Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Functional Sericulture Industry Fosterage and Support Act and matters necessary for the enforcement thereof.
Article 2(Functional sericulture products) #
"Products prescribed by Presidential Decree" in subparagraphs 1a and b of Article 2 of the Functional Sericulture Industry Fosterage and Support Act (hereinafter referred to as the "Act") means Antheraea yamamai (wild silkworms), Antheraea pernyi (Chinese oak silkworms), Bombyx mandarina (wild mulberry silkworms), and Samia cynthia ricini (castor silkworms), which have been domesticated to allow for mass rearing, and their cocoons.
Article 3(Formulation of comprehensive plan) #
(1) When the Minister of Agriculture, Food and Rural Affairs formulates a comprehensive plan for the promotion of the functional sericulture industry under Article 5(1) of the Act (hereinafter referred to as "comprehensive plan") and an implementation plan under Article 5(4) of the Act (hereinafter referred to as "implementation plan"), he or she shall notify the heads of the relevant central administrative agencies and the Special Metropolitan City Mayor, Metropolitan City Mayors, Special Self-Governing City Mayors, Do Governors, and Special Self-Governing Province Governors (hereinafter referred to as "Mayor/Do Governor").
(2) The Minister of Agriculture, Food and Rural Affairs shall formulate an implementation plan for the following year by December 31 each year to promote the comprehensive plan under Article 5(4) of the Act.
(3) The Minister of Agriculture, Food and Rural Affairs shall evaluate the performance of the implementation plan under Article 5(6) of the Act according to the following criteria and reflect the results in the implementation plan for the following year:
1. Conformity with the comprehensive plan;
2. Degree of achievement of objectives;
3. Adequacy of the implementation system and allocation of financial resources;
4. Appropriateness of implementation projects.
(4) The Administrator of the Rural Development Administration shall, pursuant to Article 5(7) of the Act, evaluate the performance of annual detailed implementation plans in accordance with the following criteria and reflect the results in the annual detailed implementation plans for the following year:
1. Conformity with the implementation plan;
2. Degree of achievement of objectives;
3. Adequacy of the implementation system and allocation of financial resources;
4. Appropriateness of implementation projects.

Article 4(Scope and methods of fact-finding surveys) #
(1) The Minister of Agriculture, Food and Rural Affairs shall conduct a fact-finding survey under Article 6(1) of the Act (hereinafter referred to as "fact-finding survey") according to the following classifications: <Amended on Mar. 23, 2013; Jun. 20, 2023>
1. Periodic surveys: Surveys conducted every 5 years for use in formulating the comprehensive plan;
2. Ad hoc surveys: Surveys conducted where deemed necessary for use in formulating and implementing policies for promoting the functional sericulture industry.
(2) A fact-finding survey shall include the following:
1. Current status of the production base, distribution, processing, etc. of the domestic functional sericulture industry and international trends;
2. Current status of the research, development, and dissemination of technologies, etc. related to functional sericulture;
3. Types and scale of support projects for the promotion of the functional sericulture industry;
4. Current status of functional sericulture technology education programs and the scale of support personnel;
5. Other matters necessary for the formulation and implementation of policies for the promotion of the functional sericulture industry.
(3) When conducting a fact-finding survey, the Minister of Agriculture, Food and Rural Affairs shall formulate and implement a survey plan including the criteria for selecting survey subjects, the date and time of the survey, and the survey methods. <Amended on Mar. 23, 2013>
(4) A fact-finding survey shall, in principle, be conducted through field surveys, and may be conducted in parallel with indirect survey methods using statistical data, literature, etc.
(5) Matters necessary to efficiently conduct fact-finding surveys, other than those prescribed in paragraphs (1) through (4), shall be determined by the Minister of Agriculture, Food and Rural Affairs. <Amended on Mar. 23, 2013>

Article 5(Policies on breeding excellent silkworm varieties and production and supply of high-quality silkworm eggs) #
(1) The Minister of Agriculture, Food and Rural Affairs may, under Article 9-2 of the Act, formulate and implement policies on the breeding of excellent silkworm varieties and the production and supply of high-quality silkworm eggs, including the following matters:
1. Designation of excellent silkworm varieties;
2. Testing for the designation of excellent silkworm varieties;
3. Management of the production and supply of high-quality silkworm eggs;
4. Other matters necessary for the breeding of excellent silkworm varieties and the production and supply of high-quality silkworm eggs, such as technical guidance and education on silkworm egg production.
(2) Detailed matters regarding the subparagraphs of paragraph (1) shall be determined and publicly notified by the Minister of Agriculture, Food and Rural Affairs.

Article 6(Designation of training institutions for professional personnel) #
(1) A person intending to be designated as a training institution for professional personnel under Article 9-3(2) of the Act (hereinafter referred to as a "training institution for professional personnel") shall submit an application for designation prescribed by Decree of the Ministry of Agriculture, Food and Rural Affairs, along with the following documents, to the Minister of Agriculture, Food and Rural Affairs, a Mayor/Do Governor, or the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereafter the same shall apply):
1. A training plan including curriculum and course content;
2. The status of educational facilities and training equipment;
3. The status of securing qualified instructors;
4. A funding plan for operational expenses.
(2) The criteria for designation of a training institution for professional personnel shall be as follows:
1. The curriculum and course content concerning silkworm rearing, processing technologies of sericulture products, etc. shall be appropriate;
2. Educational facilities and training equipment, such as lecture rooms and practice rooms, shall be adequately secured;
3. Qualified instructors, such as persons holding a master's degree or higher in sericulture or entomology, shall be adequately secured;
4. The plan for financing operational expenses necessary for training professional personnel shall be reasonable.
(3) If the Minister of Agriculture, Food and Rural Affairs, a Mayor/Do Governor, or the head of a Si/Gun/Gu designates a training institution for professional personnel, he or she shall issue a certificate of designation prescribed by Decree of the Ministry of Agriculture, Food and Rural Affairs.
(4) The items eligible for full or partial financial support to training institutions for professional personnel under Article 9-3(3) of the Act shall be as follows:
1. Instructor fees and allowances;
2. Costs for producing training materials and purchasing practical training equipment;
3. Other items deemed necessary for education and training.
(5) Detailed matters necessary for designation procedures, designation criteria, and financial support under paragraphs (1) through (4) shall be prescribed by Decree of the Ministry of Agriculture, Food and Rural Affairs.
Article 7(Delegation of authority) #
The Minister of Agriculture, Food and Rural Affairs shall delegate the following authority to the Administrator of the Rural Development Administration under Article 11 of the Act: <Amended on Mar. 23, 2013; Jun. 20, 2023>
1. Conducting fact-finding surveys on the current status, etc. of the functional sericulture industry under Article 6 of the Act;
2. Formulating and implementing policies on the breeding of excellent silkworm varieties and the production and supply of high-quality silkworm eggs under Article 9-2 of the Act;
3. Training professional personnel, and designating training institutions for professional personnel, providing support for expenses, revoking designations, and holding hearings under Article 9-3 of the Act;
4. Formulating fact-finding survey plans under Article 4(3) and preparing detailed criteria for fact-finding surveys under Article 4(5);
5. Enacting and amending public notifications regarding the breeding of excellent silkworm varieties and the production and supply of high-quality silkworm eggs under Article 5(2);
6. Issuing certificates of designation under Article 6(3).
