amended on Mar. 23, 2013>
(4) Auditors may request convocation of the board of directors where necessary to make a report under paragraph (3).
(5) The term of office of auditors shall be 3 years, and they shall not serve consecutive terms.
(6) Matters necessary for methods and procedures for performance of duties by auditors shall be prescribed by the articles of incorporation.
Article 14(Grounds for disqualification) #
(1) No person who falls under any of the subparagraphs of Article 33 of the State Public Officials Act may become an executive of Incheon National University, a national university corporation.
(2) Where an officer of Incheon National University, a national university corporation (excluding the president) causes a clear and serious impediment to school management due to accounting irregularities, embezzlement, acceptance or offering of bribes, or other corruption, or other grounds prescribed by Presidential Decree, the Minister of Education may revoke approval for assumption of office of such officer under the former part of Article 10(2) and Article 13(1). <Amended on Mar. 23, 2013; Mar. 23, 2021>
Article 15(Council) #
(1) Incheon National University, a national university corporation shall have a Council to deliberate on the following matters:
1. Matters concerning mid- and long-term plans for the operation and development of the university;
2. Matters concerning recommendation of officers under Article 10(1)7 and the former part of Article 13(1);
3. Matters concerning education, research, and welfare of faculty members and staff members prescribed by the articles of incorporation;
4. Other matters for which the president, the chairperson of the board, the chairperson of the Council, or at least 1/4 of the incumbent members request deliberation on the grounds that such matters are important for school operation.
(2) The Council shall be comprised of not more than 30 faculty members and staff members of Incheon National University, a national university corporation, and detailed matters concerning its composition shall be prescribed by the articles of incorporation.
(3) The Council shall have 1 chairperson and 1 vice chairperson, who shall be elected by mutual vote from among the members of the Council.
(4) The term of office of members of the Council shall be 2 years.
(5) The Council shall deliver the results of its deliberation to the president, and the president shall refer matters requiring a resolution of the board of directors or matters deemed important to the board of directors.
(6) In addition to matters prescribed in paragraphs (1) through (5), matters necessary for the composition, operation, and deliberation of the Council shall be prescribed by the articles of incorporation.
Article 16(Education and Research Committee) #
(1) Incheon National University, a national university corporation shall have an Education and Research Committee to deliberate on the following matters concerning education and research:
1. Matters concerning admission and graduation of students;
2. Matters concerning personnel affairs of faculty members;
3. Matters concerning faculty evaluation and research;
4. Matters concerning academic affairs management, including curriculum, academic records, and degrees;
5. Matters related to education and research among annual university operation plans under Article 30;
6. Other matters related to education and research that are referred for deliberation by the President or the board of directors.
(2) Members of the Education and Research Committee shall be comprised of not fewer than 15 and not more than 20 faculty members and external experts of Incheon National University, a national university corporation, and detailed matters concerning its composition shall be prescribed by the articles of incorporation.
(3) The Education and Research Committee shall have a chairperson, and the president shall concurrently serve as the chairperson.
(4) The term of office of members of the Education and Research Committee shall be 2 years.
(5) The Education and Research Committee shall deliver the results of its deliberation to the president, and the president shall refer matters requiring a resolution of the board of directors or matters deemed important to the board of directors.
(6) In addition to matters prescribed in paragraphs (1) through (5), matters necessary for the composition, operation, and deliberation of the Education and Research Committee shall be prescribed by the articles of incorporation.
Article 17(Finance and Management Committee) #
(1) Incheon National University, a national university corporation shall have a Finance and Management Committee to deliberate on the following matters concerning finance and management:
1. Matters concerning budget and settlement accounts;
2. Matters concerning students' financial burdens, including admission fees and tuition;
3. Matters related to finance and management among annual university operation plans under Article 30;
4. Matters concerning investment plans for major projects and profit-making businesses prescribed by the articles of incorporation;
5. Matters concerning acts imposing debt obligations;
6. Matters concerning enactment and amendment of regulations involving financial burdens;
7. Matters concerning enactment and amendment of accounting regulations;
8. Matters concerning standards for payment of remuneration and retirement allowances for officers and faculty members and staff members;
9. Other matters for which the president or the board of directors requests deliberation in connection with finance and management of the university.
(2) The Finance and Management Committee shall be comprised of not fewer than 15 and not more than 20 persons, including faculty members and staff members of Incheon National University, a national university corporation and external persons, and at least 1/3 thereof shall be external persons.
(3) The Finance and Management Committee shall have a chairperson, who shall be elected by mutual vote from among the members of the Finance and Management Committee.
(4) The term of office of members of the Finance and Management Committee shall be 2 years.
(5) The Finance and Management Committee shall deliver the results of its deliberation to the president, and the president shall refer matters requiring a resolution of the board of directors or matters deemed important to the board of directors.
(6) In addition to matters prescribed in paragraphs (1) through (5), matters necessary for the composition, operation, and deliberation of the Finance and Management Committee shall be prescribed by the articles of incorporation.
Article 18(Establishment of corporation accounting) #
(1) Corporation accounting shall be established for accounting processing of Incheon National University, a national university corporation, and matters necessary therefor shall be prescribed by the articles of incorporation.
(2) The fiscal year of Incheon National University, a national university corporation shall commence on March 1 of each year and end on the last day of February of the following year.
Article 19(Capital) #
(1) The capital stock of Incheon National University, a national university corporation shall be the amount obtained by evaluating property gratuitously transferred from a local government under Article 21, plus or minus changes resulting from capital increases, etc.
(2) The evaluated amount of property under paragraph (1) shall be based on the market price at the time of gratuitous transfer, and matters necessary for calculation of the evaluated amount shall be determined by the Minister of Education. <Amended on Mar. 23, 2013>
(3) Where Incheon National University, a national university corporation intends to dispose of property under paragraph (1) (including provision as security and exchange), it shall obtain approval in advance from the Minister of Education; provided, where it intends to dispose of property gratuitously transferred from a local government, it shall undergo consultation with the head of the relevant local government. <Amended on Mar. 23, 2013>
Article 20(Contributions) #
(1) Notwithstanding other statutes, the State shall pay contributions in a lump sum within budgetary limits to Incheon National University, a national university corporation to cover expenses incurred in the establishment and operation thereof; provided, if necessary, subsidies and other transferred funds may be paid.
(2) The metropolitan local government having jurisdiction over the location of the principal office of Incheon National University, a national university corporation shall provide contributions or subsidies to support the establishment, operation, and development thereof.
Article 21(Gratuitous transfer of public property) #
(1) Notwithstanding the Public Property and Commodity Management Act, the Local Finance Act, and other statutes, local governments shall gratuitously transfer to Incheon National University, a national university corporation public property and goods under the jurisdiction of the university at the time of establishment of Incheon National University, a national university corporation. In such cases, the Minister of Education shall consult in advance with the Minister of the Interior and Safety. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(2) National heritage belonging to the State under the Framework Act on National Heritage shall not be subject to paragraph (1). <Amended on May 16, 2023>
(3) Where necessary for operation of Incheon National University, a national university corporation, local governments may, notwithstanding the Commodity Management Act, the Public Property and Commodity Management Act, the Local Finance Act, and other statutes, gratuitously loan public property and goods to Incheon National University, a national university corporation, or permit gratuitous use and profit-making thereof.
(4) Matters necessary for conditions and procedures for loans or permission for use and profit-making under paragraph (3) shall be prescribed by Presidential Decree.
Article 22(Transfer or contribution of private property) #
(1) Incheon National University, a national university corporation may gratuitously receive transfer of property or other contributions from persons other than the State or local governments, as prescribed by the articles of incorporation.
(2) Where property acquired under paragraph (1) is disposed of, such disposition shall comply with the intent of the person providing the property or the contract entered into with such person; provided, where nothing is specifically prescribed therefor and such intent cannot be confirmed, disposition shall be governed by a decision of the board of directors.
Article 23(Expropriation and use of land) #
Where it is necessary to secure school sites for Incheon National University, a national university corporation, the State or a local government may expropriate or use land, etc. under the Act on Acquisition of and Compensation for Land for Public Works Projects.
Article 24(Long-term borrowing and issuance of school bonds) #
(1) Where necessary for university operation, Incheon National University, a national university corporation may make long-term borrowing or issue school bonds upon obtaining approval from the Minister of Education after obtaining a resolution of the board of directors, as prescribed by Presidential Decree; provided, minor matters prescribed by Presidential Decree shall be reported to the Minister of Education. <Amended on Mar. 23, 2013>
(2) Where the Minister of Education intends to approve long-term borrowing or issuance of school bonds under the main clause of paragraph (1), the Minister shall consult in advance with the Minister of Planning and Budget. <Amended on Mar. 23, 2013; Oct. 1, 2025>
Article 25(Budget and settlement accounts) #
(1) The president shall submit a budget bill to the Minister of Education as prescribed by Presidential Decree. <Amended on Mar. 23, 2013>
(2) The president shall submit to the Minister of Education, within 20 days after a resolution of the board of directors, a settlement report including financial statements audited by an accounting firm for each fiscal year. <Amended on Mar. 23, 2013>
(3) The president shall publicly disclose details of the budget and settlement accounts of corporation accounting as prescribed by Presidential Decree. <Amended on Mar. 23, 2013; Dec. 30, 2013>
Article 26(Disposition of surplus) #
Where any surplus arises as a result of settlement accounts for each fiscal year, Incheon National University, a national university corporation shall first appropriate such surplus for repayment of debts, then for compensation for carried-forward losses, and any remaining amount shall be carried forward to the following year or managed under a separate account; provided, such surplus shall be used for school operation.
Article 27(Profit-making businesses) #
(1) Incheon National University, a national university corporation may conduct profit-making businesses to the extent that they do not interfere with educational and research activities.
(2) Profits under paragraph (1) shall be used for school management, and matters necessary therefor shall be prescribed by the articles of incorporation.
Article 28(Financial support by the State and local governments) #
(1) The State shall provide administrative and financial support to foster Incheon National University, a national university corporation as a hub university with international competitiveness and enable it to perform a leading role as a national university corporation.
(2) The State shall provide annual contributions for personnel expenses, ordinary expenses, facility expansion expenses, and support funds for advancement of education and research in order to ensure stable financial operation of Incheon National University, a national university corporation.
(3) The State shall determine annual contributions in consideration of the budget of the former Incheon University at the time of establishment of Incheon National University, a national university corporation, the scale of the higher education budget, and the rate of increase thereof.
(4) The heads of institutions that recommended directors under Article 10(1) and the heads of institutions affiliated therewith may provide financial support to Incheon National University, a national university corporation, including subsidies for facility expenses, payment of scholarships, and establishment of industry-academia cooperation systems.
Article 29(Social responsibilities of national university corporations and support by the State) #
(1) Incheon National University, a national university corporation shall formulate and publicly announce 4-year plans for support and promotion of basic academic disciplines and other necessary fields, and shall formulate and implement annual implementation plans.
(2) The State shall provide necessary support, including financial support within the budgetary limits, for the implementation of the annual implementation plan under paragraph (1).
(3) Incheon National University, a national university corporation shall create an educational and research environment to foster outstanding and creative talent, and shall formulate and implement scholarship and welfare policies capable of minimizing the burden of educational expenses.
Article 30(Formulation and evaluation of university operation plans) #
(1) The president shall establish university operation performance objectives every 4 years in consultation with the Minister of Education, and shall formulate and publicly announce annual university operation plans reflecting such university operation performance objectives before the commencement of each fiscal year, and faithfully implement them. <Amended on Mar. 23, 2013>
(2) The Minister of Education shall annually evaluate and publicly announce performance results under annual university operation plans under paragraph (1), and shall reflect the results thereof in administrative and financial support. <Amended on Mar. 23, 2013>
(3) The Minister of Education may establish an independent and professional institution responsible for evaluations under paragraph (2), or entrust such evaluations to another institution. <Amended on Mar. 23, 2013>
Article 31(Affiliated schools) #
Incheon National University, a national university corporation may establish and operate schools under each subparagraph of Article 2 of the Elementary and Secondary Education Act as affiliated schools, as prescribed by the articles of incorporation.
Article 32(Application mutatis mutandis of the Civil Act) #
Except as provided in this Act, provisions concerning incorporated foundations under the Civil Act shall apply mutatis mutandis to Incheon National University, a national university corporation. <Amended on Mar. 23, 2021>
Article 33(Prohibition of use of similar names) #
No person other than Incheon National University, a national university corporation shall use the name "Incheon National University, a national university corporation" or any similar name or emblem.
Article 34(Administrative fines) #
(1) Where a person other than Incheon National University, a national university corporation uses the name "Incheon National University, a national university corporation" or any similar name or emblem in violation of Article 33, an administrative fine not exceeding 5 million won shall be imposed.
(2) Administrative fines under paragraph (1) shall be imposed and collected by the Minister of Education. <Amended on Mar. 23, 2013>
