Article 1(Purpose) #
The purpose of this Act is to contribute to the development of agriculture and fisheries and the development of rural communities by actively supporting the protection of rights and interests of female farmers and female fishers, the advancement of their status, the ensuring of maternity rights, improvement of childcare circumstances, the enhancement of the quality of life, the promotion of specialized human resources, and the expansion of gender equality in rural communities. <Amended on Dec. 24, 2018; Nov. 30, 2021>

Article 2(Definitions) #
The terms used in this Act are defined as follows: <Amended on Jun. 22, 2015; Nov. 30, 2021>
1. The term "female farmer" means a female farmer pursuant to subparagraph 2 of Article 3 of the Framework Act on Agriculture, Rural Community and Food Industry;
2. The term "female fisher" means a female fisher pursuant to subparagraph 3 of Article 3 of the Framework on Fisheries and Fishing Villages Development;
3. The term "female farmers and fishers" means female farmers and female fishers;
4. The term "organization of female farmers and fishers" means a juristic person established by female farmers and female fishers primarily for the purposes of raising the productivity of agriculture and fisheries, protecting the rights and interest of female farmers and fishers, advancing their status and promoting their welfare, etc., or an organization prescribed by Presidential Decree;
5. The term "facilities related to female farmers and fishers" means facilities prescribed by Presidential Decree, established primarily for the purposes of the protection of rights and interests and the promotion of welfare of female farmers and fishers;
6. The term "gender equality" means equal protection of human rights and equal participation and treatment in all areas without gender-based discrimination, prejudice, demeaning, and violence;
7. The term "women who return to farming/fishing/rural communities" refer to women who fit the definitions of the person who returned to farming or fishing under subparagraph 3 of Article 2 of the Act on the Promotion of and Support for Return to Agricultural and Fishing Villages and Rural Communities and the person who returned to a rural community under subparagraph 4 of the same Article;
8. The term "young women" means women ages 19 to 39;
9. The term "women from multicultural families" means women of multicultural families defined in subparagraph 1 of Article 2 of the Multicultural Families Support Act.

Article 3(Responsibilities of the State and local governments) #
The State and each local government may formulate comprehensive policies and give necessary financial support for the development of capability, the advancement of the status, the ensuring of maternity rights, the improvement of childcare environment, the enhancement of quality of life of female farmers and fishers, and the promotion of gender equality in all areas of political, economic, social and cultural lives. <Amended on Dec. 24, 2018; Nov. 30, 2021>

Article 3-2(Female farmers' day and female fishers' day) #
(1) In order to solidify the status of female farmers and improve their rights and interests, every October 15 shall be designated as Female Farmers' Day.
(2) In order to solidify the status of female fishers and improve their rights and interests, every October 10 shall be designated as Female Fishers' Day.
(3) The State and local governments may hold commemorative events suitable for the purposes of Female Farmers' Day and Female Fishers' Day.

Article 4(Functions of female farmers and fishers) #
Female farmers and fishers shall endeavor to contribute to the development of agriculture and fisheries and rural communities and to establish the foundation of national food self-support by producing and supplying quality and safe agricultural and fishery products stably through the production activities in agriculture and fisheries as main agents of development of agriculture and fisheries and rural communities.

Article 5(Formulation of master plan) #
(1) The Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries shall formulate master plans for female farmers fostering policies or female fishers fostering policies (hereinafter referred to as "master plan"), and the Special Metropolitan City Mayor, Special Self-Governing City Mayor, Metropolitan City Mayor, Do Governor, or Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") shall formulate a master plan for a City/Do to foster female farmers or female fishers (hereinafter referred to as "plan for a City/Do"), based on the master plan every five years, respectively. <Amended on Aug. 4, 2005; Feb. 29, 2008; Mar. 23, 2013; Nov. 30, 2021>
(2) The following matters shall be included in a master plan: <Amended on Mar. 17, 2010; Mar. 23, 2013; Dec. 24, 2018; Nov. 30, 2021>
1. Objects of female farmers fostering policies or female fishers fostering policies;
2. The direction of promoting female farmers fostering policies or female fishers fostering policies;
3. Important policy tasks referred to in the following items:
(a) Improvement of the management ability of agriculture and fisheries;
(b) Improvement of the status of female farmers and fishers;
(c) Ensuring of maternity rights, improvement of childcare circumstances, and enhancement of the quality of life of female farmers and fishers;
(d) Improvement of agricultural working conditions and creating a safe living environment for female farmers and fishers;
(e) Promotion of gender equality by bridging the gender gap in agriculture and fisheries and rural communities;
(f) Other measures necessary for fostering female farmers and fishers;
4. Measures to procure financial resources related to promoting female farmers fostering policies or female fishers fostering policies.
(3) The Minister of Agriculture, Food and Rural Affairs and the Minister of Oceans and Fisheries shall formulate and implement an annual execution plan (hereinafter referred to as "execution plan") according to a master plan, and a Mayor/Do Governor shall formulate and execute an annual execution plan, according to a plan for a City/Do respectively and check the execution conditions thereof. <Amended on Mar. 17, 2010; Mar. 23, 2013>
Article 6(Cooperation in formulation and execution of master plans) #
(1) If necessary for the formulation and implementation of a master plan or a plan for a City/Do and an execution plan, the Minister of Agriculture, Food and Rural Affairs, the Minister of Oceans and Fisheries, or a Mayor/Do Governor may request cooperation from the relevant central administrative agency, local government, public institution, or other juristic persons, organizations, experts, etc. <Amended on Mar. 23, 2013; Nov. 30, 2021>
(2) An institution, a juristic person, or an organization requested to cooperate pursuant to paragraph (1) shall cooperate with him or her except in extenuating circumstances.

Article 7(Deliberative council for female farmers fostering policies) #
(1) A deliberative council for female farmers fostering policies (hereinafter referred to as "deliberative council") shall be established under the jurisdiction of the Minister of Agriculture, Food and Rural Affairs or a Mayor/Do Governor in order to deliberate upon the following matters regarding female farmers fostering policies: <Amended on Aug. 4, 2005; Feb. 29, 2008; Mar. 23, 2013; Nov. 30, 2021; Oct. 31, 2023>
1. Matters concerning the formulation of a master plan, a City/Do plan and an execution plan for female farmers fostering policies;
2. Matters concerning the evaluation of the performance in the implementation of the execution plan for female farmers fostering policies;
3. Other matters submitted for deliberation by the chairperson regarding female farmers fostering policies.
(2) A deliberative council shall include experts related to female farmers fostering policies and female farmers. <Amended on Mar. 23, 2013; Dec. 10, 2019; Nov. 30, 2021; Oct. 31, 2023>
(3) Female farmers shall account for at least 30/100 of the prescribed number of members of a deliberative council. <Added on Dec. 10, 2019; Nov. 30, 2021; Oct. 31, 2023>
(4) Matters necessary for the composition, operation, etc. of a deliberative council shall be prescribed by Decree of the Ministry of Agriculture, Food and Rural Affairs; provided, matters necessary for the composition, operation, etc. of a deliberative council established under the jurisdiction of a Mayor/Do Governor shall be prescribed by rules of a City/Do. <Amended on Aug. 4, 2005; Feb. 29, 2008; Mar. 23, 2013; Dec. 10, 2019; Nov. 30, 2021; Oct. 31, 2023>

Article 7-2(Deliberation on fostering of female fishers) #
The following matters concerning the fostering of female fishers shall undergo deliberation by the central fisheries and fishing village policy review committee or a City/Do fisheries and fishing village policy review committee under Article 8 (1) of the Framework Act on Fisheries and Fishing Villages Development, respectively:
1. Matters concerning the evaluation of the performance in the implementation of the execution plan for female fishers fostering policies;
2. Other matters submitted for deliberation by the chairperson of the central fisheries and fishing village policy review committee or the chairperson of a City/Do fisheries and fishing village policy review committee under Article 8 (1) of the Framework Act on Fisheries and Fishing Villages Development regarding female fishers fostering policies.

Article 8(Fact-finding surveys on female farmers and fishers) #
(1) The Minister of Agriculture, Food and Rural Affairs and the Minister of Oceans and Fisheries shall conduct regular research on matters related to female farmers and fishers, such as the actual conditions facing female farmers and fishers in terms of rural life, labor for agriculture and fisheries, gender equality etc., for the formulation of efficient policies for female farmers and fishers and shall reflect the findings of such research in a master plan. <Amended on Mar. 23, 2013; Nov. 30, 2021>
(2) A Mayor/Do Governor shall conduct regular fact-finding surveys related to female farmers and fishers in order to formulate a plan for each City/Do and reflect the results thereof in a plan for each City/Do.
(3) Matters necessary for the timing and methods for fact-finding surveys related to female farmers and fishers under paragraphs (1) and (2) shall be prescribed by Decree of the Ministry of Agriculture, Food and Rural Affairs and Decree of the Ministry of Oceans and Fisheries, or the Rules of each City/Do. <Amended on Mar. 23, 2013>

Article 9(Improvement in management ability of female farmers and fishers) #
The State and each local government shall promote the following projects in order to improve the management ability of female farmers and fishers and to foster them as human resources specialized in agriculture and fisheries: <Amended on Nov. 30, 2021>
1. Technical education on agriculture and fisheries, education on management of agriculture and fisheries and the establishment of the education system thereof to foster female farmers and fishers specialized in agriculture and fisheries;
2. Fostering of future female farmers and fishers;
3. Supporting women who return to farming/fishing/rural communities, young women, and women from multicultural families so that they can resettle in rural areas and become professionals;
4. Fostering of and supporting for producers' organizations of female farmers and fishers;
5. Improvement in the working conditions or the promotion of automation of agriculture and fisheries suitable to female farmers and fishers for the improvement in the productivity of agriculture and fisheries;
6. Providing management consulting service and financial support to female farmers and fishers who intend to engage in independent farming or fishing.

Article 10(Improvement in status of female farmers and fishers) #
(1) The State and each local government shall formulate and execute policies on the following matters for improvement in the status of female farmers and fishers: <Amended on Nov. 30, 2021>
1. The expansion of participation of female farmers and fishers in the process of decision of policies on agriculture and fisheries and policies on fostering female farmers and fishers;
2. Arousing the professional awareness and raising the morale of female farmers and fishers;
3. Consultation on difficulties for the preparation of the foundation of stable production activities in agriculture and fisheries of female farmers and fishers;
4. Operation and support of programs meeting the actual conditions of each area, such as culture, cultivation, health, etc. of female farmers and fishers;
5. Expansion of gender equality education and training of related human resources to close the gender gap in agriculture and fisheries and rural communities.
(2) Where the State and each local government determine the management of or policies on agriculture and fisheries, or provide or support various education opportunities, they shall formulate and execute policies necessary for the protection of human rights of female farmers and fishers and for the spread of gender equality culture in rural communities.
(3) The Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries may select and reward individuals, organizations, enterprises, etc. for their significant contributions to improving female farmers' and fishers' management ability and status, guaranteeing maternity rights, improving childcare conditions, improving quality of life, etc. <Added on Nov. 30, 2021>

Article 11(Ensuring of maternity rights, improvement of childcare circumstances and enhancement of quality of life of female farmers and fishers) #
The State and each local government shall formulate and execute the following policies for the ensuring of maternity rights, the improvement of childcare circumstances and enhancement of the quality of life of female farmers and fishers: <Amended on Jul. 20, 2015; Dec. 24, 2018; Nov. 30, 2021>
1. Support for mother and fatherless-child families engaging in farming or fishing among the mother and fatherless-child families prescribed in subparagraph 3 of Article 4 of the Single-Parent Family Support Act;
2. Support for female senior citizens engaging in farming or fishing;
3. Childcare and child guidance after school in rural communities;
4. Support for the ensuring of maternity rights and the promotion of health of female farmers and fishers before and after childbirth;
5. Support for enhancing female farmers' and fishers' health for each stage of their life cycle;
6. Improving agricultural working conditions and creating a safe living environment for female farmers and fishers;
7. Grievance counseling for the ensuring of maternity rights, improvement of childcare environment, and enhancement of the quality of life of female farmers and fishers;
8. Other matters concerning the promotion of welfare of female farmers and fishers.

Article 11-2(Execution of projects supporting assistants to female farmers and fishers) #
(1) The State and each local government shall support female farmers and fishers so that they may use a person who engages in farming or fishing and housework for them (hereinafter referred to as "assistant") where they suspend farming or fishing temporarily due to childbirth.
(2) Where the State and each local government deem education to assistants necessary, they may educate such assistants in advance.

Article 11-3(Implementation of projects to support management of female farmers and fishers’ health) #
(1) The State and each local government shall regularly administer a health examination for female farmers and fishers to prevent and treat diseases that they commonly suffer from, in order to ensure maternity rights and improve their quality of lives.
(2) The State and each local government may wholly or partially subsidize a health examination administered under paragraph (1).
(3) Matters necessary for the timing, items, subsidization, etc. of a health examination administered under paragraphs (1) and (2) shall be prescribed by Presidential Decree.

Article 12(Support to organizations of female farmers and fishers) #
The State and each local government shall provide administrative support necessary for the formation and activities of organizations of female farmers and fishers and may fully or partially subsidize the expenses necessary for such activities within the budgetary limits.

Article 13(Establishment and operation of facilities related to female farmers and fishers) #
(1) The State and each local government may establish and operate facilities for the promotion of rights and interests, the ensuring of maternity rights, the improvement of childcare circumstances and the promotion of welfare of female farmers and fishers. <Amended on Dec. 24, 2018>
(2) In establishing and operating a facility related to female farmers and fishers, the State and each local government may require such facility to operate a separate program for infants, children, senior citizens, etc. in farming and fishing areas, in order to facilitate the use of female farmers and fishers. <Added on Mar. 18, 2014>
(3) The State and each local government may fully or partially subsidize within budgetary limits the expenses incurred in relation to operation of organizations of female farmers and fishers or facilities related to female farmers and fishers established and operated by individuals. <Amended on Mar. 18, 2014>

Article 14(Delegation of authority) #
The Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries may delegate some of his or her authority under this Act to a Mayor/Do Governor or the head of a Si/Gun/autonomous Gu, as prescribed by Presidential Decree. <Amended on Mar. 23, 2013>
