Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on Regulation of Special Cases of State Property and those necessary for the enforcement thereof.
Article 2(Elements of Plans for Establishment or Change of Special Cases concerning State Property) #
(1) Each plan for the establishment or change of a special case concerning State property (hereinafter referred to as "plan") submitted under Article 6(2) of the Act on Regulation of Special Cases of State Property (hereinafter referred to as the "Act") shall include the following: <Amended on Nov. 12, 2024>
1. Type of the special case to be established or changed;
2. Purpose of and necessity for the establishment or change of the special case;
3. Details of the special case concerned, including methods for calculating fees, rent, or other charges for the use of or proceeds from State property and the applicable rates; and the period of validity of and the eligibility for the permit to use or the lending of State property;
4. Period for existence of the special case concerned;
5. Proposed enactments or amendments of the statutes that serve as the basis for the special case concerned;
6. Annual funding estimates generated from the special case concerned;
7. Expectancy effect derived from the establishment or change of the special case.
(2) The head of a central government agency (referring to the head of a central government agency under Article 6 of the National Finance Act; hereinafter the same shall apply) shall examine whether the details of a plan conform to the principles prescribed in the subparagraphs of Article 5 of the Act and shall attach the results thereof to the plan. <Amended on Nov. 12, 2024>
Article 2-2(Inspection and Assessment of Special Cases concerning State Property) #
(1) The details of the assessment under Article 7(1)2 of the Act (hereafter in this Article referred to as "assessment of special cases concerning State property") shall be as follows:
1. The following matters regarding the effectiveness of special cases concerning State property:
a. The degree of achievement of the legislative objectives of the statute on which special cases concerning State property are based;
b. The level of achievement of performance objectives, such as the outcomes of operation under Article 9(1) of the Act;
2. The following matters regarding the validity of special cases concerning State property:
a. Necessity to retain special cases concerning State property;
b. The appropriateness of the amount of financial expenditure following special cases concerning State property.
(2) The head of a central government agency shall submit to the Minister of Finance and Economy his or her opinion on the retention of special cases concerning State property under his or her jurisdiction no later than the end of February of the year in which the term of existence of special cases concerning State property under his or her jurisdiction arrives under the Appendix of the Act (hereafter in this Article referred to as "assessment year"). <Amended on Dec. 30, 2025>
(3) Upon receipt of the opinion of the head of the competent central government agency in accordance with paragraph (2), the Minister of Finance and Economy shall complete the assessment of special cases concerning State property no later than May 31 of the relevant assessment year and notify the head of the competent central government agency of the results thereof no later than June 30 of the relevant assessment year. <Amended on Dec. 30, 2025>
(4) Upon receipt of a request to submit data in accordance with Article 7(4) of the Act, the head of the competent central government agency shall submit the relevant data to the Minister of Finance and Economy within 20 days from the date of receipt of such request; provided, where it is impracticable to submit such data within 20 days, the period may be extended in consultation with the Minister of Finance and Economy. <Amended on Dec. 30, 2025>
(5) A specialized research institute that the Minister of Finance and Economy may entrust surveys and research related to the assessment of special cases concerning State property in accordance with Article 7(6) of the Act shall be as follows: <Amended on Dec. 30, 2025>
Article 3(Disclosure of findings of inspection and assessment) #
The Minister of Finance and Economy shall make available the findings of the inspection and assessment of the results, etc. of operation of special cases concerning State property under Article 7(1) of the Act on the website of the Ministry of Finance and Economy. <Amended on Dec. 30, 2025>
Article 4(Reports on actual outcomes of operation) #
The actual outcomes of operation stated in Article 9(1) of the Act shall include the following:
1. Outcomes of operation for each type of special cases concerning State property;
2. Detailed outcomes of operation for each of the special cases concerning State property;
3. Funding amount for each of the special cases concerning State property;
4. Current status of establishment, change, or repeal of the special cases concerning State property;
5. Information related to the outcomes of operation of the special cases concerning State property, except as provided in subparagraphs 1 through 4.
Article 4-2(Preparation of expenditure budget for special cases concerning State property) #
When the Minister of Finance and Economy prepares an expenditure budget for special cases concerning State property under Article 10(1) of the Act, the following elements shall be included: <Amended on Dec. 30, 2025>
1. Categorical analysis to present results obtained for each type of special cases, such as reduction of and exemption from fees, etc. for using State property and transfer of State property;
2. Functional analysis to present results obtained for each area of expenditure;
3. Analysis to present results obtained for each eligible entity classified by public and private sectors;
4. Analysis to present results obtained for each central government agency having jurisdiction over special cases concerning State property.

Article 5(Delegation of authority) #
(1) The Minister of Finance and Economy shall delegate the affairs regarding investigation on the status of operating special cases concerning State property, of the affairs relating to inspection and assessment on special cases concerning State property, to the Administrator of the Public Procurement Service in accordance with Article 13(1) of the Act. <Amended on Nov. 12, 2024; Dec. 30, 2025>
(2) In order to undertake affairs delegated under paragraph (1), the Administrator of the Public Procurement Service shall prepare a plan for investigating the status of operating special cases concerning State property by the end of each February and report it to the Minister of Finance and Economy, and notify it to the heads of central government agencies, etc. under subparagraph 11 of Article 2 of the State Property Act. <Amended on Dec. 30, 2025>
