PROMOTION OF THE MOTION PICTURES AND VIDEO PRODUCTS ACT — 법갈피

Article 3(Master plans for promoting motion pictures and plans for implementation thereof) #

(1) The Minister of Culture, Sports and Tourism shall formulate and implement a master plan for promoting motion pictures and an implementation plan thereof to enhance the film and video culture and to develop the film and video industry, upon recommendation by the Korean Film Council established pursuant to Article 4 (hereinafter referred to as the "Korean Film Council") and the Korean Film Archive established pursuant to Article 34 (hereinafter referred to as the "Korean Film Archive"). <Amended on Feb. 29, 2008; Aug. 8, 2023>

(2) The master plan for promoting motion pictures under paragraph (1) shall contain the following matters: <Amended on Jun. 5, 2008; Feb. 17, 2012; May 18, 2015; Feb. 3, 2016; Mar. 13, 2018; May 18, 2021; Dec. 28, 2021; Aug. 8, 2023>

1. Basic direction-setting for promoting Korean motion pictures;

2. Surveys and research for promoting the production of motion pictures, establishment of the motion picture-making infrastructure, and development of related technologies;

3. Surveys, research, and development for promoting the distribution of motion pictures and developing exhibition systems;

4. Exports and international marketing of Korean motion pictures;

5. Collecting and preserving film materials;

6. Developing human resources in the film industry and improving motion picture workers' working environments;

6-2. Raising awareness of respect for human rights and gender equality in the film industry;

6-3. Cultivating and supporting art films and independent films;

7. Securing financial resources to expand the financial basis necessary for the promotion of motion pictures and devising ways to efficiently manage such resources;

8. International exchange and cooperation in the field of motion pictures;

9. Basic direction-setting for promoting digital cinemas, creation of infrastructure for the digital cinema industry, and measures for financing and efficient operation thereof;

10. Developing and standardizing film technology, quality certification of digital cinemas, and facility standards for, etc.;

11. Facilitating the diversification and publicness of the film and video culture;

11-2. Promoting local film and video culture;

12. Matters concerning the safety, sanitation, and disease control with respect to infectious diseases, etc. in movie theaters;

13. Other necessary matters to promote movie arts.

(3) The Minister of Culture, Sports and Tourism may prescribe matters concerning technical standards, quality certification, facility standards, etc. related to paragraph (2) 10 for the development of the digital cinema, and recommend them to relevant enterprises, such as motion picture enterprises; provided, where the Minister of Culture, Sports and Tourism intends to prescribe the technical standards, the Minister shall consult with the Minister of Trade, Industry and Resources. <Added on Jun. 5, 2008; Mar. 23, 2013; Oct. 1, 2025>

Article 14(Korean Film Council's functions) #

(1) The Korean Film Council shall deliberate on, and resolve, the following matters: <Amended on Jan. 26, 2007; Jun. 5, 2008; Feb. 3, 2016; Mar. 13, 2018; May 18, 2021; Aug. 8, 2023>

1. Presentation of views on the formulation and alteration of master plans, etc. for the promotion of motion pictures;

2. Formulation and implementation of operational plans for the Korean Film Council;

3. Enactment, amendment and repeal of the Korean Film Council’s articles of association and rules;

4. Management and operation of facilities related to the production of films;

5. Management and operation of the Motion Picture Development Fund under Article 23;

6. Survey, research, education and training for promoting Korean motion pictures and fostering the film industry;

7. Support for the distribution of motion pictures;

7-2. Matters concerning the development of film technology related to digital cinema, establishment and dissemination of standards therefor, quality certification, facility standards, etc. of movie theaters, etc.;

8. International marketing and exchanges of Korean motion pictures;

9. Development of art films, independent films, animation films, small films and short films;

2. Animation films, small films and short films, or art films or independent films recognized by the Korean Film Council;

11. Raising of awareness of respect for human rights and gender equality in the film industry;

12. Recognition of co-produced motion pictures as Korean motion pictures under Article 27;

13. Operation of the integrated computer network for movie theater admission tickets under Article 39;

14. Operation and improvement of the screen quota system for Korean motion pictures under Article 40;

14-2. Promotion of local film and video culture;

15. Implementation of policies for promoting the video industry;

16. Encouragement of wider use of a standard form contract and improvement of working environment in the film industry;

17. Other matters deemed necessary by the Korean Film Council.

(2) The Korean Film Council shall be deemed as the deliberative committee on fund management under Article 74(1) of the National Finance Act, when it deliberates on an important matter related to management and operation of the Motion Picture Development Fund pursuant to paragraph (1)5. <Added on Jan. 26, 2007>

Article 25-2(Collection of charges) #

(1) The Korean Film Council shall collect an amount equivalent to 3/100 of the admission ticket value from audiences entering a movie theater (including non-permanent movie theaters; hereafter the same shall apply in this Article) as a charge for the development of Korean films and the promotion of the movie and video product industries; provided, this shall not apply to audiences entering any of the following movie theaters:

1. A movie theater that has screened any motion picture falling under Article 38(1)2, for a period of at least 60/100 of the annual running days in the immediately preceding year;

2. A movie theater, the movie ticket sales of which (where at least 2 movie theaters are operated, referring to the aggregate movie tickets sales of each movie theater; and where the period of business in the immediately preceding year is shorter than 1 year, referring to an amount calculated by converting the sales of movie tickets in the relevant period to annual sales) in the immediately preceding year is less than the amount prescribed by Presidential Decree;

3. Movie theaters whose monthly sales of tickets decreased due to the outbreak of infectious disease under subparagraph 1 of Article 2 of the Infectious Disease Control and Prevention Act by more than a percentage prescribed by Presidential Decree (where two or more movie theaters are operated, it shall be based on the total amount of ticket sales for each movie theater) compared to the average sales of tickets in the same month for the three years (if the business period is less than three years, referring to the business period) immediately before the outbreak of infectious diseases; provided, if the business days of the same month for the three years immediately preceding the year of the outbreak of the infectious disease are less than one month, the amount of ticket sales for the month shall be based on the amount converted into monthly sales; if there are no business days of the same month, the average monthly ticket sales during the business period up to the year immediately before the outbreak of the infectious disease shall be based on the average monthly ticket sales.

(2) Every movie theater operator shall collect the charges under paragraph (1) from the audiences and pay the relevant charges to the Korean Film Council by payment deadline prescribed by Presidential Decree.

(3) Whenever paying charges collected under paragraph (2), every movie theater operator shall submit the materials related to the receipt of such charges, including a copy of the charge receipt ledger, to the Korean Film Council; provided, if the Korean Film Council is able to verify the charges that should be collected by every movie theater operator through the integrated computer network for processing movie theater admission tickets referred to in Article 39(1), no materials related to the receipt of such charges need be submitted.

(4) Where a movie theater operator fails to pay the charges received from audiences under paragraph (2) by the deadline for payment, the Korean Film Council may impose an amount equivalent to 3/100 of the amount in arrears as additional dues.

(5) Where a movie theater operator fails to pay the charges under paragraph (2) and the additional dues under paragraph (4) by the payment deadline, the Korean Film Council may collect them in the same manner as national taxes are compulsorily collected.

(6) Matters necessary for the method of collecting charges and additional dues and the payment deadline thereof, submission of materials related to the receipt of charges, etc. shall be prescribed by Presidential Decree.

(7) The Korean Film Council may pay commission fees for the receipt of charges by the operators of movie theaters under paragraph (2) with approval from the Minister of Culture, Sports and Tourism. In such cases, the fees shall not exceed 3 percent of the amount of charges collected under paragraph (1).

Article 29(Film rating) #

(1) A motion picture enterpriser who has produced or imported a motion picture (including the trailers and advertising films), shall have the motion picture rated by the Korea Media Rating Board referred to in Article 71 (hereinafter referred to as the "Korea Media Rating Board") before the screening of such motion picture; provided, the same shall not apply to the following motion pictures: <Amended on Feb. 29, 2008; Aug. 8, 2023; Mar. 25, 2025>

1. Small films and short films to be screened free of charge at a specific place, exclusively for specific persons not including youth;

2. Motion pictures to be screened in the film festivals recommended by the Korean Film Council;

2-2. Motion pictures to be imported or re-screened with the same content of the motion pictures that have been rated;

3. Any motion picture recognized by the Minister of Culture, Sports and Tourism that the rating is unnecessary, such as those for international cultural exchanges.

(2) The rating for motion pictures under the main clause of paragraph (1) shall be classified as detailed in the following subparagraphs based on the contents of a motion picture and the degree of expression, etc.; provided, advertising films to be screened before or after the screening of motion pictures shall be rated only when they fall under subparagraph 1, and trailers shall be rated according to subparagraph 1 or 4, and trailers rated "adults only" shall be seen only before or after the screening of motion pictures rated "adults only": <Amended on May 8, 2009; Feb. 17, 2012; Aug. 8, 2023>

1. All ages admitted: Motion pictures that all ages are permitted to view;

2. 12 years or older admitted: Motion pictures that persons aged 12 or older are permitted to view;

3. 15 years or older admitted: Motion pictures that persons aged 15 or older are permitted to view;

4. Adults only: Motion pictures that no one under 18 is permitted to view;

5. Restricted: Motion pictures that need to be restricted to a certain extent in its screening, advertising and publicity, as they excessively express lewdness, violence, social acts, etc. and thus are likely to markedly hamper the universal human dignity, social values, good morals, or national sentiment.

(3) No one shall screen motion pictures that have not been rated, in violation of paragraphs (1) and (2).

(4) In cases of a motion pictures with any rating provided in paragraph (2)2 or 3, no one shall admit any person under the age permitted to view the relevant motion picture; provided, the same shall not apply where such person is accompanied by his or her parents or other guardians. <Amended on Oct. 16, 2018; Aug. 8, 2023>

(5) In cases of a motion picture with any rating provided in paragraph (2)4 or 5, no one shall admit any youth to view such motion picture. <Amended on Aug. 8, 2023>

(6) No one shall alter a rating under paragraph (1) or screen a motion picture by altering its contents differently from the rated version. <Amended on Aug. 8, 2023>

(7) The detailed criteria for the rating under paragraph (2) shall be prescribed by Presidential Decree based on the following matters: <Added on May 8, 2009>

1. Matters concerning the maintenance of the democratic basic order and the respect for human rights pursuant to the Constitution of the Republic of Korea;

2. Matters concerning the sound domesticity and the protection of children and youth;

3. Matters concerning the respect for social ethics;

4. Matters concerning the maintenance of the national identity and diplomatic relations;

5. Matters concerning the violence, lewdness, anti-social acts, etc. of motion pictures in their themes and contents;

6. Matters concerning the universal human dignity and social values, good morals, and national sentiment.

(8) The Korea Media Rating Board shall deliberate on any matter concerning the provision of content information when rating a motion picture pursuant to paragraph (1). <Added on May 8, 2009>

(9) The Korea Media Rating Board shall issue the following documents to the applicant when it has rated a motion picture: <Added on May 8, 2009; Oct. 16, 2018>

1. A film rating certificate stating the rating and content information of the motion picture;

2. Documents stating duties to be fulfilled according to the rating.

(10) Procedures and methods for the rating and the provision of content information, procedures for issuing film rating certificates, and other necessary matters under paragraphs (1), (8), and (9) shall be determined by the rules of the Korea Media Rating Board. <Added on May 8, 2009; Oct. 16, 2018>

Article 45(Suspension of business and cancellation of registration against movie theaters) #

(1) The head of Si/Gun/Gu may, in case that the operator of a movie theater falls under any one of the following subparagraphs, suspend his or her business for a fixed period of not more than 3 months or cancel the registration of the movie theater, as prescribed by Presidential Decree; provided, in the cases of falling under subparagraph 1 or 8, the registration shall be canceled: <Amended on Dec. 20, 2016; Dec. 24, 2018; Aug. 8, 2023>

1. Where he or she has got the movie theater registered by fraud or other improper;

2. Where he or she has violated the provisions of Article 29(3) through (6);

3. Where he or she has put up the advertising or publicity materials, or put them up in such a manner as to be seen from outside the restricted-screening theater, in violation of Article 33;

4. Where he or she has failed to meet the standards for facilities referred to in Article 36(1);

4-2. Where he or she has failed to take disaster prevention measures under Article 37(4);

5. Where he or she has failed to screen Korean motion pictures for not less than the annual running days provided for in Article 40;

6. Where he or she has failed to comply with the order to prohibit or suspend the screening of motion pictures under Article 42;

7. Where he or she has been subjected to the business suspension on at least three occasions a year;

8. Where he or she has run the business during the period of the business suspension.

(2) If the operator of a movie theater violates the main clause of Article 29(4) or paragraph (5) of that Article, among the provisions of paragraph (1)2, in which cases it is recognized that the operator of a movie theater was unaware of the youth's age or that he or she was unable to verify the youth's age due to violence or intimidation, the head of a Si/Gun/Gu may exempt him or her from the relevant administrative disposition, as prescribed by Presidential Decree. <Newly Inserted on Oct. 22, 2024>

(3) When the head of a Si/Gun/Gu intends to cancel registration pursuant to paragraph (1), he or she shall hold a hearing. <Amended on Aug. 8, 2023; Oct. 22, 2024>

(4) The operator of a restricted-screening theater whose registration is canceled under paragraph (1) shall be prohibited from getting his or her restricted-screening theater registered at the same place within 3 years from the date of cancellation of his or her registration. <Amended on Aug. 8, 2023; Oct. 22, 2024>

Article 46(Succession of business) #

(1) Where a movie theater operator transfers his or her business, dies, or merges with other corporations, and where the transferee or successor, or a corporation established by the merger or the surviving corporation in a merger intends to succeed to the status of the previous movie theater operator, he or she shall report such fact to the head of the competent Si/Gun/Gu within 30 days from the date of such transfer, succession, or merger, as prescribed by Decree of the Ministry of Culture, Sports and Tourism.

(2) Where a person who has acquired a movie theater according to any of the following procedures intends to succeed to the status of the previous movie theater operator, he or she shall report such fact to the head of the competent Si/Gun/Gu within 30 days from the date of such transfer, as prescribed by Decree of the Ministry of Culture, Sports and Tourism:

1. Auction under the Civil Execution Act;

2. Realization under the Debtor Rehabilitation and Bankruptcy Act;

3. The sale of seized property under the National Tax Collection Act, the Customs Act, or the Local Tax Collection Act;

4. Other procedures equivalent to those referred to in subparagraphs 1 through 3.

(3) Upon receipt of a report under paragraph (1) or (2), the head of a Si/Gun/Gu shall review the details thereof and accept the report if it conforms to this Act.

(4) Where the report under paragraph (1) or (2) is accepted, the transferee, the successor, a corporation established by the merger or the surviving corporation in a merger, or a person who acquires the movie theater shall succeed to the status of the previous movie theater operator on the date of such transfer, succession, merger, or takeover.

(5) Where the status of a movie theater operator is succeeded as a result of the acceptance of a report under paragraph (1), the effect of an administrative sanction that was imposed on the previous movie theater operator for a violation under the subparagraphs of Article 45(1) shall continue in force with the transferee, the successor, or the newly established or surviving corporation after merger for one year from the date on which the aforementioned sanction is taken; and where the procedures for an administrative sanction are under way, such procedures may be proceeded with against the transferee, the successor, or the newly established or surviving corporation after merger; provided, where the transferee, the successor, or the newly established or surviving corporation after merger was unaware of such sanction or violation at the time of acquisition of the business or the merger, the procedures for an administrative sanction shall not proceed.

Article 50(Rating) #

(1) A person who manufactures or distributes (including imports; hereinafter the same shall apply) video products shall have the contents of the relevant video products rated by the Korea Media Rating Board before he or she supplies the relevant products; provided, the same shall not apply to any of the following video products: <Amended on Feb. 29, 2008; Feb. 17, 2012; Oct. 16, 2018; Sep. 27, 2022; Aug. 8, 2023>

1. Video products offered free of charge for viewing by specific persons not including youth at a specific place;

2. Online video products offered free of charge for public viewing through information and communications networks; provided, this shall not apply to music and video files a person who operates business referred to in subparagraphs 8 through 11 of Article 2 of the Music Industry Promotion Act has manufactured, distributed or provided for public viewing;

3. Video products offered for viewing at any media contest or exhibition, etc. recommended by the Minister of Culture, Sports and Tourism or the head of the relevant central administrative agency;

4. Video products of the same contents as the motion pictures which have already been rated (excluding any restricted motion pictures). In such cases, the rating of the relevant motion pictures shall be deemed as that of the video products;

5. Video products prescribed by Presidential Decree that the rating is unnecessary in the light of their producers, types of distribution, etc.

(2) The Korea Media Rating Board shall confirm that a person who applies for the rating of video products pursuant to paragraph (1) has a legitimate right to produce or distribute the video products; provided, the same shall not apply where matters concerning legitimate rights for video products produced or imported for the purpose of providing them to a city hall using information and communication networks are displayed in an electronic manner prescribed by Presidential Decree. <Amended on Sep. 27, 2022>

(3) The rating of video products under paragraph (1) shall be as follows, based on the contents of the video products and the degree of expression of image, scripts, etc.: <Amended on May 8, 2009; Aug. 8, 2023>

1. All ages admitted: Video products that all ages are permitted to watch;

2. 12 years or older admitted: Video products that persons aged 12 or older are permitted to watch;

3. 15 years or older admitted: Video products that persons aged 15 or older are permitted to watch;

4. Adults only: Video products that the youth are not permitted to watch;

5. Restricted: Video products that need to be restricted to a certain extent in offering for its watching, distribution, etc. as they excessively express lewdness, violence, social acts, etc., and thus are likely to markedly hamper the universal human dignity, social values, good morals, or national sentiment.

(4) Deleted. <May 8, 2009>

(5) Detailed criteria for the rating under paragraph (3) shall be prescribed by Presidential Decree based on the matters referred to in Article 29(7). <Amended on May 8, 2009>

(6) The Korea Media Rating Board shall issue the following documents to the applicant when it has rated a video product: <Amended on May 8, 2009; Oct. 16, 2018>

1. A video rating certificate stating the rating and content information of the video product;

2. Documents stating duties to be fulfilled according to the rating.

(7) Procedures and methods for the rating, procedures for issuing a video rating certificate, and other necessary matters under paragraphs (1), (2) and (6) shall be determined by the rules of the Korea Media Rating Board. <Added on May 8, 2009; Oct. 16, 2018>

Article 50-3(Designation and re-designation of independent rating business entity) #

(1) The Minister of Culture, Sports and Tourism may designate an independent rating business entity allowed to conduct independent rating for a specified period not exceeding five years after examining the following matters among the business entities fulfilling the requirements under paragraph (2):

1. Propriety of the plan for operating independent rating affairs;

2. Propriety of the plan for protecting youths and users.

(2) Business entities shall meet the following requirements to be designated pursuant to paragraph (1):

1. A business entity falling under any of the following:

a. A corporation that engages in business providing online video products for viewing and files a report on value-added telecommunications business prescribed in Article 22 of the Telecommunications Business Act;

b. A CATV broadcasting business entity or satellite broadcasting business entity under the Broadcasting Act or an Internet multimedia broadcast service providers pursuant to the Internet Multimedia Broadcast Services Act;

2. No record of revocation of designation or suspension of business under Article 50-6(1) for the latest five years.

(3) Where an independent rating business entity intends to continue to conduct the affairs of independent rating after the expiration of the designation period under paragraph (1), he or she shall obtain re-designation from the Minister of Culture, Sports and Tourism.

(4) The Minister of Culture, Sports and Tourism may conduct re-designation under paragraph (3), the period of which shall not exceed five years, after deliberating on the following:

1. Whether the plans referred to in the subparagraphs of paragraph (1) have been implemented and the propriety of the future plan;

2. No record of finalized business suspension under Article 50-6(1) during the latest five years;

3. Whether the results of the evaluation and improvement measures under Article 50-8(4) have been implemented.

(5) Matters necessary for the evaluation and designation under paragraph (1) and the detailed standards, procedures, etc. for re-designation under paragraph (4) shall be prescribed by Presidential Decree.

Article 50-6(Revocation of designation of independent rating business entity) #

(1) Where an independent rating business entity falls under any of the following, the Minister of Culture, Sports and Tourism may revoke the designation thereof or order a suspension of business under the main clause of Article 50-2(1) for a specified period not exceeding six months; provided, the Minister shall revoke the designation in cases falling under subparagraph 1:

1. Where the entity has been designated by fraud or other improper means;

2. Where the entity has failed to observe the matters under Article 50-4;

3. Where the entity has failed to take measures under Article 50-7(4);

4. Where the entity has continued its business in violation of the business suspension order.

(2) Where any of the grounds referred to in paragraph (1)2 arises, the Minister of Culture, Sports and Tourism may determine corrective measures and recommend that an independent rating business entity accept such measures within ten days prior to the revocation of designation or an order to suspend business, and where an independent rating business entity takes corrective measures, the Minister need not revoke the designation or order to suspend business under paragraph (1).

(3) Where the Minister of Culture, Sports and Tourism revokes the designation or orders suspension of business operations pursuant to paragraph (1), the Minister shall hold a hearing under the Administrative Procedures Act.

(4) The revocation of designation pursuant to paragraph (1) shall not have an influence on the effect of rating conducted by an independent rating business entity before such revocation; provided, this shall not apply to the revocation of designation on the grounds referred to in paragraph (1)1.

(5) Procedures necessary for the revocation of designation and an order for suspension of business under paragraph (1) and detailed standards for application shall be prescribed by Presidential Decree.

Article 50-8(Support activities of the Korea Media Rating Board) #

(1) The Korea Media Rating Board may conduct the following to support the efficient performance of the duties of independent rating:

1. Establishment and provision of a database of rating information of online video products;

2. Establishment and operation of information and communications systems for the procedures for prompt rating of online video products;

3. Establishment and operation of on-line post management systems to verify compliance with subparagraphs 1 and 2 of Article 50-4;

4. Establishment and operation of online educational systems and face-to-face educational systems for persons in charge of rating under subparagraph 3 of Article 50-4;

5. Support for the affairs related to rating for the internal rating business entities of small enterprises under Article 2(2) of the Framework Act on Small and Medium Enterprises;

6. Establishment and operation of on-line educational systems and face-to-face educational systems to improve the capacity of users of information on independent rating;

7. Improvement of systems and establishment of cooperation systems for the protection of the rights and interests of users of independent rating information.

(2) The Korea Media Rating Board may form and operate its own sectional committees for the purpose of effectively carrying out the activities prescribed in each subparagraph of paragraph (1), as prescribed by the rules of the Korea Media Rating Board.

(3) The Korea Media Rating Board may disclose the matters notified by independent rating business entities to the public pursuant to subparagraph 2 of Article 50-4.

(4) The Korea Media Rating Board shall assess compliance with the matters prescribed in Article 50-4 and the duty to take measures under Article 50-7(4) every year to maintain the appropriateness of the duties of independent rating, notify the independent rating business entity of the assessment results, and may recommend that the business entity improve the relevant affairs depending on such results.

Article 63(Succession of business) #

(1) Where a video product manufacturing business operator, a video product distribution business operator, or a video service providing business operator who files a report or files for registration pursuant to Article 57 or 58 (hereinafter referred to as "video product manufacturing business operator, etc.") transfers his or her business, dies, or merges with other corporations, and where the transferee or successor, or a corporation established by the merger or the surviving corporation in a merger intends to succeed to the status of the previous video product manufacturing business operator, etc., he or she shall report such fact to the head of the competent Si/Gun/Gu within 30 days from the date of such transfer, succession, or merger, as prescribed by Decree of the Ministry of Culture, Sports and Tourism.

(2) Where a person who has acquired all of the business facilities and apparatuses related to video products of a video product manufacturing business operator, etc. (referring to the major facilities and apparatuses prescribed by Presidential Decree) according to any of the following procedures intends to succeed to the status of the previous video product manufacturing business operator, etc., he or she shall report such fact to the head of the competent Si/Gun/Gu within 30 days from the date of such transfer, as prescribed by Decree of the Ministry of Culture, Sports and Tourism:

1. Auction under the Civil Execution Act;

2. Realization under the Debtor Rehabilitation and Bankruptcy Act;

3. The sale of seized property under the National Tax Collection Act, the Customs Act, or the Local Tax Collection Act;

4. Other procedures equivalent to those referred to in subparagraphs 1 through 3.

(3) Upon receipt of a report filed under paragraph (1) or (2) with respect to a video service providing business operator registered under Article 58, the head of a Si/Gun/Gu shall review the details of the report and accept it if it complies with this Act. <Amended on Mar. 25, 2025>

(4) Where the head of a Si/Gun/Gu receives a report filed by a video product manufacturing business operator or a video product distributing business operator, or accepts a report filed by a video product service providing business operator under paragraph (1) or (2), the transferee, successor, a corporation established by the merger or surviving the merger, or a person who takes over all of the business facilities or apparatus related to video products shall succeed to the status of the previous video product manufacturing business operator, etc. on the date of transfer, inheritance, merger, or takeover. <Amended on Mar. 25, 2025>

(5) Where a video product manufacturing business operator, etc. whose business was closed or whose registration was revoked as a result of a report on business closure filed under Article 64 files a report on or files for registration of the same type of business again at the same place within one year, he or she shall succeed to the status of the video product manufacturing business operator, etc. before filing a report on business closure.

Article 66(Restrictions on advertisement and publicity) #

(1) A person who intends to distribute or post the advertising or publicity materials related to video products (excluding the video products referred to in Article 50(3)1 through 3) or to offer them for public viewing through the information and communications networks shall obtain a verification from the Korea Media Rating Board as to whether they are harmful to youth; provided, the same shall not apply to the advertising or publicity materials of a video product with a restricted rating. <Amended on May 8, 2009; Aug. 8, 2023>

(2) Advertising or publicity materials verified as harmful to youth under paragraph (1) shall not be distributed or posted. <Amended on Aug. 8, 2023>

(3) Notwithstanding the provisions of paragraph (2), any advertising or publicity materials through information and communications networks may be offered to the general public excluding youth for the purpose of their viewing in accordance with Article 42-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection; provided, the same shall not apply where the contents of such advertising or publicity materials are verified by the Korea Media Rating Board as falling under any subparagraph of Article 50(3)5. <Amended on May 8, 2009; Aug. 8, 2023>

(4) No person shall distribute or post advertising and publicity materials showing any contents or rating that differs from the original contents or rating of a classified video product.

(5) A person who advertises or publicizes a video product with a restricted rating shall post such advertising or publicity materials in a video-viewing mini-theater for video products with a restricted rating. In such cases, the relevant materials posted shall not be visible from outside a video-viewing mini-theater for video products with a restricted rating. <Added on May 8, 2009>

(6) Necessary matters concerning procedures for verification as to whether to be harmful to youth under paragraph (1) shall be prescribed by the rules of the Korea Media Rating Board. <Amended on May 8, 2009; Aug. 8, 2023>

Article 67(Administrative disposition) #

(1) In case where any person who has filed a report on a video product manufacturing business or a video product distribution business falls under any of the following subparagraphs, the head of a Si/Gun/Gu may order the suspension of the business for a fixed period not exceeding 6 months or the closure of the business; provided, in cases falling under subparagraph 1 or 4, he or she shall order the closure of the business: <Amended on May 8, 2009; Aug. 8, 2023>

1. Where he or she has filed the report by fraud or other improper means;

2. Where he or she has violated the provisions of Article 53(1);

3. Where he or she has failed to file a report of alteration as prescribed in Article 61(1);

4. Where he or she has continued to run his or her business in violation of the order given to suspend his or her business.

(2) In case any person who conducts a video service providing business falls under any one of the following subparagraphs, the head of Si/Gun/Gu may order the business to be suspended for a fixed period not exceeding six months or revoke the registration; provided, in cases falling under subparagraph 1 or 7, he or she shall revoke the registration: <Amended on May 8, 2009; Aug. 8, 2023; Oct. 22, 2024>

1. When he or she fails for registration by fraud or other improper means;

2. Where he or she has violated the provisions of Article 53(1) or (2);

3. Where he or she has failed to meet the standards for facilities as referred to in Article 58(1);

4. Where he or she has failed to file a report of alteration as prescribed in Article 61(1);

5. Where he or she has failed to abide by the matters to be observed as referred to in Article 62(1);

6. Where he or she conducts sexual traffic, etc., or arranges or provides sexual traffic, etc., referred to in Article 2(1) of the Act on the Punishment of Arrangement of Commercial Sex Acts;

7. Where he or she has continued to run his or her business in violation of the order given to suspend his or her business.

(3) If the operator of a movie theater violates the main clause of Article 29(4) or paragraph (5) of that Article, among the provisions of paragraph (1)2, in which cases it is recognized that the operator of a movie theater was unaware of the youth's age or that he or she was unable to verify the youth's age due to violence or intimidation, the head of a Si/Gun/Gu may exempt him or her from the relevant administrative disposition, as prescribed by Presidential Decree. <Newly Inserted on Oct. 22, 2024>

(4) The head of a Si/Gun/Gu shall hold a hearing if he or she intends to order the closure of business or revoke the registration in accordance with paragraphs (1) and (2). <Amended on Oct. 22, 2024>

(5) A person who has received an order to close his or her business or a disposition to revoke registration under paragraph (1) or (2) shall return the certificate of report or the certificate of registration within 7 days from the date he or she is notified of such disposition. <Amended on Aug. 8, 2023; Oct. 22, 2024>

(6) The detailed standards for administrative dispositions under paragraphs (1) and (2) shall be determined by Decree of the Ministry of Culture, Sports and Tourism, taking into account the type of violation, the degree of violation, etc. <Amended on Feb. 29, 2008; Aug. 8, 2023; Oct. 22, 2024>

Article 70(Closure and removal) #

(1) When any person operates business without reporting or registration under Articles 57 and 58, or when any person continues business after he or she was ordered to close the business or was subject to a disposition of revocation of registration in accordance with Article 67(1) or (2), the head of a Si/Gun/Gu may direct the relevant public officials to take the following actions, in order to close the relevant place of business: <Amended on May 8, 2009; Oct. 16, 2018>

1. To eliminate signboards or any other signs of business on the relevant business or the relevant place of business;

2. To post a notice informing that the relevant business or the relevant place of business is unlawful;

3. To affix seals to such apparatuses or facilities as may be necessary for operation of the business in order to prevent them from being used.

(2) The relevant video product business operator or his or her agent shall be notified in writing before the actions under paragraph (1) are taken; provided, this shall not apply if an urgent action is required for the safety and welfare of the general public. <Amended on Mar. 28, 2008; Oct. 16, 2018; Aug. 8, 2023>

(3) When any video products referred to in Article 53(1) are found, the Minister of Culture, Sports and Tourism, the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor"), or the head of a Si/Gun/Gu may direct the relevant public officials to remove and destroy them. <Amended on Feb. 29, 2008; May 8, 2009; May 18, 2015>

(4) When a public official has removed the relevant video products pursuant to paragraph (3), he or she shall issue a certificate of removal to the owner or possessor of such products; provided, the same shall not apply where he or she refused to receive it. <Amended on Oct. 16, 2018; Aug. 8, 2023>

(5) The Minister of Culture, Sports and Tourism, a Mayor/Do Governor, or the head of a Si/Gun/Gu may, if necessary, request the video product organization to cooperate with the relevant public officials in performing the duties of removal and destruction pursuant to paragraph (3). <Amended on Feb. 29, 2008; Aug. 8, 2023>

(6) Except as otherwise provided in paragraphs (1) through (5), Article 32 or 33 of the Framework Act on Administration shall apply to administrative compulsion under paragraphs (1) and (3). <Amended on Mar. 25, 2025>

(7) Where an online video product falls under any subparagraph of Article 53 (1), the Minister of Culture, Sports and Tourism may request that the Korea Media and Communications Commission issue a corrective order to the information and communications service provider under Article 2(1)3 of the Act on Promotion of Information and Communications Network Utilization and Information Protection or to a person who manages and operates the bulletin board under Article 2(1)9 to take correctional measures such as refusal, suspension, or restriction of such handling. In such cases, prior deliberation by the Korea Media Rating Board shall be required. <Added on Sep. 27, 2022; Oct. 1, 2025>

(8) The Korea Media Rating Board may, after deliberation pursuant to the latter part of paragraph (7), request that the Korea Media and Communications Standards Commission under Article 18 of the Act on the Establishment and Operation of Korea Media and Communications Commission deliberate and make a request for correction pursuant to subparagraph 4 of Article 22 of that Act. <Added on Sep. 27, 2022; Oct. 1, 2025>

Article 90(Fees) #

(1) Deleted. <May 18, 2015>

(2) Any of the following persons shall pay the Korea Media Rating Board the fees determined by the Korea Media Rating Board upon approval of the Minister of Culture, Sports and Tourism; provided, a person falling under subparagraph 1 or 4 who does not have a profit-making purpose shall be exempted from such fees: <Amended on Feb. 29, 2008; Feb. 17, 2012; Oct. 16, 2018; Sep. 27, 2022; Aug. 8, 2023>

1. A person who applies for film rating pursuant to Article 29(1);

2. A person who raises an objection pursuant to Article 31;

3. A person who applies for a verification as to whether advertising or publicity materials of motion picture are harmful to youth pursuant to Article 32;

4. A person who applies for the rating of video products pursuant to Article 50(1);

4-2. A person who requests rating under Article 50-2(3);

5. A person who applies for the confirmation of reproduced video products, etc. or the re-issuance of the certificate of confirmation pursuant to Article 51;

6. A person who applies for the reclassification pursuant to Article 54(1);

7. A person who applies for a verification as to whether advertising or publicity materials related to video products are harmful to youth pursuant to Article 66(1).

(3) Any of the following persons shall pay fees, as prescribed by municipal ordinance of each Si/Gun/Gu (referring to an autonomous Gu): <Amended on May 8, 2009; Dec. 24, 2018; Aug. 8, 2023>

1. A person who applies for the registration or alteration of registered matters pursuant to Article 36(1);

1-2. A person who files a report on a motion picture enterpriser or files a report on the change thereof pursuant to Article 26(1);

1-3. A person who applies for the re-issuance of a certificate of report pursuant to Article 26(3);

2. A person who files a report on a video product manufacturing business or a video product distributing business pursuant to Article 57(1);

3. A person who applies for the registration of a video service providing business pursuant to Article 58(1);

4. A person who files a report on alterations or files for registration of alterations pursuant to Article 61(1).

(4) Where the Korea Media Rating Board intends to determine the fees referred to in paragraph (2), it shall consider opinions of relevant enterprisers. <Added on May 18, 2015>

Article 95(Penalty provisions) #

Any of the following persons shall be punished by imprisonment with labor for not more than 2 years, or by a fine not exceeding 20 million won: <Amended on May 8, 2009; Oct. 16, 2018; Aug. 8, 2023; Oct. 22, 2024; Mar. 25, 2025>

1. A person who has screened a motion picture, in violation of Article 29(6);

2. A person who has posted the advertising or promotion materials related to any restricted motion picture or has them available outside a restricted-screening theater, in violation of Article 33;

3. A person who has screened any such motion picture referred to in Article 29(2)1 through 4 in a restricted-screening theater, in violation of Article 43(3);

4. A person who has failed to comply with an order given to suspend business under Article 45;

5. A person who has obtained the rating of video products under Article 50(1) or has received the confirmation of reproduction, distribution, etc. under Article 51(1) without any legitimate right to such video products in any false or other unjust manner;

6. A person who has manufactured or distributed illegal video products, offered them for viewing, or to this end, displayed or kept them, in violation of Article 53(1);

7. A person who has sold, purchased or donated the rating certificate and the certificate of confirmation, in violation of Article 53(4);

8. A person who offers a video product under Article 50(3)1 through 4 to the general public for their viewing at a video-viewing mini-theater for video products with a restricted rating, in violation of Article 53-2(3);

9. A person who has engaged in video service providing business without registering the business, in violation of Article 58(1);

10. A person who has failed to abide by the matters to be observed, in violation of Article 62(1)3;

11. A person who posts the advertising or promotion materials of video products with a restricted rating at places, other than the inside of a video-viewing mini-theater for video products with a restricted rating, or makes them visible outside a video- viewing mini-theater for video products with a restricted rating, in violation of Article 66(5);

12. A person who has continued business, in violation of an order to suspend such business under Article 67(2).

Article 98(Administrative fines) #

(1) Any of the following persons shall be subject to imposition of an administrative fines not exceeding 50 million won: <Amended on May 18, 2015; Sep. 27, 2022; Aug. 8, 2023>

1. A person who admits any person prohibited from viewing a motion picture with a film rating provided for in Article 29(2)2 through 4 to his or her movie theater to view such motion picture, in violation of Article 29(4) or (5);

2. A person who distributes or posts advertising or publicity materials without obtaining verification as to whether they are harmful to youth or offers such materials for public viewing through the information and communications networks, in violation of Article 32(1);

3. A person who distributes or posts advertising or publicity materials verified as harmful to youth, in violation of Article 32(2);

3-2. A person who fails to comply with an order to suspend business under Article 50-6(1);

4. A person who offers video products for viewing, in violation of Article 53(2);

5. A person who fails to obtain verification as to whether advertising or publicity materials are harmful to youth, in violation of Article 66(1);

6. A person who distributes or posts advertising or publicity materials which are verified as harmful to youth, in violation of Article 66(2).

(2) Any of the following persons shall be subject to imposition of an administrative fine not exceeding 10 million won: <Amended on Jan. 26, 2007; May 8, 2009; May 18, 2015; Dec. 20, 2016; Dec. 24, 2018>

1-2. A person who operates business manufacturing, importing, distributing or screening motion pictures without reporting thereon, in violation of Article 26(1);

2. A person who fails to submit a motion picture film, etc. in violation of Article 35(1);

3. A person who establishes and operates a movie theater without having such movie theater registered, in violation of Article 36(1);

4. A person who fails to formulate, report on or supplement a safety-precaution plan, in violation of the former part of Article 37(1) or paragraph (2) of the same Article;

4-2. A person who fails to take disaster prevention measures in violation of Article 37(4);

5. A person who transmits the data related to the matters prescribed by Decree of the Ministry of Culture, Sports and Tourism, such as the number of viewers entering the relevant movie theater and the amount of sales of admission tickets through the integrated computer network for processing movie theater admission tickets, with intentional omission or manipulation, in violation of Article 39(3);

6. A person who fails to report or makes a false report, in violation of Article 41;

7. A person who allows a person without the national technical qualifications for motion picture projection to screen any motion picture, in violation of Article 44;

8. A person who fails to report or obtain registration of any alteration, in violation of Article 61(1);

9. A person who fails to indicate a rating or content information of a video product or misstates such rating or content information, in violation of Article 65(1) or (2).

(3) Any of the following persons shall be subject the imposition of an administrative fine not exceeding three million won: <Amended on May 18, 2015; Dec. 24, 2018>

1. A person who fails to report on any alteration, in violation of the latter part of Article 26(1);

2. A person who has fails to register alteration of any registered matter involving a movie theater, in violation of the latter part of Article 36(1);
