CHAPTER I GENERAL PROVISIONS
Article 1(Purpose) #
The purpose of this Decree is to provide for matters mandated by the Act on the Establishment of Obligatory Firefighting Unit and other matters necessary for the enforcement thereof. <Amended on Jun. 23, 2006>
Article 2(Definitions) #
(1) The term "appointment" in this Decree means new recruitment, transference, promotion, ex officio dismissal, ipso facto retirement, leave of absence, reinstatement, and retirement.
(2) The term "fire service agency prescribed by Presidential Decree" in Article 1 of the Act on Act on The Establishment of Obligatory Firefighting Unit (hereinafter referred to as the "Act") means the National Fire Agency, the Special Metropolitan City, Metropolitan City, Special Self-Governing City, Do, Special Self-Governing Province, the National Fire Service Academy, the National 119 Rescue Headquarters, local fire service academies, fire stations, 119 special response units, and firefighting experience centers (hereinafter referred to as "fire service agencies"). <Amended on May. 24, 2004; Jun. 23, 2006; Dec. 23, 2008; Jan. 28, 2011; Sep. 17, 2013; Nov. 19, 2014; Dec. 22, 2015; Jul. 26, 2017; Oct. 14, 2021>
(3) The term "superior" in Article 10 of the Act and this Decree means the head of a fire service agency, fire officials, and obligatory firefighters of a higher rank who have the authority to command and supervise the duties of an obligatory firefighting unit.
(4) The term "commander" in Article 11 of the Act and this Decree means the head of a fire service agency to which an obligatory firefighter belongs.
CHAPTER II APPOINTMENT
Article 3(Authority to appoint) #
(1) An obligatory firefighter shall be appointed by the Fire Commissioner of the National Fire Agency from among those who have been seconded pursuant to Article 25 (1) of the Military Service Act. <Amended on May. 24, 2004; Jun. 23, 2006; Nov. 19, 2014; Jul. 26, 2017>
(2) The Fire Commissioner of the National Fire Agency may fully or partially delegate his or her authority to appoint under paragraph (1) to the head of the Special Metropolitan City, Metropolitan City, Special Self-Governing City, Do, Special Self-Governing Province, the National Fire Service Academy, Central 119 Rescue Headquarters, local fire service academies, fire stations, 119 special response teams, or firefighting experience centers (hereinafter referred to as "affiliated agencies, etc."). <Amended on May. 24, 2004; Dec. 3, 2008; Dec. 3, 2008; Jan. 28, 2011; Jan. 28, 2011; Sep. 17, 2013; Nov. 19, 2014; Dec. 22, 2014; Jul. 26, 2017; Oct. 14, 2021>
