WEATHER INDUSTRY PROMOTION ACT

CHAPTER I GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Act is to prescribe matters regarding the support and fostering of the weather industry for the purposes of laying the foundation for the development of the weather industry and strengthening its competitiveness, thereby contributing to the development of the national economy.

Article 2(Definitions) #

The terms used in this Act are defined as follows:

1. "Weather industry" means an industry that manufactures or supplies weather-related goods or services;

2. "Weather forecasting" means the provision of predicted future weather conditions based on the results of observations of meteorological phenomena;

3. "Meteorological appraisal" means the estimation of meteorological phenomena at a specific location, or the determination of the extent of influence that such phenomena had on a specific event, based on the observed results of the meteorological phenomenon;

4. "Weather forecasting business" means the business of providing weather forecasts for general or specific users;

5. "Meteorological appraisal business" means the business of providing meteorological appraisal services for specific users;

6. "Weather consulting business" means the business of providing advice on business activities by analyzing and evaluating weather information;

7. "Meteorological equipment business" means the business of manufacturing, importing, installing, or repairing meteorological instruments;

8. "Weather forecaster" means a person who is in charge of weather forecasting services and is licensed by the Administrator of the Korea Meteorological Administration in accordance with Article 18;

9. "Meteorological appraiser" means a person who is in charge of meteorological appraisal services and is licensed by the Administrator of the Korea Meteorological Administration in accordance with Article 18;

10. "Weather business operator" means a person who has filed for registration for the business of weather forecasting, meteorological appraisal, weather consulting, or meteorological equipment under Article 6.

Article 3(Endeavors for advancement and development of weather industry) #

(1) The Administrator of the Korea Meteorological Administration shall endeavor for the advancement and development of the weather industry.

(2) The Administrator of the Korea Meteorological Administration shall facilitate the private utilization of meteorological information, such as enabling the meteorological information in possession to be utilized in various industries.

(3) The Administrator of the Korea Meteorological Administration shall endeavor to ensure that weather information is accurately delivered to users.

CHAPTER II FORMULATION OF PLANS FOR ADVANCEMENT OF WEATHER I

Article 4(Formulation of master plans for advancement of weather industry) #

(1) The Administrator of the Korea Meteorological Administration shall formulate and implement a master plan for the advancement of the weather industry (hereinafter referred to as "master plan") every five years, in consultation with the heads of the relevant central administrative agencies, to achieve the purposes of this Act in a systematic and efficient manner.

(2) A master plan shall include the following:

1. Domestic and international trends in the weather industry and its development prospects;

2. Objectives and basic direction for policies for the advancement of the weather industry;

3. Matters regarding the implementation of research and development and dissemination of the outcomes thereof for the development of the weather industry;

4. Matters regarding support for the development of the weather industry and expansion of investment therein;

5. Matters regarding the nurturing of specialists necessary for the weather industry;

6. Matters regarding facilitation for the enhancement and globalization of the weather industry;

7. Other matters prescribed by Presidential Decree to strengthen the competitiveness of the weather industry and expand the base necessary therefor.

(3) The Administrator of the Korea Meteorological Administration shall, where intending to make a modification to a master plan, consult with the heads of the relevant central administrative agencies; provided, the foregoing shall not apply if it is intended to make a modification to the minor matters prescribed by Presidential Decree.

(4) Matters necessary for procedures, etc. for the formulation of master plans shall be prescribed by Presidential Decree.

Article 5(Formulation of implementation plans) #

(1) The Administrator of the Korea Meteorological Administration, in consultation with the heads of the relevant central administrative agencies, shall formulate and implement an implementation plan for the advancement of the weather industry (hereinafter referred to as "implementation plan") on a sectoral basis every year in accordance with the master plan.

(2) The head of each relevant central administrative agency shall submit the implementation results of the previous year's implementation plan under their jurisdiction to the Administrator of the Korea Meteorological Administration every year. <Amended on Feb, 6, 2024>

(3) The Administrator of the Korea Meteorological Administration and the heads of related central administrative agencies shall endeavor to secure financial resources necessary for implementing implementation plans by jurisdiction. <Added on Feb. 6, 2024>

(4) Matters necessary for the formulation of implementation plans, procedures for the submission of the results of implementation plans by jurisdiction, and others shall be prescribed by Presidential Decree. <Amended on Feb. 6, 2024>

CHAPTER III REGISTRATION OF WEATHER FORECASTING BUSINESS

Article 6(Registration of weather forecasting business) #

(1) A person who intends to engage in the weather forecasting business, meteorological appraisal business, weather consulting business, or meteorological equipment business (hereinafter referred to as the "weather business") shall have personnel and facilities prescribed by Presidential Decree and file for registration with the Administrator of the Korea Meteorological Administration.

(2) If a weather business operator intends to make any modification to registered matters, they shall file for registration of modification with the Administrator of the Korea Meteorological Administration; provided, if they intends to make any modification to the minor matters prescribed by Decree of the Ministry of Environment, they shall file a report with the Administrator of the Korea Meteorological Administration.

(3) The scope of services of the weather forecasting business, etc. shall be prescribed by Presidential Decree.

(4) Matters necessary for procedures, etc. for registration, registration of modification, and report of modification under paragraphs (1) and (2) shall be prescribed by Decree of the Ministry of Environment.

Article 6-2(Report of temporary closure, permanent closure, and resumption of business) #

Where a weather business operator intends to close their business temporarily or permanently or to resume their business after a temporary business closure, he or she shall report such to the Administrator of the Korea Meteorological Administration as prescribed by Decree of the Ministry of Environment.

Article 7(Grounds for disqualification) #

No person falling under any of the following subparagraphs shall file for registration for the weather business: <Amended on Feb. 3, 2015; Dec. 27, 2016>

1. A person under adult guardianship or limited guardianship;

2. A person declared bankrupt and not yet reinstated;

3. A person in whose case 1 year has not passed from the date the imprisonment with labor or heavier punishment declared by a court was completely executed or the non-execution of the sentence became final;

4. A person who is under suspension of the execution of the imprisonment with labor or heavier punishment declared by a court for violating this Act;

5. A person in whose case 1 year has not passed since their registration was revoked under Article 8(1) (excluding cases where their registration was revoked under Article 8(1)6);

6. A corporation whose executive officers include any of the persons described in subparagraphs 1 through 5.

Article 8(Revocation of registration) #

(1) The Administrator of the Korea Meteorological Administration may, where a weather business operator falls under any of the following subparagraphs, revoke the registration or order the suspension of business operations for a fixed period not exceeding 3 months; provided, where the weather business operator falls under any of subparagraphs 1 through 3 or 6, he or she shall revoke the registration: <Amended on Dec. 27, 2016>

1. Where a weather business operator files for registration by fraud or other improper means;

2. Where a weather business operator engages in business activities during the period of a disposition suspending business operations;

3. Where a weather business operator has been subject to disposition suspending business operations more than three times in a year;

4. Where a weather business operator ceases to satisfy the registration requirements under Article 6(1);

5. Where a weather business operator fails to file for registration of modification or file a report of modification under Article 6(2);

5-2. Where a weather business operator fails to report the temporary closure, permanent closure, and resumption of business under Article 6-2;

6. Where a weather business operator falls under any of the subparagraphs of Article 7; provided, the foregoing shall not apply where an executive officer of a corporation who falls under any of subparagraphs 1 through 5 of Article 7 is replaced within 2 months;

7. Where a weather business operator fails to comply with a request for correction prescribed in Article 14(2).

(2) The Administrator of the Korea Meteorological Administration may revoke registration where a weather business operator closes their business practically and reports the permanent closure of business to the head of the competent tax office under Article 8(8) or (9) of the Value-Added Tax Act, or the head of the competent tax office deletes their business registration. <Added on Dec. 27, 2016; Dec. 31, 2018; Dec. 22, 2020>

(3) Where necessary for revoking the registration due to the grounds under paragraph (2), the Administrator of the Korea Meteorological Administration may request the head of the competent tax office to provide information on whether the business of the weather business operator is permanently closed. In this case, the head of the competent tax office in receipt of the request shall, as prescribed in Article 39 of the Electronic Government Act, provide information on whether the business of the weather business operator is permanently closed, in the absence of good cause to the contrary. <Added on Dec. 27, 2016>

(4) Matters necessary for the standards, procedures, etc. for imposing dispositions under paragraph (1) shall be prescribed by Decree of the Ministry of Environment. <Amended on Dec. 27, 2016>

CHAPTER IV SUPPORT FOR WEATHER INDUSTRY

Article 9(Support for research and development projects) #

(1) In order to support the research and development of technologies necessary for the implementation of projects of weather business operators, the Administrator of the Korea Meteorological Administration may select research and development projects deemed necessary for the advancement of the weather industry from among those applied for by weather business operators every year, and may enter into agreements with the following entities or organizations (hereinafter referred to as "lead research institutes") to conduct research. In such cases, with regard to an entity, among those under subparagraph 4, which does not have the power of representation, an agreement can be made with the representative of the corporation to which the entity belongs: <Amended on Mar. 9, 2011; Mar. 22, 2016; Jan. 5, 2021>

1. National and public research institutes;

2. Government-funded research institutes under the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutes or the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes;

3. Research institutes governed by the Specific Research Institutes Support Act;

4. Business-affiliated research institutes and departments solely responsible for research and development, among those recognized under Article 14-2(1) of the Basic Research Promotion and Technology Development Support Act, that always secure dedicated research personnel related to meteorological services;

5. Universities and colleges, industrial colleges, junior colleges, and technical colleges under the Higher Education Act;

6. Non-profit corporations in the field of meteorological services, which are established under the Civil Act or other Acts;

7. Other entities, organizations, or profit-making corporations that meet the requirements prescribed by Presidential Decree, including research personnel and facilities necessary for the promotion of research and development projects for the advancement of the weather industry.

(2) The Administrator of the Korea Meteorological Administration may pay expenses incurred in research as a contribution if an agreement under paragraph (1) is concluded.

(3) Matters necessary for research development projects, including the method of concluding agreements under paragraph (1) and the payment, use, and management of contributions under paragraph (2) shall be prescribed by Presidential Decree.

Article 10(Commercialization of research development outcomes) #

(1) The Administrator of the Korea Meteorological Administration may provide the following support to weather business operators, etc. that commercialize the outcomes of research and development (which means developing, producing and selling products using the developed technology or improving related technologies in the process; hereinafter the same shall apply) under Article 9:

1. Subsidization of expenses necessary for the development and production of prototypes and investment in facilities;

2. Creation of and permission to exclusive licenses or non-exclusive licenses of intellectual property rights, such as patent rights, granted as a result of research and development under Article 9 or the arrangement thereof;

3. Priority purchase of meteorological equipment, etc. produced through commercialization;

4. Grant of the right to use research equipment, facilities, and prototypes used or produced for research and development or arrangement therefor;

5. Other matters prescribed by Decree of the Ministry of Environment, which are necessary for commercialization.

(2) Matters necessary for methods, procedures, etc. for support under paragraph (1) shall be prescribed by Presidential Decree.

Article 11(Support for achieving international reliability of meteorological equipment) #

The Administrator of the Korea Meteorological Administration may implement the following projects to provide support for achieving international reliability of domestically developed meteorological equipment, etc.:

1. Counseling and provision of information necessary for achieving international reliability;

2. Projects necessary for supporting the evaluation of international reliability and analyzing the results of evaluation.

Article 11-2(Support for overseas expansion) #

(1) The Administrator of the Korea Meteorological Administration may promote the following projects in order to support international cooperation and overseas expansion of the weather industry:

1. Investigation and research for international cooperation and overseas expansion of the weather industry;

2. International exchanges on technology, human resources and information related to the weather industry;

3. Holding exhibitions and conferences on the weather industry;

4. Overseas marketing and publicity activities related to the weather industry and weather technology;

5. Providing support regarding overseas expansion of weather industrial bodies (referring to business operators operating in the weather industry; hereinafter the same shall apply), such as information, consultation, advice, and education.

(2) Where a weather industrial body promotes any of the following projects, the Administrator of the Korea Meteorological Administration may subsidize or lend some of necessary expenses in order to enhance the international competitiveness of the weather industry:

1. Development, design, and construction of meteorological technology and equipment;

2. Expansion into overseas markets related to the weather industry;

3. International exchange of technology, human resources, and information related to the weather industry;

4. Other projects prescribed by Presidential Decree to strengthen the international competitiveness of the weather industry.

CHAPTER V DISSEMINATION AND FACILITATION OF USE OF WEATHER I

Article 12(Fact-finding surveys on weather industry) #

(1) The Administrator of the Korea Meteorological Administration may conduct fact-finding surveys and collect data on the weather industry in order to systematically facilitate the advancement of the weather industry and efficiently formulate and implement master plans, implementation plans, etc.

(2) Where it is deemed necessary for the fact-finding surveys and data collection under paragraph (1), the Administrator of the Korea Meteorological Administration may request the relevant administrative agencies, research institutes, educational institutions, weather business operators, or other such entities to submit necessary data or opinions.

(3) Matters necessary for the scope, procedures, etc. of the fact-finding surveys under paragraph (1) shall be prescribed by Presidential Decree. <Added on Nov. 26, 2019>

Article 13(Facilitation of use of weather information) #

(1) The Administrator of the Korea Meteorological Administration may request cooperation from any of the entities under the subparagraphs of Article 3(1) of the Weather Observation Standardization Act to facilitate the private use of weather information.

(2) The Administrator of the Korea Meteorological Administration shall recommend persons who satisfy the requirements for qualification prescribed by Decree of the Ministry of Environment to provide weather information to the persons who provide weather information by using any of the following means, and establish policy measures necessary therefor:

1. Broadcasting under subparagraph 1 of Article 2 of the Broadcasting Act;

2. Telecommunications under in subparagraph 1 of Article 2 of the Framework Act on Telecommunications.

Article 14(Indication of sources of weather information) #

(1) Where a weather business operator provides weather information to a third party, they shall indicate the source. <Amended on Feb. 3, 2015>

(2) If the weather service provider fails to indicate the source under paragraph (1), the Administrator of the Korea Meteorological Administration may require correction. <Amended on Feb. 3, 2015>

Article 15(Provision of weather information) #

(1) Where a weather business operator applies for the provision of weather information, the Administrator of the Korea Meteorological Administration shall provide such information in the absence of good cause to the contrary. <Amended on May 26, 2020>

(2) When the Administrator of the Korea Meteorological Administration provides weather information under paragraph (1), a fee may be collected to cover expenses incurred in the provision of the weather information.

(3) Matters necessary for the method of providing weather information under paragraph (1), fees under paragraph (2), and others shall be prescribed by Decree of the Ministry of Environment.

Article 16(Designation of weather information support institution) #

(1) In order to efficiently provide weather information under Article 15(1) of this Act and Article 36-2(1) of the Weather Act, the Administrator of the Korea Meteorological Administration may designate a non-profit corporation with personnel and facilities prescribed by Presidential Decree and require it to perform the duties on their behalf. <Amended on Feb. 3, 2015>

(2) If an institution designated under paragraph (1) (hereinafter referred to as "weather information support institution") no longer meets the requirements for designation, the Administrator of the Korea Meteorological Administration may issue a correction order specifying a period not exceeding 2 months; and if the weather information support organization has been issued a correction order more than 3 times in a year but fails to comply therewith, the designation may be revoked.

(3) The Administrator of the Korea Meteorological Administration may subsidize expenses necessary for the weather information support organization to provide weather information within the budget.

(4) Matters necessary for the designation of a weather information support organization shall be prescribed by Presidential Decree.

Article 16-2(Designation of specialized graduate schools for convergence analysis of weather and climate data) #

(1) The Administrator of the Korea Meteorological Administration may designate a specialized graduate school for convergence analysis of weather and climate data as prescribed by Presidential Decree (hereinafter referred to as a "specialized graduate school") among graduate schools under Article 29 of the Higher Education Act and graduate school universities or colleges under Article 30 of that Act in order to train specialized professionals necessary for the promotion of the weather industry.

(2) The Administrator of the Korea Meteorological Administration may provide necessary support for the operation of specialized graduate schools designated under paragraph (1).

(3) Matters necessary for the standards and procedures for designating specialized graduate schools under paragraph (1), the content of support under paragraph (2), and others shall be prescribed by Presidential Decree.

Article 17(Establishment of Korea Meteorological Institute) #

(1) The Korea Meteorological Institute (hereinafter referred to as the "Institute") shall be established to support and foster the weather industry, develop and support weather technology, and promote the utilization of weather information. <Amended on Dec. 27, 2016; Feb. 4, 2024>

(2) The Institute shall be a body corporate. <Amended on Dec. 27, 2016>

(3) The Institute shall be established by filing for registration of incorporation at the site of location of its principal office. <Amended on Dec. 27, 2016>

(4) The Institute shall employ its executive officers and necessary employees as prescribed by the articles of incorporation. <Amended on Dec. 27, 2016>

(5) The Institute shall perform the following projects: <Amended on Jul. 16, 2013; Dec. 27, 2016; Feb. 6, 2024>

1. Surveys and research on policies and technologies to foster the weather industry and meteorological technology and promote the utilization of meteorological information;

2. Surveys and analysis of the weather industry market and use of collected information;

3. Support for startup and management in the weather industry;

4. Support for overseas expansion of the weather industry and weather technology, and international cooperation projects;

5. Projects related to the establishment of infrastructure, including the installation of support facilities to promote the weather industry, weather technology, and utilization of weather information;

6. Planning, management, evaluation of the research and development programs under the jurisdiction of the Korea Meteorological Administration, and facilitating the dissemination and practical use of the outcomes of the programs;

7. Promotion of the collection, management, analysis, provision, and utilization of converged weather information under Article 23(3) of the Meteorological Act;

8. Fostering, education, and training of professionals in the weather industry, weather technology, and weather information utilization;

9. Publicity, exhibition, and education for understanding, utilization, and dissemination of the weather industry, weather technology, and weather information;

10. Verification and type approval of meteorological and seismological observation equipment and other projects related thereto;

11. Installation, inspection, and operation of meteorological and seismological observation equipment and technical support related to such equipment;

12. Projects entrusted to the Institute by the State, a local government, or any other person; or those designated as the business of the Institute under other statutes and regulations;

13. Other projects prescribed by Presidential Decree to achieve the establishment purposes of the Institute.

(6) The Government may contribute or subsidize expenses incurred in the operation of the Institute and the execution of projects under the subparagraphs of paragraph (5). <Amended on Jul. 16, 2013; Dec. 27, 2016>

(7) The Government may, where necessary for the establishment and operation of the Institute, lease State property free of charge notwithstanding the provisions of the State Property Act. <Amended on Dec. 27, 2016>

(8) The provisions of the Civil Act governing incorporated foundations shall apply mutatis mutandis to the Institute, except as provided in this Act and the Act on the Management of Public Institutions. <Amended on Dec. 27, 2016>

CHAPTER VI LICENSING OF FORECASTERS

Article 18(Licensing of weather forecasters) #

(1) Persons falling under any of the following subparagraphs may become weather forecasters or meteorological appraisers after obtaining a license from the Administrator of the Korea Meteorological Administration:

1. A person who has obtained a professional engineer qualification in the field of meteorology under the National Technical Qualifications Act;

2. A person who has been engaged in weather-related fields prescribed by Presidential Decree for at least 2 years after obtaining an engineer qualification in the field of meteorology under the National Technical Qualifications Act;

3. A person who has completed an educational course prescribed by Presidential Decree after obtaining an engineer qualification in the field of meteorology under the National Technical Qualifications Act.

(2) Matters necessary for procedures for obtaining a license for weather forecaster or meteorological appraiser, fees, license certificates, etc. shall be prescribed by Presidential Decree.

(3) A person who has obtained a license for weather forecaster or meteorological appraiser shall undergo refresher training within 1 year from the date of every fifth anniversary after obtaining the license, as prescribed by Decree of the Ministry of Environment.

(4) No weather forecaster or meteorological appraiser shall lend his or her license to another person.

(5) No person other than a weather forecaster or meteorological appraiser shall use the title "weather forecaster" or "meteorological appraiser".

Article 19(Grounds for disqualification of weather forecaster or weather appraisal) #

None of the following persons shall become a weather forecaster or meteorological appraiser: <Amended on Feb. 3, 2015; Dec. 27, 2016>

1. A person under adult guardianship or limited guardianship;

2. Deleted; <Apr. 18, 2017>

3. A person for whom three years have not elapsed since his or her imprisonment without labor or heavier punishment declared by a court for violation of this Act was completely executed or exempted;

4. A person for whom 1 year has not elapsed since their license was revoked under Article 20(1) (excluding cases where their license was revoked under Article 20(1)8).

Article 20(Revocation and suspension of licenses) #

(1) If any of the following subparagraphs applies to a weather forecaster or meteorological appraiser, the Administrator of the Korea Meteorological Administration may revoke their license or suspend the validity thereof for up to 1 year; provided, such license shall be revoked in the case of subparagraphs 1,2, and 8:

1. Where a weather forecaster or weather appraiser has obtained their license by fraud or other improper means;

2. Where a weather forecaster or meteorological appraiser continues to practice using their title even after being subject to disposition on suspension of license;

3. Where a meteorological appraiser makes a fraudulent appraisal;

4. Where a meteorological appraiser delays meteorological appraisal work without good cause or performs a meteorological appraisal without sufficient investigation;

5. Where a weather forecaster or meteorological appraiser divulges the personal information of clients, that they has learned in the course of performing their duties;

6. Where a weather forecaster or meteorological appraiser fails to undergo refresher education under Article 18(3);

7. Where a weather forecaster or meteorological appraiser lends their license to another person, in violation of Article 18(4);

8. Where a weather forecaster or weather appraiser falls under any of the subparagraphs of Article 19.

(2) Matters necessary for the criteria, procedures, etc. for dispositions imposed under paragraph (1) shall be prescribed by Decree of the Ministry of Environment.

Article 21(Expansion of employment for holders of weather-related licenses and qualification certificates) #

The Administrator of the Korea Meteorological Administration shall encourage the expansion of employment of weather forecasters, meteorological appraisers, or persons who have obtained technical qualifications in the field of meteorology in accordance with the National Technical Qualifications Act, and shall establish and implement necessary policy measures for this purpose. <Amended on May 26, 2020>

CHAPTER VII SUPPLEMENTARY PROVISIONS

Article 22(Submission of data and inspection) #

(1) The Administrator of the Korea Meteorological Administration may, if deemed necessary, require a weather business operator or weather information support institution to submit necessary data as prescribed by Presidential Decree, and the Administrator may, when deemed necessary in relation to illegal or unlawful business management, etc., require public officials under their control to enter the office, inspect ledgers, documents, or other objects, or ask questions to relevant persons.

(2) A public official who enters an office to conduct inspections under paragraph (1) shall carry a certificate indicating their authority and show it to the relevant persons.

Article 23(Hearings) #

The Administrator of the Korea Meteorological Administration shall hold a hearing if they intends to impose any of the following disposition:

1. Revocation of registration of a weather business in accordance with Article 8;

2. Revocation of designation of a weather information support institution in accordance with Article 16(2);

3. Revocation of license for weather forecaster or meteorological appraiser in accordance with Article 20(1).

Article 24(Delegation of authority) #

The authority of the Administrator of the Korea Meteorological Administration under this Act may, in part, be delegated to the head of an institution under his or her control as prescribed by Presidential Decree.

Article 25(Legal fiction as public officials for purposes of applying penalty provisions) #

An executive officer or employee who engages in the provision of weather information at a weather information support institution shall be deemed public officials for purposes of applying Articles 129 through 132 of the Criminal Act.

CHAPTER VIII PENALTY PROVISIONS

Article 26(Penalty provisions) #

(1) If a weather forecaster or meteorological appraiser gives and receives, demands, or promises money or other valuables or benefits in return for an improper solicitation in the course of performing their duties, he or she shall be punished by imprisonment with labor for not more than 3 years or by a fine not exceeding 30 million won. <Amended on Mar. 18, 2014; May 26, 2020>

(2) Any of the following persons shall be punished by imprisonment with labor for not more than 2 years or by a fine not exceeding 20 million won: <Amended on Mar. 18, 2014>

1. A person who engages in the weather business without filing for registration or registration of modification under Article 6(1) or (2);

2. A person who files for registration or registration of modification under Article 6(1) or (2) by fraud or other improper means;

3. A person who lends a license for weather forecaster or meteorological appraiser to another person, in violation of Article 18(4);

4. A person who uses the title "weather forecaster" or "meteorological appraiser", in violation of Article 18(5);

5. A person who continues to provide services by using the title "weather forecaster" or "meteorological appraiser" even after being subject to a disposition on suspension of license imposed under Article 20(1).

(3) A meteorological appraiser who makes a fraudulent appraisal shall be punished by imprisonment with labor for not more than 1 year or by a fine not exceeding 10 million won. <Amended on Mar. 18, 2014>

Article 27(Joint penalty provisions) #

If the representative of a corporation or an agent or employee of, or other person employed by a corporation or an individual commits a violation described in Article 26 in connection with the business of the corporation or the individual, not only shall the violator be punished accordingly, but also the corporation or the individual shall be punished by a fine prescribed in the relevant Article; provided, this shall not apply to cases where the corporation or the individual has not been negligent in giving due attention and supervision concerning the relevant business to prevent the violation.

Article 28(Administrative fines) #

(1) A person who fails to submit data under Article 22 without good cause or submits false data, refuses or impedes the inspection by the relevant public officials, refuses to answer questions or hampers questioning by them shall be subject to an administrative fine not exceeding 2 million won.

(2) Administrative fines under paragraph (1) shall be imposed and collected by the Administrator of the Korea Meteorological Administration as prescribed by Presidential Decree.
