Article 1(Purpose) #
The purpose of this Decree is to prescribe matters delegated by the Act on the Promotion of the Korea Research Institute for Local Administration (hereinafter referred to as the "Act") and matters necessary for its enforcement. <Amended on Oct. 29, 2015>
Article 2(Operation and management of fund) #
(1) The Korea Research Institute for Local Administration Support Act (hereinafter referred to as the "Institute") shall establish and manage a separate account for the fund created from contributions.
(2) When the Institute intends to reduce the principal of the fund, it shall obtain approval from the Minister of the Interior and Safety. <Amended on Feb. 29, 2008; Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(3) The fund must not be used for purposes other than the facilities and operation of the Institute.
(4) The Institute shall determine specific regulations on the operation and management of the fund and obtain approval from the Minister of the Interior and Safety; the same shall also apply where it intends to change such regulations. <Amended on Feb. 29, 2008; Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
Article 3(Procedures for grant of contributions) #
(1) The Institute shall submit a request for contributions for the following fiscal year, accompanied by the following documents, to the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") by October 31 each year, and shall report such fact to the Minister of the Interior and Safety without delay: <Amended on Mar. 23, 2013; Nov. 19, 2014; Nov. 29, 2016; Jul. 26, 2017; Oct. 25, 2022>
1. A project plan for the following fiscal year;
2. An estimated statement of financial position and an estimated profit and loss statement for the following fiscal year;
3. Other documents necessary to clarify the details of the budget.
(2) When the budget for contributions is finalized, the Mayor/Do Governor shall notify the Institute thereof.
(3) When the Institute intends to receive the contributions finalized and notified under paragraph (2), it shall submit an application for the grant, accompanied by a fund execution plan, to the Mayor/Do Governor.
Article 4(Approval of project plans and budget) #
(1) The Institute shall submit a business plan and a budget to the Minister of the Interior and Safety for approval at least 1 month before the commencement of each fiscal year, as prescribed in Article 6 of the Act. <Amended on Feb. 29, 2008; Feb. 29, 2008; Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(2) When the Institute obtains approval from the Minister of the Interior and Safety under paragraph (1), it shall notify the Mayor/Do Governor of the details thereof without delay. <Amended on Feb. 29, 2008; Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
Article 5(Disposal of surplus) #
The Institute shall first compensate for losses carried over from the preceding fiscal year with the surplus of each fiscal year, and if there is any balance, it shall be carried over to the revenue of the following fiscal year or transferred to the fund.
Article 6(Submission of financial statements) #
The Institute shall submit a statement of revenue and expenditure for each fiscal year under Article 7 of the Act, accompanied by the following documents, to the Minister of the Interior and Safety within 2 months after the end of each fiscal year: <Amended on Feb. 29, 2008; Feb. 29, 2008; Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017; Jan. 15, 2021>
1. A statement of financial position and statement of profit or loss;
2. A table comparing the business plan for the relevant year with its execution results;
3. An opinion of a certified public accountant under Article 7 of the Act.
