Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Korea Institute for Defense Analyses Act and matters necessary for the enforcement thereof.

Article 2(Registration of incorporation) #
The matters to be registered for the incorporation of the Korea Institute for Defense Analyses (hereinafter referred to as "KIDA") under Article 2(2) and (3) of the Korea Institute for Defense Analyses Act (hereinafter referred to as the "Act") shall be as follows:
1. The purpose;
2. The name;
3. The place of its main office;
4. The names and addresses of executive officers;
5. The method of public announcement.

Article 3(Registration of relocation) #
When KIDA relocates its principal office, it shall, within 3 weeks after the relocation, file for registration of the new office location and the date of relocation at either the former or new location.

Article 4(Registration of changes) #
Where any registered matters specified in the subparagraphs of Article 2 are changed (excluding cases falling under the registration of relocation under Article 3), KIDA shall, within 3 weeks after the change, file for registration of the changed matters at the location of its principal office.

Article 5(Documents to be attached to application for registration) #
(1) An application for registration of incorporation under Article 2 shall be accompanied by the articles of incorporation of KIDA and documents certifying the authorization from the Minister of National Defense under Article 3(2) of the Act.
(2) An application for registration of relocation under Article 3 shall be accompanied by documents certifying the relocation of the principal office.
(3) An application for registration of changes under Article 4 shall be accompanied by documents certifying the changes to the registered matters.

Article 6(Timing and methods for contributions) #
(1) Contributions by the Government to KIDA under Article 4 of the Act shall be paid by the Minister of National Defense or the Administrator of the Defense Acquisition Program Administration within the budget.
(2) When the budget for contributions under paragraph (1) is finalized, the Minister of the Defense Acquisition Program Administration shall notify KIDA of the details without delay.
(3) Upon receipt of the notification under paragraph (2), KIDA shall file an application for the payment of contributions to the Minister of National Defense or the Administrator of the Defense Acquisition Program Administration, attaching quarterly business and budget implementation plans.
(4) Upon receipt of an application under paragraph (3), the Minister of National Defense or the Administrator of the Defense Acquisition Program Administration shall pay contributions to effectively implement the quarterly business and budget implementation plans.

Article 6-2(Ex officio directors) #
The ex officio directors of KIDA under Article 8(2) of the Act shall be the following persons: <Amended on Mar. 23, 2013; Dec. 30, 2025>
1. The Vice Minister of National Defense;
2. The President of KIDA (hereinafter referred to as the "President");
3. One person each designated by the Minister of National Defense, the Minister of Planning and Budget, and the Minister of the Office for Government Policy Coordination, from among public officials belonging to the Senior Executive Service of their respective ministries;
4. The Director General of the Strategic Planning Bureau of the Joint Chiefs of Staff.

Article 6-3(Chairperson of Board) #
The Vice Minister of National Defense shall serve as the chairperson of the board of directors under Article 9(2) of the Act.

Article 7(Business plans and budget) #
The business plans and budget proposal submitted by KIDA to the Minister of National Defense under Article 14 of the Act shall separately indicate the objectives and policies of the business, the details of major business activities, and the necessary budget, and shall be accompanied by materials necessary for ascertaining such details.

Article 8(Reporting on implementation results of business plans and settlement of accounts) #
(1) A quarterly report on the implementation of business plans under Article 15(1) of the Act shall be submitted by the 20th day of the month following the end of each quarter, and the statement of accounts for each business year under paragraph (2) of that Article shall be accompanied by an analysis report on the implementation of business plans, a statement of surplus funds, and other necessary documents.
(2) The matters not subject to audit by a certified public accountant under the proviso of Article 15(2) of the Act shall be as follows:
1. Matters classified as military secrets under the Military Secret Protection Act;
2. Matters equivalent to those specified in subparagraph 1 that the Minister of National Defense deems particularly necessary for military security purposes.

Article 8-2(Evaluation of KIDA) #
(1) The President shall submit to the Minister of National Defense, under Article 15-2 of the Act, a research and management performance evaluation report assessing the following matters by January 15 of the year following each fiscal year: <Amended on Dec. 20, 2022>
1. Reasonableness of performance objectives;
2. Degree of achievement of performance objectives;
3. Degree of effectiveness of research and business;
4. Appropriateness of organizational and personnel management;
5. Other matters deemed necessary to be evaluated by the Minister of National Defense.
The details regarding the methods and procedures, etc. for evaluation under paragraph (1) shall be prescribed by the articles of incorporation of KIDA.

Article 9(Cooperation in business affairs) #
When requesting support for KIDA's business affairs from the heads of relevant agencies under Article 17(1) of the Act, the President shall specify the following:
1. The necessity of support;
2. Divisions requiring support and the details of business affairs;
3. Recipients of support and period of support;
4. Other necessary matters.

Article 10(Loan or transfer of state property) #
(1) The gratuitous loan or transfer of state property and the gratuitous lending or transfer of military supplies under Article 18(2) of the Act shall be effected by contract between the managing agency or managing institution of such property and KIDA.
(2) When KIDA intends to receive the gratuitous lending or transfer of military supplies under paragraph (1), it shall make a request to the managing institution of such military supplies by specifying the following matters:
1. Specifications of items by name;
2. Classification of gratuitous lending or transfer;
3. Reasons for requesting gratuitous lending or transfer;
4. Timing, period, and other conditions of gratuitous lending or transfer.
