Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Special Act on the Restoration of Honor for Participants in the Donghak Peasants Revolution, and matters necessary for the enforcement thereof. <Amended on Jun. 4, 2007>
Article 2(Composition of Deliberation Committee for Restoration of Honor for Participants in Donghak Peasants Revolution) #
The competent public officials among the members of the Deliberation Committee for Restoration of Honor for Participants in Donghak Peasants Revolution (hereinafter referred to as the "Committee") pursuant to Article 3 of the Special Act on the Restoration of Honor for Participants in the Donghak Peasants Revolution (hereinafter referred to as the "Act") shall be appointed from among public officials at the Director-General level of the Ministry of the Interior and Safety, the Ministry of Patriots and Veterans Affairs, and the Ministry of Culture, Sports and Tourism, and the Ministry of Planning and Budget who shall be designated by the heads of the respective agencies. <Amended on Apr. 11, 2023; Dec. 30, 2025>

Article 3(Duties of chairperson) #
(1) The chairperson of the Committee shall represent the Committee and exercise overall control over its affairs.
(2) If the chairperson is unable to perform his or her duties due to unavoidable reasons, a member of the Committee designated in advance by the chairperson shall perform his or her duties.
Article 4(Committee meeting) #
(1) The Chairperson of the Committee shall convene and preside over the meetings of the Committee.
(2) A meeting of the Committee shall be held with the attendance of a majority of all incumbent members, including the chairperson, and the resolutions shall be passed with the concurrent vote of a majority of those present.
(3) If a committee member who is a public official is unable to attend a committee meeting due to unavoidable circumstances, a public official designated by the committee member may perform the duties on his or her behalf. <Added on Mar. 20, 2018>

Article 8(Application for registration of bereaved family) #
(1) A person who intends to be recognized as a bereaved family member pursuant to Article 5(1) of the Act shall submit to the Committee an application form for the registration of bereaved family members of participants in the Donghak Peasants Revolution in Form 1, attached with the following documents: <Amended on Jun. 12, 2006; Jun. 4, 2007; May. 4, 2010; Nov. 2, 2010; Mar. 20, 2018>
1. 1 copy of documents or materials proving that the applicant's parents, grandparents, great-grandparents, or great-great-grandparents were participants in the Donghak Peasants Revolution;
2. 1 copy of documents related to the family register of participants in the Donghak Peasants Revolution;
3. The certificate of records of family relations of the applicants;
4. One copy of other evidential materials verifying that the applicant is a bereaved family member.
(2) The Committee shall, upon receipt of an application form under paragraph (1), enter it in the receipt ledger of applications for registration of bereaved family members in Form 2. <Amended on Mar. 20, 2018>
Article 9(Decision) #
(1) If the Committee deliberates and resolves on matters concerning the determination and registration of participants in the Donghak Peasants Revolution and their bereaved family members pursuant to Article 5(2) of the Act, it shall prepare a written decision on the participants of Donghak Peasants Revolution and their bereaved family members in Form 3, stating the following matters: <Amended on Jun. 4, 2007; Dec. 30, 2015; Dec. 31, 2015; Mar. 20, 2018>
1. Applicant's name, address, and date of birth;
2. Statement of decision;
3. Grounds for decision;
4. Date of decision.
(2) The Committee, upon preparing a written decision in accordance with paragraph (1), shall register the bereaved family members and send (including electronic transmission) to the applicant a notice of the registration of bereaved family members of participants in the Donghak Peasant Revolution in Form 4 within 10 days from the date of deliberation and resolution (or, if the bereaved family members are not registered, the results of deliberation and resolution). <Amended on Jun. 4, 2007; Mar. 20, 2018>

Article 10(Preparation and keeping of register) #
(1) The Committee shall prepare and keep the register of Donghak Peasant Revolution participants and their bereaved families in Form 5 regarding the participants of Donghak Peasants Revolution and their bereaved families, who have been determined and registered pursuant to Article 9. <Amended on Jun. 4, 2007>
(2) If the applicants for registration or related persons and others request to inspect the register, the Committee shall allow them to inspect it.
(3) The preparation, keeping, and inspection of the register according to paragraphs (1) and (2) may be done through electronic information processing. <Added on Mar. 20, 2018>
Article 11(Allowances) #
(1) The committee members attending a committee meeting may be paid allowances and travel expenses within budgetary limits; provided, this shall not apply if a committee member who is a public official attends a committee meeting in direct relation to his/her duties. <Amended on Mar. 20, 2018>
(2) If the Committee hears opinions from the applicants for registration or the witnesses, etc. or conducts verification or fact-finding survey with them, it may pay them travel expenses and other actual expenses, within budgetary limits. <Amended on Mar. 20, 2018>
Article 11-2(Entrustment of operation and administrative affairs of committee) #
The Minister of Culture, Sports and Tourism shall, under Article 10(1) of the Act, entrust the operation and administrative affairs of the Committee to the Donghak Peasants Revolution Memorial Foundation under Article 9 of the Act.

Article 12(Enforcement rules) #
Except as otherwise provided for in this Decree, matters necessary for the enforcement of this Decree, such as the operation of the Committee, shall be determined by the chairperson of the Committee following a resolution by the Committee.
